Bull establishing and protecting the Hospital of the Holy Spirit in Saxia

Bull of Pope Innocent III ·

incumbent.

1 Innocent, bishop, servant of the servants of God, to Guido, master of the Hospital of St. Mary in Saxia and of the Holy Spirit on Mount Fiesole, and to his brothers, both present and future, professing the regular life in perpetuity, greeting and apostolic blessing. Among the works of piety which, according to the Apostle, have the promise of life both present and future, divine Scripture commends hospitality to us especially and frequently, inasmuch as it comprehends all those things on account of which the Lord in the examination of the last judgment asserts that He will reward the good and punish the wicked. For this feeds the hungry, gives drink to the thirsty, gathers in strangers, clothes the naked, and not only visits the sick, but assuming their infirmities upon itself, cares for the infirm, comes to the aid of those in prison, and shares in the infirmity of those living in sickness, participates in the burial of the dead. Through this, certain ones pleased the angels by receiving them as guests, when Abraham and Lot, devoted to hospitality, merited to entertain angels, through whom Abraham, already advanced in age, received the promise of future offspring, and Lot was delivered from the burning of Sodom. Two disciples also, who constrained Jesus by hospitality, whom they did not know in the exposition of Scripture, they knew in the breaking of bread. Through this, the superfluous wealth of the rich, which gathered together might perhaps be kept unto death, is distributed to the necessities of the poor unto life. Through this, earthly things are exchanged for heavenly, and transitory things for eternal by a happy commerce, while through the hands of the poor we lay up treasure in heaven, where neither rust nor moth destroys, and where thieves do not break in nor steal, and we make for ourselves friends of the mammon of iniquity, who when we shall have failed may admit us into the eternal tabernacles.

2 § 1. Attending to these things, therefore, not only for our own salvation but for that of our predecessors and successors, and of our brothers the bishops, priests, and deacons of the Roman Church and cardinals, both living and also deceased, we have with the alms of the Roman Church constructed a venerable hospital at St. Mary in Saxia, a place altogether suitable for exercising the office of hospitality, in which in future times, God granting, the poor and sick may be received and refreshed, and other works of piety may be exhibited.

3 § 2. We decree that the regular order, which according to God and the institution of the brothers of the hospital of the Holy Spirit in the same place is known to have been instituted by us, shall be inviolably observed in perpetuity therein.

4 § 3. This, however, being added, that in the same Church there shall always be at least four clerics professing the rule of the same hospital, who, praying specially for us and our predecessors and successors and brothers, both living and deceased, shall freely administer all spiritual things, and in these matters shall be subject to the correction of none other than the Roman Pontiff. To whom, whenever it shall be expedient, after warning being given, let there be a charitable proclamation by the brothers for God's sake, that he himself, having learned the truth, may decree what his prudent counsel shall have deemed to be provided.

5 § 4. They themselves, content with the food and clothing which we command to be provided to them according to the same rule, shall be devoted to divine offices and attend to ecclesiastical sacraments, so that concerning other hospital business, except by the permission of the master, they shall in no way involve themselves, but shall leave all to your disposition, son master, and to that of your successors, or of those who by you or by them shall have been appointed for this, without contradiction or murmuring. § 5. Moreover, since in the hospital of the Holy Spirit hospitality flourishes greatly in our days by the grace of God, we unite this to that and that to this, by the counsel of our brothers, so that this may afford that so much more useful protection, as being nearer to us, it may more easily implore our defense, and that may more conveniently come to the aid of this in ministers, as the persons conversing in that are more apt for the office of hospitality. Yet in such manner through this union that the aforesaid hospital of the Holy Spirit shall in no way be withdrawn from the jurisdiction of the Church of Maguelone, that constitution alone being observed which we have decreed to be observed between the same Church of Maguelone and the aforesaid hospital of the Holy Spirit.

6 § 6. We further decree that one master alone shall be placed in charge of both hospitals, who shall visit each annually, and what he shall see to be determined or amended, he shall determine and amend, and shall have free faculty of transferring brothers wherever they shall have been, as he shall better see fit to be expedient.

7 To him and to his successors. If perchance anyone at the city or anywhere else...

8 beyond the mountains, the way of all flesh being entered, the brothers of the hospital of St. Mary in Saxia shall not delay in announcing his death to the brothers of the Holy Spirit. And they, at Rome, shall send two or three of their brothers, who shall celebrate a regular election with the brothers of the hospital of St. Mary in Saxia. But if perchance he shall have died at Mount Pessulanus, or anywhere beyond the mountains, let the brothers of the Holy Spirit announce his death to the brothers of St. Mary, who, as we have said, shall send two or three of their brothers to Mount Pessulanus to celebrate the election regularly.

9 § 7. Moreover, since the church of St. Mary in Saxia and the hospital constructed there pertain to us by no intermediate means (save that the clergy of the same Church ought by our mandate to assist in the scrutiny, baptism and litany of the basilica of the prince of the apostles), lest a man of unequal condition be preferred to the same, and a servant who stands to another master, or falls, be placed over the aforesaid hospital, which is subject to our jurisdiction alone; we exempt your person, son master, and that of your successors from the power of any prelates whatsoever. So that no one shall dare to promulgate against you or them a sentence of interdict or excommunication without the mandate of the Apostolic See. And if it shall have been pronounced otherwise, we decree that it shall not hold.

10 § 8. Although we unite the aforesaid hospitals, lest such union should introduce confusion, since even if union be pleasing to God, discretion nevertheless be acceptable to Him, by the present privilege we ordain that the brothers who shall have been appointed to collect alms for the poor of the hospital of St. Mary in Saxia shall be content with Italy, Sicily, England, and Hungary alone, but the brothers of the hospital of St. Spirit on Mount Pessulanus shall be free collectors of alms in other provinces, so that each may be content with their own boundaries, nor shall they invade the boundaries of others. Nor shall the alms which shall have been collected for the hospital of St. Mary in Saxia be transferred to the hospital of St. Spirit, nor shall those which shall have been collected to it by the devotion of the faithful be carried to that one on any occasion.

11 § 9. If any of your brothers, who shall have been sent to collect alms in any city, castle, or village, shall arrive, if perchance that place shall have been placed under interdict from divine offices, for the reverence of almighty God, at their welcome arrival, let the churches be opened once in the year with bells rung, so that a word of exhortation concerning the acquiring of alms may be set forth to the people in the Church.

12 § 10. We further decree that the receivers of the alms collected under the protection of your fraternities, saving the right of their lords, shall remain under the protection of St. Peter and our protection and shall enjoy peace in the lands in which they shall be.

13 § 11. In like manner also we ordain that whoever shall have been received in your fraternity, if perchance the parish church, during the time he was a parishioner, shall have been placed under interdict from divine offices, and it shall happen that he dies, ecclesiastical burial shall not be denied to him, unless he shall have been excommunicated or specifically placed under interdict.

14 § 12. But tithes from the lands and vineyards which you cultivate for the benefit of the sick and poor with your own hands or at your own expense, or from the sustenance of animals, or from the fruits of your gardens, no one shall presume to exact or extort.

15 § 13. It shall be lawful for you to have in the houses which you now have or shall have in the future for your use and that of your family, as well as for the sick and poor dwelling there, an oratory and cemetery without hindrance or contradiction of any kind.

16 § 14. But the Chrism, Holy Oil, the consecrations of altars or basilicas, the ordinations of clerics who shall be promoted to orders, you shall receive from the diocesan bishops, if indeed they shall be Catholic and shall have communion with the most holy Roman See, and shall be willing to exhibit them to you without any malice. Otherwise it shall be lawful for you to approach any bishop whomsoever you shall prefer, having the grace and communion of the Apostolic See, who, relying on our authority, shall furnish to you what you request.

17 § 15. But when a general interdict of the land shall have been made, it shall be lawful in your churches, with the doors closed, excluding the excommunicated and those under interdict, with bells not rung, to celebrate divine offices in a suppressed voice.

18 § 16. It shall be lawful also for you to receive free and absolute persons fleeing from the world to conversion, and to retain them without any contradiction.

19 § 17. We further prohibit that it be lawful for any of your brothers, after profession made in your places, to depart thence without the permission of his master, unless for the sake of a stricter religious life. But no one shall presume to retain one departing without the security of your common letters.

20 § 18. If, however, any of the brothers, after making profession, should be found to be disturbers of your religious life, perhaps useless, it shall be permitted to you, son Master, and to your successors, with the assent and counsel of the wiser part of the chapter, to remove them, and to give them license to pass over to another Order, where they may be able to live according to God, and to appoint others in their place, who shall be proved in your society for the space of one year. When this is completed, if their conduct shall have required it, and they themselves shall have been found useful for the service of the hospital, let them make regular profession.

21 § 19. Furthermore, we strictly command that no ecclesiastical or secular person exact from you, son Master, or from your successors and the brothers of those hospitals, any oaths of fidelity, homages, oaths, or other securities, which are customary among the laity.

22 § 20. Finally, the tithes which you are able to obtain from clerics or laymen by the counsel and assent of the bishops, and those which you shall acquire with the consent of the diocesan bishops and the clerics to whom they belong, we confirm to you by apostolic authority. Let no one therefore, etc.

23 § 21. Henceforth we beseech and entreat our successors, the Roman Pontiffs, in Christ Jesus, and exhort them, that they who is to come to judge the living and the dead, may specially care for your hospitals, so that your places, with persons and things assigned to the office of hospitality, as special patrons, they may specially cherish and defend. For although they are bound by the office of Apostolic service to provide for other pious places, they ought nevertheless to bestow special care upon this hospital, which was founded and given from the goods of the Roman Church, and which we believe will be enlarged in our days and in those of our successors. If therefore, etc. And to all, etc.

A nessuno dunque, ecc.

A tutti inoltre, ecc.
