Pastorale officium
Clemente XII - Costituzione 'Pastorale Officium'
2 Clemente Papa XII, a perpetua memoria.

Clemens XII - Constitutio 'Pastorale Officium'
1 Constitutio, qua, praevia confirmatione et innovatione alterius constitutionis sanctae memoriae Pauli Papae IV anno MDLV editae, decernitur decanatum S. R. E. cardinalium collegii ipso iure deferendum esse cardinali antiquiori episcopo, qui tempore vacationis ipsius decanatus in Romana Curia praesens, vel ex causâ publicâ ac Romani Pontificis destinatione dumtexat, non tamen ratione residentiae apud aliam ecclesiam sibi commissem, a dicta Curia absens fuerit; aliaque insuper statuuntur et ordinantur tam circa eiusmodi decanatum quam circa sex episcopatus suburbicarios, eisdem cardinalibus assignari solitos pro titulo sui cardinalatus.
2 Clemens Papa XII, ad futuram rei memoriam.
3 Pastorale officium, quo dominici gregis regimini per ineffabilem divinae bonitatis abundantiam, nullo licet meritorum nostrorum suffragio, praesidemus, exigit, ut, inter gravissimas multiplicesque apostolicae servitutis curas quibus assidue premiur, ad ea, quae sacrum venerabilium fratum nostrorum S. R. E. cardinalium collegium, Sedis B. Petri et universae Ecclesiae senatum amplissimum, spectant, rite ac recte constituenda atque ordinanda peculiari studio advigilemus.
4 § 1. Dudum siquidem felicis recordationis Paulus Papa IV praedecessor noster provide considerans, eosdem S.R.E. cardinales in partem apostolicae sollicitudinis vocari, ut pro tempore existenti Romano Pontifici in ipsius universalis Ecclesiae administratione assistant, isque eorum consilio agenda disponat, ac partem praecipuam sacri corporis et membra ipsius Romani Pontificis existere; simulque attendens, dicti collegii cardinalium decanum singulari negotiorum huius Sanctae Sedis notitiâ ac peritib, quae absque diutinb continubque in Romanâ Curiâ residentiâ vix haberi potest, praeditum esse oportere, habitâ super his cum tunc existentibus eiusdem S.R.E. cardinalibus in consistorio suo secreto, maturâ deliberatione, de illorum consilio et unanimi assensu sancivit, qaod decanatus praedicti sacri collegii de cetero perpetuis futuris temporibus nonnisi ad episcopum cardinalem antiquiorem in Curib praesentem, aut ex causb publicâ absentem et extra Curiam per Romanum Pontificem destinatum, devenire posset, et aliàs, prout in constitutione ipsius Pauli praedecessoris, anno Incarnationis dominicae MDLV, IX kalendas septembris, pontificatus sui anno I editâ, uberius coutinetur.
6 § 3. Quamquam vero piae memoriae Benedictus Papa XIII praedecessor pariter noster per quasdam suas sub plumbo, anno itern Incarnationis dominicae MDCCXXIV, VII idus septembris, pontificatus sui anno I, absentiam a Curi` praefatâ episcopis cardinalibus antiquioribus, dummodo apud metropolitanas seu cathedrales ecclesias, quas in administrationem obtinent, personaliter resideant, in assecutione eiusdem decanatus nullatenus obesse, sed decanatum huiusmodi ipso iure deferri praedictis episcopis cardinalibus antiquioribus absentibus, et apud dictas metropolitanas seu, cathedrales ecclesias actu residentibus, statuere tunc opportunum duxerit, prout in eius litteris praefatis, quarum, perinde ac supradictae Pauli praedecessoris constitutionis tenores praesentibus pro plene et sufficienter expressis et ad verbum insertis haberi volumus, plenius etiam continetur:
8 § 5. Quod vero attinet ad alteram controversiam, aliàs circa ipsum decanatum excitatam, num scilicet in eius assecutione cardinalis anterior in ordine episcopali, sed posterior in cardinalatu, praeferendus esset cardinali posteriori in ordine episcopali, sed anteriori in cardinalatu, declarationem a Benedicto praedecessore in litteris suis praefatis desuper editam tenore praesentium approbantes, pro maiori illius firmitate ac potiori cautelb, iterum statuimus, antiquitatem inter episcopos cardinales in dictâ Curiâ praesentes non esse metiendam sive ducendam a tempore suae promotionis ad cardinalatus honorem, sed a tempore eorum ingressus in ordinem episcopalem, itaut decanatus eiusdem sacri collegii ad antiquiorem in ordine episcopali, tametsi posteriorem in cardinalatu, pervenire debeat, et qui prius alicui ex dictis sex ecclesiis suburbicariis praefectus fuerit, praeferatur in assecutione decanatus huiusmodi alteri, qui ante ipsum ad cardinalatus dignitatem promotus fuisset.
1 A Constitution, by which, with the prior confirmation and renewal of another constitution of Paul, Pope of blessed memory, issued in the year 1555, it is decreed that the deanery of the Sacred Roman Church's college of cardinals is to be conferred by the law itself upon the senior cardinal bishop, who at the time of the vacancy of that deanery is present in the Roman Curia, or is absent from the said Curia on account of a public cause and the Roman Pontiff's designation only, and not however by reason of residence at another church committed to him; and moreover other matters are established and ordained both concerning such deanery and concerning the six suburban bishoprics, which are accustomed to be assigned to the same cardinals as the title of their cardinalate.
2 Clement, Pope XII, for the memory of the future.
3 The pastoral office, by which we preside over the governance of the Lord's flock through the abundance of ineffable divine goodness, though without the support of our merits, requires that, amid the most grave and manifold cares of apostolic service by which we are continually pressed, we should watch with particular diligence over those matters which pertain to the sacred college of our venerable brethren of the Holy Roman Church, the most ample senate of the See of Blessed Peter and of the universal Church, so that they may be rightly and properly established and ordained.
4 § 1. Indeed, Paul, Pope of blessed memory, our predecessor, having providently considered that these same cardinals of the Holy Roman Church are called to share in apostolic solicitude, so that they might assist the Roman Pontiff existing at any time in the administration of the universal Church, and that he might dispose of matters by their counsel, and that they are the principal part of the sacred body and members of the Roman Pontiff himself; and at the same time considering that the dean of the said college of cardinals ought to be endowed with singular knowledge of the affairs of this Holy See and with experience, which can scarcely be obtained without long and continuous residence in the Roman Curia, having taken counsel on these matters with the cardinals of the same Holy Roman Church then existing in his secret consistory, with mature deliberation, by their counsel and unanimous assent, he enacted that the aforesaid deanery of the sacred college should henceforth in perpetuity come to none other than to the senior cardinal bishop present in the Curia, or absent on account of a public cause and sent outside the Curia by the Roman Pontiff, and otherwise, as is more fully contained in the constitution of that same Paul, our predecessor, issued in the year of the Lord's Incarnation 1555, on the ninth day before the kalends of September, in the first year of his pontificate.
5 § 2. And when subsequently a doubt arose whether, according to the sense of this constitution, the deanery of this kind ought to be conferred upon cardinal bishops senior by promotion who, when the vacancy of the said deanery occurred, were indeed absent from the Curia itself, but were residing at metropolitan or cathedral churches, whose governance and administration they retained together with one of the six cathedral churches in the suburbs, which are accustomed to be assigned to senior cardinals as the title of their cardinalate, by apostolic concession: Clement, Pope XI, of revered memory, our predecessor also, committed the discussion of this question, which he wished to be resolved, to seven prelates of the same Curia distinguished in learning, prudence and integrity, who, having weighed the entire matter most carefully, as was fitting, unanimously judged that the absence of these senior cardinal bishops from the Roman Curia on account of their residence at metropolitan or cathedral churches, over which they presided by apostolic dispensation, in no way sufficed for them to obtain such deanery: which judgment the same Clement, our predecessor, not only approved and ordered to be observed inviolably in like manner for all future times; but moreover in his own secret consistory held on the third day of the month of March in the year 1721 ordered it to be read aloud, and to be entered and preserved among the acts of the consistory.
6 § 3. Although, however, Benedict, Pope XIII, of pious memory, our predecessor likewise, by certain of his letters under lead, in the year of the Lord's Incarnation 1724, on the seventh day before the ides of September, in the first year of his pontificate, deemed it then opportune to establish that the absence from the aforesaid Curia of senior cardinal bishops, provided they reside personally at the metropolitan or cathedral churches which they hold in administration, should in no way hinder the obtaining of the same deanery, but that such deanery should be conferred by the law itself upon the aforesaid senior cardinal bishops absent and actually residing at the said metropolitan or cathedral churches, as is more fully contained also in his aforesaid letters, the tenor of which, just as that of the aforesaid constitution of Paul, our predecessor, we wish to be held as fully and sufficiently expressed and inserted word for word in the present:
7 § 4. We, however, directing the consideration of our mind to the most serious reasons upon which the aforesaid sanction of our predecessor Paul is known to rest, and moved by other just and reasonable causes affecting our mind, after deliberation which we have held diligently upon the foregoing matters with many of our venerable brothers, the aforesaid cardinals of the Holy Roman Church, by their counsel, and also by our own motion, and from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, confirming and renewing that of our predecessor Paul by this our perpetual constitution to endure, we decree and command that henceforth, whenever the aforesaid deanery shall have become vacant in any manner whatsoever, by the law itself there shall succeed to that deanery the senior cardinal bishop who at the time of that vacancy is present in the said Curia, or who on account of public business and the appointment of the Roman Pontiff alone, yet not however by reason of or on account of residence in the metropolitan or cathedral church whose governance and administration he retains by apostolic indult, shall be found absent from the same Curia at that time.
8 § 5. As for the other controversy, otherwise raised concerning the same deanery, namely whether in its acquisition a cardinal earlier in the order of bishops but later in the cardinalate should be preferred to a cardinal later in the order of bishops but earlier in the cardinalate, approving by the tenor of these presents the declaration issued by our predecessor Benedict in his aforesaid letters upon this matter, for its greater firmness and more careful safeguard, we again decree that seniority among cardinal bishops in the said Curia present is not to be measured or reckoned from the time of his promotion to the honour of the cardinalate, but from the time of their entry into the order of bishops, so that the deanery of the same sacred college ought to pass to the one more senior in the order of bishops, although later in the cardinalate, and he who was first placed in charge of one of the said six suburban churches shall be preferred in the acquisition of such deanery to another who had been promoted to the dignity of cardinal before him.
9 § 6. Furthermore we enact and declare that only by cardinals who shall have been present in the aforesaid Curia at the very time of the vacancy of one of the said six cathedral suburban churches customarily assigned for the title of the cardinalate, and those absent from the same Curia likewise on account of public business and the appointment of the Roman Pontiff alone, not however on account of residence at another church committed to them, as aforesaid, can such a cathedral suburban church thus becoming vacant be chosen; nor are cardinals absent from the same Curia, except in the sole case expressed above, to be admitted to such choice, even through a procurator specially appointed from the same college; revoking therefore and annulling, and declaring wholly void and null any indults whatsoever of choosing the aforesaid suburban churches in absence, and through a procurator, from any other cause whatsoever, even residence at another church, which may have been granted hitherto by our Roman Pontiff predecessors, which however have not yet been carried into execution. And although we are persuaded that our successors will by no means grant such indults, which could bring no small detriment to the same suburban churches and their dioceses, just as we ourselves intend to abstain entirely from granting them; nevertheless, if any should happen to be granted contrary to this our disposition at any time and in any manner whatsoever, those obtained surreptitiously ought to be held as such, and can benefit no one in any way, just as if they had not been issued, we likewise decree.
10 § 7. Moreover, if it should ever happen that cardinals presiding over a patriarchal, primatial, archiepiscopal or cathedral church are found present in the said Curia on account of legitimate cause or by permission of the Apostolic See at the time when a vacancy of one of these six suburban churches has occurred, it shall be our part and that of the Roman Pontiff existing at the time to attend carefully and deliberate, when they shall be absolved from the bond by which they are held to the prior church, for the purpose of choosing and obtaining the vacant church from the said suburban ones, whether it be expedient to grant them the retention of the other church which they previously governed, under the name of administration or otherwise, and especially whether both are so near to each other that they can conveniently bestow pastoral care upon each and rightly fulfil their ministry. For the rest, we cannot but most earnestly commend those who, in order that they may continue to devote all their care and study to the advantage of the church now committed to them, and that nothing be taken away from the vigilance due to it, voluntarily abstain from such choice, just as in former times many cardinals did with the highest praise (mindful of that most salutary admonition of the Fathers of Trent, "truly indeed he is to be deemed most blessed to whom it has fallen to govern one church well and fruitfully and with the salvation of the souls committed to him").
11 § 8. Furthermore, considering that it is customary for cardinals to have the faculty of choosing another from among the six suburban churches, whenever one becomes vacant, leaving behind the one which had been assigned to them as their titular church; but if this should happen frequently, it could bring spiritual inconvenience to the flocks, whose pastors are thus changed so often: We will that henceforth cardinals who, ascending from the order of presbyters to that episcopate, shall have obtained one of the aforesaid suburban churches, may thereafter pass to another, leaving the former and with the approval of the Roman Pontiff, only once, saving always and unharmed to them nevertheless the faculty of choosing, with prior resignation of the former, the church of Ostia, which enjoys special prerogatives, and especially that one by which the cardinal who presides over it is accustomed to consecrate the Supreme Pontiff with solemn rite, with the pallium also being employed.
12 § 9. Finally, although We do not in the least doubt that Our venerable brethren, the cardinals of the Holy Roman Church, bishops of the six aforesaid cathedral churches, have hitherto adequately fulfilled all the parts of their office incumbent upon them, and We may justly promise the same of them hereafter, as well as of others who shall be placed in charge of such churches; yet for Our pastoral solicitude, which can never be excessive in this matter, We have deemed it fitting to bring to their remembrance that they are bound, even if they dwell in the said Curia to assist the Roman Pontiff, to visit their churches and dioceses by themselves, according to the prescription of the sacred canons and decrees of the Council of Trent, or, if they shall be legitimately hindered, through their vicar general in spiritual matters, or another fit and suitable ecclesiastical man; and likewise to present to the Pontiff himself a report of the state of those churches and dioceses over which they preside, according to the constitution of like memory of Sixtus, Our predecessor also, which begins Romanus Pontifex, etc., and to diligently perform the other things which pertain to the episcopal office. In this matter indeed it is most fitting for them, on account of the sublime degree of honor and dignity which they hold in the Church of God, to shine forth as an example to all other bishops, which they will follow.
13 § 10. Decreeing likewise that these present letters and whatever dispositions therein, even for the reason that the same cardinals of the Holy Roman Church having an interest or right in the premises, or in any way pretending to have one, have not consented to them, nor have been called or heard concerning them, or for any other cause, color, pretext and ground, even one closed in the body of law, shall at no time ever be noted with the vice of subreption or obreption or nullity, or of Our intention or any other even formal and substantial defect, impugned, infringed, retracted, or brought into controversy, nor shall against them the remedy of opening of the mouth, restitution in full, or any other whatsoever of law, fact, or grace be attempted or obtained, or obtained even by motu proprio, knowledge and fullness of power equally granted or emanated, nor shall anyone be able to use or avail himself of it in judgment or outside of it; but these present letters shall always and perpetually be firm, valid and efficacious, and shall produce and obtain their full and complete effects, and shall be inviolably observed in all things and by all those to whom it pertains and shall pertain at any time, and shall most fully suffice to them respectively; and thus and not otherwise by any judges ordinary and delegated, even auditors of causes of the apostolic palace, and the same cardinals, even legates a latere, and the sacred college, and any others whatsoever exercising and about to exercise any preeminence and power, with the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, it ought to be judged and defined; and if anything contrary to these things shall be attempted by anyone whatsoever, by any authority, knowingly or unknowingly, it shall be null and void.
14 § 11. Notwithstanding the foregoing, and especially the letters of Our predecessor Benedict and all other general or special constitutions and ordinances of the Apostles, even those made in consistory, and Our own rules and those of the Apostolic Chancery, even, insofar as it may be necessary, that clause concerning not taking away acquired right, and also that cardinals are not comprehended in constitutions and rules to be issued by Us, unless those concern the favour of the same cardinals or shall have been issued by their counsel or that of the greater part of them, as well as consistorial decrees and those of the said sacred college, and others, even those strengthened by oath, apostolic confirmation, or any other firmness of the matter, statutes, styles, uses and customs, even immemorial ones, privileges also, faculties, indults and apostolic letters, granted to the same college and cardinals under whatsoever tenor and forms of words, and with whatsoever even derogatory clauses of derogations, and other more efficacious and most efficacious and unusual clauses, and irritant and other decrees, even those issued by Our own motion, knowledge and fullness of power in like manner, and even in consistory, and otherwise in whatsoever manner and from whatsoever cause, even one perhaps necessarily to be expressed here, contrary to the foregoing; all and singular of which, even if for their sufficient derogation special, specific, express and individual mention of them and their whole tenors, and word for word, and not by general clauses importing the same, or any other expression should be had or some other exquisite form should be observed for this purpose, We having the tenors of all and singular of them present as fully and sufficiently expressed and inserted word for word, otherwise remaining in their force, for the purpose of the foregoing, on this occasion only, specially and expressly and most fully and amply We derogate, and will that it be derogated, and command; and all other things contrary whatsoever.
15 § 12. We also will that to copies or exemplars of these same present letters, even printed ones, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given in judgment and outside it as would be given to these presents themselves if they were exhibited or shown.
