Debitum pastoralis

CLIX.
1 The Congregation on the discipline of religious is confirmed and newly erected with the granting of facilities and the abolition of the Congregation on the state of religious. Innocent Pope XII, for perpetual memory of the matter. The duty of pastoral office by which we preside over the government of the Catholic Church diffused throughout the whole world by divine disposition urges and impels us, so that, caring with paternal solicitude for the Christian faithful who have fled from the waves of the world into the harbor of religious life, we may favorably attend to those matters by which their regular observance and discipline may be preserved intact by appropriate means, and, wherever it has collapsed, with the Lord assisting, may be able to be repaired, and we may interpose the parts of power granted to us by the Lord with zealous charity thereupon, just as we judge it to be salutarily expedient in the Lord for the glory of almighty God, the increase of religion, and the spiritual edification of the Christian people. § 1. Since therefore we have at another time undertaken the holy and salutary work of restoring regular discipline, which is most fruitful for the Church of God and its benefit, we have established a Congregation of certain venerable brothers of ours 1

3 of the cardinals of the Holy Roman Church and of our beloved sons, the prelates of the Roman Curia, specially deputed concerning the same regular discipline; and that Congregation thus deputed has hitherto issued many decrees which are indeed very useful and opportune in this matter; yet, as we have learned not without grave distress of our mind, although the observance of such decrees has been prosperously and happily introduced in very many monasteries or convents of religious men, and thence there arises daily an increasing harvest of the fruits of chosen holy works, blessed by the Lord, nevertheless the same heavenly seed has not borne fruit elsewhere; for the enemy of mankind has not ceased, nor does he yet cease, to oversow tares in the field of the Lord, which choke the seed of the father of the family: hence it is that we, mindful of that prophetic utterance, Cry, cease not, lift up thy voice like a trumpet, in order that our constant and earnest will in pursuing this begun work with special study and the greatest application of mind may be made more and more known to all, and every occasion for transgressors to excuse themselves by a vain and false pretext of our silence may be entirely cut off, by our own motion, and from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, we perpetually approve and confirm the aforesaid Congregation of cardinals and prelates over regular discipline deputed by us as aforesaid, and to be deputed in the future both by us and by our successors the Roman Pontiffs, by the tenor of these presents, and we add to it the force, strength and protection of inviolable and irrefragable apostolic muniment; and nevertheless we also perpetually erect and institute the same Congregation of cardinals and prelates over regular discipline anew, insofar as it may be necessary. The faculties of this Congregation thus confirmed or newly erected by us shall be and ought to be, within the bounds of Italy and the adjacent islands, to designate and depute for novitiates and professed convents monasteries, colleges and houses of whatsoever monks and regular men of any Order, congregation, society and institute, both Mendicant and non-Mendicant, even those necessarily to be expressly named, as well as to change, transfer, suspend and suppress such novitiates and professed houses, as utility and necessity shall have demanded and required; to give licences to the superior regulars, to whom it pertains, to receive in the novitiates thus deputed novices for the habit and profession; to execute the decrees both of Clement, Pope of happy memory, our predecessor, concerning the reformation of regulars, and especially those which concern the institution and education of novices, and those issued by the same Congregation over regular discipline on the eighteenth day of July in the year sixteen hundred ninety-five by our command; to decide whatsoever controversies arising therefrom, but especially to promote the observance of exact common life; and, for this purpose alone, to examine diligently new foundations of whatsoever convents, monasteries, colleges and houses of this kind, so that namely no place of religious men may henceforth be founded, erected, or instituted in any way, unless in those places where the same common life, according to the prescription of the decrees last mentioned, can be perpetually and exactly observed; finally to do, ordain, decree, establish and execute all and singular things which can in any way pertain to the same regular discipline being effectively established or restored, and in all the aforesaid matters to proceed even with ecclesiastical penalties and censures. Moreover (because, following in the footsteps of some of our Roman Pontiff predecessors also, we have judged that we ought to bestow a certain principal solicitude of our apostolic office upon the regulars of Italy and the adjacent islands, as being nearer to us, and placed as it were before the eyes of this Holy See, and whom therefore it especially behoves to shine forth by the example of a more perfect religious life, so we do not think that all the other religious men diffused throughout the whole world and subject to our special care are to be neglected; for we know ourselves to be debtors both to those who are far off and to those who are near), by the tenor of these presents we command and enjoin, and let it be the principal and special duty and care of the said Congregation to us and to the Roman Pontiff existing for the time being to suggest and propose to us continually those things which it shall have judged in the Lord to be necessary and opportune for fostering or repairing the discipline of the same regulars existing anywhere, of whatsoever Order, congregation, society or institute they may be, and for aiding their happy progress in the way of the commandments of the Lord and their praiseworthy endeavours.

More fittingly by law that for and (cf. t.).
