To the Cardinal of Como, archpriest of the Church of St. Peter in the City, there is granted faculty and jurisdiction for knowing causes concerning both the said church and its persons, and its fabric in any manner whatsoever.
1 Sixtus, bishop, servant of the servants of God, to our beloved son Evangelist, titular of St. Matthew in Merulana, cardinal presbyter of Cosenza, greeting and apostolic benediction. Since by the duty of our pastoral office we are bound to provide salutarily for the security, stability, and good governance of all churches; and since we direct the gaze of our mind with particular care toward the venerable and holy basilica of the Prince of the Apostles in our beloved City, both because it excels others in dignity and excellence, and because our singular affection, which we bear toward the same Blessed Peter, to whose chair, though with unequal merits, we have been called by the Lord, requires that we bestow this care more earnestly.
2 § 1. Wherefore, desiring to provide for the convenience and preservation of the rights of the same basilica and of our beloved sons, the canons and ministers of its chapter, and that the aforesaid persons be not dragged before various tribunals, and to ensure their peace and freedom from the expense of litigation, and trusting greatly in the Lord in your integrity, prudence1 and circumspection, to whom we have recently committed the archpriesthood of the same basilica, then vacant, for life, by our own motion, not at the instance of your petition or that of the said chapter and canons, or made on your behalf or on theirs to us, but from our mere deliberation and from certain knowledge, we extend and enlarge to you, so long as you shall hold the aforesaid archpriesthood, and to your vicar in the said basilica, now perhaps appointed by you and to be appointed by you for the time being, by the tenor of these presents, all and singular jurisdictions, powers and privileges, exemptions, liberties, prerogatives, precedences, indults, and also authorities and faculties even over the collation of any ecclesiastical benefices whatsoever, which were granted in general or in particular by Paul III of happy memory, Pius IV, and any other Roman Pontiffs, our predecessors of blessed memory, to Alexander, bishop of Ostia, called Cardinal Farnese, otherwise archpriest of the said basilica, and previously also of the church of St. Mary Major in the City, with respect to the aforesaid basilica and church respectively, and in consideration of his person, and for his lifetime only.
3 § 2. And notwithstanding by our own motion and knowledge granted, to all and singular causes, whether ecclesiastical and spiritual, mere, or profane and mixed, even those compromised, both civil and criminal (saving however the penalty of blood and corporal affliction), between the said canons and chapter and beneficiaries and clerics, as well as chaplains, ministers and servants respectively, or any one of them on the one part, and any other persons whatsoever, of whatever status, degree, order, condition, dignity and pre-eminence existing, as well as hospitals, pious places and colleges, communities or universities on the other part, whether between the said chapter and canons aforesaid or any one of them, and the beneficiaries, clerics or chaplains aforesaid or any of them, before whatsoever judges, ordinary, extraordinary, commissioners and executors, even cardinals of the holy Roman Church, and auditors and locum tenentes of the Rota and causes of the Apostolic Camera Court, concerning whatsoever matters, goods and sums of money, even by force of obligation in the form of the Apostolic Camera pending and depending respectively, of all and singular status and merits, names and surnames and qualities, as well of the aforesaid parties and persons, as also of the matters concerning which they depend, duly expressed, calling to us by these presents, and those in the state and terms in which they are at present found, and which it shall happen to be moved anew in the future, both actively and passively, even by the aforesaid canons, chapter, beneficiaries, clerics and chaplains, or any one of them, against whatsoever persons, convents, colleges, chapters, universities, societies, hospitals and places whatsoever, secular and of whatever Orders, militias and hospitals regular, privileged also by the aforesaid canons and chapter, against the beneficiaries, clerics and chaplains aforesaid, concerning whatsoever sums of money, ecclesiastical benefices, rents, canons of wheat, grain, wine, sums of money or other things in payment, lands and things and goods ascending to whatsoever sum of money, number, quantity and value, to the said basilica or its united or annexed churches and parochial, or its chapter, canons, beneficiaries, clerics and ministers, even privately, and by reason of individual persons in whatsoever manner pertaining, or their interest, directly or indirectly, commonly or severally, and concerning any one of them, and other matters in the acts of the cause and causes of this sort more fully set forth and to be set forth, and on their occasion, with all and singular their incidents, dependents and emergents, annexed and connected, to you and your aforesaid vicar now and for the time being appointed by you:
§ 3.
4 Summarily, simply and in summary manner, not without the formality and appearance of judgment, with only the truth of the fact inspected, and insofar as it shall be necessary, executive, even by royal hand, without the observance of substantial terms and any judicial procedure, whether the making of a register or extract, any appeal whatsoever being set aside, even if not frivolous, to be heard, known, decided, and brought to a proper conclusion, by apostolic authority, by the tenor of these same presents we commit and command, and these to endure in perpetuity.
§ 4.
5 With power to the said parties respectively in the curia and outside it actively and all others, whom you shall think it necessary to interest, commonly or severally, to be named in the execution of citation, in the Roman Curia and outside it, even by public edict, summarily and extrajudicially consulted concerning unsafe access, to cite.
§ 5.
6 And to all the judges aforesaid, judges in and out of whom and as often as it shall be necessary, and under ecclesiastical and pecuniary censures, to be moderated and applied at your discretion, even by similar edict to be inhibited; and the causes themselves introduced or to be introduced before any of them in fact, to be called away from them and resumed; and in the event of non-petition, the aforesaid penalties and censures to be declared damnably incurred and fallen into, and those also to be aggravated and re-aggravated at repeated times, ecclesiastical interdict to be imposed, and the aid of the secular arm to be invoked.
§ 6.
7 In place moreover of sentence or sentences aforesaid, executive mandates in the usual and customary form to be decreed, and whatsoever shall have been judged by you and the aforesaid vicar or one of you, to be executed.
§ 7.
8 Expenses whatsoever to be taxed and moderated.
§ 8.
9 And in all and singular causes aforesaid, or before any one or in honor of God in whatsoever manner of the aforesaid matters, even on single days and hours, except on days sacred in honor of God, proceeding
10 the matter of God in no way has [any of the foregoing], even on individual days and hours, proceeding except on feast days in honor of God
§ 9.
11 Likewise canons and the chapter, and canons and beneficed clerics and chaplains aforesaid,
12 from the bond of oath, to the effect of acting, and other ecclesiastical censures and penalties, as shall be necessary, absolving;
13 the said persons, or any one of them, from the bond of oath, to the effect of acting, and from other ecclesiastical censures and penalties, as it shall be expedient to absolve.
§ 10.
14 And all and singular other things to be done, managed and exercised in the aforesaid matters, necessary or in any way opportune.
§ 11.
15 And moreover, lest to the prejudice of the Commission's authority, jurisdiction and faculties, the aforesaid causes should happen to be withdrawn from you or your vicar by various pretexts, and committed to other judges, we decree and declare that all and whatsoever commissions, whether of grace or of justice, concerning the interest of the basilica, chapter and aforesaid persons in any way, otherwise than signed by our hand and by the Roman Pontiff existing for the time being, and you called to that, and inhibitions emanating under their pretext, and processes to be had by the same, and whatever thereafter ensuing for the time being, shall be of no force or moment; and notwithstanding those, you and your vicar may proceed to further matters in such causes, and are in no way bound to obey the aforesaid commissions and inhibitions emanating under their pretext, and by reason of non-obedience you can in no way incur any censures or penalties, as we decree and declare.
§ 12.
16 Giving also to you the faculty of exercising pontifical functions in the aforesaid basilica, and ordinary jurisdiction also in spiritual matters over the canons, beneficed clerics and ministers aforesaid; so that by you or by your license only, and not otherwise, by any Catholic bishop whatsoever, having the grace and communion of the Apostolic See, to be appointed by you, to all even sacred and presbyteral orders to be promoted. You and bishops thus appointed may promote them, without our or our successors' or the vicar's or any other ordinary's license, by dimissorial letters or examination, you are able and ought.
§ 13.
17 Finally, considering that although formerly Pope Clement VII, our predecessor of pious memory, erected one college of deputies of the fabric of the aforesaid basilica so called, and both he himself and various other Roman Pontiffs our predecessors granted to that college the power of creating officials, of knowing causes exclusively as against all and any other judges, and many most ample faculties, jurisdictions, exemptions, immunities, indults and privileges; and in particular took the college and fabric thus and its persons under the immediate protection of himself and the Roman Pontiff existing for the time being and the Apostolic See, and subjected them to himself and the aforesaid See, so that they recognized no other superior than the Roman Pontiff, exempting the fabric and college thus even from the complete superiority and jurisdiction of the archpriest of the said basilica existing for the time being; nevertheless it is very expedient that you apply yourself to the aforesaid fabric with your authority, counsel and laudable zeal, yourself, so long as you shall live and shall hold the aforesaid archpresbyteriate, as protector and superior of the fabric and its aforesaid college, by apostolic authority, by the tenor of these presents, exercising pontifical
18 functions and ordinary jurisdiction over canons, etc.
19 exercising;
20 the superiority of the College of the Fabric of St. Peter, having, and reforming officials, we commit and appoint; giving and granting to you and your vicar full and free and complete faculty of convening the congregation of the aforesaid college, where, when and as often as it shall seem good to you, and presiding over the same, reforming and correcting officials, deputies, ministers and persons of the said fabric, and from them exacting accounts of administration and of the office committed to each and of both receipts and expenditures, establishing salaries with the counsel of the aforesaid college, diminishing, and if need be, augmenting, and those who in causes concerning the aforesaid fabric shall have rendered sentences or otherwise judged, scrutinizing, and in the creations of officials and admissions of persons or deputies of the aforesaid college casting a vote, so that you, if you be present, have a double vote, removing any abuses, establishing with the counsel of the same college new statutes, changing, declaring and correcting, and conducting cases
21 § 14. Any and all cases concerning the interest of the said fabric pending in any tribunal whatsoever, both those already moved and those to be moved, to persons or persons well-disposed to you, yet existing of the same fabric's college, committing, and those, if it shall seem good, even from those before whom they shall have been introduced and prepared, withdrawing, and by yourself knowing, hearing, terminating, or to another or others of the same college of the fabric committing, and all things in the aforesaid matters and concerning the same necessary and in any way opportune doing, managing, decreeing mandate and executing.
22 § 15. We also decree that these present letters of concession shall endure during your lifetime, or so long as you hold this archpresbyterial office, both in our time and in the times of our successors, the Roman Pontiffs, and shall retain their force and firm validity; nor can these same present letters be comprehended in any revocations, rescissions, or other contrary dispositions of similar or dissimilar faculties and graces, to be issued by us or our successors, the Roman Pontiffs, from time to time, and by similar action, from certain knowledge and from the fullness of apostolic power, nor can they be diminished, suspended, limited, moderated, or reduced to the terms of law by them; but these same present letters shall be perpetually valid and efficacious; and as often as such contrary dispositions shall be issued, so often shall these be deemed restored to their pristine and most valid state, in which they were before, and under a later date, to be chosen by you or your vicar, newly granted; and whatever shall have been rightly done, established, made, commanded, granted, and executed by virtue of these letters shall obtain perpetual force and firm validity.
23 § 16. And thus by whatever judges, auditors of causes of the Apostolic Palace, even cardinals of the Holy Roman Church, with all faculty of judging and interpreting otherwise removed from them and from each of them, in any cause and instance, judgment and decision ought to be made. And if anything contrary to these matters should be attempted by anyone, of whatever authority, knowingly or unknowingly, it shall be null and void.
24 § 17. Notwithstanding the constitutions, clauses, and ordinances of the aforesaid and apostolic ordinances; and in the congregations, even general ones, issued in the style of the Palace, the rule of the Apostolic Chancery prohibiting executive mandates to be expedited otherwise than under lead, the faculties and jurisdictions aforesaid of that fabric and its college of appointed officials, as well as our vicar in the Eternal City, and the senator, auditor of causes of the Curia of the Apostolic Camera, or cardinals and whatever judges of the City aforesaid, under whatever form of words, and from the most urgent causes, granted and renewed to them by us; which, even if it be expressly provided in them that derogation from them, or not unless in certain manner and form expressed in them, may be valid, their tenor, as if special mention had been made word for word, we hold as expressed in these presents, and we specially and expressly derogate from them, and from all other things contrary whatsoever.
25 Let no one, etc.
26 Given at Rome at St. Peter's, in the year of the Lord's Incarnation one thousand five hundred and ninety, on the fourth day before the Kalends of March, in the fifth year of our pontificate.
