Bull founding the University of Santo Tomas in Manila
XLV.
Foundation of the University of St. Thomas in Manila.
Pope Innocent X, for the record of future ages.
1 Placed by the Lord's disposition, though with unequal minds, in the eminent watchtower of the Apostolic See, and turning over in the recesses of our mind how much the Catholic faith is increased by the study of letters, how the worship of the divine majesty is extended, how truth is recognized, and how justice is cultivated, we willingly direct our attention to those matters on account of which such studies of letters are everywhere promoted and humble persons desiring to apply themselves to them may be able to do so, and we more readily impart the offices of our solicitude in them, as the pious wishes of the Christian faithful, especially those resplendent with royal dignity, demand, and as we perceive in the Lord to be salutarily expedient, having weighed the circumstances of the places.
2 § 1. Since, therefore, as was recently set forth to us in the name of our most beloved son in Christ Philip, the Catholic King of Spain, in the city of Manila in the Philippine Islands of the Western Indies there exists one college under the denomination of St. Thomas of the Order of the Friars of St. Dominic, in which thirty secular students are educated, and grammar, rhetoric, logic, philosophy, and scholastic and moral theology are taught or read, with great benefit to the inhabitants of those parts; and the city of Manila is more than three thousand leagues distant from the nearer universities of general studies, namely Lima and Mexico; and for this reason the same King Philip greatly desires that in the aforesaid college an academy be erected and instituted by us:
3 § 2. We have therefore been humbly petitioned in the name of the same King Philip, that, consulting the convenience of the inhabitants of the aforesaid city and the instruction in good letters, in the said city and in the buildings of the aforesaid college we should deign to erect and institute by apostolic authority an academy in which the religious of the said Order would publicly profess grammar, rhetoric, logic, philosophy, and scholastic and moral theology, and would teach any young men whatsoever, and otherwise provide opportunely in the foregoing matters by apostolic benignity.
4 § 3. We therefore, wishing favorably to accede to the pious wishes of the same King Philip in this matter, inclined by these supplications, with the counsel of some of our beloved sons, the Cardinals of the Holy Roman Church and prelates of the Roman Curia, appointed by us concerning this matter, in the aforesaid city of Manila, in the buildings of the said college where schools now are, or perhaps will be constructed in a more ample form, we erect and institute by the same authority, by the tenor of the present, an academy in which the religious of the said Order shall publicly profess grammar, rhetoric, logic, philosophy, and scholastic and moral theology, and shall teach any young men whatsoever, to endure only so long and until some public university of general studies shall have been erected in the said city of Manila, or in its province, by apostolic authority; and the same academy, thus erected and instituted, we commit to the care, governance, and administration of the said Order and its Master General for the time being, or to one to be appointed by him, who shall have authority over the whole academy and its rector, masters, scholars, and all others aforesaid, so that all and each of them may use, possess, and enjoy not only in the manner of other academies and their rectors, masters, readers, doctors, teachers, scholars, proctors, beadles, messengers, officials, ministers, and other persons in general or in particular in any way whatsoever granted to them, but equally and in like manner principally, in all things and throughout all things,
5 the sciences are enumerated, which those peoples will apply their labor to under King Philip.
6 the will is acceded to.
7 4-15 Ah. C ?6i5 appointed by us in council, in the aforesaid city of Manila, in the buildings of the said college where schools now are, or perhaps will be constructed in a more ample form, an academy in which the religious of the said Order shall publicly profess grammar, rhetoric, logic, philosophy, and scholastic and moral theology, and shall teach any young men whatsoever, to endure only so long and until some public university of general studies shall have been erected in the said city of Manila, or in its province, by apostolic authority, we by the same authority, by the tenor of the present, without however any prejudice to anyone, do erect and institute; and the same academy, thus erected and instituted, we commit to the care, governance, and administration of the said Order and its Master General for the time being, or to one to be appointed by him, who shall have authority over the whole academy and its rector, masters, scholars, and all others aforesaid, so that all and each of them may use, possess, and enjoy not only in the manner of other academies and their rectors, masters, readers, doctors, teachers, scholars, proctors, beadles, messengers, officials, ministers, and other persons in general or in particular in any way whatsoever granted to them, but equally and in like manner principally, in all things and throughout all things, all and whatsoever privileges, indults, liberties, immunities, exemptions, favors, graces, prerogatives, honors, and preeminences,
8 Number 8 4. And moreover to the rector of the same academy and to those to whom ° . .. ... they may be promoted at the proper time, those who . . ,. , . have earnestly pursued their studies, so long as such academy shall endure, we commit those whom in the academy itself thus erected through the proper time they shall have studied and found suitable in knowledge and morals, the rector existing, we commit to the same academy, etc. (n. t.). 1 Some things are lacking, for example, the rector existing, we commit, the same academy, etc. (n. t.). 2 Badly edited. Main. reads that same (r. t.). in the aforesaid faculties, which in the said college as aforesaid are taught or read, to the degree of bachelor also of licentiate, of master, and of doctor, as well as of master (the form of the decrees of the Councils of Vienne and Trent being observed in all things and throughout, which we do not intend to derogate from in any respect, and 1 otherwise laudable customs of other academies) to promote, and to exhibit the insignia of their degrees; and so that those promoted to the said degrees by him may afterwards publicly and privately also in all other academies and universities of general studies interpret the aforesaid faculties and teach others, dispute concerning them, exercise acts befitting the degree or degrees, as well as all privileges, favors, graces, prerogatives and indults, by which others in the aforesaid or other academies, universities, and elsewhere, according to their constitutions and customs promoted to the aforesaid degrees use, enjoy and possess by right or custom, and shall be able to use, enjoy and possess in the future, in all things and throughout, just as if the degrees in academies or universities of this kind according to their customs and practices had been duly received, to use, enjoy and possess; as well as for the time being existing master general of the said Order, so that through himself, or the rector of the said college and thus erected academy, or another, or others, for the healthful and happy direction of the said academy, and for the offices and functions of the rector, masters, procurators, beadles, messengers and others and 2 officials, and the manner and form of teaching and otherwise exercising their offices, and the maintenance of scholars, whatever statutes and ordinances, lawful however and honest and not contrary to the sacred canons and the decrees and constitutions of the Council of Trent 1 The word according to is lacking, or it should be read otherwise (r. t.). 2 The particle and seems to be to be deleted (r. t.). The authority of the Councils of Vienne and Trent being preserved.
9 nibus apostolicis not contrary to apostolic authority to enact and promulgate, and those for the quality of times, things and persons to change, correct and reform, or to annul and abrogate them, and to enact others anew, and concerning their observance to impose penalties at his discretion, and the doctors, masters, readers, scholars, procurators, beadles, and other ministers and officials of the said academy to elect and remove, or to confirm elections made, freely and lawfully may, by the authority and tenor aforesaid we grant and indulge.
10 Decree ir- § 5. Our present letters truly to be valid, firm and effective, and to have their full and complete effect and to obtain, and thus, and not otherwise, by any judges ordinary and delegated, even auditors of causes of the apostolic palace, and cardinals of the Holy Roman Church, to be judged and defined, and we declare to be null and void, if otherwise concerning these things by anyone, by whatever authority, knowingly or unknowingly, it should happen to be attempted.
11 Derogation of con- 8 6. Notwithstanding the constitutions and ordinances of the said Order, even by oath, apostolic confirmation, or any other firmness, statutes and customs, and all other things to the contrary whatsoever.

XLV.
Fondazione dell'università di Manila di S. Tommaso.
Innocenzo Papa X, a perpetua memoria.
7 nella predetta città di Manila, negli edifici del detto collegio dove ora sono le scuole, o forse in forma più ampia si costruiranno, un'accademia nella quale i religiosi del detto Ordine insegnino pubblicamente la grammatica, la retorica, la logica, la filosofia e la teologia scolastica e morale, e istruiscano i giovani di qualunque condizione, duratura tuttavia finché e fino a quando in detta città di Manila, o nella sua provincia, non sia eretta per autorità apostolica qualche pubblica università di studi generali, con la medesima autorità, per il tenore dei presenti, senza tuttavia pregiudizio di alcuno, erigiamo e istituiamo; e la medesima accademia, così eretta e istituita, affidiamo alla cura, al governo e all'amministrazione del detto Ordine e del suo maestro generale pro tempore esistente, o da lui da deputarsi, il quale di tutta l'accademia, del suo rettore, dei maestri, degli scolastici e di tutti gli altri predetti, affinché di tutti e di qualunque privilegi, indulti, libertà, immunità, esenzioni, favori, grazie, prerogative, onori e preminenze, concessi a tali accademie e ai loro rettori, maestri, lettori, dottori, precettori, scolastici, procuratori, bidelli, nunzi, ufficiali, ministri e altre persone in genere o in specie in qualunque modo, non solo all'instar di essi, ma parimente e ugualmente in via principale, in tutte le cose e per tutto, usino, godano e fruiscano;
8 Numero 8 4.
