Erection of the Congregation for Indulgences and Sacred Relics.
CLEMENT POPE IX.
1 To perpetual memory of the matter.
2 In the very beginning of Our Pontificate, when We had found that many Congregations of Our Venerable Brothers, the Cardinals of the Holy Roman Church, had been instituted by Our predecessors, the Roman Pontiffs of blessed memory, for the treatment and determination of certain matters and affairs flowing continually from all parts of the world into the most ample bosom of the Roman Curia, for the utility of the Catholic Church and the temporal dominion of the same Holy Roman Church, by prudent and salutary counsel, which would relieve in their respective parts the great burden of cares incumbent upon Us; yet We had not seen any erected which would be particularly charged with the care and disposition of the sacred treasury of Indulgences, and with the recognition, investigation, and proper disposition of sacred relics. § 1. Desiring to dispense this same inestimable treasure by faithful stewardship, and to arrange properly and in order all things which pertain to sacred relics of this kind, We selected certain of the aforesaid Cardinals, and some Prelates of the aforesaid Curia, and other men distinguished by religion, piety, learning, and experience in affairs, by whose counsel, work, and industry We might more easily fulfill so grave a part of Our office to the glory of almighty God, the honor of the Church, and the spiritual edification of the faithful of Christ. These indeed, coming together from time to time as the importance of matters and affairs demanded, have rightly and fruitfully administered the province committed to them by Us, and in accordance with the sentiment of Our mind. Wherefore, hoping in the Lord that their industry will be no less useful in the future, and desiring that the fruit of the salutary counsel which, with God as author, We have undertaken, should, with His aid and increase granted, endure perpetually:
3 § 2. By Our own motion, and from certain knowledge, and mature deliberation, and from the fullness of Apostolic power, We do erect and institute in perpetuity the Congregation of the same Holy Roman Church of Cardinals, and Prelates, and other men aforesaid, selected and appointed by Us as aforesaid, and to be chosen and appointed in the future both by Us and by Our Successors, the Roman Pontiffs, with the faculty to expedite every difficulty and doubt emerging in the relics of Saints or in Indulgences, which does not pertain to the dogma of faith (though We and the Roman Pontiff existing for the time being are to be consulted concerning more grave and difficult matters); and, if any abuses have crept into them, to correct and amend them, judgment form being entirely set aside; but to remit to the proper Judges those cases which require judicial form: to prevent false, apocryphal, and indiscreet Indulgences from being printed by the press, to recognize and examine those printed, and where it shall seem good to Us or to the Roman Pontiff existing for the time being, to reject them by Our or his authority; to recognize and examine newly discovered relics, which Our predecessor Pope Innocent III of blessed memory prohibited in the General Council of the Lateran from being venerated in public worship unless previously approved by the authority of the Roman Pontiff; and in granting Indulgences and in bestowing the relics of Saints to exercise moderation, and to ensure that all things are done piously, soundly, and without corruption: by the tenor of the present letters We erect and institute in perpetuity.
4 § 3. Decreeing that these same present letters shall always be firm, valid, and efficacious, and shall obtain and secure their full and complete effects, nor can they ever in any way be noted, impugned, infringed, retracted, called into controversy, or reduced to the terms of law on account of any vice of subreption or obreption or nullity, or of Our intention, or any other defect whatsoever, even substantial and formal, and unforeseen and unthought of, or requiring necessary expression.
5 § 4. And thus and not otherwise in the premises by which 1669.
6 Clause removed, both the ordinary and delegated Judges, and also the Auditors of the causes of the Apostolic Palace, and the aforesaid Cardinals of the Holy Roman Church, even Legates de latere, and all others whatsoever, exercising any preeminence and power, and shall be, with the faculty of judging and interpreting otherwise taken from them and from each of them, ought to be judged and defined, and if anything contrary to these things shall be attempted by anyone whatsoever by any authority, knowingly or unknowingly, it shall be null and void.
7 § 5. Notwithstanding, insofar as our and the Apostolic Chancery rule concerning acquired right, not taking away, and other Apostolic, and in universal, provincial, and synodal Councils issued general or special Constitutions and Ordinances, as well as any, even by oath, Apostolic confirmation, or any other firmness strengthened statutes and customs, even immemorial; privileges also, Indults, and Apostolic letters to any persons and places under whatever tenor of words and forms, and with whatever, even derogatory clauses of derogations, and other more efficacious, most efficacious, and unusual clauses, irritant and other decrees in general, or in particular, or otherwise in any way contrary to the aforesaid granted, confirmed, and repeatedly renewed, All and singular of which, even if for their sufficient derogation of them, and their whole tenors special, specific, express, and individual, and word for word; not however through general clauses importing the same, mention, or any other expression had to be made, or any other exquisite form to be observed for this, the tenors of this kind as if word for word; nothing whatsoever omitted, and the form observed in them expressed, and inserted, the present ones for fully and sufficiently expressed and inserted being held, those otherwise in their force remaining, to the effect of the aforesaid, this time only, specially and expressly we derogate, and to all others contrary in any way. § 6. We will, however, that of the same present letters transcripts, but also printed copies, subscribed by the hand of some public Notary, and furnished with the seal of a person constituted in Ecclesiastical dignity, the same faith entirely in judgment and outside be had, which would be had to the same present ones, if they were exhibited or shown.
