Bull on the construction of the Basilica of St. Peter

Bull of Pope Clement VII ·

1 to the perfection of the fabric of the basilica of St. Peter, prince of the apostles, of the City, with the facility of appointing judges for the cognition of cases concerning the said fabric.
Clement, bishop, servant of the servants of God, for perpetual remembrance of the matter.

2 The care of the government undertaken by us, and the authority of the pontifical office, induces us to attend to those things which the Apostle Paul ...

3 in Rome we should direct our attention chiefly, through which the glorious martyrs, princes of the earth, Peter and Paul, who first preached the Gospel of Christ in the nurturing City, and in it, after they had founded and established the Christian religion, and filled the whole world with the splendor of sacred doctrine and the fame of miracles, received the crown of holy martyrdom, under the same persecutor, on the same day and in the same place, may be honored with greater veneration by the Christian faithful, in proportion as they excelled in greater merits among the other apostles. Although our Savior always had particular care of them, inasmuch as, to omit innumerable other things, He raised up Peter walking upon the waters with His right hand, lest he should sink, and delivered Paul, shipwrecked a third time, from the depths of the sea; yet He willed that Peter himself, to whom He gave the keys of the kingdom of heaven, should have the fullness of power, and be the prince of the other apostles. And therefore it is not fitting that the church or basilica, dedicated in his name, near which the Apostolic Palace exists, and in which the Roman Pontiffs are accustomed to celebrate pontifical masses solemnly upon the altar of the blessed Peter himself every year, should lack necessary restoration and repair; and that it should be seen by those who, for the sake of devotion, flock to visit 1 the thresholds of these same apostles, as if abandoned and forsaken.

4 § 1. Indeed, considering that in the very city of Rome, in which the Almighty established and confirmed the primacy of His holy Church, Constantine of blessed memory, who held the monarchy of the empire, after he merited to receive from St. Sylvester, through the sacrament of holy baptism, the truth of faith and the hope of eternal salvation, erected a church in his own Lateran palace in honor of the Savior of the world, and built the basilica of these same apostles from the foundations with nearly equal form and magnitude, and carried out with his own shoulders twelve baskets of earth from their foundations, and obtained that these same churches be consecrated by the blessed Sylvester himself on the same day; and revolving many other things in our mind, we judge it to pertain to our office that, after the happy memory of Julius, Pope II, our predecessor, considering that just as Peter, the prince of the apostles, is held in esteem, so his basilica, in the beauty and magnificence of the building, ought to hold the principal place among others, and therefore ordered it to be demolished, so that it might be restored and repaired with a far more ample and more admirable edifice.

5 § 2. We, who are successors of the blessed Peter himself, and are bound to pursue him with particular devotion, what that same Julius, our predecessor, prevented by death, and successively Leo X, Hadrian VI, Roman Pontiffs also our predecessors, were unable to accomplish on account of various hindering causes, we shall undertake with all effort and with all our strength. Attending, however, to the fact that this sacred and sublime temple of the blessed Peter is not ours, nor of any one person, but common to all Christian nations, since power over all peoples has been given by the Lord God and the Son of God to Peter himself, and he and his successors, the Roman Pontiffs, have received this authority...

6 In this manner the Pontiff, so that the church of St. Peter the Apostle, prince of churches, may be more excellent than others, has erected this college for the completion of its fabric, and since Pontiffs, for the salvation of all, ought to be mediators with our Lord Jesus Christ, we have therefore thought it right to institute and ordain one college of sixty men of the Roman Curia of whatever nations, who ought to have diligent care for the restoration of the said basilica, God favoring. And when the more worthy curials of each nation dwelling in our Roman Curia, not exceeding the number of sixty, shall have been chosen by this our mandate; we, so that the desired effect may follow therefrom, and the fabric of that basilica, whose completion we desire with sincere affection of heart, may be encompassed with more prosperous success, and the alms for the same fabric to be distributed by the pious devotion of the Christian faithful may be faithfully exacted and preserved, and moreover those revenues may be duly converted into that fabric itself and no other cause, being willing to provide opportunely; revoking all and singular prefects and officials appointed to the work of the said fabric, of whatever dignity, status, degree and condition they may be, even if they shine forth with pontifical dignity or the honor of the cardinalate, by the said predecessors and us and the Apostolic See hitherto appointed, and all commissions and faculties made and granted to them thereupon under whatever form of words; and absolving the same prefects and officials from such prefecture and other offices and commissions otherwise made to them specially or generally, by our own motion, not at the instance of any petition offered to us on this matter, but from our mere deliberation and from certain knowledge, we do erect and institute by apostolic authority, by the tenor of these presents, one college, to be called the college of the fabric of the Basilica of Blessed Peter, of all the orators of Christian kings and princes and of republics, and from each of such nations, as is aforesaid, elected, in place of whom, as time goes on, others of the same nations may be similarly elected when those die or remain absent for a long time, provided always that the said number of sixty be not exceeded.

7 § 3. And this college and for the time being the individual persons existing in it we exempt and wholly free from all superiority, dominion, power, jurisdiction and authority of whatever persons, of whatever dignity and excellence, even if holding the honor of the cardinalate and the office of legate a latere and whatever faculty for the time being, even by reason of the archpresbyterate of the said basilica, as to all and singular things which concern such fabric, by the authority and tenor aforesaid, and we take under our protection and that of the aforesaid See, and to us and the same See, so that they ought to recognize no other than us and our successors the Roman Pontiffs as superiors, and no other may in any way exercise any superiority, dominion, power, jurisdiction or authority over them, we immediately subject them.

8 § 4. And to the same college we commit the full administration, care and direction and all the government of the said fabric; and to the same college, so that from their own body they may elect officials for a time to be determined by them, both for the special care of the fabric itself and whatever other matters concerning it, and also (provided they be chosen from the more worthy doctors and clerics) for the administration of justice, who, according to the faculty granted to them by the same college, may proceed against debtors of the said fabric, as justice shall require; and to establish decent salaries for the officials thus elected, and all and singular things which any other colleges whatsoever, both in the said City and Roman Curia, and elsewhere, can and ought by law or custom to establish, ordain and dispose, both for the prosperous government and due order of the college itself, and for preventing the frauds of those committing them in the dispensation of the revenues of such fabric and other matters concerning the fabric itself, which, after they shall have been established, ordained and disposed by them, shall by that very fact be deemed approved and confirmed by the said apostolic authority, as we now and as we then approve and confirm them, they may freely and lawfully establish, ordain and dispose, full and free faculty, authority and power, by apostolic authority and tenor aforesaid, we grant.

9 § 5. And moreover, so that all things to be done by the same college and officials may be done with all hatred, love and sacrament removed...

10 should be done unless with our approval, according to the fear of God and right conscience being directed, by the same authority and tenor we establish and ordain that all and each of the said college and through them for the time being to be elected officials, under attestation of eternal damnation, that they themselves in such fabric administration, care and direction and governance and election of officials, according to God, without deceit, fraud, hatred or rancor, as each of them their conscience shall have dictated, shall proceed, and shall give their vote, and shall exercise office, an oath, which by the aforesaid college or by those to be deputed by them, as often as the nature of the business shall have required it, to officials to be deputed for the time being as it shall have seemed fit to expedite, may be repeated, they are bound to take.

11 § 6. And that all and each monies, alms and goods owed and to be owed, even pious ones and forgotten oblations, all in oblations, both in the said City and outside it, to be expended for the said fabric, shall remain with the college or officials to be elected aforesaid or a depositary to be deputed by the college, and by them the keys of the chests and trunks, where monies and alms in the same city are to be kept, shall be guarded; and all the same monies by the same college and officials, to be deputed or to be elected by them for this purpose, for the work of the said fabric and not for any other use whatsoever shall be distributed, expended and converted, even if we and our successors the Roman Pontiffs should otherwise dispose and ordain, even by whatsoever mandates, both in writing and also by word of mouth, under whatsoever penalties and censures to be made: which orators of kings, princes and also of republics in the said Curia residing, for the same college shall firmly resist, and, in such event, the aforesaid college monies, things and all goods aforesaid, in the name of the orators, shall deposit; nor shall the said orators or college, by reason of such residence, incur any censures or penalties, nor can the aforesaid college be bound to anything other than to depositing, as aforesaid; and the same orators in that case monies, things and goods of this kind cannot expend for any other work than the said fabric, and those who shall have done otherwise, shall be bound to restitution from their own property of damage to the same fabric inflicted by their fault or deed.

12 § 7. And that all and each things by the inferior officials aforesaid for the time being to be elected done and transacted, with subscription of officials to be deputed and seal of the aforesaid college furnished, may be valid, and obtain full force and firmness, and make faith in court and outside, as if by our chamberlain and presidents of the Apostolic Chamber done and transacted. And similarly delays, pacts, transactions, relaxations or remissions, by the aforesaid college to be made for the peace of mind of debtors of the same fabric, shall have that force and authority which they would have, if with us and with our successors the prelates and chamberlain and presidents of the Chamber of this kind they had been made and celebrated, nor in anything else, by the chamberlain and aforesaid presidents or any others whatsoever officials, can they be molested or disquieted.

13 § 8. And that collectors, for exacting collections from inheritances, legacies and other goods from donations on account of death, or irrevocably given between the living of the said fabric made or to be made, and pious alms both in the Curia and basilica aforesaid, and outside the same Curia and in whatsoever cities, dioceses and places to be expended, cannot be deputed, elected and sent by others than by the aforesaid college; and by the same college for the time being deputed and elected, so that without any impediment and with their peace of mind they may be able to exercise the office committed to them, and their servants, clerks only, serving for the work of the said fabric, during their office and its exercise only, from all superiority and jurisdiction of whatsoever ecclesiastical ordinaries free and exempt, and under our and the said See's protection constituted and be deemed to be. And that the community, city or university of the place, in which or where the deputed collector shall have been, ought to adjoin one citizen layman of good repute and suitable in means, who together with the collector may intervene in exactions, and keep account, and of the acts make faith to the aforesaid college, and may share in the spiritual graces, which the collector shall enjoy.

14 § 9. And that all and each goods and monies in inheritances and legacies of the said fabric, to be reduced, donations on account of death or between the living or in any way whatsoever left and made, to the last bidder and highest offerer, whether the said goods consist in movable or immovable things or in names of debtors, shall be publicly put up for auction and sold; and from the revenues and aforesaid goods monies to be derived shall remain with the college or depositary to be deputed by the college, for the purpose that the work of the said basilica may be continued and finished, shall be deposited.

15 § 10. And lest the College itself be judged by them at the time of electing officials, for the purpose of settling oblations, goods and things of the said see and fabric, both by election of contracts and causes of the fabric of whatever dispositions between living persons and last wills for the time being owed, in various tribunals they be compelled to litigate, and through various quibbles and subterfuges solutions be deferred, and thus the prosecution of such fabric be impeded or retarded, that the college of the aforesaid exercise ordinary jurisdiction, and concerning whatever causes of whosoever debtors of the said fabric, even of whatever greatest sums and from whatever cause contracted, with the counsel of experts, to know and judge; and, at the instance of the steward or procurator of the same fabric, to be appointed by the college aforesaid, against whosoever debtors of the said fabric from whatever causes, of whatsoever dignity, grade or condition they shall be, present namely in the said Curia, by royal hand, ascertained of debits by whatever instruments or by suitable witnesses the party being cited to be examined, to give and conclusively proving the debt, or otherwise legitimate proofs, even if the debt mediately from whatever title, even of cession freely and without fraud nor to any advantage of the ceding party made, or application, to the same fabric pertains, solemnity introduced by natural law, or if it shall be expedient, by single citation only, personally or to their house of usual habitation, if it shall seem good, being omitted, without other judicial formality, even on individual days and time of whatever ferias, not however to the honor of God for the time being appointed, even to us and our successors Roman Pontiffs from the Roman Curia being absent, and also the See being vacant, until effective execution; likewise against chapters, colleges, communities and universities and persons having and detaining things and goods pertaining to the said fabric, even by force of penal monition, by the college itself, under censures and penalties to the same fabric, if things and goods of this kind shall not be restored, to be applied, to decree; and against the contumacious, single or multiple citations, if it shall seem good, being preceded, even by affixion on the doors or gates of the basilica of the Prince of the Apostles, even through censures and ecclesiastical penalties and other opportune remedies of law to proceed, and to decree an executive mandate, in place of pronouncing sentence or letters; likewise to cite and admonish all the aforesaid, even through public edicts, to be affixed in public places round about, which shall bind those same as if intimated to them personally, ascertained summarily and extrajudicially of unsafe access to them, after the manner of auditors of causes of the Apostolic Palace, without other special commission of us or our successors.

16 § 11. And both present and absent censures poe debtors, even if absent personally unjustly inOigen- ' ...

17 or otherwise appeared, unless they shall pay, or shall have legitimately shown payment; likewise individual persons of chapters, colleges, communities and universities detaining things and goods of the fabric of this kind, without other solemnity of law, to bind with sentence of excommunication, to suspend from divine offices, and to declare excommunicated and suspended, and to aggravate the excommunication and other censures and penalties aforesaid, as often as need shall be, even by repeated instances, and against them to invoke the aid of the secular arm, and to impose general or special interdict, both in churches and in cities and places, in which the aforesaid debtors and offenders shall have remained, and to which it shall happen that they decline, and to suspend, remove or revoke the same, and to exercise freely and lawfully whatsoever other remedies accustomed to be exercised by the presidents of the Apostolic Chamber, until from the debt itself the fabric shall have been fully satisfied.

18 § 12. And if it should happen that the said debtors, with the intention of deferring payments, can be presumed with probability, before or after they have been condemned by the judges of the said Curia to pay the whole of that in which they have been found to be true debtors, to confirm the burdens inflicted or to be inflicted upon them through various subterfuges and remedies, even by means of nullity of the judicial act not observed, and for this reason to have procured that causes of appeal or appeals, and of nullity and nullities, be committed to certain judges, in the said Curia or outside it, all and singular causes concerning the said fabric, both of the principal matter to the prejudice of the jurisdiction granted to such college, and of appeal and nullity, or of appeals and nullities, ought to be decided by the college itself or by officials to be appointed by it, and ought not to be committed to any judge, nor can commissions be signed by anyone deputed by us and the Apostolic See to sign commissions of justice, even if he should be a cardinal of the said Roman Church, nor by the vice-chancellor of the same Holy Roman Church or his locum tenens existing for the time being, unless by us and our aforesaid successors, by our hand, the said officials being called first, and nullity of process cannot be brought into question, nor be cognized; but rather, nullities being rejected, even of censures, as if nullity had been declared on account of danger to souls, even if from the acts it should be evident of them, the principal matter may be proceeded with anew, unless from the acts it shall have been established concerning the justice of the principal matter, or otherwise it can appear within a brief time.

19 § 13. And that decrees and mandates concerning judges for the aforesaid payment, made by officials of such college, if justice requires it, against debtors placed before them, can in no way be impeded by any officials of the city, even by the barons and marshals, but ought to be executed. Nor can such mandates and executions be impeded or retarded by any officials, even the aforesaid cardinals, even the See being vacant, even collegially, by any sought-out pretext, or even by our chamberlain and the presidents of such Chamber, or even by letters of safe conduct and delays given for payment, even with suitable security; and all letters of safe conduct and delays, to be granted by the chamberlain and the aforesaid presidents of the said Chamber or by the college of cardinals of the Holy Roman Church, even the said See being vacant or the Roman Pontiff being absent from the Roman Curia, shall be of no force or moment; and, notwithstanding those, mandates and decrees of this kind ought to be executed by the officials to whom they shall have been presented.

20 § 44. And that all who shall have impeded executions or perceptions of monies and goods in favor of the fabric of any kind whatsoever, both movable and immovable, from any cause and disposition, of last will or between living persons, pertaining to the said fabric, and shall have concealed the same goods or instruments or testaments, codicils, last wills, donations, both from cause of death and between living persons, or shall have impeded them from coming to the knowledge of the college and collectors, both in the said city and Curia and outside them to be appointed, by that very fact incur the sentence of excommunication; and can be declared and published as excommunicated both by the college and its officials for the time being appointed, and also by the same collectors, in the parts and places where they shall have been appointed; nor can they be absolved by others than the said officials or collectors, even by virtue of any letters and faculties whatsoever, even of crusade to be granted to any princes, unless they shall have first made satisfaction, or, if they shall have been constituted in the article of death, security having been given for making satisfaction by themselves, if they shall have recovered, otherwise enjoining satisfaction upon heirs and executors; and the officials and collectors themselves can extend such absolution to the relatives of those impeding and concealing, who by law are obliged, for the impediments and concealments made and done by them.

21 § 45. And that notaries, rectors of parishes or churches or vicars or any others whatsoever, asked concerning the aforesaid donations or having knowledge of them, ought to and must intimate them, within a month, to the college or collectors; and, if collectors are not present, in the episcopal curia of the place.

22 § 46. We decree and declare, by the force of the premises for the aforesaid reason, that if against these or any of them, whatever apostolic letters, and any declarations, concessions and clauses general or special, even derogatory of derogations, stronger, more efficacious and unusual, and decrees that render null, as well as mandates, even penal ones, under whatever form and expression of words, containing in themselves, even expressly derogating from the present, even by our own motion and knowledge similar and from the fullness of apostolic power, from us or our aforesaid successors, or from our or the same successors' authority, or in whatever other ways have emanated, or at any time whatever have appeared, by which the effect of these same presents might be retarded or impeded, or in whatever way derogated from
