Bull on cardinals' residence in the Roman Curia and penalties for leaving the Papal States without permission

Bull of Pope Innocent X ·

1 nals from the Ecclesiastical State without the license of the Supreme Pontiff, and the return of those who departed without such license to the Roman curia.

Innocent, Pope X, for the record of the future.

2 Since, according to the disposition of the sacred canons, our venerable brethren, the cardinals of the holy Roman Church, are called to share in the solicitude of the apostolic office, to assist personally the Roman Pontiff existing for the time being, and to render their labor in the governance of the universal Church, and are said to be part of the body and members of the Pontiff himself, and are placed in charge of diverse churches of the nourishing City according to their cardinal title or diaconate, and for this reason are bound to reside with the same Roman Pontiff in the curia of Rome, it is fitting that certain Roman Pontiffs, our predecessors, having prudently considered how unseemly and detestable it is that cardinals abandon a place and dwelling so sublime contrary to the duty of their office, and, what is more culpable, depart from the Ecclesiastical State without having obtained the license of the Pontiff existing for the time being, have issued various constitutions and decrees prohibiting such departure under diverse penalties, to be determined also by the Roman Pontiffs existing for the time being.

3 § 1. Since, however, we are taught by experience that sufficient provision has not been made thereupon, and lest so pernicious an evil should grow from day to day, we have determined to apply more opportune remedies, by our own motion, and from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, by this our perpetual constitution we establish, decree and declare, that all and each of the cardinals of the same holy Roman Church, now and existing for the time being, who without having obtained license from us and the Roman Pontiff existing for the time being shall henceforth transfer themselves outside the temporal dominion of the Ecclesiastical State, shall immediately and by that very fact, without any declaration by a judge or any other person preceding, be deprived of and not possess all and whatsoever privileges, immunities, exemptions and indults, even of conferring ecclesiastical benefices, as well as of transferring pensions or ecclesiastical fruits even reserved in place of pensions, and of making a will and disposing of property, granted to them in any manner whatsoever by the Apostolic See;

4 § 2. And moreover they shall likewise incur by that very fact, without any declaration, the penalty of interdict from entering a church; and shall also be subject to other penalties to be determined in any manner by us and our successors, the Roman Pontiffs; and to the sequestration of all and each of the fruits, revenues, proceeds, rights, perquisites and emoluments of all kinds, both of whatsoever offices and duties, even the greater ones, even those granted in consistory, and worthy of special note and express mention, which in any manner whatsoever, even by title truly burdensome, as well as of monasteries and any other whatsoever benefices, whether secular and whatsoever;

5 It imposes penalties on those who contravene.

6 Of the Orders also of St. Anthony of Vienne and of the hospital of St. John of Jerusalem, holding regular discipline, even if they possess jurisdiction whether spiritual or temporal, which they obtain in title, commenda, administration and in any other manner whatsoever and shall obtain for the time being, as well as pensions upon any ecclesiastical fruits, from any cause whatsoever, even of sustenance and maintenance, and otherwise howsoever assigned to them, and of ecclesiastical fruits even held in place of pensions reserved to them, may and ought to be proceeded against, even without any citation, intimation or declaration. And if the aforesaid cardinals, within six months, which we assign for three canonical monitions, peremptory delays and terms, to be reckoned from the day of their departure, shall not have returned personally and with effect to the Roman Curia, beyond the penalties and other matters aforesaid, and cumulatively with them, even by that very fact, as is premised, they shall incur the penalties of privation of all and singular fruits, revenues, proceeds, rights, emoluments and gains whatsoever, both of whatsoever offices and duties, even greater ones, even granted in consistory, and worthy of special note and express mention, which in whatsoever manner even by title truly burdensome, as well as of monasteries and any other whatsoever benefices secular and of any Orders even of St. Anthony of Vienne and of the hospital of St. John of Jerusalem holding regular discipline, which they obtain in title, commenda, administration and in any other manner whatsoever and shall obtain for the time being, as well as of pensions upon any ecclesiastical fruits from any cause whatsoever even of sustenance and maintenance and otherwise howsoever assigned to them, and of ecclesiastical fruits even in place of pensions reserved to them, to be freely distributed and disposed of at the pleasure of ourself and of the Roman Pontiff existing for the time being, and without any right being acquired to the titulars. But if, the aforesaid six months having elapsed, during another six months immediately following, which we likewise assign and will to be assigned for three canonical monitions and peremptory delays and terms, they shall still be absent, and shall not have returned personally and with effect to the Roman Curia within the term of these last-mentioned six months, cumulatively with all and singular the aforesaid penalties, even the penalty of privation of the same aforesaid all and singular offices and duties, even greater ones, even granted in consistory and otherwise in whatsoever manner even by title burdensome as is aforesaid, and of monasteries and benefices secular, howsoever qualified as above, and of fruits and pensions, even held in place of pensions, to be freely distributed and disposed of at the pleasure of ourself likewise and of the Roman Pontiff existing for the time being, and without any right being acquired to the titulars, as is premised, they shall likewise incur by that very fact and without other declaration. § 3. But those cardinals who before the statute concerning cardinals, the present constitution being issued, obtained from us the aforesaid license to depart outside the temporal jurisdiction of the Ecclesiastical State without the license of the Supreme Pontiff,

7 have transferred themselves (all things nevertheless remaining safe and firm which have been done and transacted by us or by others by our mandate concerning this in any manner whatsoever hitherto, and in the future to be done and transacted), if within six months from the day of the publication of the present constitution, to be made here in the City, as below, to be reckoned, which we likewise assign for three canonical monitions and peremptory delays and terms, they shall not have returned personally and with effect to the Roman Curia, by that very fact likewise without other declaration they shall incur the penalties of interdict of entrance into church and privation of the faculty of making a will and disposing, and of all privileges and indults aforesaid, and of fruits, offices and duties, even greater ones, even granted in consistory, and even by title burdensome, and of pensions, monasteries and any other whatsoever above expressed; and if, the aforesaid six months having elapsed, the same cardinals, who as is aforesaid have already transferred themselves outside the said Ecclesiastical State without our license, within another six months immediately following, which we also assign for three canonical monitions and terms as above, shall not have returned personally and with effect to the Roman Curia, they shall moreover incur the penalty of privation of the aforesaid offices and duties, even greater ones, even granted in consistory; and even by title burdensome, and of monasteries, benefices and any other whatsoever above expressed in like manner. Other penalties

8 § 4. But if both cardinals who, without our permission as aforesaid, have already transferred themselves outside the Ecclesiastical State, and those whom it shall happen in the future, as above, to transfer themselves outside the same State without the permission of us and of the Roman Pontiff existing for the time being, shall not have returned personally and with effect to the Roman Curia within three other months immediately following, which we likewise assign as three canonical admonitions and peremptory delays and terms, and thus in total within fifteen months, we decree that it is possible to proceed to other penalties even however much greater and more severe, and worthy of individual mention and special note, to be declared by us and our successors the Roman Pontiffs, and also even to the penalty of deprivation of the dignity of the cardinalate inclusive. And finally, so that henceforth, both at present and in perpetual future times, whenever it shall happen that any one of the same cardinals of the holy Roman Church, now and existing for the time being, transfers himself outside the aforesaid State without our permission and that of the Roman Pontiff existing for the time being, as above, without our permission, the same cardinal in offices, duties, legations, prefectures, governorships, protections of orders or congregations of regulars, archconfraternities or confraternities, colleges, monasteries, hospitals and other pious places of whatsoever kind, as well as in the administration of his title or diaconate, and also of his episcopate, cardinalate, and of whatsoever other churches, even cathedral, metropolitan and patriarchal, with respect to which he exercises some jurisdiction, and of whatsoever monasteries and other ecclesiastical benefices, as aforesaid, and otherwise in whatsoever manner qualified, and of their jurisdiction both spiritual and temporal, and generally in all and whatsoever duties, even worthy of special note and individual expression, enjoined and committed to him by the aforesaid Apostolic See, we are able to substitute and subrogate a cardinal or prelate or any other whatsoever (notwithstanding whatsoever faculties, permissions and indults on this matter even by motu proprio and also in consistorial and other manner howsoever hitherto granted and henceforth to be granted) in no way is able and avails, we similarly decree in perpetuity, determine and declare, and the faculties and permissions and indults aforesaid, their tenor being held as expressed in these presents, for this purpose, from the day on which he departed outside the said State1 not having first obtained our permission, we annul, invalidate, and evacuate of force and effect, and we wish them to be held as not granted, just as if they had never been thought of.

9 § 5. But from the incurring of all and singular penalties both expressed above and also to be declared in whatsoever manner by us and our successors the Roman Pontiffs, we do not wish anyone to be able to excuse himself by the pretext or reason of whatsoever service or business of whatsoever princes, even of the emperor and kings, or of republics, kingdoms, provinces, nor by reason of whatsoever command or mandate of them or of them whenever or in whatsoever manner made or to be made, or distance of places, or by reason of whatsoever other cause or occasion, even public, or otherwise favorable, even enclosed in the body of law or apostolic constitutions, unless such cause or causes enclosed in the body of law shall have been alleged or alleged before us and the Roman Pontiff existing for the time being, and proved or proved, and expressly admitted or admitted. And further we do not wish anyone to be able to be absolved by whatsoever person, even by the college of cardinals in this matter, even the Apostolic See being vacant, or even by way of grace or justice to be restored, but we reserve to ourselves and to the Roman Pontiff existing for the time being exclusively with respect to all the entire cognition, absolution, relaxation, restoration, reintegration, rehabilitation and whatsoever other dispensation or disposition concerning the aforesaid matters, and any of them. Moreover by these same presents we do not intend to derogate in any way from the constitution edited by Urban, Pope of blessed memory, also our predecessor, concerning the residence of patriarchs, primates, archbishops and bishops, even cardinals.

10 § 6. Decreeing these present letters, and all and singular things contained in them, to be free from any defect of subreptiousness, obreption, or any nullity or invalidity whatsoever, and from any defect of Our intention, and from any other defect howsoever substantial, even from the fact that those having or pretending to have any interest whatsoever in the foregoing, and especially the cardinals of the same Holy Roman Church, have not consented to the foregoing, nor have been called to and heard concerning them, and that the solemnities and all other things to be observed and fulfilled have in no way been observed and fulfilled, and that the causes on account of which these same present letters were issued have not been adduced, verified, or otherwise sufficiently or even in some respect justly justified, and by whatever other color, pretext, occasion and title, even in the body of the law itself, and from any other whatsoever cause, however reasonable, just and privileged, even if necessarily to be expressed, they can by no one at any time be noted, impugned, invalidated, retracted, called into question or controversy, or reduced to the terms of law, or any remedy of opening of the mouth, restitution in full, or any other remedy whatsoever of law, fact or grace be obtained against them, or even by similar motion and even with consistorial consent be used by anyone in judgment or outside it at no time whatsoever; nor can these same present letters, and whatever is contained in them, under revocations, suspensions, limitations, or other contrary dispositions of similar or dissimilar constitutions and dispositions, even by motion, knowledge, deliberation and fullness of power on the part of Us, and even consistorially, or otherwise howsoever by any Roman Pontiffs, predecessors and successors of Ours, and also by Us, made and to be made, for the time being howsoever made, be comprehended, but always excepted from them, and perpetually valid, firm and efficacious exist and be, and their full and complete effects produce and obtain, and by all and singular to whom it pertains and shall pertain in any way in the future be inviolably observed, just as if they had emanated from Our secret consistory with the counsel and unanimous assent of the same venerable brothers Our cardinals,

11 § 7. And thus and not otherwise in all and singular the foregoing by any judges ordinary or delegated, even auditors of causes of the apostolic palace, and nuncios of the aforesaid See, as well as cardinals of the same holy Roman Church, even legates a latere, and any others whatsoever exercising any authority and power, now and for the time being existing, with the faculty of interpreting, declaring, and defining otherwise in any way taken away from them and from each of them, everywhere to be judged, interpreted, declared and defined; so that, if it should ever happen that any doubt or hesitation arise or be raised concerning the foregoing or any part thereof, no one except Us and the Roman Pontiffs Our successors can interpret and declare these present letters in any way, and whatever is otherwise attempted by anyone, by any authority, knowingly or unknowingly, shall be null and void.

12 § 8. Notwithstanding the foregoing, and any apostolic constitutions and ordinances, even issued and to be issued in universal, provincial and synodal councils, and the rules of the apostolic chancery, even, insofar as it be necessary, that one concerning not taking away acquired right, as well as the statutes and customs of the sacred college of the said cardinals, and any others whatsoever, even confirmed by oath, apostolic confirmation, or any other firmness, privileges also, licenses, faculties, indults and apostolic letters, to the same college and to any cardinals and any others whatsoever, under any tenor and forms of words, and with any derogatory clauses even of derogations, and other more efficacious and unusual clauses and decrees, even irritant ones, in general or in particular, even by motion, knowledge, deliberation and fullness of power similar, and even consistorially, and otherwise howsoever, and from any cause even perhaps necessarily to be expressed here, granted in the contrary, emanated, confirmed and many times approved, as well as all and singular things which the aforesaid predecessors in their said constitutions and decrees wished not to stand in the way; all and singular of which, even if for their sufficient derogation special, specific, express and individual mention of them and their whole tenors, and word for word, and not by general clauses importing the same, or any other expression should be had, or some other exquisite form to be observed for this should be required, We having the tenors of all and singular of them present for fully and sufficiently expressed and inserted, for the purpose of the foregoing specially, expressly and most fully derogate; and all other things whatsoever to the contrary.

13 § 9. But in order that these same present letters and whatever is contained in them may be brought to the knowledge of all, and lest anyone of them be able to pretend ignorance,

14 § 10. We will that these same presents be published by one or more of our couriers at the doors of the basilica of the Prince of the Apostles, and of the apostolic chancery, and in the open space of the Campus Florae of the City, and that copies thereof be affixed there and left affixed, which thus published and affixed shall bind and affect all and each whom they concern, no less than if they had been personally intimated and notified to each one of them,

15 § 11. And that to the transcripts of these same presents, even if printed, subscribed by the hand of some public notary, and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given in judgment and outside it everywhere, which would be given to the presents themselves, if they were exhibited or shown.

16 Given at Rome, at St. Peter, under the Fisherman's Ring, on 19 February 1646, in the second year of our pontificate.

Notes

  1. Rather read withdrew (r. t.). It removes excuses.
  2. Urban VIII issued another Constitution concerning cardinals departing from Rome beyond forty miles.
  3. More aptly read transfer (r. t.). He decreed that cardinals should not be permitted to depart outside the Ecclesiastical State without the permission of the Supreme Pontiff.

Innocenzo Papa X, a perpetua memoria.

3 § 1. Poiché tuttavia l'esperienza ci insegna che non è stato sufficientemente provveduto da parte nostra, e affinché un male così pernicioso non continui a crescere di giorno in giorno, abbiamo deciso di applicare rimedi più opportuni, motu proprio, e da certa scienza e matura deliberazione nostra, e dalla pienezza della potestà apostolica, con questa nostra costituzione perpetua stabiliamo, decerniamo e dichiariamo, che tutti e singoli i cardinali della medesima santa Chiesa Romana, ora e per il tempo che sarà, che d'ora innanzi si trasferissero fuori dai confini temporali dello Stato Ecclesiastico senza aver ottenuto da noi e dal Romano Pontefice che di volta in volta esiste la licenza, subito e per ciò stesso, senza alcuna dichiarazione precedente di giudice o di altri, siano privati e rimangano privati di tutti e di qualunque privilegio, immunità, esenzione e indulto, anche di conferire benefici ecclesiastici, nonché di trasferire pensioni o frutti ecclesiastici anche riservati in luogo di pensioni, e di testare e disporre, concessi loro in qualunque modo dalla Sede Apostolica;

4 § 2. E inoltre incorrano parimenti per ciò stesso nella pena dell'interdetto dell'ingresso in Chiesa senza alcuna dichiarazione; e siano inoltre soggetti ad altre pene da determinarsi in qualunque modo da noi e dai nostri successori Romani Pontefici; e al sequestro di tutti e singoli i frutti, redditi, proventi, diritti, emolumenti e guadagni di ogni genere, tanto di qualunque ufficio e incarico, anche maggiori, anche concessi in concistoro, e di speciale nota e espressa menzione degni, che in qualunque modo, anche a titolo veramente oneroso, quanto di monasteri e di altri qualunque benefici sia secolari che di qualunque;
