APOSTOLIC DISMEMBERMENT OF THE MARIANA ARCHDIOCESE AND ERECTION OF THE DIOCESE OF BELO HORIZONTE. BENEDICT, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER.

1 Pastoral solicitude imposes upon Us the duty of taking the greatest care that the distribution of the governance of the Catholic world respond fittingly to the necessities of times and places. It is therefore incumbent upon Us to be vigilant that the number of ecclesiastical circumscriptions be increased in various regions, as opportunity and especially the spiritual good of the Christian faithful demands. Since therefore the partition of the Mariana archdiocese, which is to be numbered among the greater ones by reason of the extent of its territory and the frequency of its peoples, serves the good of souls and the order of governance, We have determined to do this. Wherefore, having taken counsel with Our beloved sons the Cardinals of the Holy Roman Church, who are placed over the Sacred Consistorial Congregation, and having completed all things which were necessary to know for the matter, having supplied, insofar as it is necessary, the consent of those to whom it pertains or who may presume their interest to be involved, and also making use of the faculty reserved to Us and the Apostolic See in the Apostolic Letters under the leaden seal, whose beginning is "Ad universas orbis Ecclesias," given at Rome on the twenty-seventh day of the month of April in the year one thousand eight hundred and ninety-two, freely undertaking a new dismemberment of a diocese in the Brazilian Republic, as often as it shall seem expedient, from the fullness of Apostolic power, We divide the aforesaid Mariana archdiocese into two parts, and We restrict it toward the east, and in the western part We erect a new diocese, to be called Belo Horizonte. To this new diocese We assign and attribute the municipalities commonly called the Prefecture of Belo Horizonte, Contagem, Santa Luzia, Sabara, Gaeté, Siete Lagoâs, Bomfim, Entre Rios, Santa Quiteria, Itauna, Para, Pequy, Pitanguy, Divinopolis, Itapecerica, Oliveira, Passatiempo, Campo-Bello, Perdoès, Boni Succeso with the parish called Hitiruna. The diocese of Belo Horizonte thus defined by these boundaries, We erect and establish its seat and episcopal cathedral in the city of "Belo-Horizonte," from which the diocese itself takes its name, and We raise it to the rank of an episcopal city, together with all the rights and privileges which other episcopal cities enjoy and possess by common law. The church moreover existing there and dedicated to the Blessed Mary Virgin Assumed into Heaven We raise and exalt to the status and dignity of a cathedral; and at the same time to it and to its Bishops for the time being We grant the honors, insignia, favors, graces, privileges and rights, which other cathedral churches and their Prelates possess and enjoy by common law or by legitimate custom.

2 This cathedral church We constitute as a suffragan to the metropolitan church of Mariana, and its Bishops for the time being We subject to the metropolitan jurisdiction of the aforesaid Archbishop of Mariana; yet with the faculty reserved to Us and the Apostolic See of freely decreeing a new dismemberment of this diocese, as often as it shall seem opportune in the Lord.

3 As to the administration and governance of this diocese, the institution of the cathedral chapter or college of consultors, the erection of the diocesan seminary, the election of a Vicar Capitular or Administrator during a vacant see, the rights and duties of the clergy and faithful themselves, and other matters of this kind, We command that what the sacred canons decree be observed.

4 As to what pertains to the clergy, We decree that, as soon as the dismemberment of the Mariana archdiocese and the erection of the new diocese of Belo Horizonte shall have taken effect, those presbyters shall by that very fact be considered ascribed to the church in whose territory they legitimately exist, whether detained in the care of souls or in some ecclesiastical office.

5 The episcopal table shall be constituted by the taxes of the episcopal curia and other offerings of the faithful, for whose good this new diocese has been erected.

6 We further will that at the expense of this diocese two chosen young men of good promise be sent without interruption to the Pontifical Pius Latin American College of the City, so that there, almost under the very eyes of the Roman Pontiffs, they may apply themselves to ecclesiastical disciplines. We moreover command that all documents and acts which pertain to this diocese and its clergy and faithful be handed over as soon as it can be done from the chancery of the Mariana archdiocese to the chancery of the diocese of Belo Horizonte, so that they may be preserved in its archive.

7 Now these Letters and whatever is contained in them, even if anyone to whom it pertains or who presumes it pertains to him has not been heard and has not consented to the foregoing, even if he should be worthy of express, specific and individual mention, can never at any time be noted, impugned, or called into question on account of the vice of subreptiousness or obreption, or nullity, or of Our intention, or any other defect whatsoever, even if substantial and unforeseen; but these Letters, as made and emanated from certain knowledge and fullness of power, shall exist perpetually valid and shall be valid, and shall produce and obtain their full and complete effects, and ought to be inviolably observed by all to whom it pertains; and if otherwise anything should be attempted against these by anyone whatsoever, by any authority, knowingly or unknowingly, We will and decree that it be entirely null and void and shall be null and void. To carry all these things into execution as aforesaid, We appoint the venerable brother Henry Gasparri, Archbishop with the title of Sebastea, Apostolic Nuncio in the Brazilian Republic, and We grant to him the necessary and opportune faculties, even to subdelegate, for the purpose in question, any man constituted in ecclesiastical dignity, and to pronounce definitively upon any difficulty or opposition arising in any way in the act of execution; moreover imposing upon him the duty of sending to the Sacred Consistorial Congregation, within six months to be reckoned from the date of these present Letters, an authentic copy of the execution completed.

8 We command finally that to copies of these Letters, even printed ones, subscribed however by the hand of some public notary and furnished with the seal of someone constituted in ecclesiastical dignity, the same faith be given as would be given to these Our Letters, if they were exhibited or shown. Notwithstanding, insofar as it may be necessary, the rules established in synodal, provincial, general and universal Councils, special or general Apostolic constitutions and ordinances, and any other dispositions of the Roman Pontiffs, Our predecessors, and all other things whatsoever to the contrary.

9 Let no one therefore infringe or act contrary to these Our Letters of dismemberment, erection, decree, mandate, derogation and will. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul His.

3 Quod vero attinet ad huius dioecesis administrationem et regimen, ad Capituli cathedralis vel consultorum collegii institutionem, ad Seminarii dioecesani erectionem, ad Vicarii Capitularis, seu Administratoris sede vacante, electionem, ad ipsorum clericorum et fidelium iura et onera, aliaque huiusmodi, servanda iubemus quae sacri canones decernunt.

4 Quod vero ad clerum spectat, statuimus ut, statim ac dismembratio archidioecesis Mariannensis, novaeque dioecesis Bellohorizontinae erectio effecta sit, eo ipso presbyteri illi Ecclesiae adscripti censeantur, in cuius territorio legitime exstant, vel animarum cura, vel aliquo ecclesiastico officio detenti.

5 Episcopalem autem mensam constituent Curiae episcopalis taxae aliaeque fidelium oblationes, in quorum bonum nova haec dioecesis erecta est.

6 Volumus praeterea ut huius dioecesis sumptibus duo delecti iuvenes bonae spei in Pontificium Collegium Pium Latinum Americanum de Urbe non intermissa vice mittantur, ut ibi, sub ipsis fere oculis Romanorum Pontificum, ecclesiasticis disciplinis incumbant. Mandamus insuper ut omnia documenta et acta, quae hanc dioecesim eiusque clericos et fideles respiciunt, quamprimum fieri poterit, a cancellaria archidioecesis Mariannensis tradantur cancellariae dioecesis Bellohorizontinae, ut in eius archivo custodiantur.

1 La sollecitudine pastorale Ci impone l'obbligo di provvedere con la massima diligenza affinché la distribuzione del governo della Chiesa cattolica nel mondo corrisponda adeguatamente alle necessità dei tempi e dei luoghi. Ci incombe pertanto di vigilare affinché il numero delle circoscrizioni ecclesiastiche sia aumentato nelle varie regioni, secondo l'opportunità e soprattutto secondo il bene spirituale dei cristiani fedeli. Poiché dunque il bene delle anime e l'ordine del governo consigliano di dividere l'arcidiocesi Marianense, che per l'estensione del territorio e la frequenza della popolazione deve essere annoverata tra le maggiori, Noi abbiamo stabilito di farlo. Perciò, di concerto con i diletti figli Nostri Cardinali della Santa Romana Chiesa, preposti alla Santa Congregazione Concistoriale, compiute tutte le cose che erano necessarie a sapersi per la cosa, supplito, per quanto fosse necessario, il consenso di coloro che vi hanno interesse o si presume che vi abbiano interesse, usando inoltre della facoltà a Noi e alla Santa Sede riservata nelle Lettere Apostoliche munite di piombo, il cui inizio è « Ad universas orbis Ecclesias », date a Roma il ventisette aprile dell'anno milleottocentonovantadue, liberamente procedendo a una nuova divisione della suddetta arcidiocesi Marianense nella Repubblica Brasiliana, tutte le volte che ciò sembrasse opportuno, dalla pienezza della potestà apostolica, dividiamo in due parti la predetta arcidiocesi Marianense, la restringiamo verso oriente, e nella parte occidentale erigiamo una nuova diocesi, che dovrà chiamarsi Bellohorizontina. A questa nuova diocesi assegniamo e attribuiamo i municipi comunemente detti Prefettura di Bello Horizonte, Contagem, Santa Luzia, Sabara, Gaeté, Siete Lagoâs, Bomfim, Entre Rios, Santa Quiteria, Itauna, Para, Pequy, Pitanguy, Divinopolis, Itapecerica, Oliveira, Passatiempo, Campo-Bello, Perdoès, Boni Succeso con la parrocchia denominata Hitiruna. La diocesi Bellohorizontina così delimitata nei suoi confini, erigiamo e istituiamo la sede e la cattedra episcopale nella città di « Bello-Horizonte », da cui la diocesi stessa prende il nome, e la eleviamo perciò al rango di città episcopale, insieme con tutti i diritti e i privilegi di cui godono e si avvalgono le altre città episcopali per diritto comune. La chiesa ivi esistente e dedicata alla Beata Vergine Maria Assunta in cielo, l'eleviamo e l'esaltiamo allo stato e alla dignità di cattedrale; e contemporaneamente a essa e ai suoi Vescovi pro tempore attribuiamo gli onori, gli insegni, i favori, le grazie, i privilegi e i diritti di cui si avvalgono e godono per diritto comune, o per legittima consuetudine, le altre chiese cattedrali e i loro Presuli.

2 Questa chiesa cattedrale la costituiamo suffraganea della chiesa metropolitana Marianense, e i suoi Vescovi pro tempore li sottoponiamo al diritto metropolitico del suddetto Arcivescovo Marianense; tuttavia a Noi e alla Santa Sede rimane riservata la facoltà di liberamente decretare una nuova divisione di questa diocesi, tutte le volte che nel Signore sembrasse opportuno.

3 Per quanto riguarda l'amministrazione e il governo di questa diocesi, l'istituzione del Capitolo della cattedrale o del collegio dei consultori, l'erezione del Seminario diocesano, l'elezione del Vicario Capitolare, o dell'Amministratore sede vacante, i diritti e gli obblighi degli stessi chierici e fedeli, e altre cose di questo genere, ordiniamo che si osservino le cose che i sacri canoni decernono.

4 Per quanto riguarda il clero, stabiliamo che, non appena sia effettuata la divisione dell'arcidiocesi Marianense e l'erezione della nuova diocesi Bellohorizontina, per ciò stesso i presbiteri di quella Chiesa siano considerati iscritti nella Chiesa nel cui territorio legittimamente si trovano, sia che siano incaricati della cura delle anime, sia che ricoprano qualche ufficio ecclesiastico.

5 La mensa episcopale sarà costituita dalle tasse della Curia episcopale e dalle altre offerte dei fedeli, per il cui bene è stata eretta questa nuova diocesi.

6 Vogliamo inoltre che a spese di questa diocesi due giovani scelti di buona speranza siano inviati senza interruzione al Pontificio Collegio Pio Latino Americano di Roma, affinché ivi, quasi sotto gli occhi stessi dei Romani Pontefici, si dedichino alle discipline ecclesiastiche. Ordiniamo inoltre che tutti i documenti e gli atti che riguardano questa diocesi, i suoi chierici e i suoi fedeli, siano trasmessi al più presto possibile dalla cancelleria dell'arcidiocesi Marianense alla cancelleria della diocesi Bellohorizontina, affinché siano custoditi nel suo archivio.

7 Le presenti Lettere e tutto ciò che in esse è contenuto, anche se coloro ai quali interessa o presumono che interessi, non fossero stati ascoltati e non avessero consentito alle premesse, anche se degni di menzione espressa, specifica e individuale, non potranno mai in alcun tempo essere impugnate, contestate o messe in controversia per vizio di subreptizio, di obreptizio, di nullità, o di Nostra intenzione, o per qualsiasi altro difetto, anche sostanziale e inaspettato; ma esse, come fatte e emanate da certa scienza e da pienezza di potestà, sussisteranno perpetuamente valide e saranno, e produrranno i loro pieni e interi effetti, e dovranno essere inviolabilmente osservate da tutti coloro ai quali spetta; e se per caso da chiunque, con qualsiasi autorità, consapevolmente o inconsapevolmente, fosse tentato il contrario su queste cose, vogliamo e decretiamo che sia completamente irritum e vano e sarà. Per l'esecuzione di tutte queste cose, come sopra, abbiamo incaricato il venerabile fratello Enrico Gasparri, Arcivescovo titolare di Sebastea, Nunzio Apostolico nella Repubblica Brasiliana, e gli abbiamo conferito le facoltà necessarie e opportune, anche di subdelegare, allo scopo di cui si tratta, qualsiasi uomo costituito in dignità ecclesiastica, e di pronunciarsi definitivamente su qualsiasi difficoltà o opposizione che sorga in qualunque modo nell'atto dell'esecuzione; inoltre gli abbiamo imposto l'obbligo di inviare alla Sacra Congregazione Concistoriale, entro sei mesi computati dalla data delle presenti lettere, una copia autentica dell'esecuzione compiuta.

8 Ordiniamo infine che ai transunti di queste Lettere, anche stampati, sottoscritti però da mano di qualche notaio pubblico e muniti del sigillo di qualcuno costituito in dignità ecclesiastica, sia attribuita la medesima fede che sarebbe attribuita a queste Nostre Lettere, se fossero esibite o mostrate. Non ostante, per quanto sia necessario, le regole edite nei Concili sinodali, provinciali, generali e universali, le costituzioni e ordinazioni Apostoliche speciali o generali, e qualsiasi altra disposizione dei Romani Pontefici, Nostri predecessori, e qualsiasi altra cosa contraria.

9 A nessuno dunque sia lecito infrangere o contravvenire a queste Nostre Lettere di dismembrazione, erezione, decreto, mandato, deroga e volontà. Se qualcuno invece, con temerario ardimento, presumesse di tentare questo, sappia che incorrerà nell'indignazione di Dio onnipotente e dei beati Apostoli Pietro e Paolo Suoi.
