17 § 31. Per le necessità comuni e proprie dei novizi;

22 § 35. Poiché tuttavia in alcuni Ordini è stato introdotto l'uso della filiazione, si dichiara;

1 All other things notwithstanding.

Institutions concerning the reception and education of novices in religious monasteries and convents designated or to be designated.

2 § 18. Since the instruction of novices is most useful and necessary for regular discipline in individual monasteries of religious, and since nothing has been found to have had greater force in relaxing that grave and most praiseworthy manner of living of the ancient fathers than either excessive facility in receiving novices beyond the number which the monasteries themselves could support and sustain, or negligence in testing and examining their spirit, whether it truly came from God and from the principal desire to serve Him, or finally carelessness in educating and instructing them.

3 § 19. Therefore, in order that such inconvenience in receiving and educating novices may henceforth be prevented, it is commanded to all superiors and to each one to whom it pertains, that in receiving novices and in their instruction and education, as well as in the election of the master and other ministers, beyond other things which are contained in the sacred canons and decrees, especially of the Council of Trent, pontifical constitutions, and the constitutions of any Order or institute, in the year 1602:

4 henceforth be guarded against, it is commanded to all and each to whom it pertains, that in receiving novices and in their instruction and education, as well as in the election of masters and other ministers, besides other things which are contained in the sacred canons and decrees, especially of the Council of Trent, pontifical [documents], and the constitutions of any Order or institute, [let them observe what follows]. An. Cu 1602

5 in other designated monasteries and convents, both now and hereafter to be designated for this purpose, these things which follow are to be observed inviolably and executed perpetually with care.

6 in others designated, which now and hereafter are to be designated for this purpose to monasteries and convents, let them take care that these things which follow be perpetually observed and executed inviolably.

7 § 20. First, as regards the manner of receiving novices, beyond the diligent inquiry which is to be made concerning the birth, bodily condition, morals and previous life of each one, and especially of those who exceed the sixteenth year of age, whether they be criminals, burdened with debt, or subject to rendering an account of some administration (according to the form of the constitution of blessed memory Sixtus V and the moderations which followed), the superiors to whom it shall pertain shall also carefully inquire into this, so that in those monasteries and convents in which a novitiate of the shorter form has been instituted by apostolic facility, no one henceforth be admitted to religion who is not born of honest parents and does not possess the conditions prescribed by the sacred canons and the constitutions of the Supreme Pontiffs, according to the decree on the form of receiving novices, issued on 19 May 16021

8 § 22. Finally, superiors are to inquire diligently with what spirit, with what mind and will they have chosen the kind of regular life, what end they have proposed to themselves, whether they are led by zeal for greater fruit and a more perfect life, and so that they may be able to be more freely familiar with God, or rather are they led by levity or some human affection or disordered movement of mind, and whether their parents are destitute and in need of their help and support.

9 § 23. Let them also provide that all lay brothers and oblates to be received, before they are admitted to the regular habit, are to be diligently instructed by those to whom this duty falls, concerning the rule which they are to profess, the three essential vows, the regular state, and other particular institutes and constitutions of each Order. And because it is the custom of certain religions, not only to admit lay brothers to profession, but also to receive those called oblates, each Religion is bound to observe its own particular constitutions and special institutes concerning the reception of such oblates.

10 § 23. Let them also provide that all converts, and those who are to be received as oblates, before they are admitted to the regular habit, shall be diligently instructed by those to whom this duty falls, concerning the rule which they are about to profess, the three essential vows, the regular state, and the other particular institutions and constitutions of each Order. And because it is the custom of certain religious communities to receive not only converts who are to be admitted to profession, but also those whom they call oblates, each religious community shall be bound to observe its own particular constitutions and special institutions regarding the reception of such oblates.

11 § M. Novices and those newly received into the habit of confession, and introduced in place of their novitiate, shall examine and purge their conscience of their entire previous life through a general confession of all their sins.

12 5 25. As to the quality of the place, the form of the novitiate, and whatever pertains to each novitiate, the place shall be suitable; such a novitiate shall have its own enclosure separated and distinct from that part of the convent and monastery in which the professed dwell; and it shall have as many separate cells for sleeping as there are novices in number, or a dormitory so spacious that individual beds may be conveniently arranged for each one; in which there shall also be found a cell, or a certain and determined place for the master and his assistant; in it also, besides other common conveniences, there shall be a suitable place for holding spiritual conferences or discussions, and for hearing the master's instructions and teachings, and into which, in winter time, they may gather to warm themselves by a common fire. Moreover, an oratory or chapel, if it can conveniently be done, for exercising the novices in spiritual matters, especially in the performance of ecclesiastical ceremonies and functions. There shall also be a particular garden, well enclosed and fortified, for honest recreation; if not, let them enter the garden common to the other brothers at the time of recreation: but while the novices are dwelling there, the master shall take care, with the authority of the superior of the place, if it be necessary, that no one else enter into it. To such a place of novitiate, access shall never be open to anyone of the same or another Order, even to the officials of the convent and monastery, under any pretext whatsoever, except to the master and his assistant, and also to the superior of the monastery or convent, if he should at any time deem it necessary to enter; in which case, however, let him always take with him as a companion one of the senior fathers of the convent or monastery. The key to the enclosure of this place shall always be kept by the master, and it shall be permitted to him alone, and only for grave cause, to permit anyone entrance there; but if any of the novices should wish to speak to someone, let him do so in the presence of the master and not otherwise.

13 § 26. A companion for the master of novices, if the multitude of novices to be instructed should make one necessary, shall be assigned to him, similar in life and morals, as far as it can be done; who in those matters which pertain to the governance of the novitiate shall be immediately subject to the master, and both the master and the assistant shall be chosen by the provincial chapter for a term of at least three years in this office. But if in any case new places of novitiate should be granted outside the time of chapter, then the election of the master of novices and such assistant in these new places is permitted to be made by the general or provincial, or the minister, or their visitors or vicars, with the consent however of the definitors or other more grave fathers; and the same shall be observed if within the three years, either one or both of them should happen to be removed from those places or to die for some urgent cause, in whose place or places others of similar character ought to be substituted. Both the master of novices and the assistant shall have exemption from all offices and burdens which might hinder the care and governance of the novices. The master himself shall be initiated into the priestly order, and shall be established in at least the thirty-fifth year of his age, and shall have persisted in the Religion for a decade from the emission of profession. The assistant, however, shall exceed the twentieth year; and both shall be outstanding in learning and, as far as it can be done through the diligence and care of superiors, also in the example of their antecedent life; moreover, devoted to the works of prayer and mortification, endowed with prudence and charity, grave not without affability, showing the zeal of God with gentleness, far removed from every disturbance of heart and mind, especially from anger and indignation, which are wont to hinder charity in themselves and toward others, and finally such as to present themselves in all things as an example of good works, so that those who are subject to their care may not so much fear them as revere them, nor ever be able to detract anything from them. Let the master also have full and absolute power concerning the instruction of the novices and the governance of the novitiate, so that it shall not be permitted to visitors or superiors, whether greater or even local (except as noted), to interfere in any way. Let him exercise diligent care that all novices be assiduously exercised in regular discipline, and that they recognize especially the excellence and preeminence of the divine vocation to which they have been made worthy, which is the true and perfect observance of solemn vows and how necessary the constitutions of each Order are; the manner of persisting fruitfully in prayer, both vocal and mental, of restraining illicit passions and vices (to which nature, weakened by sin, is at all times prone and inclined) through the custody of the senses and mortification; austerity, fasts, hairshirts, disciplines, examination of conscience, frequent discussion of it, frequency of the sacraments, especially of Confession, which shall take place at least twice in each month, through daily opening of the soft interior movements, the manifestation of the heart and temptations, through the exercise of humility in the lowlier ministries, through modesty in all actions and prolonged silence.

14 § 27. Let every novice apply himself twice daily to prayer, both mental and vocal, each according to his own capacity and the order prescribed to him by the master, and let him strive to examine his own conscience several times a day. To the master alone is committed the care of hearing the confessions of the novices. It is permitted, however, to the superior, even the local superior, if he shall judge it expedient, either by himself or through another deputed by him, to hear the confessions of the same novices once or twice in a year. § 28. Let them daily be present at the sacrifice of the Mass and at the canonical hours, and let them attend the night and day divine offices in the choir at the appointed times.

15 § 29. Let them also engage in bodily exercises, read or write spiritual matters and recreations, interspersing modest recreation of mind, which in a solitary place and suitable location outside the novitiate shall be established once a week, or at least in alternate weeks for a longer period, and let it always take place with the master present or with a companion, who shall watch carefully lest two remain apart from others, and at that time let them scrutinize the inclination toward which each one's nature tends.

16 § 30. It is not permitted to them, during the time of novitiate and probation, to remain together with the professed, except in the choir, in the church at the time of offices, in processions or in the refectory for the purpose of taking meals, nor shall they be permitted to accompany the professed when they go out of the house.

17 § 31. For the common and particular needs of the novices which may occur, one of the novices himself, more advanced in age and character, shall be deputed, who, in the absence of the companion, with the permission of the master, shall do all things as shall be necessary; to him also may be committed the care of the door and the provision of matters of lesser importance within the novitiate.

18 § 32. Since, however, although the care of the instruction and good formation of clerics and lay brothers ought to be the principal concern, the religious instruction of lay brothers is not to be omitted, but rather to be embraced with equanimity, since it is sufficiently established that these also, when they profess the same rule, bring perfect formation, both dignity and ornament to religion, and edification, example and utility to other faithful Christians. To the lay brothers themselves a place for sleeping, separated from the clerical novitiate (as far as can conveniently be done), is ordered to be assigned. They, however, notwithstanding this separation, ought to be subject to the master of novices, or to the superiors of monasteries and convents, according to the statutes and constitutions of each Order, and to render obedience, by whom they are to be instructed not only concerning bodily services to be tested and exercised, but also, according to their capacity and convenience, concerning spiritual matters, especially concerning the manner of mental prayer, which, that it may be done more conveniently, they ought to be called to the chapters and spiritual conferences which are wont to be held by the masters of novices, as long as they gather in the churches at the appointed hours, unless they are then actually occupied in their duties.

19 § 32. However, although the care and proper instruction of converting clerics ought to be the principal concern, the religious instruction of converts is nevertheless not to be neglected, but rather to be embraced with equanimity, since it is sufficiently established that these men also, when they profess the same rule, bring about perfect education, both dignity and ornament to religion, and edification, example and usefulness to other Christian faithful. To the converts themselves, a place separated from the clerical novitiate for sleeping is to be assigned (as conveniently as it can be done). They, however, notwithstanding this separation, ought to be subject to the master of novices, or to the superiors of monasteries and convents, according to the statutes and constitutions of each Order, and to render obedience; by whom they are to be instructed not only concerning bodily observances to be tested and exercised, but also, according to their capacity and convenience, in spiritual matters, especially in the manner of mental prayer, with diligence; which, so that it may be done more conveniently, they ought to be called to the chapters and spiritual conferences, which are customarily held by the masters of novices, provided they gather in the churches at the appointed hours, unless they are then actually occupied in their own duties.

20 § 34. The superior of any convent in which a novitiate has been established shall have a particular book in which the profession of each novice shall be registered, and let the novice who has professed sign it with his own hand, and let the witnesses who were present subscribe it. A lay brother, however, who is ignorant of letters, having professed, shall place the sign of the Cross with his own hand in the presence of the same witnesses who shall have subscribed; and let the book be preserved and kept in the archive where the writings pertaining to the monastery or convent are wont to be kept.

21 3. The Superior of any convent in which the novitiate shall have been established shall have a particular book of Professions, in which the profession of each novice shall be registered, and which the novice who has made profession shall sign with his own hand, and likewise the witnesses who shall have been present. But a lay brother who has made profession, being illiterate, shall make the sign of the Cross with his own hand in the presence of the same witnesses who shall have subscribed; and the book shall be preserved and kept in the archive, where writings pertaining to the monastery or convent are customarily deposited.

22 35. Because, however, in certain Orders the practice of affiliation has been received, We declare that in certain cases...

23 it is decreed that certain monasteries or convents designated by each Order should have those to be educated; nevertheless it shall be lawful for the superiors of monasteries and convents of such Orders, in which the use of filiation has been received, to enroll in the sons of their places those whom they shall find endowed with the aforesaid qualities, according to the constitutions of each Order, and thus enrolled, when they shall have been received into the Order according to these present institutions and other things to be observed, to send them to the places of novitiates with testimonial letters, so that as sons of the said convents or monasteries, they may be received in their name and at their instance, and be tested in the novitiate, and then, before they are sent back to the same monasteries or convents of such filiation, they must be exercised in the profession to perfection, as has been stated above.

24 § 36. Moreover, lest the places of one monastery or convent be preoccupied by another, it shall be the duty of the general or provincial chapter to prescribe the number for all, and likewise to determine the same arrangement concerning the contribution of sustenance (if it should be necessary) and to prescribe to individual convents and monasteries what shall seem more expedient.

25 § 37. But in order that novices already received into the number of professed (as is stated above) may be better established and confirmed in good spirit and in the observance of regular discipline, it is commanded that immediately after profession is made, if in the convents or monasteries assigned for novitiates there shall be a place for a second novitiate or professed master, distinct and separated from the habitation of novices and of the ancient professed, they be placed there, if the monastery or convent is able to support them; if not, let them be transferred to another more suitable convent or monastery, in which such a place with the requisites for the novitiate described above may be found, or be accommodated or newly constructed. From this, however, those Religious Orders are excepted which, by the force of their constitutions or institutions, are accustomed to retain new professed within the novitiate for a longer course of time, to which in this matter no derogation is made: yet it is permitted to them that, notwithstanding the aforesaid constitutions, they may do the same if they shall judge it more expedient for reason and for the Order: in which places they shall live under rules and a manner of living still more strict than that which the older professed observe; so that in the affairs of monasteries or convents they shall not interfere, nor shall the number of religious to be assigned to any convent be determined.

The place of the professed to be chosen

26 in common discussions, nor shall they exercise any office of external obedience, and they shall remain there until they shall have reached an age sufficient for receiving sacred orders, or at least for three years after profession, during which time they shall be able, indeed they ought, to apply themselves to the study of letters, under the direction and governance of a superior, who should be endowed with those qualities which have been said ought to be present in the master of novices.

27 § 38. It is declared, however, that on account of the aforesaid matters it is not to be considered that license is granted to receive novices in places designated for novitiates, except in places designated or hereafter to be designated for the novitiate, and for the number only prescribed or to be prescribed in each of them.

28 § 39. Finally, if those who among religious are superior in grade and order, and others to whom it pertains, shall have been remiss in all or any of the aforesaid matters, or shall have contravened in any way, let them know for certain that they shall suffer deprivation of all offices which they then hold, and graver penalties according to the measure of the fault admitted. Given at Rome at St. Peter's, on 19 March 1603.
