Confirming the Erection of the Diocese of León in Nicaragua
Paul III
1 To the perpetual memory of the matter. We deem it just and consonant with reason that those things which have proceeded from the grace of the Roman Pontiff, although upon his supervening death letters completed have not been made, should obtain their effect. For indeed, some time ago, when among other provinces in the Islands of the Indies so called, with the Lord granting it, under the happy auspices of our most beloved son in Christ Charles, Roman Emperor always August, who is also King of Castile and Leon, newly discovered and acquired and subjected to his temporal dominion, there was one called Nicaragua, whose inhabitants and dwellers, lacking knowledge of the Divine Law, without any instruction in the Orthodox Faith, were living, and in which no church had yet been erected, and therefore, in order that those same inhabitants and dwellers, capable of reason and humanity, might adhere to the aforesaid faith and, the darkness of errors having been dispelled, might come to the light of truth and might know our Saviour the Lord Jesus Christ, the Redeemer of all mankind, it was necessary to sow and plant spiritual things there and to preserve the fences of the Lord's fold to which straying sheep might be brought back and in which, once brought back, they might be preserved. Our predecessor of happy memory, Pope Clement VII, who gladly interposed the parts of the Apostolic office committed to him from above for those things by which rays of light might shine forth to each one placed in darkness so that they might come to the true light, and therefore in individual places, as their necessity and other reasonable causes demanded, planted new Episcopal Sees and Churches for the excellent preeminence of the Apostolic See, so that through these plantations a new adherence of peoples might increase to the militant Church and the profession of Christian and Catholic Faith might everywhere arise, be enlarged and flourish, and places even humble might be illuminated, and their inhabitants and dwellers, surrounded by a new See and the assistance of honourable prelates, with the Lord as author, might more easily be able to attain the rewards of eternal happiness, under a decree, namely, on the fourth day before the Kalends of March in the eighth year of his Pontificate, having held a mature deliberation upon these matters with the then Cardinals of the Holy Roman Church, of whose number we were then, and by their counsel, the aforesaid Emperor Charles most earnestly desiring this and humbly supplicating the same predecessor, to the praise and grace of Him to whom the earth and its fullness belong and all who dwell in it, and to the jubilation of the whole heavenly Court and to the exaltation of the Faith itself and to the salvation of the souls of the aforesaid inhabitants and dwellers, invested the town called Leon in the said province of Nicaragua, in which some of the faithful were dwelling, with the title of city, and made it into a city which should be called Leon; and in it one Cathedral Church under the invocation of the Glorious Mother of God, ever Virgin Mary, for one bishop to be called Bishop of Leon, who should preside over it and should cause its structures and buildings to be constructed and made; and in it and in the aforesaid city and in the diocese to be assigned to the same Church, to preach the word of God and to convert its inhabitants and infidels and barbarous peoples to the worship of the Orthodox faith and, once converted, to instruct and confirm them in the same and to impart to them the grace of Baptism, and to minister and cause to be ministered and to instruct the Ecclesiastical Sacraments and other spiritual things to all those so converted as well as to all other faithful dwelling in the city and diocese of this kind for the time being and coming to them; and likewise in the Church and city and diocese aforesaid to exercise, bear and perform Episcopal jurisdiction, authority and power and other things which other bishops in their cities and dioceses could and ought to exercise, bear and perform; and likewise from all the revenues thereof except gold and silver and other gems and precious stones, which he decreed should be free to the aforesaid predecessor and to the Kings of Castile and Leon existing for the time being in this regard, tithes, first-fruits due by right, and other Episcopal rights, just as other bishops in Spain by right or custom exacted and received, to exact, receive and levy freely and lawfully; and to erect and institute dignities, canonries and prebends and other ecclesiastical benefices with and without cure, and to confer and sow other spiritual things as he should deem expedient for the increase of Divine worship and the salvation of the souls of those same inhabitants; and who should be subject by Metropolitan right to the Archbishop of Seville existing for the time being, with See and table and other insignia and Episcopal rights, and likewise with the privileges, immunities and graces which other Cathedral Churches and their prelates in the same Spain by right or custom used, possessed and enjoyed, to use, possess and enjoy in any way in the future, by Apostolic authority he perpetually erected and instituted, and to the Church so erected he granted and assigned the town of Leon so erected into a city as a city, and the district and territory or parts of the same province assigned or to be assigned by the same Emperor and King Charles with fixed boundaries as a diocese, and their inhabitants and dwellers as clergy and people; and nevertheless he reserved, granted and assigned by the same authority the right of patronage to present within a year on account of the distance of the place suitable persons to the said Church whenever its vacancy should occur for the time being, except for the first time, to the Roman Pontiff existing for the time being, by him to be appointed to the episcopate of the same Church upon this presentation, and likewise to the dignities, canonries, prebends and benefices to be erected as aforesaid, from their first erection after they should be erected, and from then onwards for the time being, becoming vacant to the Bishop of Leon existing for the time being, similarly by him to be appointed to the same dignities, canonries, prebends and benefices upon this presentation to the aforesaid Charles and to the King of Castile and Leon existing for the time being by similar counsel. But lest concerning the erection, institution, concession, assignment and reservation of this kind, for the reason that upon the supervening death of the said predecessor letters completed thereupon have not been made, there might be any hesitation whatsoever, and lest the same Charles the Emperor and the King of Castile and Leon existing for the time being and the Bishop of Leon be deprived of their effect, we will and likewise by Apostolic authority decree that the erection, institution, concession, assignment and reservation aforesaid shall obtain their effect from the said fourth day before the Kalends of March just as if letters of the same predecessor completed under the date of the same day had been made thereupon, as is set forth above, and that these present letters shall fully suffice to prove the same erection, institution, concession, assignment and reservation everywhere, nor shall any further support be required to prove it. Let no one therefore our absolution, etc. If anyone, etc. Given at Rome at St. Peter's in the year one thousand five hundred thirty-four, on the third day before the Nones of November, in the first year of our Pontificate.
