states and places of the Holy Roman Church, or concerning their alienations and infeudations to be treated under any pretext whatsoever, even of evident utility i.
Pius, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 The care of the government which we have undertaken admonishes us, concerning the universal Church, which by the Lord's authority we preside over, that the cities, lands, towns and places subject to us and to the Apostolic See in temporal matters mediately and immediately, be preserved perpetually in the right, dominion and property and possession of the said See. § 1. Indeed, although certain of our Roman Pontiff predecessors, through their constitutions, have prohibited alienations of ecclesiastical things and have revoked and annulled those already made; nevertheless, since in times past certain persons excessively ambitious and desirous of dominion, under various pretexts, colors and causes, often even false ones (which we report not without the greatest sorrow of our heart), have endeavored by suggestions and insinuations to certain Roman Pontiffs to show and persuade that it would be more useful and expedient for the Holy Roman Church and the aforesaid See, if certain cities, lands, towns, castles, fortresses and places, pertaining to the right and property of the same See, should be granted in fief, in governance, in vicariate, in duchy or in any other perpetual title, or for three generations, or for life, or otherwise for a long1 time; or even because they had been otherwise given in fief or alienated by any such other title, and therefore, as having devolved or being about to devolve to the aforesaid See, could and ought by right to be again infeudated and alienated, and hence certain alienations, infeudations and concessions have emanated from the Apostolic See, from which it is known that it has received no small diminution not only of patrimony, but also of esteem.
2 § 1. Hence it is that we, considering the singular faith of all the aforesaid cities and places and their ready devotion exhibited to the same See at all times, to have been and to be very useful and salutary; and wishing not only to remove such alienations (which in our time we intend to abolish entirely) from the midst, and what we do not permit to ourselves we indicate to our successors, which we hope they will not forget before the tribunal of our Lord Jesus Christ, in the examination of the great day of His coming, that we shall render an account of our stewardship, but in order that all occasion of such alienations being made be utterly abolished, as much as we are able with God, to provide further, adhering also to the constitutions of our predecessors in such matters and renewing them, by our own motion and from our certain knowledge, not at the instance of any petition offered to us on this matter, but from the mere deliberation of our heart, and from the fullness of apostolic power, having also taken mature consultation on these matters with our venerable brothers the cardinals of the holy Roman Church in our secret consistory, by their counsel and unanimous assent (who have also sworn not to contravene the present constitution, nor to consent to Pontiffs attempting alienations contrary to the tenor hereof, and not to seek or accept absolutions from such an oath), by this our constitution to endure perpetually we decree and declare that the aforesaid cities and places, even those hitherto accustomed to be given in fief or in any title of alienation, howsoever devolved to us and the aforesaid See and to devolve in the future, without any further declaration and apprehension of their possession, by that very fact incorporated into the See and the Apostolic Chamber, and to have returned to the right and property and dominion and possession of old, just as if, for forty years and more, the aforesaid cities and places had been immediately possessed by us and the aforesaid See, and had never been granted in fief or in any other title.
3 § 3. We establish and decree that a prohibition against all and singular communities, whether of cities, lands and places aforesaid, as well as citizens and inhabitants of the same, and all other whatsoever persons, both ecclesiastical and secular, of whatsoever dignity and order, even episcopal or greater, existing, and cardinals of the holy Roman Church, both publicly in the councils of the cities and places aforesaid, and privately elsewhere in whatsoever places, even if they be governors of the same cities and lands or legates or prolegates of the Apostolic See, treating, consulting, or otherwise speaking of infeudations or alienations of the cities and places aforesaid immediately pertaining and belonging to us and the aforesaid See, even if devolved, even if customarily given in fief commonly and repeatedly, even by reason of exchange or under annual census or canon or otherwise howsoever, even in consideration of merits toward the aforesaid See, or under pretext of necessity or evident utility to be made, or of requesting from us and the aforesaid See whatsoever persons, of whatsoever dignity, status, degree, even connected to us and our successors by blood, even cardinals of the holy Roman Church, or any other temporal or ecclesiastical dignity holding office, as dukes, vicars, governors or any other title, for life or in perpetuity or for a long time, or even at the pleasure of the Apostolic See, of the cities and places aforesaid, and therefore of choosing orators to be sent to us and our successors concerning the aforesaid matters or on their occasion, proposing, both they themselves and the orators receiving such office, or any others whatsoever insinuating or persuading such alienations to the Roman Pontiff existing for the time being, by themselves or through another or others, by that very fact incur the sentence of excommunication, from which, unless by the Pontiff himself, except in the article of death, they cannot be absolved. And moreover they are rebels against the holy Roman Church and the aforesaid Apostolic See, even in the first count of lèse-majesté, and traitors of the cities and places aforesaid, and their goods are devolved and incorporated into our Apostolic treasury and Camera by that very right and are to be so deemed; and they are by that very fact deprived of all churches, monasteries and other ecclesiastical benefices obtained by them in whatsoever manner, nor can they ever at any time be restored to the cities and places aforesaid. And if it should happen at any time that they be restored, nevertheless they remain infamous, and the gates of honors and dignities are perpetually closed to them.
4 § 4. And since we have understood that some, even cardinals, hold, have and possess cities, lands, towns, castles, fortresses and places for life or for a third generation, or otherwise from the aforesaid See, even by reason of onerous cause, with the faculty of making improvements in them, so that they cannot be removed from them unless the monies expended in such improvements be first restored to them, we by these presents revoke and annul all and singular faculties of making the aforesaid improvements granted to whatsoever persons, even cardinals, by our same predecessors or others having authority for this in whatsoever manner, and that they ought not to benefit anyone henceforth; and to anyone whatsoever having the faculty of making such improvements, we absolutely interdict and prohibit making them after the publication of these presents, even for the fortification and protection, unless they have been made by reason of necessary preservation of the same places; and if otherwise it be done or attempted by anyone, we will and declare that whatsoever improvements made by them contrary to the tenor of these presents shall accrue to the places themselves, and our Camera is not to be held and obligated to their satisfaction.
5 § 5. Decreeing that these present letters, under whatsoever revocations, cassations, derogations and other contrary dispositions, under whatsoever tenors and forms, and with whatsoever clauses and decrees made for the time being in whatsoever manner, are in no way to be comprehended, but always excepted from them, and as often as those shall be issued, so often are these to be restored to their pristine state and granted anew and are to be so deemed.
6 § 6. Null and void moreover if otherwise a decree be attempted concerning these matters by anyone, by whatsoever authority, knowingly or unknowingly.
7 § 7. Notwithstanding apostolic constitutions and ordinances, and those of the cities and places aforesaid, strengthened by oath, apostolic confirmation or any other firmness, statutes and customs and all other things whatsoever to the contrary.
8 § 8. Thus therefore let the constancy of devotion and faith of the aforesaid cities and places toward us and our successors and the same Roman Church persevere, so that by right the virtue of integrity may deserve to obtain greater benefits from the same See. § 9. We will, moreover, that just as all the cardinals individually present have promised and sworn in our secret consistory to observe this constitution, insofar as it shall be in them, and not to contravene it, nor to consent to Pontiffs acting against it, or to seek absolution from the oath taken, nor to accept absolution offered or granted, the same ought to be promised and sworn by the absent cardinals from the consistory, in their dwelling places, and by the Roman Curia, and whenever they shall have betaken themselves to the same Curia, and by future cardinals in due time, upon the assumption of the biretta, and this promise and oath ought to be added and inserted in the form of oath customarily taken by the same cardinals; and we decree that those acting contrary to this incur the penalty of perjury and perpetual infamy of law and fact by that very fact. For this reason also, since the cardinals, upon the occurrence of a vacancy of the Apostolic See, in the conclave, when they are accustomed to take an oath concerning the letters of Julius, Pope and our predecessor, regarding the election of the Roman Pontiff and other constitutions, ought also to promise and swear by each of them who shall be elected Roman Pontiff, and afterwards the same person assumed to the height of the supreme pontificate, after his assumption, to inviolably observe the present constitution of ours, and then after his coronation, to reiterate this promise and oath through his special letters confirming these. But if this shall be refused or deferred by the Pontiff (which is not to be believed), then the said cardinals, in the first secret consistory, and especially their dean and the heads of the Orders, ought not to cease to petition and beseech and entreat him with all urgency and most urgent insistence for the observance of these things, and we establish and ordain that they diligently take care that he accomplish this altogether.
9 § 10. And that the present letters be reduced to a public document, and after the aforesaid letters of Julius, which are accustomed to be read in the said conclave, be joined among our other constitutions, and also be described in the register of the Apostolic Chancery with our other extravagantes, and be published at the doors of the basilica of St. Peter, prince of the Apostles, and in our Apostolic Chancery, and at the edge of the Campus Florae. And because it would be difficult for these to be carried to each and every place, we also decree and declare that to their transcripts, even if printed and subscribed by the hand of some notary, and furnished with the seal of some prelate, the same faith shall be given everywhere, in judgment and outside of judgment, as would be given to these if they were exhibited or shown.
10 § 11. Let no one whatsoever be permitted to infringe this page of our declaration, revocation, decree, statute and interdict, prohibition, ordinance and will, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
11 Given at Rome at St. Peter, in the year of the Lord's Incarnation one thousand five hundred sixty-seven, on the fourth day before the Kalends of April, in the eleventh year of our pontificate.
