• §. 11. Nulli ergo omnino Hominum liceat hanc paginam Nostre creationis, institutionis, electionis, deputationis, facultatum impertitionis, separationis, sejunctionis, dismembrationis, applicationis, concertionis, assignationis, decreti, derogationis, & voluntatis infringere, vel ei ausu temerario contraire: Siquis autem hoc attentare praesumpserit, indignationem Omnipotentis Dei, ac Beatorum Petri & Pauli Apostolorum ejus, se novent incurfurum. 1 A public gymnasium or academy is erected on the Capitoline Hill for training and instructing apprentices in painting and sculpture, with an annual endowment established for necessary expenses.

2 BENEDICT BISHOP,

3 Servant of the Servants of God, for perpetual memory of the matter.

4 Among the cares worthy of the Supreme Pontiff, we consider that no small place is held by those matters which pertain to protecting and promoting the liberal arts, by which noble talents are cultivated and freely occupied; and which, while imitating and expressing the beauty of natural things, declare the nobility and excellence proper to human nature itself; and serving not only the convenience of citizens, but also the divine worship with dignity, bring both utility and splendor to society.

5 § 1. This care, established in every well-ordered city, we have judged ought to be undertaken by us with particular reason: to whom, namely, by the counsel of Divine providence, the dominion and governance of that city has been entrusted, which once embraced whatever was precious or elaborated with distinguished skill, either in its dominion and empire, or in its own bosom, and made its own excellence known to all, and transferred that praise received from subject nations to itself, and then brought it to other peoples, who were entirely deprived of it; and from the rest of the globe drove away ignorance and barbarism once and again. § 2. But since the glory of the arts easily perishes when the practice of artisans ceases; we see that it could gradually diminish in this our city: while the city itself, filled with the splendid works of ancient and recent painters and sculptors, rests in a certain possession as if in security; and is little solicitous in forming new apprentices in those arts, and thus allows the masters of the future to be almost extinguished: not sufficiently considering that it could be reduced to such a scarcity of artisans, that when some work for use, for ornament, for memory must be accomplished with dignity, it would be compelled to implore the aid of foreigners, and to expect assistance from those who were once accustomed to seek the principles of more refined culture and of all sciences and arts from itself. § 3. Since we have judged that this evil ought to be remedied in timely fashion; after we have collected many monuments of ancient art, restored many, and provided for their preservation for public utility; we have enriched the Capitoline Picture Gallery, collected and arranged by the munificence of our predecessor Pope Clement XII, with a great accession of great Greek, Egyptian, and Roman statues; and we have placed in the same Capitol, in buildings raised from the ground to the southern slope of the hill, a great number of paintings of distinguished masters sought from various places and acquired at great expense, arranged aptly and decorously; now finally in that same place, where so many prodigies of art are seen, presented to the admiration of men and as an example to artisans, we have resolved to establish also a public institution of the liberal arts for apprentices, and we wish that they be provided with that training which by the opinion of all we have known to be most suitable, and thus we are confident will be most apt for forming future painters and sculptors, who may be able to renew the glory of the ancient Roman Academy and propagate it to all posterity.

6 § 4. Since indeed the principle and foundation of the art of painting and sculpture is established in the most exact skill of delineation; and this can be acquired more certainly from the contemplation of nature itself than from servile imitation of previous artisans; for this reason we have caused a spacious hall to be fitted out in the structure of the aforesaid buildings erected by us; so that there whoever strives to make progress in the art of delineation, exercising himself upon the example of a living man, may learn to draw certain and true lines: which once being well imbued with the laws of nature and taught to exact and conform to their norm the forms conceived in the mind, in every kind of liberal craft to which talent and study may have led them, they may be able to work with confident hand. Which indeed advantage, since it is otherwise difficult for studious youths in the city, in the year 754 of the City of Rome in the month of June.

11 Benedict XIV. Year 14.

12 would supply it, and it would have to be obtained mostly at a price and by the contribution of money; We judged that We could bestow nothing more pleasing to them, or more useful for the promotion of these honest arts, than if We were to provide by a perpetual gift of Our liberality, so that all expenses necessary for hiring a man for the delineation of examples, for preparing and illuminating the place, and for directing and urging the work itself, would be furnished from public funds. For by this means We judged it was to be hoped that, invited by Our benefaction, young men would eagerly seize the opportunity of advancement offered to them, and would be increasingly kindled to cultivate and perfect these most excellent arts with all care. 1. Now indeed, wishing to prescribe a certain form for this work and to assert its perpetual stability, by Our own motion, and with certain knowledge, through this Our Constitution to remain perpetually, in the aforesaid buildings erected at Our command and expense on the Capitol, namely in the lower hall of the same designated for this purpose, We erect and institute a Gymnasium, or Academy, to be called by the common name of the Academy of the Nude, for the benefit and use of poor students who desire to learn the art of delineation; and as the head and president of this Gymnasium or Academy thus created and instituted, by the tenor of these present Letters, We choose and appoint Our Venerable Brother Sylvius, Bishop of Sabina, Cardinal of the Holy Roman Church, called Valentini, Our Secretary in the affairs of the universal State, and Camerlengo of the said Holy Roman Church, who has greatly aided Us in undertaking counsel in this matter and bringing it to completion, by his diligence in conducting affairs and his singular devotion to the good arts, and thereafter his successors in this office of Camerlengo; commanding the same Sylvius, Bishop and Cardinal, that he prepare as soon as possible appropriate Laws and prudent Statutes for the constitution and perpetual governance of the destined work, and also promulgate them in Our name and authority; and giving to the same, modern and existing for the time being, president and protector of the aforesaid Academy or Gymnasium, all necessary and appropriate facilities, so that for the execution and progress of this work, he may make whatever useful and suitable ordinances from time to time, and issue decrees, and enjoin and exact the observance of both these and the Laws and Statutes thus made, and also, whenever the matter shall warrant it, he may be able to revoke, correct, and change them for the better; as it shall seem to his prudence to be more expedient for the utility of the Academy or Gymnasium itself, and for the fulfillment of Our mind and will.

13 f. 6. For the endowment of the same Gymnasium, by which the expenses occurring for the wages of men delineating and proposing other things necessary for the execution and direction of such work may be made and sustained; We assign an annual sum of three hundred scudi, with ten for each scudo, from the public Treasury, which We have also established in this City for preserving and offering for sale shoes, from the revenues (which indeed We ourselves by another Schedule of Our Motu Proprio signed on the 22nd of June in the year 1748, and existing in the Acts of Our beloved Son Gregory of Castellani, one of the Secretaries and Notaries of the aforesaid Camera, in Our Monte Pietatis, to the credit of the same Camera, in a particular account however, and to the free disposition of the said Sylvius Bishop and Cardinal Camerlengo, and his Successors in this Office, so that he and his Successors may dispose of them, after participation made to Us and to the Roman Pontiff for the time being, We have wished to be received), from the same Apostolic Camera's revenues, by Our motion and knowledge aforesaid, and by the fullness of Apostolic authority, through these same presents, We perpetually separate, sever, and disjoin: And the same sum each year, by two equal and anticipated payments, in the same Monte Pietatis, to the credit of the aforesaid Academy called Capito of the Nude, and to the disposition of the said Cardinal modern and existing for the time being as its Protector, to be freely deposited, We also perpetually apply, grant, and assign to the same Gymnasium or Academy, for the aforesaid purposes: Commanding the same Sylvius Bishop and Cardinal, and his Successors, the aforesaid Academy's Protectors and Presidents for the time being in the future, that they take care that such sum of money be expended, according to their prudent judgment, in whatever opportune and necessary and useful expenses for correctly ordering and promoting the aforesaid work, without any burden of rendering account. For We shall hold as ratified and approved whatever they shall prudently determine, order, and do in this matter, and We shall cause it to be inviolably observed by all to whom it pertains, with appeal set aside, by Our authority.

14 § 8. And thus, and in no other way, through whatever Ordinary and Delegated Judges, even the Cardinals of the holy Roman Church, as well as the Auditors of the Palace of the Apostles, and the General Treasurer of the same Camera, and the Clerics Presiding, subject to them and to each of them in any other manner of judging and interpreting faculty and authority, it ought to be judged and determined: and also null and void, if otherwise concerning these things by anyone by any authority knowingly or unknowingly should happen to be attempted.

15 f. 9. Notwithstanding any contrary Constitutions and Ordinances, apostolic, general or special, and, as far as it is necessary, the institution of the aforesaid Treasury and the application of revenues arising therefrom, as is set forth by Us: also privileges, indults, and Apostolic Letters, to the same Camera, and to its Officials and Ministers, and to any others whatsoever, under whatsoever tenors and forms, with whatsoever also derogatory clauses of derogatory clauses, and other more efficacious clauses, and irritant Decrees, even by motion, knowledge, and fullness of power equal, even Consistorially, and otherwise in any way granted in contrary to the premises, and also repeatedly confirmed, approved and renewed. § 10. All and each of which, even if for their sufficient derogation, of them and their whole tenors, special, specific, express, and individual mention, and word for word, not however through general clauses importing the same, or any other exquisite form to be observed for this, We have wished to be expressed in these presents by Our beloved son Benedict XIV. An. XIV.

16 and sufficiently expressed, and inserted, having those otherwise in their strength remaining, to the effect of the premises specially and expressly, and most widely and most fully we derogate; and to all other things contrary whatsoever. § 2. Let it be lawful for no one of mankind to infringe this page of Our erection, institution, election, deputation, impartation of faculties, separation, disjunction, dismemberment, application, concertion, assignment, decree, derogation, and will, or to dare to act contrary to it with rash presumption: But if anyone shall presume to attempt this, let him know that he will incur the indignation of Almighty God, and of the Blessed Apostles Peter and Paul His.
