STUTZ, ULRICH

STUTZ, ULRICH. – Jurist, b. in Zurigo on 5 May 1868, d. in Berlino on 6 July 1938.

He received his doctorate in law in 1892 at the University of Berlino; in 1893 he became extraordinary professor of German law and ecclesiastical law at the University of Basilea, in 1896 at the University of Friburgo in Brisgovia, in 1904 at Bonn, and finally, in 1917, at Berlino. While in Friburgo, in 1902, he founded the renowned collection Kirchenrechtliche Abhandlungen, and at Bonn, in 1911, the Kanonistische Abteilung of the Zeitschrift der Savigny-Stiftung für Rechtsgeschichte, while he had already been director of the Germanistische Abteilung since 1879.

He was a member of the most important scientific, historical, and legal academies. Although a fervent Protestant and an authoritative member of the General Synod of the Prussian Evangelical Church, he showed sincere tolerance and sympathy toward the Catholic Church, whose history and institutions he studied objectively and appreciated. His scholarly output from 1887 to 1938 amounted to 1,945 works (cf. the complete list in Zeitschr. d. Savigny-Stiftung [Kanon. Abt.], 27 [1938], pp. 686-763), among which the most important are: Die Eigenkirche als Element des mittelalterlich-germanischen Kirchenrechtes (Berlino 1895); Geschichte des kirchlichen Benefizialwesens von seinen Anfängen bis auf die Zeit Alexanders III. (ivi 1893); Die kirchliche Rechtsgeschichte (Stoccarda 1905); Der neueste Stand des deutschen Bischofswahlrechtes, mit Exkursen in das Recht des 18. und 19. Jahrhunderts (ivi 1909); Der Geist des CIC (Stoccarda 1918); Trennung von Kirche und Staat in ihrer Bedeutung für die Denkmalpflege (Berlino 1919); Die päpstliche Diplomatie unter Leo XIII. nach den Denkwürdigkeiten des Kard. Domenico Ferrara (ivi 1926); Zur Neuordnung der S. Paenitentiaria Apostolica (ivi 1935).
