Bull erecting the Congregation for the Borders of the Papal States
The Erection of the Congregation over the Boundaries of the State subject to the Apostolic See mediately or immediately, with the appointment of its Prefect and Consultors, and the faculties granted to them i.
Urban, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 The duty of pastoral office, committed to us by divine disposition, though with unequal powers, continually presses upon our mind with urgent insistence, so that we may apply effective aid and labor, to the extent granted to us from on high, to those matters which concern the maintenance and preservation of the boundaries and limits of our cities, towns and places, and other goods, and of the Apostolic See, and the security and tranquility of their inhabitants, our subjects and those of the said See, even through the diligent erection of new congregations watching over the aforesaid matters, and that we may dispose otherwise thereupon, as we perceive in the Lord to be salutarily expedient for the benefit of our camera and the same subjects, and for the protection of our Ecclesiastical State.2 § 1. Recently indeed, moved by the aforesaid reasons and by certain other reasons then expressed, and by the protection of the Roman Pontiffs, our predecessors of happy memory, we became aware of them, together with Sixtus V, who prohibited and established in a constitution (which is noted in the rubric of the preceding Constitution, page 597, where all the aforesaid constitutions are cited) that goods be not alienated to foreigners, and that fortresses and other jurisdictional goods be not alienated either to foreigners or to subjects without the license of the Apostolic See; which prohibition was renewed by Clement VIII and Paul V, and likewise this Pontiff confirmed, declared and extended them. And since many alienations had been made contrary to the aforesaid constitutions, he fixed a term for the parties to revoke them without the infliction of penalties incurred, as in the preceding Constitution, page 597. Since this proved of little avail, he erected and instituted this Congregation.
2 on the kalends of July in the first year of his pontificate, in which it is provided that goods be not alienated to foreigners, and fortresses and other jurisdictional goods be not alienated either to foreigners or to subjects without the license of the Apostolic See, and another constitution issued by Clement VIII of pious memory, on the day before the nones of July in the tenth year of his pontificate, renewing and extending that of Sixtus, and the remaining constitutions, to endure perpetually, and also that issued by Paul V of revered memory, Roman Pontiffs our predecessors, on the twelfth day before the kalends of December in the thirteenth year of his pontificate, respectively given; and the aforesaid constitutions of Sixtus and Clement our predecessors, both renewing and declaratory, we have not only approved, confirmed and renewed by apostolic authority to endure perpetually, but also extended and amplified by the said authority to endure perpetually to ruined fortresses, tenancies, and even non-jurisdictional estates on the boundaries of a jurisdictional place, and to goods situated in our and the Holy Roman Church's State and boundary, and to those of foreign princes, their leases, and the impositions of annual rents upon the aforesaid, and the sales of those imposed, as in our letters thereupon given on the kalends of June in the fourth year of our pontificate.
3 § 2. But because, as was afterwards made known to us not without grave sorrow of our mind, various alienations have been made with impunity contrary to the tenor of the aforesaid constitutions and letters, and, unless some opportune remedy be applied in the aforesaid matters, there is danger lest in the course of time and by variety some jurisdiction be usurped, and the jurisdictional boundaries or limits be confused, or occasion be given to such confusion and usurpation: § 3. We, in the aforesaid matters, wishing to provide opportunely as much as we can with the Lord, and not intending to derogate from such constitutions and letters, from which by these presents we are to receive, but willing that they remain perpetually in their former vigor, having the full and sufficient expression of their complete and entire tenors, even the more accurate ones and dates, just as if they were inserted word for word, by these presents, of our own motion, not at the instance of any petition offered to us thereupon, but from certain knowledge, and by our mere deliberation, and from the fullness of apostolic power, we erect a Congregation to be called the Congregation concerning the Boundaries of the Ecclesiastical State subject to us and to the Apostolic See mediately or immediately, which ought to consist of one of the same Holy Roman Church's cardinals, who shall be prefect, and of others partly from the sacred council of the said State, partly from the aforesaid apostolic camera, and also of certain other distinguished men to be selected by the Roman Pontiff existing for the time being, who shall respectively be consultors of the said congregation;
4 § 4. And with him, and the prefect and such consultors, all and singular sales, exchanges, alienations, and whatsoever other dispositions made and to be made against or beyond the tenor and form of the said constitutions and letters, both at the instance of the parties and ex officio, to know, examine, and, as it shall seem good to them, in whole or in part to quash, annul, or declare null, to moderate, restrict, revoke, confirm and approve, or to grant anew; to remove, declare and decide whatsoever doubts arising or arising from the same constitutions and letters, causes and occasion of such alienations, as well as controversies and suits whatsoever, whether between us, the See, the apostolic chamber and whatsoever persons, both secular and ecclesiastical, of whatsoever dignity, degree, order, status, condition and preeminence, even concerning which special and individual mention should be made,1 and whatsoever cities, fortresses, towns, universities, colleges, monasteries and places even pious and religious, regular and secular, even exempt, by whatsoever name called, whether also between the same persons, cities, colleges, monasteries and places aforesaid, moved or to be moved, and all and singular other causes civil and criminal and capital and mixed to hear, know, and as to criminal causes, provided that they themselves do not pronounce sentence of blood, without incurring any irregularity to define and decide; and the boundaries whatsoever of such State and of each of its cities, towns, lands and any other places to visit, declare, place and remove; those disturbing, concealing, removing, cutting or placing boundaries, or otherwise in any way and manner delinquent in and upon the boundaries and limits, and concerning the boundaries, or depending upon them, annexed or connected, or waters in or near the boundaries in any way deriving, or removing from the same, or buildings by whatsoever name called constructing, and whatsoever servitude near or at the boundaries imposing, civilly, and, provided that they themselves do not pronounce sentence of blood, as aforesaid, criminally at their discretion, all and whatsoever appeal removed, to punish; or to any person well-pleasing to them even not constituted in ecclesiastical dignity, who nevertheless shall be judged by the prefect and such consultors suitable for this, such causes to commit,1 or the same in whole or in part with the same faculties to subdelegate; and one or more commissioners or notaries for taking informations, and drawing up processes, when, as often as, and with whom it shall be necessary, and for visiting the boundaries, and making plans and descriptions thereof, with provisions, salaries, 1 Badly edited. Mainardi reads committendas (r. t.). VIII PP. 601 An. C, 1627 and expenses to be declared by the prefect and consultors aforesaid, and to be paid by the communities of places, and others having interest, or also by our chamber at the discretion of the same prefect and consultors, to send and appoint; and to persons whatsoever dwelling in or near the boundaries of the aforesaid State for the defense of such boundaries to bear whatsoever arms (not however of shorter measure) at like discretion to grant license; as well as all and singular causes, suits, controversies and questions concerning and upon the boundaries, or their annexes or connections, principally or secondarily, as aforesaid, moved and to be moved from our sacred consultative, good government, and waters, and other whatsoever tribunals, judges, presidents, governors even of the City, as well as the apostolic chamber's general and sacred palace of the apostolic causes auditors, our also and of the said See legates a latere, both ex officio and at the instance of the parties to reassume and evoke, to cite and inhibit, even under censures and penalties at like discretion to be imposed, moderated and applied, and those thus reassumed and evoked, all, and whatsoever other causes concerning the premises in any way, summarily, simply and plainly, the sole truth of the fact inspected, and by royal hand, and without tumult and form of judgment, likewise with whatsoever appeal removed to know, or to the same congregations, tribunals, legates, judges and other persons well-pleasing to the same congregation to remit and commit with the same faculties, even at like discretion; and respectively, with participation however of us, and not otherwise, all things to do and perform, which concerning the boundaries, territories and alienations, sales, exchanges, the premises all and singular and concerning them we and the Apostolic See could do, and which for the quiet of our subjects and the good government.1
5 and whatever cities, fortresses, towns, universities, colleges, monasteries and places even pious and religious, regular and secular, even exempt, called by whatever name, or also between the same persons, cities, colleges, monasteries and aforesaid places, moved or to be moved, and all and singular other causes civil and criminal and capital and mixed, to hear, to know, and as to criminal causes, provided that they themselves do not pronounce sentence of blood, to define and decide without incurring any irregularity; and to visit, declare, place and remove whatever boundaries of such State and of the individual cities, towns, lands and any other places thereof; and to punish those disturbing, concealing, removing, cutting or placing boundaries, or otherwise in any way and manner delinquenting in and upon the boundaries and limits, and around the boundaries, or depending upon them, annexed or connected thereto, or diverting waters in or near the boundaries in any manner, or removing them from the same, or constructing a building called by whatever name, and imposing any servitude near or at the boundaries, civilly, and, provided that they themselves do not pronounce sentence of blood, as aforesaid, criminally at their discretion, all and any appeal being removed; or to commit such causes to any person well-pleasing to them, even not constituted in ecclesiastical dignity, who nevertheless shall have been judged suitable for this by the aforesaid prefect and consultors, or to subdelegate the same in whole or in part with the same faculties; and to send and depute one or more commissioners or notaries for taking informations, drawing up processes, when, as often as, and with whom it shall be necessary, and for visiting the boundaries, and making plans and descriptions thereof, with provisions, salaries, and expenses to be declared by the aforesaid prefect and consultors, and to be paid by the communities of places and others having interest, or even by our chamber at the discretion of the same prefect and consultors; and to grant permission to any persons dwelling in or near the boundaries of the aforesaid State to bear whatever arms (not however of shorter measure) for the defense of such boundaries at like discretion; and likewise to reassume and evoke, cite and inhibit from our sacred consulta, of good government, and of waters, and from any other whatsoever tribunals, judges, presidents, governors even of the City, as well as from the general chamber of the apostolic and of the sacred palace of the apostolic causes auditors, our own and of the said See legates a latere, both ex officio and at the instance of parties, all and singular causes, suits, controversies and questions moved and to be moved concerning and upon the boundaries, or their annexes or connections, principally or secondarily, as aforesaid, even under censures and penalties to be imposed, moderated and applied at like discretion, and to know those thus reassumed and evoked, all and whatever other causes concerning the aforesaid in any manner, summarily, simply and plainly, the sole truth of the fact being regarded, and by royal hand, and without the tumult and form of judgment, likewise with any appeal being removed, or to remit and commit the same to the same congregations, tribunals, legates, judges and other persons well-pleasing to the same congregation with the same faculties, even at like discretion; and respectively, with our participation however, and not otherwise, to do and transact all things which concerning boundaries, territories and alienations, sales, exchanges, the aforesaid matters and each and every one of them and concerning them we and the Apostolic See could do, and which for the quiet of our subjects and
6 the preservation of the status which they shall respectively judge necessary or in any way opportune, even exclusively with respect to the aforesaid congregations, tribunals, persons and judges, and others also in any way qualified, whether the matter be incidental or principal, full, free and absolute power shall reside, by the apostolic authority aforesaid, by the tenor of these presents likewise, we perpetually erect and institute. Appointment § 5. And in the congregation thus erected and instituted, for its happy governance and administration, we constitute and appoint our beloved sons: Martius, deacon cardinal of St. Mary the New, called Ginetti, as prefect; Stephen Duratius, our and the apostolic camera's general treasurer; and John Beninus, clerk of the same camera; and Francis Vitellius, prelate of the aforesaid sacred consulta; and also the secretary of the same consulta existing for the time being; and Anthony Cerumi, advocate of our consistory, camera and fisc; and Caesar Raccagnus, general commissioner of the same apostolic camera; and Felix Contelorius, keeper of our Vatican library and its archives; and John Baptist Confalonerius, master in theology and keeper of the archives of the Castle of St. Angelo, notaries of the Apostolic See, as consultors, and the same Felix as secretary, by the same authority and tenor.
7 § 6. Decreeing that these present letters can never be noted or impugned on account of subreption or obreption or nullity thereof, or of our intention, or any other defect, but that they shall always and perpetually be valid and efficacious, and shall obtain and secure their full and complete effects, and that they shall not be comprehended under any revocations, suspensions, derogations, or other contrary dispositions, even those containing the whole tenor thereof,
8 but shall always be excepted therefrom; and as often as they shall be revoked or limited, or suspended, or derogated from, so often shall they be restored to their pristine state, replaced and fully reintegrated, and newly granted;
9 but shall always be excepted therefrom; and as often as they shall be revoked or limited, or suspended, or derogated from, so often shall they be restored to their pristine state, replaced and fully reintegrated, and newly granted;
10 § 7. And thus, and not otherwise, in the premises being settled, by all and singular through whomsoever ordinary or delegated judges, exercising any authority whatsoever, even the auditors of the causes of the apostolic palace and cardinals of the same holy Roman Church, even legates and vicelegates a latere, and nuncios of the said See, the faculty and authority of judging and interpreting in any other way being taken away from them and from each of them, it ought to be judged and decided everywhere and in any instance whatsoever; and whatever shall be attempted otherwise concerning these things by anyone, by any authority, knowingly or unknowingly, shall be null and void.
11 § 8. We therefore command the aforesaid, and the prefect existing for the time being, as well as the consultors of the said congregation, and each of them, that they observe and execute these our present letters, and cause them to be observed by others, as much as in them lies, by all appropriate remedies of law and fact, firmly and inviolably.
12 § 9. Notwithstanding, insofar as it be necessary, our right acquired not to be taken away, and likewise of the Pope Pius IV of similar memory, also our predecessor, concerning similar or other favors in any way concerning the aforesaid camera, to be registered and intimated in the same camera, so that these presents shall be valid without other admission and registration in the same camera, and shall obtain their due effect, and other apostolic constitutions and ordinances, even those issued in provincial, synodal and universal councils, special or general, and those of the camera and consulta of this kind, or of other congregations or tribunals, if any there be, to the contrary notwithstanding.

Concerning the faith of copies. § 19. We will moreover that to copies of these same presents, even printed, subscribed by the hand of some notary of the said apostolic chamber, and furnished with the seal of the chapter or prefect, or some one of the modern and for the time being existing consultors of this kind, the same faith altogether, as much in court as outside it, in all things and through all things be given, which would be given to these same presents, if they were exhibited or shown.

3 § 3. Noi, nei predetti argomenti, quanto possiamo nel Signore, volendo opportunamente provvedere, e delle predette costituzioni e lettere, dalle quali per le presenti non intendiamo derogare, ma nel loro primitivo vigore vogliamo che perpetuamente rimangono, avendo i totali e interi tenori anche più veri e dati, come se di parola in parola si inserissero, dalle presenti per pienamente e sufficientemente espressi, di moto proprio, non per istanza di alcuna petizione a noi in proposito presentata, ma da certa scienza, e dalla nostra meditata deliberazione, e dalla pienezza della potestà apostolica, eriggiamo una Congregazione sui confini dello Stato Ecclesiastico a noi e alla Sede Apostolica mediamente o immediatamente soggetto da denominarsi, la quale deve constare di uno dei cardinali della medesima santa Romana Chiesa, che sia prefetto, e di altri parte dalla sacra consulta dello Stato medesimo parte dalla camera apostolica predetta, nonché anche di alcuni altri uomini insigni dal Romano Pontefice per il tempo esistente da eleggersi, i quali siano rispettivamente consultori della medesima congregazione;
