DECRETO

3 I. Firmis remanentibus Constitutione S. Pii V diei 14 Oct. anni 1568, incipient. Romanus Pontifex et declaratione sa. me. Pii PP. Revocatis ad hunc effectum omnibus indultis ac privilegiis iam obtentis a S. Sede, necnon dispositionibus contrariis in respectivis Constitutionibus contentis, etsi tales Constitutiones fuerint a S. Sede Apostolica approbatae.

4 II.

5 III. Dispositiones contentae in decreto S. C. Concilii iussu sa. me. Urbani VIII edito die 21 Septembris 1624 incipien. Sacra Congregatio, ac in decreto eiusdem S. C. iussu sa. me. Innocentii XII edito die 24 mens. Iulii anni 1694, incipien.

6 IV.

1 Nevertheless, to meet the necessity of the matter, the Sacred Congregation of Bishops and Regulars provided by issuing the following

DECREE

2 Since Institutes of simple vows have increased greatly through the singular beneficence of God, and while many good things arise from them, so also do certain inconveniences result from the easy departure of students from such societies and the consequent return to the diocese of origin established by law. Moreover, this is made more serious by the scarcity of temporal goods by which the Church is now pressed, whence Bishops often cannot provide that such persons live honorably. These matters, and others of this kind, even concerning students of Orders of solemn vows, being considered by certain sacred Prelates of places, for the dignity of the ecclesiastical order and the edification of the faithful, they have earnestly petitioned the Apostolic See that some remedy be applied. When therefore our Most Holy Lord Pope Leo XIII had referred the entire matter to this Sacred Congregation of Bishops and Regulars, which is placed in charge of ecclesiastical business and consultations, the Eminent Fathers in a Plenary Assembly held in the Vatican buildings on the 29th day of August in the year 1892, after mature examination and discussion, and having weighed the entire state of the matter, deemed it fitting to issue appropriate provisions by a general decree to be observed everywhere in perpetuity for all future times. Which, when our Most Holy Lord in an Audience on the 23rd of September of this year 1892 graciously deigned to approve and confirm to the undersigned Secretary, those things which follow are by the present decree established and decreed by apostolic authority.

3 I. The Constitution of St. Pius V of the 14th of October in the year 1568, beginning Romanus Pontifex, and the declaration of our Most Holy Lord Pope Pius IX issued on the 12th day of June in the year 1858, by which the Superiors of Regular Orders are prohibited from granting dimissorial letters to Novices or to those professed of simple vows of three years, so that they might be promoted to the Holy Orders under the title of Poverty, remaining firm, these same provisions are extended also to Institutes of simple vows, so that the Superiors of these Institutes cannot henceforth grant dimissorial letters for the Holy Orders, or in any way promote students to sacred Orders under the title of the Common Table or of Mission, except only to those students who have indeed made simple vows, but perpetual ones already, and are stably aggregated to their own Institute; or who have at least persevered for three years in simple temporary vows in those Institutes which defer perpetual profession beyond three years. All indults and privileges already obtained from the Holy See being revoked for this purpose, as well as provisions contrary to those contained in the respective Constitutions, even if such Constitutions have been approved by the Apostolic See.

4 II. Hence it must be known that henceforth there shall not be a dispensation from the general rule, so that a student of a Congregation of solemn vows be promoted to the Major Orders unless he has first made solemn profession, or has persevered for a full three years in simple vows, if the student be attached to an Institute of simple vows. — But if sometimes a legitimate cause should occur why someone should receive the Sacred Orders before the three years are completed, dispensation may be sought from the Apostolic See, so that a Cleric might make solemn vows, although he has not completed the three years; as regards Institutes of simple vows, however, so that he might make perpetual simple vows, although the time prescribed by the Constitutions of the respective Institute for profession of perpetual simple vows has not been completed.

5 III. The dispositions contained in the decree of the Sacred Congregation of the Council issued by order of His Holiness Urban VIII on 21 September 1624, beginning Sacra Congregatio, and in the decree of the same Sacred Congregation issued by order of His Holiness Innocent XII on 24 July 1694, beginning Instantibus, and in other general decrees by which the method to be observed by the Superiors of Regular Orders in expelling their own students is ordained, not only remain in their full force, but are also imposed for observance upon the Superiors of Institutes of simple vows, whenever there is question of some student bound by simple vows indeed but perpetual, or bound by simple temporary vows and moreover constituted in sacred Orders to be dismissed: so that these Superiors themselves are able to dismiss none of them, as has just been said, except for grave, external, and public fault, and unless the culpable party be also incorrigible. But in order that anyone may truly be held to be incorrigible, the Superiors must first administer, at distinct times, a threefold admonition and correction; when this avails nothing, the Superiors must institute a process against the delinquent, the result of the process being made known to the accused, granting to him a suitable time in which he may present his defences either by himself or through another religious of the same Institute; and if the accused himself does not present his own defences, the Superior, or the Tribunal, must appoint a defender, as above, from among the students of the respective Institute ex officio. After these things the Superior with his Council may pronounce sentence of expulsion or dismissal, which however shall have no effect if the condemned party has duly appealed from the sentence pronounced to the Sacred Congregation of Bishops and Regulars, until a definitive judgment shall have been pronounced by the same Sacred Congregation. — But whenever the aforesaid method of proceeding cannot be observed on account of grave causes, then recourse must be had to this Sacred Congregation for the purpose of obtaining a dispensation from the prescribed solemnities, and the faculty of proceeding in summary fashion according to the practice in force at this Sacred Congregation.

6 IV. Students of solemn vows, or of simple perpetual, or of temporary vows constituted in sacred Orders, who have been expelled or dismissed, shall remain perpetually suspended, until the Holy See otherwise provides for them; and moreover they shall have found a benevolent Bishop as receiver, and shall have provided for themselves from ecclesiastical patrimony.

7 V. Those constituted in sacred Orders and bound by simple vows whether perpetual or temporary, who have of their own accord sought and obtained dismissal from the Apostolic See, or who have otherwise been dispensed from simple or perpetual or temporary vows by Apostolic privilege, shall not leave the cloister until they have found a benevolent Bishop as receiver, and have provided for themselves from ecclesiastical patrimony, otherwise they shall remain suspended from the exercise of the Orders they have received. This applies also to students of simple temporary vows, who have already been released from any bond of profession, on account of the time elapsed since they made their vows.

8 VI. Professed members of both solemn and simple vows shall not be admitted to sacred Orders by the Ordinaries of places unless, besides other things established by law, they exhibit testimonial letters showing that they have devoted themselves to sacred theology for at least one year, if the question concerns the subdiaconate, for at least two years if the diaconate, and as regards the priesthood, for at least three years, provided however that the regular curriculum of other studies has been completed beforehand.

9 These things the aforesaid Sacred Congregation has constituted and decreed by express mandate of His Holiness, any contrary provisions whatsoever, even those worthy of special and individual mention, notwithstanding in no way.

10 Given at Rome, from the Sacred Congregation of Bishops and Regulars, on 4 November 1892,
