Bull dividing the Archdiocese of Santiago de Chile and erecting new dioceses

Bull of Pope Pius XI ·

OF THE DISMEMBERMENT AND ERECTION OF A BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 The nature of apostolic duty demands of Us that We take all those measures which appear to conduce to the good of souls. To accomplish this, however, a correct circumscription of the Catholic world is most helpful, which must be so arranged or altered that it may aptly respond to the conditions of times and places. The Roman Pontiffs ought therefore to take care that, when in some region, either on account of the increased number of the Christian faithful, or on account of excessive extent, pastoral office cannot be exercised by a single Bishop alone, there the number of dioceses under the care of Bishops be increased, as is necessary.

2 This indeed has come to pass with respect to the archdiocese of St. James of Chile, whose extent and the vast number of the faithful, increasing more and more day by day, have for some time suggested that it ought to be divided into parts, that is, into several dioceses. Wherefore We, having obtained the vote both of the Ordinary of the same archdiocese and of the Apostolic Nuncio with the Republic of Chile, and having duly weighed all matters, have determined to proceed to the dismemberment of the archdiocese itself. Having therefore supplied, insofar as it may be necessary, the consent of those to whom it pertains, or who may presume that it pertains to them, by the fullness of apostolic power We establish and decree the following.

3 First, We separate and sever from the archdiocese of St. James of Chile the civil provinces commonly called Talea and Guricó, with their twenty-six parishes, and We erect them into a diocese to be called Talea, whose seat We establish in the city of Talea, and there We raise to the honour of a cathedral the parish church of St. Augustine. Likewise, We sever from the archdiocese of St. James of Chile the civil provinces commonly called O'Higgins and Colchagua, with all and singular thirty-one parishes therein, and We constitute them into a new diocese to be called Rancagua, from the city of Rancagua, in which the episcopal seat shall be, and there We elevate the parish church of the Holy Cross to the dignity of a cathedral. Likewise, We tear away from the archdiocese of St. James of Chile the civil province of Valparaiso with the parishes existing therein and contained in it, and We erect it into a separate diocese, to be called Valparaiso from the city of Valparaiso, and moreover to this diocese shall be assigned the islands of Juan Fernández (Mas a Tierra and Mas a Fuera), which hitherto belonged to the aforesaid archdiocese of St. James. The episcopal seat of this new diocese shall be in the city of Valparaiso itself, and We constitute as cathedral the church which is now being built in the same city, dedicated to Our Lady of Mount Carmel. Finally, We likewise sever from the archdiocese of St. James of Chile the civil province of Aconcagua with its sixteen parishes and erect it into a new diocese to be called St. Philip of Aconcagua, named from the city of St. Philip. We establish the seat of this new diocese in the city of St. Philip, and We raise to the rank of cathedral the church of St. Philip the Apostle existing there. Wherefore, these dismemberments being accomplished, the archdiocese of St. James shall retain only the province of St. James, with its forty-five parishes, and the island of Easter.

4 The boundaries of these dioceses, however, shall be the same as the boundaries by which the civil provinces and circumscriptions (commonly called departments) of which each diocese consists are now delimited.

5 To these newly erected cathedral Churches and to their Bishops for the time being We grant the honours, insignia, favours, rights and privileges which other cathedral Churches and their Ordinaries in Latin America enjoy and possess by common law or by legitimate custom. We constitute these cathedral Churches suffragans of the metropolitan Church of St. James of Chile, and their Bishops for the time being We subject to the metropolitan jurisdiction of the same Archbishop of St. James, with the faculty reserved to the Apostolic See of freely determining anew the dismemberment of their dioceses, whenever it shall seem expedient in the Lord.

6 Since, however, the circumstances of the times prevent the institution of a chapter of canons in each diocese at this time, We command that, in place of canons, diocesan Consultors be chosen according to the manner of can. 423 and following. We command moreover that, as soon as it can be done, at least a small diocesan seminary according to the prescriptions of the Code and the norms handed down by the Sacred Congregation of Seminaries be erected in each diocese; and that in the meantime the students of the faculty of philosophy and theology of the new dioceses of Talea, Rancagua, Valparaiso and St. Philip, until otherwise determined, be sent to the Seminary of St. James of Chile. We further will that, at the expense of each diocese, two chosen young men, or at least one, be sent without fail to the Pontifical Pius Latin American Seminary of the City.

7 As to the governance and administration of these dioceses, the election of a Vicar Capitular or Administrator during a vacant see, the rights and obligations of clergy and the faithful, and other such matters, We command that what the sacred canons decree be observed. But as to what pertains especially to the clergy, We decree that as soon as the erection of the dioceses shall have been made, by that very fact the presbyters of the church shall be considered enrolled in that church whose territory they legitimately occupy. It shall be the duty of each Ordinary to ensure that all documents and acts relating to the new dioceses be delivered to their Chancery as soon as possible, so that they may be preserved in the respective archives.

8 The episcopal mensa of the new dioceses shall be constituted by the emoluments of the Curia and other offerings which are customarily provided by the faithful for whose benefit these dioceses are erected, apart from those which have already been collected for this purpose and are assigned by the civil Government. The Archbishop of St. James, however, shall pay to each newly erected diocese within the limits of the territory which hitherto pertained to his archdiocese, namely of Talca, of Rancagua, of Valparaiso and of St. Philip, a sum according to the manner prescribed in the Code of Canon Law. These present Letters and all things contained therein, even from the fact that anyone concerned, or who presumes his interest to be concerned, has not been heard and has not consented to the foregoing, even if they should be worthy of express, specific and individual mention, can never at any time be noted, impugned, or called into question on account of the vice of subreptiousness or obreption or nullity, or of Our intention, or any other defect, however substantial and unforeseen; but these Letters, as made and emanated from certain knowledge and the fullness of power, shall perpetually be valid and shall be, and shall produce their full and complete effects and obtain them, and ought to be inviolably observed by all to whom it pertains; and if otherwise anything contrary to these things shall be attempted by anyone, by whatever authority, knowingly or unknowingly, We will and decree that it be wholly null and void and shall be.

9 These matters being thus disposed as above, for the execution of all the same, We appoint the venerable brother Benedict Aloisi-Masella, Archbishop of the title of Caesarea, Apostolic Nuncio to the Republic of Chile, granting to him the necessary and opportune faculties, even of subdelegating, for the purpose of which it is a question, any man constituted in ecclesiastical dignity or office, imposing upon him the burden of sending to the Sacred Consistorial Congregation within six months to be reckoned from the date of these present Letters, an authentic copy of the execution completed. We will finally that to transcripts of these Letters, even printed ones, subscribed however by the hand of some public Notary and furnished with the seal of some man constituted in ecclesiastical dignity or office, the same faith be given as would be given to these Letters, if they were exhibited or shown in the original.

10 Notwithstanding, insofar as it is necessary, the rules established in synodal, provincial, general and universal Councils, special or general Apostolic constitutions and ordinances, and any other dispositions of the Roman Pontiffs, Our predecessors, and all other things to the contrary whatsoever.

11 Let no one infringe upon this page of dismemberment, erection, elevation, concession, statute, derogation, mandate and Our will, or act contrary to it. If anyone, however, shall presume to attempt this with rash boldness, let him know that he will incur the indignation of almighty God and of the blessed Peter and Paul, His Apostles.

12 Given at Rome, at St. Peter's, in the year of Our Lord one thousand nine hundred twenty-five, on the eighteenth day of the month of October, in the fourth year of Our Pontificate.

Quapropter Nos, praehabito voto tum Ordinarii eiusdem archidioecesis, tum Apostolici Nuntii penes Rempublicam Chilenam omnibusque rite perpensis, ad ipsius archidioecesis dismembrationem deveniendum censuimus.

12 Datum Romae, apud Sanctum Petrum, anno Domini millesimo nongentesimo vigesimo quinto, die decima octava mensis octobris, Pontificatus Nostri anno quarto.
