FROM THE SACRED CONGREGATION OF THE COUNCIL

DECREE

1 On betrothals and matrimony, issued by order and authority of Our Most Holy Lord Pope Pius X by the Sacred Congregation of the Council.

2 That clandestine marriages might not be rashly entered into, which the Church of God has always with the most just causes detested and forbidden, the Council of Trent providently took precautions, cap. i, Sess. XXIV on the reform of matrimony, decreeing: "Whoever shall attempt to contract matrimony otherwise than in the presence of the parish priest or another priest with the permission of the parish priest or the Ordinary and of two or three witnesses, the Holy Synod renders such persons altogether incapable of contracting in this manner, and decrees that such contracts are invalid and null."

3 But since the same Sacred Council had commanded that such a decree be published in individual parishes, and it would have force only in those places where it had been promulgated; it came to pass that many places, in which that publication was not made, were deprived of the benefit of the Tridentine law, and remain so even to this day, and remain subject to the difficulties and inconveniences of the old discipline. Yet even where the new law prevailed, not all difficulty was removed. For often grave doubt arose in determining the person of the parish priest in whose presence matrimony should be contracted. Canonical discipline indeed established that the proper parish priest should be understood to be he in whose parish one of the contracting parties had a domicile, or a quasi-domicile. But because it is sometimes difficult to judge with certainty concerning a quasi-domicile, not a few marriages were exposed to the danger of being null: and many also, either through the ignorance of men or through fraud, were found to be altogether illegitimate and invalid. These things, long lamented, we see happen more frequently in our age, the more easily and swiftly travel with peoples, even the most distant, is accomplished. For which reason it seemed to wise and most learned men expedient that some change be introduced in the law concerning the form of celebrating marriage. Moreover, many sacred Bishops from every part of the earth, especially from the more renowned cities, where the necessity appeared more grave, humbly presented petitions to this effect to the Apostolic See.

4 It was likewise requested by the Bishops, both of Europe for the most part and of other regions, that provision be made against the inconveniences which arise from betrothals, that is, mutual promises of future matrimony, privately entered into. For experience has sufficiently taught what dangers such betrothals carry with them: first indeed incentives to sin and cause for inexperienced girls to be deceived; afterwards irreconcilable disputes and lawsuits.

5 Moved by these circumstances, Our Most Holy Lord Pope Pius X, in the solicitude which he bears for all the Churches, desiring to use some moderation to remove the aforesaid harms and dangers, entrusted the Sacred Congregation of the Council to examine this matter and to propose to Him what it should judge opportune. He also wished to hear the opinion of the Council constituted to reduce canon law into one body, as well as of the Eminent Cardinals who were chosen by special commission for the preparation of the same code: by whom, as also by the Sacred Congregation of the Council, meetings were held frequently for this purpose. When, however, the opinions of all had been obtained, Our Most Holy Lord commanded the Sacred Congregation of the Council to issue a decree by which laws approved by Him, from certain knowledge and mature deliberation, should be contained, by which the discipline of betrothals and matrimony should henceforth be governed, and their celebration should be made expeditious, certain and orderly. In execution therefore of the Apostolic mandate, the Sacred Congregation of the Council by the present letters establishes and decrees the following.

ON BETROTHALS

6 I. - Only those betrothals are held to be valid and to produce canonical effects which have been contracted by a written document signed by the parties and either by the parish priest or the local Ordinary, or at least by two witnesses. If either or both parties cannot write, this shall be noted in the document itself; and another witness shall be added, who together with the parish priest or the local Ordinary, or the two witnesses mentioned above, shall sign the document.

7 II. - By the name of parish priest in this and in the following articles is meant not only he who legitimately presides over a canonically erected parish; but in regions where canonically erected parishes do not exist, also a priest to whom the care of souls has been legitimately entrusted in some defined territory, and who is equated with a parish priest; and in missions, where territories are not yet perfectly divided, any priest universally appointed by the Superior of the mission to the care of souls in some station.

ON MATRIMONY

8 III. - Only those marriages are valid which are contracted in the presence of the parish priest or the local Ordinary or a priest delegated by either of them, and of at least two witnesses, according however to the rules expressed in the following articles, and saving the exceptions which are set forth below in n. VII and VIII.

9 IV. - The pastor and the local Ordinary validly assist at matrimony, § 1°. from the day only of having obtained possession of the benefice or begun office, unless they have been excommunicated or suspended from office by public decree naming them specifically; § 2°. within the limits only of their own territory: in which they validly assist at the matrimonies not only of their own subjects, but also of non-subjects; § 3°. provided they are invited and asked, and neither constrained by force nor grave fear, and they require and receive the consent of the contracting parties. V. - They assist licitly, however, § 1°. when it has been legitimately established for them that the contracting parties are free, the prescriptions of law being observed; § 2°. when it has moreover been established that there is domicile, or at least a monthly residence of one of the contracting parties in the place of matrimony; § 3°. but if this be lacking, so that the pastor and local Ordinary may licitly assist at matrimony, they need the license of the pastor or Ordinary of one of the contracting parties, unless grave necessity intervene, which may excuse them from it. § 4°. Regarding vagrants, except in case of necessity, it is not lawful for the pastor to assist at their matrimonies unless the matter has been referred to the Ordinary or to a priest delegated by him, and he has obtained license to assist. § 5°. In any case, however, let it be held as a rule that matrimony be celebrated before the bride's pastor, unless some just cause excuse it.

10 VI. - The pastor and the local Ordinary are able to grant license to another priest, determined and certain, that he may assist at matrimonies within the limits of their territory. The delegate, however, in order to assist validly and licitly, must observe the limits of the mandate, and the rules established above for the pastor and local Ordinary in nos. IV and V.

11 VII. - When danger of death is imminent, where the pastor, or local Ordinary, or a priest delegated by either, cannot be had, to provide for conscience and (if the case warrant it) for the legitimation of offspring, matrimony can be contracted validly and licitly before any priest and two witnesses. VIII. - If it should happen that in some region the pastor or local Ordinary, or a priest delegated by them, before whom matrimony can be celebrated, cannot be had, and this condition of affairs has persisted already for a month, matrimony can be validly and licitly entered into by the spouses emitting formal consent before two witnesses.

12 IX. - § 1°. When matrimony has been celebrated, the pastor, or he who takes his place, shall immediately record in the book of matrimonies the names of the spouses and witnesses, the place and day of the celebrated matrimony, and other matters, according to the manner prescribed in the ritual books or by his own Ordinary; and this even if another priest, either delegated by him or by the Ordinary, assisted at the matrimony.

13 § 2°. Moreover, the pastor shall note also in the book of the baptized that the spouse contracted matrimony in his parish on such a day. But if the spouse was baptized elsewhere, the pastor of the matrimony shall transmit notice of the contracted marriage to the pastor of the baptism, either by himself or through the episcopal curia, so that the matrimony may be recorded in the baptism book.

14 § 3°. Whenever matrimony is contracted according to the norm of no. VII or VIII, the priest in the former case, the witnesses in the latter, are bound jointly with the contracting parties to ensure that the marriage entered into is noted in the prescribed books as soon as possible.

15 X. - Pastors who have heretofore violated the prescriptions here set forth shall be punished by the Ordinaries according to the measure and gravity of the fault. And moreover, if they have assisted at anyone's matrimony contrary to the prescription of § 2 and 3 of no. V, they shall not retain the emoluments of their stole, but shall remit them to the proper pastor of the contracting parties.

From the S. Congregation of the Council

16 XI -

17 § 1°. All those baptized in the Catholic Church and converted to it from heresy or schism are bound by the laws established above (whether these or those have afterwards fallen away from it), whenever they enter into espousals or matrimony among themselves.

18 § 2°. They also hold for the same Catholics mentioned above, if they contract espousals or matrimony with non-Catholics, whether baptized or not baptized, even after obtaining a dispensation from the impediment of mixed religion or disparity of worship; unless for some particular place or region it has been otherwise determined by the Holy See.

19 § 3°. Non-Catholics, whether baptized or not baptized, if they contract among themselves, are bound nowhere to observe the Catholic form of espousals or matrimony. Let this decree, legitimately published and promulgated, be held as such by its transmission to the local Ordinaries: and let the things disposed in it begin to have the force of law everywhere from the solemn day of the Resurrection of Our Lord Jesus Christ next following, in the year 1908.

20 In the meantime, however, let all local Ordinaries take care that this decree be published to the people as soon as possible, and be explained in the individual parish churches of their dioceses, so that it may be rightly known by all.

21 These present shall be valid by special mandate of our Most Holy Lord Pius X, notwithstanding anything to the contrary, even those worthy of particular mention.

22 Given at Rome on the 2nd day of the month of August in the year 1907.

EX S. CONGREGATIONE CONCILII

DECRETUM

5 His rerum adiunctis permotus SSmus D. N. Pius PP.

7 II.

VIII. - Si contingat ut in aliqua regione parochus locive Ordinarius, aut sacerdos ab eis delegatus, coram quo matrimonium celebrari queat, haberi non possit, eaque rerum conditio a mense iam perseveret, matrimonium valide ac licite iniri potest emisso a sponsis formali consensu coram duobus testibus.

12 IX. - § 1°.

13 § 2°. Praeterea parochus in libro quoque baptizatorum adnotet, coniugem tali die in sua parochia matrimonium contraxisse.
