De dominici gregis salute
Bull on the restoration of the episcopal see of Civitavecchia and its union with Porto-Santa Rufina
1 in the city of Centumcellae. Leo, bishop, Servant of the Servants of God, to perpetual remembrance of the matter. § 1. Concerning the welfare of the Lord's flock, for which we are entrusted by divine care with the governance of His kingdom, we are impelled to direct our attention to that which we know redounds to the benefit of its stability and of religion. This pertains moreover to the establishment of episcopal sees, when a more prompt and felicitous administration of sacred matters is effected by the nature of places, and reasons and considerations occur by which the same may be decreed good and salutary. § 2. We did not overlook this in our mind, when we received petitions from the clergy, community, and people of our city of Centumcellae, by which we were earnestly besought that, separating it from the diocese of Viterbo, we should constitute an episcopal see there to be united to the Portuan and of St. Rufina churches. Indeed we ourselves had observed the outcomes which, on account of the harshness of the times, had not always been as fruitful as those which our predecessor of happy memory, Pius VII, most providently and felicitously sanctioned for the promotion of sacred matters there through apostolic letters in the form of a Brief, which he gave on a certain day in August in the year one thousand eight hundred and five. A more salutary remedy therefore appeared to be to place, or rather to restore, an episcopal see in that city, which illustrious monuments of antiquity testify to have existed from the fourth to the twelfth century. Since however the matter concerned a city which lacks sufficiently ample territory, it was evident that it would not be expedient if a peculiar and proper diocese were assigned to it without connection, and therefore it seemed that it should more usefully be attributed to our venerable brother the cardinal bishop of Porto, whose diocese is adjacent to and borders the territory of Centumcellae. For thus would it have been consulted most carefully for the convenience and dignity of the same cardinal bishop of Porto and St. Rufina, who, although he is second in the college of our venerable brothers the cardinals of the Holy Roman Church, nevertheless does not possess in his diocese either a cathedral church chapter, nor a city, nor certain other things by which the leaders of the sacred order ought to be provided in order to govern dioceses more felicitously. Hence the examples of our predecessors were before our eyes, who for the same reasons entrusted to the cardinal bishop of Ostia, who is the dean of the same college, the governance of the church of Velletri, with the right attributed to him of having the bishop of Velletri as his suffragan, who would be devoted to performing pontifical offices, and especially to conferring the sacrament of confirmation and administering sacred ordinations. This also seemed fitting to sanction for Centumcellae, both on account of the splendor of that city itself, which excels especially through the frequency of citizens and visitors and the celebrity of its port, and on account of the great convenience by which both the city itself and the diocese of Porto would be increased by the presence of a suffragan bishop dwelling there. There was added moreover a most welcome recollection at the beginning of this century that the cardinal Leonardo Antonelli, then bishop of Porto and St. Rufina, at the counsel especially of Vincent Mary Strambi, a citizen of Centumcellae, formerly bishop of Macerata, had desired this office, whose special religion, prudence, and learning commended this counsel to us so greatly.
2 § 3. These things indeed, and others of this kind, showed to us both honest and approved grounds for approving the petition: nevertheless, referring the matter to our venerable brothers placed in charge of consistorial affairs, and with their judgment, we have at length, upon the petitions being brought again, deemed it fitting to proceed.
3 § 4. Wherefore, having carefully examined the matter with the greatest seriousness, to the praise and glory of almighty God and of His Mother the Virgin Mary, and for the increase of the holy militant Church, complying with the wishes of Our beloved sons the clergy, community and people of the city of Centumcellae, from certain knowledge and mature deliberation of Ours, and from the fullness of apostolic power, We perpetually dismember, sever, separate and remove the aforesaid city together with its entire territory and parochial and other churches, monasteries and pious places, and any ecclesiastical benefices whatsoever with and without cure of souls, both secular and of whatever regular orders existing therein, and all persons of either sex, both lay and clerical, beneficed presbyters and any religious persons likewise dwelling there, from the diocese of Viterbo, to which they belonged, and We constitute the said city of Centumcellae as an episcopal city to be called Centumcellensis with its episcopal curia and all the rights, honors and prerogatives with which the cities of Our pontifical See are distinguished, and which the citizens thereof enjoy and possess, and which they may enjoy and possess in whatever manner in the future. The parochial church called collegiate and dedicated to God in honor of St. Francis, after the suppression of its collegiate status, We perpetually erect and constitute as the cathedral church, which shall also be parochial, of Centumcellae under the former title of St. Francis of Assisi by similar apostolic authority. And the same church thus erected We subject immediately to the Apostolic See, and as the cardinal bishop of Ostia and Velletri has the church committed to him, We perpetually unite and declare united to the churches of Porto and St. Rufina, so that the cardinal bishop of Porto and St. Rufina existing for the time being shall also be considered and be bishop of Centumcellae, and to the former titles of bishop of Porto and St. Rufina shall also add the title of bishop of Centumcellae, especially in matters concerning Centumcellae, and the cardinal bishop shall preside over the same church, city and territory of Centumcellae and its clergy and people, and shall exercise all and singular the rights, offices and functions of a bishop with the chapter of the cathedral to be constituted as written below, seal, episcopal table as hereinafter to be established, and other cathedral rights, preeminences, indults, jurisdictions and prerogatives, which other cathedral churches and especially those called suburban enjoy.
4 § 5. And to the cathedral church thus erected We constitute a chapter from the collegiate church thus called, uniting the collegiate chapter into the chapter of the episcopal church of Centumcellae and respectively the prepositorship into one, and the parochial dignity heretofore into one likewise and first dignity after the pontifical, henceforth with the care of souls to be established, which shall enjoy all honors, privileges and preeminences competent to it by right, and six canonries actually existing, and moreover two new canonries for the theological and penitential prebends, and four beneficiaries always bound to the service of the choir and chapter We perpetually erect and constitute, with the faculty for the cardinal bishop of Centumcellae in this first instance only to confer the institution of canonries on those whom, in the manner and form which he shall judge more expedient in the Lord for his conscience, both on the prepositus and six canons actually existing and on the two new canons theological and penitential, and on the four beneficiaries to be chosen by himself, saving nevertheless and remaining firm in the same cathedral church as much the reservations and provisions of the Apostolic See regarding the prepositorship as regarding the collation of canonries, as well as regarding two of the already existing canonries by patronage attributed to the community of Centumcellae by Our predecessor of happy memory Pius IX, to whom on account of the heavy expenses incurred on this occasion for the good of the church We also by apostolic benignity grant and attribute a third canonry from those already erected, and finally saving in favor of the chapter thus erected and substituted the privileges, honors, indulgences and other graces whatsoever both spiritual and temporal and mixed granted to the same chapter by apostolic and any other legitimate authority, and also from right and custom, or otherwise competent.
5 Thus having constituted this cathedral chapter of Centumcellae in this manner, we impart to it the faculty of drawing up statutes and decrees for the service of the Church and for the happy governance of the bishop, according to the norm of the sacred canons, which afterwards, in order to obtain the desired confirmation, are to be reviewed and approved by the cardinal bishop. And moreover, so that the order itself of canons may appear adorned with canonical ornament and may observe sacred rites, we grant to the same prepositus and canons the use in winter time of a great cape of violet color with ermine fur over the rochet, and in summer time the use of a surplice over the rochet; to the beneficiaries moreover in winter time the use of a similar cape with fur nevertheless of clerical color over the surplice, and we likewise grant to the same chapter to enjoy all and singular the honors, graces and privileges by which the chapters of cathedral churches of the suburban dioceses freely and legitimately enjoy and possess, provided that they are not acquired by particular indult. § 7. So that the cardinal bishop for the time being, bishop of Porto and St. Rufina and Centumcellae, may have assistance for pontifical functions and other duties to be exercised by the office of suffragan bishop in the church of Centumcellae, as was provided for Velletri by our predecessors, by these our letters we erect and constitute with appropriate statutes and endowment to be received from the fruits of the episcopal mensa, having conferred upon the same cardinal bishop the privilege of presenting to us and our successors a man suitable according to the sanctions of the canons to be promoted to some episcopal church in the lands of the infidels, who ought to reside in the aforesaid city of Centumcellae, and shall enjoy all the honors, preeminences, privileges and rights which are by right attributed to similar other suffragan bishops. § 8. For the proper and convenient residence of the cardinal bishop and the convenience of his curia, and also for the seminary of ecclesiastical boys to be erected according to the decrees of the Council of Trent, we decree that the necessary and suitable buildings are to be assigned and attributed in perpetuity respectively, to be approved by the executor of the present letters written below, as near as possible to the cathedral Church.
6 § 9. As for what pertains to the endowment of the mensa and curia, as well as of the chapter and the fabric of the cathedral and the episcopal seminary, since we have already made opportune provision concerning all these things by our own motu proprio signed by our hand under the seventh day of this month, the tenor of which is to be held as inserted and to be considered as related here word for word, we confirm all and singular things contained in the same by these presents, and we command that they be fully and entirely observed now and in the future by all to whom it pertains. § 10. So that all things disposed by us as above may be brought duly and speedily to their effect, to our venerable brother Joseph, cardinal of the Holy Roman Church, bishop of Praeneste, whom we elect and appoint as executor of these our letters, we grant all necessary and opportune faculties for fully obtaining the effect of the aforesaid matters, even to subdelegating one or more persons constituted or to be constituted in ecclesiastical dignity, and for freely and licitly defining and pronouncing definitively upon any opposition which may arise in any way in the act of execution, with any appeal removed; and we enjoin upon the same executor that he take care that any documents concerning the city of Centumcellae be extracted from the episcopal chancellery of Viterbo and delivered to the new episcopal chancellery of Centumcellae, and that copies of all acts to be made thereupon, drawn up in authentic form, be transmitted to Rome in due time to be preserved in the archive of the congregation placed over consistorial matters according to custom.
7 § 11. We will and decree that these present letters and whatever is contained in them, even on this account that those who have or claim to have an interest were not called and heard, and did not consent to the aforesaid, their consent being supplied, insofar as it is necessary, from the fullness of apostolic power, can never at any time be noted, impugned or brought into controversy on account of the vice of subreption or obreption or nullity, or of our intention or any other even substantial defect, but shall always and perpetually be valid and efficacious and shall produce and obtain their full and complete effects, and ought to be inviolably observed by all to whom it pertains.
8 § 12. Notwithstanding any right acquired, without prejudice to Durofiim, concerning the suppressions of the communities of Liège on the part [of those] called whose interest it is, and other [provisions] of Ours and of the apostolic chancery, as well as the special or general constitutions and apostolic ordinances issued in synodal, provincial, and universal councils, and likewise the aforesaid letters of Our predecessor Pius VII expedited in brief form, and any other dispositions of the same and of Our other Roman pontiff predecessors, and all other things contrary in any way whatsoever.
9 § 13. We will moreover that transumpts of these letters, even if printed, nevertheless subscribed by some notary public and furnished with the seal of a person constituted in ecclesiastical dignity, shall receive the same faith entirely as would be given to these presents themselves, if they were exhibited or shown.
10 § 14. Let it be lawful for no one whatsoever to infringe this page of Our dismemberment, disjunction, separation, election, union, assignment, attribution, concession, indult, declaration, commission, deputation, mandate, will, decree, and derogation, or to act against it with rash presumption; but if anyone shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
11 Given at Rome at St. Peter's in the year of Our Lord's incarnation one thousand eight hundred twenty-five, on the fourth day before the Ides of December, in the third year of Our pontificate.
