Apostolic Constitution on the canonical promotion of clerics and ordinands

Apostolic constitution of Pope Sixtus V ·

CXL.
Against clerics wickedly and simoniacally promoted, and bishops and others sinning in the conferral of orders. Sixtus, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 Preamble. The holy and salutary sacrament of sacred Orders, instituted by our Lord and Saviour Jesus Christ himself, and delivered by a singular gift of divine goodness to the blessed apostles and their legitimate successors, ought to be administered so holily and religiously to the glory of almighty God and the salvation of souls, that those things which, whether from the type and figure of the old law, or otherwise from the great foresight of the holy Fathers, concerning the birth, age, life and probity of morals, holiness, knowledge and other qualities required in sacred ordinations, have been wholesomely established through the sacred canons or apostolic constitutions, or the decrees of general councils, shall be observed inviolately. For if in the old testament we read so many things concerning the integrity and purity of priests and ministers of the altar and concerning their excellence and dignity, of which the Lord said through the prophet Malachias: The lips of the priest shall keep knowledge, and they shall seek the law at his mouth, because he is the angel of the Lord of hosts; certainly much greater reason and diligence must be employed in promoting both clerics of the lower grades and also presbyters, who are constituted for the perfecting of the saints in the work of the ministry, in the building up of the body of Christ, as has been handed down most frequently concerning these very matters both in the divine word and in the precepts of the blessed apostles, and likewise in the statutes of the holy Fathers.1

2 § 1. Wherefore we, on account of the care and solicitude of all churches enjoined upon us by the Lord for this cause, have deemed it fitting to admonish those very pastors and prelates of churches, whose proper duty it is to enrol suitable persons in the clerical militia, and to promote them rightly to the minor and major orders, by our authority, that in executing this part of their pastoral office they henceforth watch more carefully, observe the canonical sanctions as is fitting, and that no occasion of offence be given to anyone, nor their ministry be disparaged, they strive to avoid all those scandals and absurdities which we see, to our great sorrow of heart, arising more frequently from defective and less canonical ordination of clerics. For since many, even sometimes unsuitable and unworthy, not called by the holy calling of God, but rather deceived by the wiles of Satan, under the pretext of devotion and piety, untimely and disordinately affecting indeed a sacred thing and divine office, or proposing to themselves some temporal advantage or gain, or through excessive simplicity and inexperience or malice or fraud, rashly thrust themselves forward to receive the clerical character and other orders before legitimate age or from one who is not their bishop, or without prior due examination and approbation, or otherwise less lawfully, or even recklessly. Bishops ought indeed with paternal charity and prudence to consult better for the salvation of those who often know not what they ask, even better than they themselves request and more wholesomely, and to consider not so much what they demand as what is expedient; and to provide with the utmost diligence, both in ordaining subjects of another diocese, that they promote no one without letters dimissory from their ordinary, and in recognizing those very letters, lest they be falsely made or by someone who does not have the authority to grant them; and finally in examining the birth, age, life, morals, knowledge, suitability, title and other qualities, lest anything be wanting in persons of their own or another diocese to be promoted to clerical honour and ecclesiastical orders of those things which are required by the prescription of the sacred canons.

3 § 2. In order therefore that the prelates of the churches may understand that if in so grave a matter and of such great moment they have sinned through fault or negligence, they will render an account of their stewardship not only in the terrible judgment of God, but also in this present age to the Roman Pontiff, by the present constitution we perpetually establish and ordain that, if henceforth any prelate, presiding over episcopal, archiepiscopal, primatial or even patriarchal dignity, or an abbot, having authority from the Apostolic See to confer the first tonsure and minor orders upon his subjects, shall have conferred the clerical character upon any secular person or any regular of whatsoever Order or military profession, existing as unfit or irregular from some crime, vice or defect or otherwise, or outside the times established by law, or without true dimissorial letters of his ordinary, or by leap or furtively, or as regards seculars, without a sufficient title of benefice or patrimony, or before the age prescribed by the decrees of the sacred Council of Trent for the first tonsure and for each order, or without observing the intervals of time, so that someone might be advanced to several sacred orders in a single day or on continuous days, or after receiving one order, without reasonable cause, before the time fixed by the same Council of Trent has elapsed, might be promoted to another order, without dispensation or apostolic indult, unless due diligence having been applied, just error and probable ignorance of fact excuse him, let him be punished in that in which he has offended, and by that very fact let him be suspended from the conferral of any orders whatsoever, and indeed from the tonsure itself and from the execution of all pontifical functions, and let him be interdicted from entering a church, and let him be punished with other graver penalties at the discretion of ourself and of the Roman Pontiff existing for the time being. But if, despising such suspension and interdict, he shall have rashly thrust himself into the aforesaid matters, let him by that very fact incur suspension also from the governance and administration of his church or monastery, and from the receipt of the fruits of the same table, and of whatsoever benefices obtained by him in title or in commendam or otherwise; and let him not be able to obtain the relaxation of his interdict or suspension or the remission of penalties from any other than from the Roman Pontiff existing for the time being.

4 § 3. And nevertheless, following in the footsteps of the blessed memory of Pius II and our other Roman Pontiff predecessors, who by their constitutions or by rules published in the Apostolic Chancery inflicted diverse penalties against such badly promoted clerics, we declare the same clerics henceforth badly promoted to be perpetually suspended from the execution, ministry and exercise of the orders received and from all hope and facility of ascending to other superior orders; and if they shall have presumed to minister in them, we deprive them, made irregular in this way, of all and whatsoever dignities, offices and ecclesiastical benefices obtained by them in title, in commendam or otherwise, howsoever qualified, whether secular or of whatsoever Order or military profession, and even if the same clerics themselves were regular, by active and passive voice by that very fact, and we decree and declare that they, deprived in this way, and for obtaining those and other similar or dissimilar benefices in the future are perpetually unfit and incapable; reserving to ourself and to the Apostolic See perpetually the disposition of such dignities, offices and benefices thus vacant for the time being.

5 § A. But in order that men, who up to now have been more inclined to such wicked deeds on account of excessive indulgence and hope of impunity and ease of pardon, might abstain from these things and be on their guard in future, we, having removed that facility beforehand and before it takes root in custom, do perpetually reserve to ourselves and our successors alone, by the authority and tenor of the foregoing, the difficulty of both absolving and dispensing, even over irregularity in the cases expressed above, even in the forum of conscience. We forbid that by anyone, whether a secular or any regular priest of any Order or prelate exercising any authority whatsoever, nor by means of any jubilees and indulgences, even the most full and extraordinary, granted by our predecessors or by ourselves or by our successors, in the year of jubilee or at any other time and of the holy crusade, or by any other title, manner and form, by our own motion and in consistory, or at the instance of any princes, kings or emperors, or in their contemplation and regard, with whatsoever most ample clauses derogatory in general or in particular granted or to be granted in the future, nor by force or pretext of faculties or privileges, called the Great Sea or otherwise named in any way, which have been granted to any Orders, congregations or regular persons, or to bishops, by decrees of the Council of Trent or by the office of the Sacred Apostolic Penitentiary, or by our minor or even major penitentiaries and of the Roman Pontiff existing for the time being, or otherwise granted in any way for the time being, persons so offending as aforesaid, namely both the prelates or abbots promoting and the clergy badly invested or ordained, can or ought to be absolved from the aforesaid crimes and excesses, except in the article of death. Nor can they be dispensed with in any way concerning the irregularity contracted on account of the foregoing, even if the crime shall have been entirely hidden.

6 § 5. But truly, because stronger remedies are to be applied to graver ills, and laws are to be changed according to the qualities of persons, places and times, and penalties are to be made more severe and mitigated; since by the suggestion of Satan and the assent of human frailty such sins are seen to have already advanced to the height of vices and to be in a precipice.

7 Therefore, in order that men may be deterred from sin at least by fear of punishment and confusion of their own honor, we are compelled to prepare a new antidote to this poison. And for this reason we will that those who seek absolution and dispensation of this kind shall always, although the crime shall still have been hidden, seek absolution not through the office of the Sacred Penitentiary, but from ourselves and from the Roman Pontiff existing for the time being in both forums; otherwise the said grants and absolutions themselves, even with the clause that the tenor of the present constitution and the other things aforesaid shall be held as expressed, shall be altogether null, void and invalid, and shall avail no one whatsoever.

8 § 6. Moreover, if any prelate or abbot, all the foregoing being observed, shall promote to tonsure and orders persons who are capable and suitable, but having received money, price or reward from those to whom he confers tonsure or orders in a simoniacal manner, shall invest or promote them, we will that, besides the other censures and penalties against those ordering and ordained simoniacally inflicted and imposed by the sacred canons and apostolic constitutions otherwise, which we in no way intend to derogate from, all and singular the aforesaid things shall also have place in those so promoting and promoted.

9 § 7. We decree by the present letters under the clause of any exemptions, faculties and graces, even in any cases whatsoever reserved to the Apostolic See in any way, even in the bull In coena Domini, even under the name of a plenary jubilee or holy crusade, granting faculty of absolving to any persons generally or specially, that they are in no way comprehended, but shall always be excepted and considered as excepted from them.

10 § 8. And thus in all and singular the foregoing matters by any judges and commissioners whatsoever, even auditors of causes of the Apostolic Palace and cardinals of the Holy Roman Church, the faculty of judging and interpreting in any other way being taken away from them and from each of them, it ought to be judged and decided in any cause and instance; and whatever shall be attempted otherwise concerning these things by anyone whatsoever, by any authority, knowingly or unknowingly, shall be null and void.

11 § 9. Notwithstanding the apostolic constitutions and ordinances, even those issued in councils, even general ones; and all other things to the contrary whatsoever.

12 missionaries, even the auditors of causes of the Apostolic Palace and cardinals of the Holy Roman Church, with any faculty of judging and interpreting otherwise taken away from them and from each of them, in any cause and instance, ought to be judged and decided; and whatever shall be attempted otherwise concerning these things by anyone whomsoever, by whatever authority, knowingly or unknowingly, is null and void.

13 § 9. Notwithstanding the constitutions and ordinances of the Apostles, and those issued in councils, even general ones; and any other things whatsoever to the contrary.

14 § 10. But in order that these present letters may become known to all, we command that they be affixed and published at the doors of the Lateran Basilica of St. John and of the Basilica of the Prince of the Apostles of the City, and in the open space of the Campus Florae, and after fifteen days, those who are in the City, but those who are outside it and this side of the mountains, within four months, and those who are beyond the mountains, within eight months, reckoning from the day of this publication, shall be bound and held to observe them just as if they had been personally intimated to each one of them.

15 § 11. And copies of these same present letters, even printed ones, etc.

16 § 12. Let no one whatsoever of mankind, etc.

17 etc.

18 Given at Rome at St. Peter's, in the year of the Lord's Incarnation one thousand five hundred eighty-nine, on the nones of January, in the fourth year of our pontificate. Dated 5 January 1589, pontificate year iv.

7 e trovarsi in precipizio.

17 ecc.
