Bull on the Chinese Rites and the Missionaries' Oath
CCXVII.
Mandate for complete observance of the responses given by the editorial authority in the matter of the rites of the Chinese, with the formal oath to be taken by missionaries, and other ordinances.
1 Clement, Pope XI, for the record of future ages. From that day on which, though without any pressing necessity compelling us to undertake the governance of the Catholic Church, the Lord so disposing, we assumed the helm of this office, grave in its amplitude and most troublesome in the wickedness of the times, nothing has been more urgent for us, with hand set to the task, than to settle by apostolic judgment the most bitter contentions that have long since arisen in the empire of China among the apostolic missionaries of those regions, and have grown stronger day by day, both concerning certain Chinese words used there to express the holy and ineffable name of God, and concerning certain rites of those peoples, deemed superstitious by some of the aforesaid missionaries but permitted by others, as being merely civil in nature, so that, with dissensions removed that trouble the propagation of Christian religion and Catholic faith, all might at last speak the same thing in the same sense and in the same judgment, and God might be glorified with one voice by those who are sanctified in Christ Jesus. By this counsel those responses, which were confirmed and given to various questions raised concerning such matters, after a lengthy examination begun in the time of our predecessor of happy memory, Pope Innocent XII, and then continued by our command for many years, and after hearing the arguments of both sides as well as the opinions of several theologians and qualified persons, were given by the authority of the Congregation of our venerable brothers, the cardinals of the holy Roman Church, general inquisitors against heretical depravity appointed by apostolic authority, and we on the twentieth day of November in the year of our Lord seventeen hundred and four confirmed and approved them by the same authority.1
2 § 2. Now those things which were decreed in these responses are as follows:
3 Since God, the best and greatest, cannot be suitably expressed among the Chinese by European words, the word Tien Chu, that is, Lord of Heaven, which is known to have been received by long and proven use among Chinese missionaries and the faithful, should be admitted for signifying the same true God; but the names Tien, Heaven, and Xang Ti, Supreme Emperor, are to be entirely rejected. For this reason, tablets with the Chinese inscription King Tien, Worship Heaven, are not to be permitted to be hung in the churches of Christians, or, if already hung, are not to be permitted to remain there henceforth.
4 To these matters it is in no way and for no reason to be permitted to Christian faithful, whether they preside, minister, or be present at solemn sacrifices or oblations, which are customarily made by the Chinese, at each equinox of any year, to Confucius and to deceased ancestors, as being imbued with superstition. Similarly, it is not to be permitted that these same Christian faithful exercise and perform in the houses of Confucius, which are called by the Chinese name Miao, ceremonies, rites, and oblations which are done in honor of the same Confucius, both on individual months at new moon and full moon by the mandarins or chief magistrates and other officials and literati, and by the same mandarins or governors and magistrates before they assume office, or at least after having obtained possession of the same, and finally by the literati who, after they have been admitted to degrees, forthwith betake themselves to the temple or house of Confucius. Furthermore, it is not to be permitted to Christians to make less solemn oblations to the same in temples or houses dedicated to ancestors, nor to minister in them or serve in any way, or to perform other rites and ceremonies.
5 Likewise, it is not to be permitted to the aforesaid Christians to perform, together with gentiles or separately from them, oblations, rites, and ceremonies of this kind before the tablets of ancestors in private houses, or in the sepulchers of the same ancestors, or before the deceased are committed to burial, in their honor, as is customary, nor to minister to them or be present at them; indeed all the aforesaid things, as being such that, when the arguments on both sides have been weighed and all things have been carefully and maturely discussed, they are found to be performed in such a way that they cannot be separated from superstition, are not to be permitted even to those who cultivate Christian law, unless preceded by public or secret protestation that they are performing these things not in a religious but in a civil and political manner only toward the deceased and are seeking or hoping for nothing from them.
6 Nevertheless, by these things that mere material presence or assistance is not to be considered condemned, which, when performed with gentiles engaging in superstition, without any approval either express or tacit of the actions, and with every ministry entirely excluded, is sometimes afforded to the same superstitious acts by Christians, when otherwise hatreds and enmities cannot be avoided; provided, however, that first, if it can conveniently be done, a protestation of faith is made, and the danger of subversion ceases. Finally, it is not to be permitted to the Christian faithful to retain tablets of deceased ancestors in their private homes according to the custom of those regions, that is, with a Chinese inscription by which the throne or seat of the spirit or soul of N. is signified; indeed, neither with another inscription by which a seat or throne is designated, and thus the same as the former, although more concealed, is seen to be signified. But as to tablets inscribed with the name of the deceased alone, their use can be tolerated, provided that in making them all things that smack of superstition are omitted, and scandal being excluded, that is, provided that those who are not Christians cannot think that tablets of this kind are retained by Christians with that intention with which they themselves retain them, and moreover with a declaration added and placed at the side of the tablets themselves, by which both what the faith of Christians concerning the deceased is, and what the piety of sons and grandsons toward their ancestors ought to be, is set forth.
7 By the foregoing, nevertheless, it is not to be concealed that other things, if there are any, which are customarily performed by those nations toward the deceased, which are truly not superstitious, nor bear the appearance of superstition, but are contained within the limits of civil and political rites, can be performed. Moreover, what these are, and by what precautions they can be tolerated, is to be left to the judgment both of the apostolic commissioner and visitor general then existing and of his vicar in the empire of China, and of the bishops and apostolic vicars of those regions; who, however, in the meantime ought to take care with all the study and diligence they can, so that, with the ceremonies of the gentiles entirely abolished, those rites which the Catholic Church piously prescribes for the deceased may gradually be received in use by Christians and for Christians in this matter.
8 § 3. After these things, however, after nearly six months had elapsed, namely on 25 September 1710, the aforesaid responses, together with the decree, which, adhering expressly to them, was issued by the late lamented Charles Thomas, while he lived, called cardinal of the Holy Roman Church, then patriarch of Antioch, commissioner and visitor general apostolic in the aforesaid empire of China, on 25 January 1707, were by the votes of the same cardinals, who had discussed the matter most maturely and diligently and not continuously, by all and each to whom it pertained, decreed and declared by us to be observed firmly and inviolably under the censures and penalties expressed in the mandate or decree of this kind, with every color or pretext of acting contrary being entirely removed, and especially notwithstanding any appeal interposed by any persons to us and the Apostolic See, which for this reason we similarly decreed to be entirely rejected, and in fact rejected, as is more fully contained in the decree issued in this matter.
9 § 4. All these things ought fully and abundantly to have sufficed, so that those things which that man had sown as tares in that field might be rooted out entirely, and the faithful, with all pretexts removed, might obey all our mandates and those of this Holy See with that humility and obedience as was fitting, especially since at the end of the aforesaid responses, confirmed and approved by us as is set forth above, the cause was pronounced to be already finished in open and clear words. But, since, as from those same regions, not without the deepest sorrow of our heart, it has come to the hearing of our apostolate, the execution of these responses so earnestly prescribed by us has been badly evaded by many, either by a vain and false pretense that they were suspended by us or less legitimately promulgated, or by reason of conditions, as is wrongly asserted, inserted in them, and to be verified before their execution itself, and of the facts on which they were based not being justified, or by the color of further declarations to be issued by us in this matter, or by fear of grave dangers which could befall both the missionaries and the mission itself from the mandated execution, or finally by the pretext of a decree formerly issued, namely on 23 March 1656, on such Chinese rites or ceremonies by the aforesaid Congregation of cardinals, and also approved by Alexander VII, our predecessor of blessed memory, not without grave injury to our pontifical authority, scandal to the Christian faithful, and detriment to the salvation of souls, it has been sufficiently and greatly evaded, or at least excessively delayed:
10 § 5. Hence it is that we, entrusted by divine commission with the apostolic office of service, desiring to remove entirely and completely from the midst such difficulties, evasions, subterfuges and pretexts, and wishing to provide for the peace of the Christian faithful and the salvation of souls, as far as is granted to us from on high, by the counsel of the same cardinals, and also by our own motion, and from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, to all and each of the archbishops and bishops in the aforesaid empire of China, and to others in the kingdoms and provinces bordering upon or adjacent to it, now and for the time being whenever they exist, under penalty of suspension from the exercise of pontifical functions and interdict from entering a church, and to their officials and vicars general in spiritual matters and other Ordinaries of those places, and also to apostolic vicars who are not bishops, and their provicars, as well as to missionaries both secular and of any Order, congregation, institute and society, even of Jesus, regulars, under penalty of excommunication latae sententiae, from which no one by anyone except by us or the Roman Pontiff existing for the time being, unless constituted in the article of death, can be absolved, and as regards regulars also under penalty of deprivation of active and passive voice, penalties to be incurred by those acting contrary ipso facto without any other declaration, by the tenor of the present we command, and in virtue of holy obedience we mandate, that the aforesaid response and all and each of the things contained in them be observed exactly, integrally, absolutely, inviolably and unshakably, and that they be similarly observed by those whose care pertains to them, as far as in them lies, and that they cause this to be done. Nor shall they, whether any of those expressed above, or any other by whatever title, cause, occasion, color or pretext, dare or presume to contravene in any way whatsoever.
11 § 6. Furthermore, by our own motion, knowledge, deliberation and fullness of power, we establish and by the same penalties of excommunication reserved and deprivation of active and passive voice we ordain, that all and each of the ecclesiastics, both secular and of the aforesaid Orders, congregations, institutes and societies, even of Jesus, regulars, sent to China or to the aforesaid other kingdoms and provinces either by this Holy See or also by their superiors, and whenever in the future they are to be sent, by whatever title or force of faculty they exist or shall exist there, namely those sent, as soon as these letters become known to them, and those to be sent, before they begin to exercise any missionary office there, shall absolutely be bound and obliged to take an oath of faithfully, integrally and inviolably observing such precept and mandate of ours, according to the formula to be noted at the end of these present letters, in the hands of the commissioner and apostolic visitor existing for the time being in the aforesaid empire of China, or of another deputed by him, or, he being lacking, in the hands of the bishops or apostolic vicars of the said regions, in whose respective jurisdiction they dwell or shall dwell, or of others deputed by them, and regulars moreover in the hands of the superiors of their religion or of those deputed by them existing in the same regions, so that, before the taking of such oath and subscription under the same formula to be made by each one who shall have taken the oath itself with his own hand, no one shall be able to continue or exercise any missionary office, nor even as deputed by bishops or local Ordinaries, or as a simple priest of his religion, or by any other title, cause or privilege, concerning which express, special and most special mention would need to be made, to hear the confessions of the Christian faithful, to preach, or to administer the sacraments in any way whatsoever, and they shall be able to use no faculties whatsoever, whether granted to them specifically or to their respective Orders, congregations, institutes and societies, even of Jesus, generally by the aforesaid See, but as regards them, beyond and in addition to the penalties expressed above, all and each of the aforesaid faculties shall entirely cease, and shall be of no force and shall be deemed to be of no force.
12 § 7. Moreover, all oaths and documents of this kind are to be transmitted by whatever missionaries, whether secular or regular, to the sacred Congregation for the Propagation of the Faith through the hands of the commissary and apostolic visitor for the time being existing, or of the bishops or apostolic vicars, as is aforesaid, to be taken; and after they have been secured by subscription, or at least authentic copies thereof, by the same commissary and apostolic visitor for the time being existing, bishops and apostolic vicars are to be transmitted to the aforesaid Congregation of cardinals as quickly as possible. Moreover, the superiors regular of any Order, congregation, institute and society, even of Jesus, now and for the time being existing there, are bound under the same penalties not only to take the same oath in the hands of the aforesaid commissary and apostolic visitor for the time being existing, or of the bishops or apostolic vicars, according to the manner prescribed, and to subscribe to its formula, but also to exact its taking from their respective subjects, and to transmit authentic documents concerning it as soon as possible to their respective general superiors, who shall immediately deliver them to the aforesaid Congregation of cardinals.
13 § 8. Decreeing that these same present letters and whatever is contained in them, even for the reason that the aforesaid and any others whatsoever who have or in any way pretend to have an interest in the premises, of whatever status, degree, order, preeminence and dignity they exist, or are otherwise worthy of specific and individual mention and expression, have not consented to them, nor have been called, cited and heard thereto, and the causes on account of which these present letters have emanated have not been sufficiently adduced, verified and justified, or from any other cause whatsoever, however just, juridical and privileged, colour, pretext and head, even in the body of closed law, even of enormous, most enormous and total injury, at no time whatsoever may be noted, impugned, infringed, invalidated, retracted, called into controversy, or reduced to the terms of law, or against them the remedy of opening of mouth, restitution in full, or any other whatsoever of law, fact or grace be attempted or obtained, or even by motion, knowledge and fullness of power on equal terms granted or emanated, anyone in judgment or outside it be able to use or avail himself in any way; but these same present letters shall always be firm, valid and effective, and shall be, with whatever defects of law or fact, which against them, even under the pretext of whatever privileges granted from the aforesaid See, for the purpose of impeding or retarding their execution, in any way or from any cause could be opposed or objected, in no way resisting, obtain their full and complete effects, and for this reason, all and singular impediments in any way brought or to be brought being entirely and wholly rejected and in no way attended to, be inviolably and firmly observed by those to whom it pertains and for the time being whenever it shall pertain, and thus and not otherwise in the premises by whatever ordinary and delegated judges, even auditors of causes of the apostolic palace, and cardinals of the same Holy Roman Church, even legates a latere and nuncios of the aforesaid See, and any others whatsoever exercising and about to exercise whatever preeminence and power, the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, be judged and defined; and if otherwise anything be attempted concerning these things by anyone, by whatever authority, knowingly or unknowingly, it shall be null and void.
§ 9. Notwithstanding the premises, and, derogating ~ ., to the contrary.
14 insofar as it may be necessary, by Our authority and that of the Apostolic Chancery, not taking away the rule concerning acquired right, and by other apostolic constitutions and ordinances, as well as those issued in universal, provincial and synodal councils, whether general or special, and likewise the statutes and customs and prescriptions of whatsoever Orders, congregations, institutes, and societies, even of Jesus, and of whatsoever churches, and all other matters whatsoever, even those confirmed by oath, apostolic confirmation, or any other firmness, however lengthy and immemorial the prescriptions, and also privileges, indults and apostolic letters, granted to the aforesaid Orders, congregations, institutes, and societies, even of Jesus, and to churches and all other persons whatsoever, even those adorned with the most sublime and specially worthy of mention dignity, by the aforesaid See, for whatsoever cause, even by way of contract and remuneration, under whatsoever tenor and forms of words, and with whatsoever even derogatory clauses of derogations, and other more efficacious, most efficacious and unusual clauses, irritant and other decrees, even by Our own motion, knowledge and fullness of power similar, or at the instance of whatsoever persons, even those shining with imperial, royal, or any other worldly or ecclesiastical dignity, or in their contemplation, or otherwise howsoever made in contravention of the aforesaid, granted, issued, repeatedly iterated, and approved, confirmed and renewed however many times; all and singular of which, etc.; and all other things whatsoever to the contrary.
§ 10. Moreover, the formula of the oath, as is premitted above, to be taken, is as follows, namely:
15 to be taken above, is as follows, namely:
16 I, N., a missionary sent or assigned to China, or to the kingdom of N., or to the province of N., by the Apostolic See, or by my superiors according to the faculties granted to them by the Apostolic See, by apostolic precept and mandate concerning rites and ceremonies
