Omnipotens Deus
Bolla sull'unione e riforma dell'Ordine francescano

3 vita e moribus idoneo a lui eleggere potessero. Quo easu ipse Ministro codesti Fratelli Conventuali paterne visitare, ipsiique Fratelli Conventuali eum eumdem Ministrum Generalem come totius detto ordine superiore omni carità, e dilettione ricevere debbano, dum modo idem Ministro Generale ora, e pro tempore esistente nulla iudicialmente circa ipsos Fratelli Conventuali, e domos loro, e loca, e etiam Monasteri e Monialium sotto loro cura degentium esercitare, nisi eo modo, quo Ministro generale allora Fratrum Conventuali

1 LEO, Bishop, Servant of the Servants of God, for perpetual remembrance of the matter. Almighty God, whose works are perfect, who has most wisely ordained all things in number, weight, and measure, and by whose nod all things are governed. We, the Roman Pontiff, head of the Catholic Church, so that those things which are fitting for divine honour and the salvation of the faithful may be accomplished, not only do this, but as far as in us lies, with celestial grace inspiring us, we strive toward the duties of perfect perseverance. Indeed, in these most recent days, when we have convoked the General Chapter of the entire Order of Blessed Francis, and have decreed that it ought to be celebrated in the house of the Minorites at Viterbo, under the pious union of all the aforesaid Friars under one reformed head, and other things to be done for the truth of such union, by the counsel and assent of our venerable Friars, Ministers of the Holy Roman Church and Cardinals, and also by humble and most earnest prayers to the Christian King and Princes, by apostolic authority we have established, decreed, and ordained. That henceforth for perpetual times, the Minister General of the entire Order of St. Francis, skilled in letters and proven in the observance of the discipline, living by the privileges granted to them, shall be elected by those Friars; to whom all and each of the Friars according to the rule of the same Blessed Francis ought to be subject and obedient. And then the Conventual Friars with the privileges granted to them by the Apostolic See, living by revenues and other possessions, or those wishing to retain temporal goods according to such privileges, by other letters which we have established and ordained, one of the same Conventual Friars

3 suitable in life and morals to choose for themselves. He who is called their Master General, from the same Friars Conventual living under the aforesaid privileges, was to have care, and to seek confirmation of his election from the Minister General of the whole order, as is contained more fully in the aforesaid letters. And when in the General Chapter celebrated in this house of Aracoeli in the manner aforesaid, with our authority present as Protector of the same order, and two others from the Cardinals of the Holy Roman Church specially deputed by us for this purpose, on the day appointed by us for this, Fr. having voice in the election of this Minister General, we elected the beloved son Christopher of Forli, who had been Vicar General of the Friars Minor of the family, as Minister General of the whole order of St. Francis rightly and properly. But the Friars Conventual, living with privileges, as is aforesaid, in the house of the Holy Apostles also of the city of the said order, likewise legitimately congregated for this purpose, elected the beloved son Anthony Marcellus, suitable in life and morals, as Master General of these Friars Conventual. We have heard that the elections of the aforesaid Minister and Master were made by the same Friars according to our aforesaid ordinances, the Holy Spirit working this with the greatest harmony, peace, and unity. We blessed Anthony, elected as Master of the Friars Conventual, present before us in the Lord, and we wished this our blessing to suffice for the confirmation which he was bound to seek from the aforesaid Minister General, for this time only, and desiring through the same Christopher, Minister, and Anthony, Master, thus elected, and their successors, that the Friars committed to them be governed under protection and wise rule, and be preserved in peaceful and tranquil state, we provide in such manner that henceforth the odor of good repute of the same Friars may exhale perpetually among all Christian faithful, even Kings and Princes of the Christian Religion, and peace and unity most desired by all may be preserved, and every occasion of discord, which the enemy of mankind could procure, may be extinguished, and be entirely removed through the same Minister and Master and other professors of this order to be observed inviolably and inviolably. By our own motion and from certain knowledge and mature deliberation with the same Cardinals presiding, we have deemed it to be established, namely, that the successors of Anthony, Master General of the Friars Conventual, elected by the same Friars Conventual from time to time, were bound to seek confirmation from the same Minister General and his successors, Ministers General of the whole order, just as the Vicars General then of the family were called, and that the Master now and for the time being elected to the governance of the Friars Conventual of St. Francis according to our said ordinance should be called Master General of the Friars Conventual in perpetuity. And that in the individual provinces appointed to the governance of the Friars Conventual henceforth Provincial Masters of the Friars Conventual, as they were formerly called, and by the Ministers Provincial of regular observance in the provinces according to the custom of the said order respectively existing for the time being, with the confirmation of their elections made for the time being, in the manner in which the Provincial Vicars formerly of the family were called, then Ministers Provincial of the Friars Conventual, shall be bound to seek. And that both the General and Provincial Ministers aforesaid, both before and after the confirmation of this General and of the other Masters, both from the General and Provincial and from the other Friars Conventual of this kind, and from their and other friars and sisters of the said order, so called, insofar as they had been under the governance of the Minister General of the Conventual, or insofar as they might intermeddle, or visit them through themselves or their Commissaries, or correct them, can exercise no jurisdiction or suspension over them, except when the same Minister General existing for the time being shall come to the houses and places of the said Friars Conventual, in which case the Minister himself may visit the same Friars Conventual paternally, and the same Friars Conventual ought to receive the said Minister General as the superior of the whole said order with all charity and affection, provided that the same Minister General now and existing for the time being exercise nothing judicially concerning the same Friars Conventual and their houses and places, and also Monasteries of Nuns under their care, except in the manner in which the Minister General then of the Friars Conventual—

5 over the Brethren of the family, and their entire houses and places and Monasteries of Nuns during the time of the convocation of the said General Chapter exercised, exercised the office. And furthermore to the General, and Provincial Ministers for the time being existing under the penalty of excommunication latae sententiae we enjoin, and command, that they do not dare to direct, or to indicate even with the favor of temporal lords, the Curia, and Universities, Towns, Lands, and Villages, and also ecclesiastical properties, even of Prelates whose care, or of the same Cardinals, or by any other pretext, or maliciously contrived device, that the houses and places of the Brethren Conventual, or Monasteries of Nuns entrusted to the Master General of the Conventuals of this kind, and which heretofore under the said Minister general of the Brethren Conventual had been, in any way whatsoever be taken from them, presume to procure. And nevertheless whatever has been attempted to the contrary, let it be by that very fact null and void. The houses moreover, and places, and Monasteries of Nuns to the Master General of the Brethren Conventual we will to be understood as subject, which by Apostolic or other authority were subject to the Minister General before the celebration of the said General Chapter most recently to be celebrated in the said house of Aracoeli, and in whose possession at that time the Master General of the Conventuals existed, especially the house or Convent of the Blessed St. Saviour of the City, and also many houses and many Monasteries of Nuns, which to the same Minister General were then immediately subject, which all from now to the Master General of the Conventuals immediately subject perpetually are, and shall be held, excepting the houses and places and monasteries of Nuns of the said Brethren reformed by our prior letters which recently to those who are General and provincial Ministers in their provinces respectively in all things subject to remain we will. We also establish, that if the Conventual Brethren at any time shall wish to reform themselves, the reformation itself according to Apostolic privileges granted to them through the General and provincial Masters ought to be made, unless the Brethren of some house or Convent to true and regular observance and complete obedience of the General or provincial Ministers come, and to the General and other Ministers placed in authority wish to subject themselves. Which if the Brethren in those houses in which from one hundred up to one hundred and fifty, in other houses in which the number from twenty up to one hundred of the same Brethren Conventual shall have been, two parts only to subjection and submission of this kind consent, then the General and other provincial Ministers for the time being existing, houses of Brethren to subjection and submission of this kind in the manner prescribed consenting any contradiction notwithstanding, houses of Brethren Conventual and their Brethren of this kind freely and lawfully receive can. Houses moreover of Brethren Conventual, in which a smaller number than ten shall be, even with the consent of all the Brethren Conventual of the same houses, no house receive can, but those the General and other provincial Masters of the reformation freely shall leave. To individual Brethren Conventual to the General and provincial Ministers to pass we will, from their superior first sought, though not obtained, license, free passage license and faculty we grant. Furthermore we will, that those from among the Brethren Conventual, who from outside a reformed life under the General or provincial Masters' care to lead shall wish, under their regime remain can, provided that by some notable distinguishing sign they be distinguished and separated from those, who a regular life under the general or provincial Ministers lead, as the General Minister and Master between themselves shall agree in the goods of the aforesaid houses to be reformed immovable, and all, whose Brethren reformed are not, nor capable to be willing general and other provincial Masters to their free disposition freely remaining. And lest among the reformed and Conventual Brethren aforesaid over precedence difficulty and contention arise can, we will, and also we establish, that among them such order shall be observed. Namely that in processions and funerals and exequies, as well as in all other public acts, Brethren Conventual Brethren of regular observance in place of dignity shall be held. If however some aged Fathers or Guardians of houses Conventual remain wish with certain Brethren in the old way under the general and provincial Ministers existing, then, and in this case, that such difficulty be avoided and the peace be preserved, thus proceed can, and they themselves

7 Conventual always against the fierce, the standard nevertheless to be borne freely, thus may they be able. All in all, thus each privilege, conduct by order both through us and through others whosoever Roman Pontiff hitherto conceded, to the Brothers of Regular Observance and Conventuals (insofar as they are not contrary to their privileges) by authority, thus and even more by the present we perpetually communicate to one another, thus we wish the suffrages, and we concede all these things anew to them. Wherefore to the General Chapter by Apostolic authority, and to the universal Father of the Order, Archbishops, and Bishops, and to the Prelates of Churches, and to whosoever we constitute in ecclesiastical dignity we command through Apostolic letter, that they themselves and each one of them uniting our intentions, and in them contained whatever, where and when it shall be necessary, as befits the pious ministry or if any of them be required thereupon, solemnly publishing, and assisting them in the premises with the aid of effective defense, they shall make them by these present letters and by all and each contained in them to enjoy peacefully and to rejoice. Not permitting them to be molested either by themselves or also by however many others exercising any authority or power in any way indebitably disturbed or harassed, contradicting the rights of the Church, and applying opportune remedies against avarice by appeal pending judgment, invoking also the aid of the secular arm if need be. Notwithstanding, Whatever Apostolic letters and even decrees of the Sacred Council of Constance said to the religion, Treatises, families, congregations, denominations, or any of them, without their authorities and institutions, under whatever forms of words, formalities and clauses stronger and as if from stronger sources or perhaps to be conceded in the future, to which (even the derogation of them from them and their whole renewals special, specific, express in their own right, and from the Orb to the food, not however through general clauses importing that, mention be made or any other expression had, or any other exquisite form to be observed of them all renewals the present we have expressly exposed, and in letters having particulars at the beginning robust permanently, this time only specially and expressly we derogate from whatever contrary things. Or if it has been indulged to the Ministers and Masters and Brothers aforesaid, or to any others commonly or separately from the Apostolic See, that they cannot be interdicted, suspended or excommunicated by Apostolic letters not making full and explicit mention word for word of the indult of this kind. Certainly because it seems difficult for these present letters to be borne to each place where it shall be necessary, we will and by Apostolic authority it is fitting that, the transcripts being made by the hand of a public Notary signed and fortified by the seal of some Ecclesiastical Prelate, that faith be given entirely in judgment and outside of judgment which would be given if the present original letters were exhibited or shown. Let it be lawful for no one at all of men to infringe this page of our precepts, fraternity, communication, conclusion, mandate, derogation, will and decree in any way or to dare to contend against it. If anyone however shall presume to do this, let him know that he will incur the indignation of Almighty God and of the Blessed Peter and Paul His Apostles. Given at Rome *
