To the Bishops of France on Refusing the Sacraments to Opponents of Unigenitus
1 beat, is defined by this Encyclical Letter. To our Venerable Brethren, the Cardinals of the Holy Roman Church, and the Archbishops and Bishops of the Kingdom of Gaul, assembled in the most recent assembly of the Clergy of Gaul,
2 BENEDICT POPE XIV.
3 Greeting and Apostolic Blessing. From all regions of the Christian world, to which the pastoral care committed to our weakness extends, when many things are often brought to us which keep our mind solicitous and anxious for the state of all and each of the Churches, scarcely however have greater causes of disturbance and sorrow befallen us than from the inconveniences of most grave controversies and dissensions, by which we have learned that this most flourishing Kingdom and the Catholic nation of the Gauls has been tossed about for some years now. Nor have we ceased during this whole time of your disturbances to beseech God, the best and greatest, most earnestly, and also through the intercession of others' prayers, to pray and implore that He, who is the God of peace, might deign to restore true and solid tranquility to your troubled Churches. We have also often, by sending Apostolic letters to our most beloved son in Christ, Louis, the Most Christian King of Gaul, implored his aid and arm for the protection and defense of ecclesiastical peace. To those, however, who have had recourse to Us and to the Apostolic See concerning these matters, we have always given such responses by which we have declared ourselves ready and prepared, for the peace of the Gallic Church, which we pursue with sincere and constant affection, to spend willingly whatever of life remains to us; and to undertake and press forward all things which might be proposed to us for action, provided that such counsels should be recognized as apt and suitable for uprooting the seed of evils, and whose execution might be undertaken with hope of prosperous outcome, and would appear to proceed usefully to the intended end.
4 § 2. The grave and prolonged solicitude concerning your affairs, with which we have hitherto been affected, has not been little relieved by the letter of the Gallican Clergy sent to us on 31 October of the year just past; and indeed, reading it, we perceived your likeness, Venerable Brethren, and your perfect constancy and confession in guarding the true and holy doctrine entrusted to you, and in retaining that observance and veneration toward the Apostolic See of Blessed Peter, the center of Catholic Unity, which your ancestors have always professed. For we have found no dissension among you regarding canonical rules and principles; but only a difference among you in choosing and establishing the means which must necessarily be employed, so that these same common principles may be brought into practice. Although it would have been greatly to be wished that this were far removed from your assembly, nevertheless it ought not to seem strange to those who know that this has otherwise happened among the sacred Bishops, conspicuous in both learning and sanctity of morals, in the treatment of most grave matters. But into great consolation, preconceived by us, there presented itself the singular piety and religion of the Most Christian King, joined with his hereditary obedience to this Apostolic See, which was evident not only in the recent letters which he sent hither on 19 December of that same year past, transmitting the aforesaid letter of the Clergy to us, but also in all his other writings, in which we can and ought to testify that we have always perceived in that Royal mind the sentiments which most befit an Orthodox Prince, endowed with true religion toward God and sincere piety toward the Roman See, and the same most loving of peace and concord to be restored and preserved in his kingdoms. § 3. So great is assuredly in the Church of God the authority of the Apostolic Constitution which begins Unigenitus, and the same vindicates for itself such sincere veneration, obedience, and submission everywhere, that no one of the Faithful can, without grave spiritual peril, withdraw himself from the due subjection toward it, or in any way resist it. Hence it follows that in the controversy which has arisen, whether the Viaticum of the most holy Body of Christ ought to be denied to such refractories seeking it, it must be answered without any hesitation, whenever they are publicly and notoriously refractary to the aforesaid Constitution, that it ought to be denied to them; namely from the general rule which forbids a public and notorious sinner to be admitted to the participation of the Sacrament of Communion, whether he seek it publicly or privately. § 4. Public and notorious refractories are, in the case under discussion, whosoever have been declared such by sentence pronounced by a competent Judge, on the ground that they have stubbornly denied the veneration, obedience, and submission due to the aforesaid Constitution Unigenitus; and also those who have confessed themselves guilty of such contumacy in judgment; and moreover those who, although neither condemned by a Judge nor having confessed their guilt in judgment, nevertheless, either at the time when they themselves are about to receive the Viaticum, voluntarily profess their own disobedience and contumacy against the Constitution Unigenitus, or in the course of their previous life are known to have manifestly committed something opposed to the veneration, obedience, and submission due to the same Constitution, and morally persevere in that deed; which is so commonly known that the public scandal arising therefrom has not yet ceased: for in these cases there is present the same moral certainty which is had concerning those deeds upon which the Judge has pronounced sentence, or at least there is present another moral certainty similar to and equivalent to the aforesaid. § 5. In which, however, there must be kept before the eyes the difference which exists between that notoriety by which some deed is discovered, the guilt of which deed consists in the external action alone;
5 Christian piety and religion.
6 Public and notorious refractories to the Constitution. The Viaticum is rightly denied to public and notorious refractories.
7 Double or manifold species, varied in manner.

9 Certainty from which not sufficiently suitable is held.
10 Anxiety of some in doubtful cases.
11 The method is prescribed to which the minister of the Sacraments can safely adhere.

13 Benedict XIV. Year XVII.
14 consists, as is well known, in the notoriety of a usurer or concubinarian; and another kind of notoriety, by which those external deeds are noted, the guilt of which depends greatly upon the internal disposition of the mind; and it is indeed of this kind of notoriety that we now treat. For the former must certainly be proved by grave proofs; but the latter must be proved by weightier and more certain arguments. § 6. That certainty, however, which we mentioned above, is by no means to be said to exist in other cases, in which the crime rests upon conjectures, presumptions, and uncertain reports, which for the most part owe their origin to men either ill-disposed in mind, or who are led by prejudiced opinions, or the interests of factions; and while credence is given to these, it is sufficiently established by the experience both of past times and of our own age, in how many ways men may err and be deceived, and be led astray.
15 § 7. Since, however, certain Pastors of souls and Ministers of the Church, commended for piety and zeal, deferring to such conjectures and presumptions, when they are called upon to administer the sacred Viaticum to some, remain anxious in mind, fearing lest they cannot administer it without peril to their own conscience; we set forth a certain rule of action which they should follow. § 8. They ought therefore first to observe whether, namely, he who requests the final Viaticum, when he previously used to approach the sacred table, especially at Paschal time, was administered Eucharistic Communion by the Parochial Priest of the place where he dwelt: for if this was not denied to him in life, it will be an argument that either that man was immune from all stain, or at least was not reputed to be a truly notorious sinner; and from this it will follow that the sacred Viaticum cannot be denied to the same person publicly requesting it at the end of life; unless perhaps, after he was once admitted to the Eucharistic table, and before that time when he requires the last Sacraments, he is known to have committed something by which he has contracted the mark of a public and notorious sinner, according to what has been premised.
16 § 9. But where from this kind of investigation certain foundation does not suffice them, upon which they may rely; and on the other hand valid presumptions against the sick person, and grave and urgent indications militate, on account of which they cannot reasonably set aside the scruple that has arisen to them; in these circumstances of affairs, it is necessary for them, with witnesses removed, to address the sick person, and to show to him with all gentleness and meekness, not as if disputing and wishing to convince him, what and what kind of indications are those which render his manner of life suspect; and to beseech and implore him, that he repent, at least in that moment of time upon which the fate of his eternal salvation depends; and moreover to demonstrate to him, that although they are prepared to minister to him the most holy Viaticum of the Body of Christ, and indeed they will in fact minister it to him, he will not on that account be safe before the tribunal of Christ, but rather will constitute himself guilty of a new and horrible crime, from the fact that he has eaten that judgment to himself and drunk it; but that they will minister the Sacrament of the Body of Christ to him for no other reason than that they obey the Church commanding, which, besides the care it has to prevent public scandal, is also concerned, out of its own piety, to prevent the infamy of the sick person himself, and therefore does not repel him from the sacred table, while it regards him, though a sinner in the sight of the Lord, yet does not acknowledge him as a public and notorious sinner in its own tribunal.

21 §. 10.* This norm of judging and acting, therefore, you must, Venerable Brethren, as being approved by Our judgment of the Apostolic See, propose to the inferior pastors of souls and to other Priests throughout your cities and dioceses who legitimately administer the Sacraments. This judgment indeed, which We have interposed upon the controversies now in force, is based both upon ecclesiastical rules and upon the decrees of Councils once held in those very regions of Gaul, and is supported by the opinions of grave theologians of your nation itself. Therefore, just as it was a matter of praise for you, following the examples of your illustrious predecessors, to refer these controversies brought forward and doubts arising therefrom to Us and the Apostolic See, and to seek from here a certain rule for restoring and preserving the peace of your Churches, so now you will increase your duties and your merits alike before God and the Church, if you take care that the method of acting written above be observed entirely by those to whom it pertains in all cases that arise. We expect this from your Fraternities with the greater confidence, and We promise ourselves this, the more We ourselves are conscious that nothing of diligence or zeal has been omitted by Us, whether in weighing and discussing the articles which the Bishops, gathered together in the aforesaid assemblies of the Clergy, proposed, although not with unanimous opinion, and in drawing from their very disagreement notions opportune for thoroughly grasping the matter and defining it with right judgment; or in reading and weighing the opinions written out by our Venerable Brethren, the Cardinals of this Holy Roman Church, whose counsel on this matter We sought; or in executing and performing all other things by which, with the help of Divine light, which meanwhile We have not ceased to implore with the most ardent prayers, We might merit to obtain.
22 §. 11. Nor do We doubt that our most dear Son in Christ, the Most Christian King, after he not only approved the Council undertaken by you, but also, as We have hinted above, did not refuse to foster and aid it by his letters sent to Us, will, for his manifest religion and piety toward God and the Church, strive to provide powerful assistance to your Fraternities, so that it may be free and complete for you as well as for the inferior ministers of the Church to regulate the administration of the sacred Mysteries according to the norm of acting described above. Relying upon this confidence, We have deemed that no discourse should be held here concerning the remaining articles of your Brethren respecting the episcopal rights concerning the granting or denying of participation in those same Sacraments, and the various controversies arising on this matter; but rather We have judged it proper to deal with the Most Christian King himself through other letters of Ours, so that he might protect the sacred rights of the episcopate by his greatness of soul and eminent virtue. This very thing We are certain he will do, both by his own custom and by the manner of his forebears: so that the most noble Church of Gaul, with his royal favor obedient to Our studies and yours, may rejoice to have recovered its former splendor and to have quickly regained the tranquility disturbed for a time. As an auspicious beginning of this most desired outcome, We most lovingly impart the Apostolic Blessing to your Fraternities and to all the peoples entrusted to your pastoral care.
23 Given at Rome at St. Mary Major, on the sixteenth day of October, in the year of Our Lord seventeen hundred and sixty-six, in the seventeenth year of Our pontificate.
