Bull erecting the Diocese of Austin

Bull of Pope Pius XII ·

A NEW DIOCESE OF AUSTIN IS ERECTED FROM TERRITORY TAKEN FROM THE DIOCESES OF ST. ANTHONY, GALVESTON, AND DALLAS. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR A PERPETUAL RECORD OF THE MATTER

1 For the better advancement of the good of souls, it is most beneficial that ecclesiastical divisions be so arranged as to respond most aptly to the needs of the faithful according to the circumstances of places. Considering this carefully, We have deemed it right to accede with willing mind to the petitions presented to Us, by which the venerable Brother Hamlet John Cicognani, Archbishop with the title of Laodicea in Phrygia and Apostolic Delegate in the United States of North America, having first obtained the favorable vote of the venerable Brothers Robert Emmet Lucey, Archbishop of St. Anthony, Christopher Edward Byrne, Bishop of Galveston, and Joseph Patrick Lynch, Bishop of Dallas, requested from the Apostolic See that certain parts of the territory hitherto belonging to the Churches of St. Anthony, Galveston, and Dallas be dismembered and that from them a new diocese be constituted. By the counsel therefore of the venerable Brothers Our Cardinals of the Holy Roman Church placed over Consistorial Affairs, and having supplied, insofar as it is necessary, the consent of others whose concern it is or who presume it to be their concern, all matters having been weighed, with certain knowledge and from the fullness of Our apostolic power, We separate from the territory of the archdiocese of St. Anthony the counties which are commonly called McCulloch, St. Saba, Mason, Llano, Blanco, Hays, Caldwell, and the southern region, this side of the Colorado River, of the counties Burnet, Travis, and Bastrop; from the diocese of Galveston We separate the counties Lampasas, Coryell, McLennan, Limestone, Bell, Falls, Robertson, Williamson, Milam, Brazos, Lee, Burleson, Washington, Austin, and the northern region, beyond the Colorado River, of these five counties, namely: Burnet, Colorado, Fayette, Bastrop, and Travis; from the diocese of Dallas finally We dismember the counties Coleman, Brown, Mills, and Hamilton. All this territory, thus torn away from the aforesaid dioceses, We erect and constitute into a new diocese, to be called the Diocese of Austin, which shall therefore comprehend the following civil counties, namely: Coleman, Brown, Mills, Hamilton, McCulloch, St. Saba, Lampasas, Coryell, McLennan, Limestone, Bell, Falls, Robertson, Mason, Llano, Burnet, Williamson, Milam, Brazos, Blanco, Travis, Bastrop, Lee, Burleson, Washington, Hays, Caldwell, Austin, and the northern region of the counties Fayette and Colorado mentioned above. The city of Austin, from which this new Diocese of Austin takes its name, We raise to the rank of an episcopal city, to enjoy henceforth all and singular the rights, honors, and prerogatives which other cities in the Catholic world, distinguished by an episcopal see, use and enjoy. The Temple of St. Mary dedicated to God there, We raise to the dignity of a cathedral church, and in it We establish the episcopal chair. To this new cathedral Church and to its Bishops for the time being We grant all the rights, honors, insignia, privileges, which other episcopal Churches and their Prelates enjoy and possess by common law, and We likewise bind them with all the burdens and obligations with which others are bound. This Diocese of Austin We constitute as a suffragan of the metropolitan Church of St. Anthony, and its Bishops for the time being We subject to the metropolitan authority of the Archbishop of St. Anthony. Since, however, the circumstances of times and places do not permit that a Cathedral Chapter be constituted there at present, We grant that in the meantime diocesan Consultors be chosen and employed in place of canons according to the rule of law. As to the governance, administration, Seminary of the Diocese of Austin, the election of a Vicar Capitular or Administrator, the rights and duties of clergy and faithful, and other such matters, We command that what the sacred canons prescribe concerning these things be observed. As to what pertains particularly to the clergy, We decree that as soon as these Our Letters shall be carried into execution, the clergy shall by that very fact be considered enrolled in that Church in whose territory they legitimately reside. We finally command that all documents and acts which concern this new diocese be delivered by the Chancellors of the dioceses of St. Anthony, Galveston, and Dallas, as soon as it can be done, to the episcopal Curia of Austin, so that they may be carefully preserved in its archives. For the execution of all these things as disposed and constituted above, We appoint the venerable Brother Hamlet John Cicognani mentioned above, to whom We grant the faculties necessary and suitable for this purpose, even to subdelegate, for the effect in question, any man constituted in ecclesiastical dignity, and We impose upon him the duty of transmitting an authentic copy of the acts of the execution accomplished to the Consistorial Congregation as soon as it shall be possible. These present Letters and whatever is contained in them, even from the fact that anyone whose concern it is or who presumes it to be his concern, even if worthy of specific and individual mention, has not been heard or has not consented to the foregoing, can never at any time be noted, impugned, or called into question on account of the vice of subreptitiousness or obreption or nullity, or of Our intention, or any other defect, however substantial and unforeseen; but these Letters, as made and emanated from certain knowledge and the fullness of power, shall exist perpetually valid and shall produce their full and complete effects and shall be obtained, and shall be inviolably observed by all to whom it pertains; and if otherwise anything contrary to these things should be attempted by anyone, by whatever authority, knowingly or unknowingly, We will and decree that it be entirely null and void; notwithstanding, insofar as it is necessary, the rules established in synodal, provincial, general, and universal Councils, general or special apostolic constitutions and ordinances, and any other dispositions of Our Predecessors the Roman Pontiffs, and other contrary matters, even those worthy of special mention, all of which by these presents We derogate. We finally will that to copies or excerpts of these Letters, even printed ones, subscribed however by the hand of some public notary and furnished with the seal of a man constituted in ecclesiastical dignity, the same faith be given as would be given to these presents if they were exhibited or shown. Let no one be permitted to infringe this page of dismemberment, erection, constitution, concession, statute, subjection, decree, delegation, derogation, and Our will, or to act contrary to it. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
