Bolla di approvazione della congregazione dei Cappuccini
XXIV.

XXIV.
Approbation of the congregation of the brothers Hermits, now Capuchins, of the Order of Friars Minor Conventual of St. Francis, with the prescription of the habit and the granting of graces and privileges.
1 Clement, bishop, servant of the servants of God, to our beloved sons Ludwig and Raphael of Forosemproni, professed of the Order of Friars Minor, greeting and apostolic blessing. The zeal for religion, the honesty of life and morals, and other praiseworthy merits of probity and virtue, upon which you are commended to us by trustworthy testimony, move us to grant favorably, as much as we are able with God, your petitions, especially those which regard the salvation of souls and the propagation of Religion.
2 § 1. Indeed, on your behalf, a petition was recently presented to us containing that you, formerly, led by the fervor of serving the Most High, entered the Order of Friars Minor of the Observance, now called hermits, under the Rule of the blessed Francis, and began to make profession therein, and remained for a certain time, and thereafter, by the license of your superior at that time, according to the form of apostolic letters issued concerning the union and concord between the aforesaid and the brothers called Conventuals of the said Order, you transferred yourselves to the consortium of the same Conventual brothers, and from that time were kindly received by the master provincial of the province of the Marches of the said Conventual brothers and were aggregated to the number and consortium of the other Conventual brothers of the same province; and thereafter, you desiring, for the salvation of your souls and the glory of God, to lead a hermitic life, and, as far as human frailty permits, to observe the Rule of blessed Francis, the said master provincial granted you license to approach the Roman Curia, and to petition and obtain from us and the Apostolic See whatever should seem to you opportune for the salvation of your souls and the glory of God.
3 § 2. And also our beloved son Andrew, cardinal of the title of St. Prisca, protector of the said Order, urged you to make a similar petition, yet on this condition, that one from your consortium, in the name of all of you, should be bound to present himself each year to the master provincial or the chapter of the province of the said Conventual brothers, in which you would dwell, as a sign of subjection, and he himself, the master provincial (if it should seem good to him), might visit you once a year and no more, and if he should find that you were not observing the aforesaid Rule, he could admonish you to observe it more fully, and compel you by fitting means; but beyond this, he should neither transfer you from place to place, nor impose anything else upon you, nor exact anything from you contrary to your profession made in it, but rather should be bound to protect and defend you so that you might be at peace serving the Most High in divine worship, as is more fully said to be contained in the letters patent of the same cardinal protector and master provincial made thereupon.
4 § 3. Wherefore, on your behalf, we were humbly petitioned that we should deign to grant you the faculty of leading such a hermitic life, and otherwise to provide opportunely in the premises by apostolic benignity.
5 § 4. We therefore, who desire the salvation of your souls, each one of you from any excommunication, suspension and interdict and other ecclesiastical sentences, censures and penalties, whether by law or by man, imposed for any occasion or cause whatsoever, if you are bound by any of them in any way, for the purpose of obtaining the effect of these presents only, absolving by the tenor of these presents and holding as absolved, and having the aforesaid letters and whatever is contained in them as sufficiently expressed by these presents, inclined to these supplications, by apostolic authority, by the tenor of these presents, we grant to you that, according to the aforesaid Rule, you may lead a hermitic life.
6 § 5. And that you may wear a habit with a square hood.
7 from the bond of excommunication, suspension, and interdict and other ecclesiastical sentences, censures and penalties, whether imposed by law or by man, for any occasion or cause whatsoever, if he is bound by them in any manner, for the purpose of obtaining the effect of these presents only, absolving him by this document and considering him absolved, and holding the aforesaid letters and whatever is contained in them as sufficiently expressed by these presents, inclined by such supplications, by apostolic authority, by the tenor of these presents, [we grant] to you that, according to the aforesaid Rule, you may lead the eremitical life.
8 § 7. And that both you and those with you may wear a beard.
9 § 8. And that you may betake yourselves to hermitages or any places whatsoever, with the consent of the lords of those places, and dwell in them, and lead there an austere and hermitic life, and beg in any places whatsoever.
10 § 7. And, just as you, to wear a beard from the barber.
11 § 8. And to hermitages or whatever places, with the consent of the lords of those same places, you may betake yourselves, and dwell in these, and lead there a strict and eremitical life, and beg in whatsoever places.
12 § 9. Likewise to all and singular privileges, indults and graces granted to the Order of the Brothers Minor and to the hermitage of Camaldoli of Blessed Romuald and its hermits, whether in general or in particular, heretofore conceded and hereafter to be conceded, and which they themselves use, possess and enjoy in any manner whatsoever, and shall be able to use, possess and enjoy in the future, we likewise grant to you equally as principals, just as to them, full and free license and faculty to use, possess and enjoy freely and lawfully.
13 § 10. And nevertheless to all and singular archbishops, bishops and abbots and other persons constituted in ecclesiastical dignity, as well as canons of metropolitan or other cathedral churches, and the vicars general in spiritual matters of those archbishops, bishops and abbots, we command by apostolic writings to your discretion that each of them, by himself or through others or another, shall assist you and each of yours with the protection of effective defense in the foregoing matters, and shall cause you and each of yours to enjoy and possess peacefully all and singular of the foregoing, and shall not permit any of yours to be molested, hindered or disturbed in any way contrary to the tenor of these presents. Any contradictors and rebels whatsoever, even through whatever censures and penalties and other remedies in them which shall please him, with appeal set aside, shall be restrained, invoking to this end, if need be, the aid of the secular arm.
14 § 11. Notwithstanding the constitutions of happy memory Pope Boniface VIII, our predecessor, issued even singly, and in the General Council on two occasions, and other apostolic constitutions and ordinances; as well as the statutes and customs of the said Order, even those strengthened by oath, apostolic confirmation or any other firmness; and also privileges, indults and apostolic letters granted by whatsoever Roman Pontiffs, our predecessors and ourselves and the aforesaid See, even by force of a general law and perpetual statute, and by our own motion and from certain knowledge, and from the fullness of apostolic power, and with whatsoever irritant, annulling, cassatory, revocatory, preservative, exceptive, restorative, declaratory, attestative and derogatory clauses of derogations, and other more efficacious, most efficacious and unusual clauses, in whatsoever manner, even repeatedly, granted, confirmed and renewed, all of which, even if, for their sufficient derogation, special, individual and word-for-word mention of them and their entire tenors should be had, and not merely through general clauses importing the same, and if it should be expressly provided in them that they could in no way be derogated, their tenors being held as sufficiently expressed and inserted word-for-word in these presents, and the modes and forms to be observed in that matter, as observed in detail, we on this occasion only, with those otherwise remaining in their force, specially and expressly derogate from them, and from all other things contrary whatsoever.
15 Let no one therefore, etc.
16 Given at Viterbo, in the year of the Lord's Incarnation one thousand five hundred twenty-eight, on the fifth day before the Kalends of July, in the fifth year of our pontificate.
17 Given on 3 July 1528, pontificate year 5.
