Pastoralis officii

officials in the Roman Curia, and the designation of their number. — 42. Penal sanction. — 43. Decree rendering null contrary acts.
1 Leo, bishop, servant of the servants of God, for perpetual remembrance of the matter, with the approval of the sacred Council.
2 The watchful care of the pastoral office divinely entrusted to us admonishes us that, following the example of a diligent father of a household, who sowed good seed in his field, and is commended in the Gospel by the Lord, we should cleanse and render pure the Roman Curia, the peculiar field of this holy Apostolic See and of the Roman Pontiffs, by uprooting with the spade of justice and prudence whatever noxious weeds grow there, and the tares which the enemy has oversown, and which, irrigated from the fountain of ambition and avarice, have grown excessively; and while we strive to do this with all diligence and labor, we have determined to reduce to the ancient and legitimate line of observance the beloved sons, the officials of the Roman Curia, who, abusing the excessive gentleness and clemency of their superiors and also the license of the times, and in order to satisfy their private advantage and avarice, the root of all evils, have long since transgressed the boundaries of honesty and justice fixed beforehand, and have neglected the ancient and just institutions of their offices.
3 § 1. And therefore, in order to make clear what concerning the aforesaid reform they ought to observe in the future and from what they ought to abstain, and to prescribe openly, to remove all occasions of dispute, and wishing to impose graver penalties if anyone should presume to act contrary to our constitutions, we have expressly commanded the venerable brothers our cardinals of the Holy Roman Church, appointed as executors through the letters of Julius, our predecessor of happy memory, issued concerning such reform, and others moreover who, after Julius, as it pleased the Lord, was taken from our midst, by divine favor and clemency were assumed to the summit of the apostolic office, and who, wishing to follow this most necessary reform of officials, which the same Julius was unable to complete, and to bring this matter, with the approval of the sacred council, to the desired conclusion, were added by us, that according to the order delivered to them, they should call those officials for whom it had not been declared and expressly set forth through the letters of the aforesaid Julius what they ought to observe in the future, so as to remove from them all excuses which they might be able to make; and having diligently heard and fully examined them and their rights, they should declare and decree the moderations of fees and emoluments which henceforth, without excuse, they should observe and from which they should abstain; and should afterwards report to us and to this sacred Lateran council, so that for their inviolable and perpetual observance, they might be corroborated by the protection and approval of apostolic authority and the sacred council, as is more fully contained in the decree of the eighth session.
4 § 2. By which cardinals and the prelates joined to them, diligent investigation having been made, and complaints against the excesses of officials, in which they were said to have sinned, having been heard, as well as the defenses of the officials themselves having been examined, and many congregations having been held concerning these matters, in which we wished to be present for the most part personally, and all things having been maturely discussed, and finally a report having been made in our secret consistory, and in the congregation of prelates the matters which had been done having been recited openly, we have made the reforms written below, according to the moderations and reductions and corrections of fees and mandates and prohibitions of the same appointed cardinals, to the praise of almighty God, and to the honor of us and of this holy See, and to the relief and exoneration of all the faithful, which we will that in all things and through all things henceforth, in perpetual future times, be observed inviolably and firmly, and without any diminution or transgression, under the incurring of the penalties contained in the letters of Julius our predecessor concerning such matters, and ours, with the approval of the sacred council, read and published in the preceding eighth session next before, expressly set forth, as is contained in those letters.
5 § 3. And if there should be any transgressors of such matters under the penalties of our ordinances at present, we will that they be punished most severely by the same cardinals and those joined to them, so that by their example others may be quickly deterred from such excesses.
6 § 4. By which provision of ours we judge it will come to pass that all Christian faithful fleeing to this holy Apostolic See for grace and justice as to a most benign mother, after they have satisfied their petitions with no unjust exaction vexing them, may be able to return to their own homes not without the greatest praise of this See. And lest anyone, even though absent, be deceived by the cunning fraud of solicitors or circumvented in any way, we will that it be certain and known to all through the things written below what sum of payment ought to be paid to officials for their labor in each and every matter.
7 § 5. First, whereas the masters of ceremonies have hitherto, by reason of the pallium of this church, for which reason the pallium was customarily given, been accustomed to receive one ducat for every hundred of the sum to which the fruits of that church are assessed in the books of the Camera, we permit this; but that they henceforth, for the bestowal of the said pallium at the request of the church, whose fruits are assessed at five hundred, receive three; for a church whose fruits are assessed at one thousand ducats in the books of the Camera, five; and above that, whatever the assessment of the church's fruits may be, let them receive no more than ten ducats. For a creation, one hundred monies for each; for the death of cardinals, fifty ducats and nothing more, in utensils or other things, let both receive together. For the creation of a duke or captain or standard-bearer of the Holy Roman Church, let them receive what they have been accustomed to receive hitherto, and no more. When a knight is created or an attendant, three; from any king, however many there may be, not more than ten; from the orators of any prince or community, let them not be able to receive beyond five ducats, even if given willingly. And thus only if they shall have attended them; but if they shall have failed in the aforesaid matters, or shall not have attended the orators, let our master of the household cause the emoluments of one month to be retained from the provisions to be paid to them by our depositary and paid to him. For the sword or rose, from the custom of the Roman Church to be delivered to princes by custom. For the oath taken in the hands of the first cardinal deacon by those promoted in the Roman Curia by these presents to churches and to consistorial monasteries, or by those to whom those should be commended, in taking it, beyond two and one-half ducats of another similar ducat let them exact nothing whatsoever. Let them assist cardinals and prelates celebrating with due reverence and charity, and let them admonish them sincerely, as they shall see fit, what is proper and what is necessary and how much is expedient, without any payment. No one hereafter who is a bishop can also be master of ceremonies, but as soon as he obtains such an office he shall be promoted to the cathedral church, and the office itself shall be understood to be vacant; he, however, who presides can remain, with the consent of us or our successors the Roman Pontiffs and the will of the masters existing for the time being. But so that all things may be sufficiently and with full satisfaction of all be governed, we wish in the future that one master be from beyond the mountains, the other from this side of the mountains, and that they retain two suitable substitutes, so that, acquiring skill in ceremonies, they who serve continually in our chapel and Curia may be found suitable, yet without prejudice to the masters, but let them be clerks of the said chapel with customary honors and emoluments, and let them serve those sent on legations to various parts of the world without detriment to the Curia. For the exequies of the Pontiff one hundred between both; for the creation of the same, two hundred ducats and vestments and candles or sacrificial torches only can they receive. For the exequies of inferior prelates and orators, one of them only, and if called, shall attend, and shall have two ducats and four candles or torches, which are lit at the elevation of the Body of Christ, only, and ought not to exact further. And, so that they may exercise their office more decently and sustain themselves more conveniently, the archpresbyterate of the church of St. Giles in the City, and one canonry and one prebend of the same kind, whose fruits, revenues and proceeds and true annual values we wish to be held as expressed, we unite, annex and incorporate perpetually to the same office of ceremonies: so that, the present archpriest of that church and some canon of that church ceasing or dying, it may be lawful for the same masters, by themselves or by another or others, to apprehend corporeal possession of the archpresbyterate, canonry and prebend by their own authority and to retain perpetually, and to convert their fruits, revenues and proceeds to their own and the archpresbyterate's, canonry's and prebend's uses or benefits, no license whatsoever being required on this matter. Notwithstanding our constitution concerning unions to be committed to the parts, and the privileges and indults granted to the Roman people and all other things to the contrary.
