In Apostolatus culmine

Bull erecting the University of Santo Domingo

Bull of Pope Paul III ·

1 28 October 1538 – Paul III – Bull 'In apostolatus culmine'

2 Paul, Bishop, Servant of the Servants of God.

3 For perpetual remembrance of the matter.

4 In the summit of the Apostolate, by the disposition of the Lord, constituted though with unequal merits, and turning over in the secret places of our heart the fruits grateful to God and to the Christian commonwealth, which are known to proceed from the study of letters, we willingly intend to provide opportunely for those things by which individual faithful, even Religious serving the Most High under regular observance, their Prelates especially requiring this, by persisting in such study, may be able to obtain the honors and rewards of their labors, and in these matters we favorably impart the parts of Apostolic providence, as we perceive it to be salutarily expedient in the Lord.

5 Indeed, on behalf of our beloved sons the Master Provincial of the Province called the Holy Cross according to the custom of the Order of Friars Preachers, and the Prior and Friars of the house of St. Dominic, of the City also of St. Dominic, of the said Order, a petition was recently exhibited to us, containing that they, attending to the fact that the inhabitants of the Islands of the Ocean Sea, in which the said City is situated, were infidels and worshipped idols, whence desiring to root out such infidelity entirely and to plant fruitful trees there, and to illuminate the City of those infidels by preaching and by example of life, they have directed innumerable persons of both sexes from the same inhabitants through the washing of regeneration to the worship of the Christian Religion by divine grace, and have procured their conversion to the Catholic faith, and from the time of such conversion hitherto, by incessantly preaching the Word of God there, they have gathered most abundant fruits in the field of the Lord.

6 And if in the said City, which is indeed very notable, and situated in a region very remote and wholly ignorant of sacred letters, and to which a copious multitude of men is accustomed to flow from the neighboring Islands, both dwelling there and for the sake of business, and in which a study erected anew by Apostolic authority flourishes, lacking sufficient Apostolic privileges and indults for the granting of degrees of promotion customarily granted in the Universities of general study of the Kingdoms of Spain, to which the said Islands are known to be subject, a similar general University of Doctors, Masters and Scholars with seal and chest and other customary insignia, preeminences, liberties, exemptions and immunities in the manner of the town of Alcalá, of the Diocese of Toledo, and of the other Universities aforesaid, were to be erected and instituted perpetually, then indeed the said City would be decorated more abundantly on account of the multiplication of its inhabitants, and the inhabitants and dwellers of it and of the said Islands would be more fervently instructed in the Christian Religion, and the said Provincial and Prior and Friars would be more readily invited to undertake greater works of virtue and charity, and their honors and advantages would be very much consulted.

7 Wherefore on behalf of the Provincial, Prior, and Friars, we were humbly supplicated that in the same City we should deign to erect and institute perpetually one similar University of Doctors, Masters, and Scholars in the manner of the said University of Alcalá, as aforesaid, which ought to be ruled and governed by one Regent or Rector, to be named, and that the scholars thereof for the time being, both secular and of any of the Regular Orders whatsoever, even coming from anywhere, might there in any lawful faculty of letters, their courses completed, and other things being observed as is customary in the other Universities aforesaid, be promoted to the degrees of Bachelor and Licentiate and Doctor and Master customarily conferred, after examination and with four Doctors in the same faculty assisting there, to be named or appointed by the Prior aforesaid and the Regent of the said University of St. Dominic existing for the time being, and their votes sworn, receive their customary insignia, and the Doctors and Masters in the said faculty, and if these do not exist, the Regent of the said University or the Bishop of St. Dominic existing for the time being, might promote the same Scholars to the said degrees and bestow upon them their customary insignia, and moreover as often as need be conduct Readers there and assign Readers to themselves, and provide from competent salaries, provided that faculties suffice for this, and draw up statutes and ordinances concerning this in the manner of the Universities aforesaid, and change, correct and reform them, and do other things necessary and opportune in the premises and concerning them, as shall seem good to them, establish and ordain, and otherwise provide opportunely concerning these things from Apostolic benignity, we deigned to do so.

8 We, wishing to follow the aforesaid Provincial, Prior, and Brethren, and each of them individually with special favors and graces, and absolving them by the tenor of these presents from whatsoever excommunication, suspension and interdict, and other ecclesiastical sentences, censures, and penalties imposed by law or by man, for whatsoever occasion or cause, if they are bound by any of these in any manner whatsoever, for the purpose of obtaining the effect of these presents only, and consenting that they be absolved, inclined by these supplications, by the Apostolic authority aforesaid and by the tenor of these presents, we erect and institute in the same City one similar University of Doctors, Masters, and Scholars in the manner of the said University of Alcalá, which ought to be ruled and governed by one Regent, or Rector to be named, and that the Scholars of that University, both secular and of any of the Regular Orders whatsoever, coming from anywhere, may there in any lawful faculty of letters, their courses having been completed, and other things being observed as they ought to be observed, as is the custom in the aforesaid Universities, be promoted to the degrees of Bachelor, Licentiate, and Doctor, and Master by means of this prior examination, and with four Doctors being present in the same faculty, to be named or appointed by the Prior and the Regent of the said University of St. Dominic aforesaid for the time being, and by their sworn votes, receive their customary insignia; and the Doctors, and if they do not exist, the Regent or Bishop of St. Dominic aforesaid may promote the same scholars to the said degrees, bestow upon them their customary insignia, and as often as need shall be, hire readers for that place and assign them lessons, and provide for competent salaries, provided that the faculties of the said University of St. Dominic suffice for this; and likewise they may freely and lawfully make, and are able to make, statutes and ordinances concerning this matter in the manner of the aforesaid universities, and change, correct, and reform them, and do other things necessary and opportune in the premises and concerning them, as shall seem good to them, by the authority and tenor aforesaid, we establish and ordain; and moreover to all and singular Bachelors, Licentiates, Doctors and Masters in the same University of St. Dominic respectively promoted to the said degrees for the time being, we grant and indulge by the authority and tenor aforesaid, that they may freely and lawfully use, enjoy, and possess all and singular privileges, indults, immunities, exemptions, liberties, favors and graces, by which those promoted to the singular degrees aforesaid respectively in Alcalá as well as Salamanca, or any other whatsoever University of the said Kingdoms, according to its rite and customs, use, enjoy, and possess, or shall be able to use, enjoy, and possess in any manner whatsoever in the future.

9 Notwithstanding Apostolic constitutions and ordinances issued in Provincial and Synodal Councils, general or special, and privileges also, indults, and Apostolic letters granted, confirmed, and renewed to the Universities of these Kingdoms and to each of them, under whatsoever form of words, even by our own motion, and the Pragmatic sanctions and municipal statutes of the said Kingdoms, even strengthened by Apostolic confirmation or any other firmness: all of which, even if for their sufficient derogation special, specific, express, and individual mention of them and their entire tenors should be had, or any other expression or form to be observed should be required, and it be expressly provided in them that they may in no way be derogated from, we hold the tenors of all of them as if they were inserted word for word in these presents as sufficiently expressed, and the modes and forms to be observed for this as individually observed, otherwise remaining in their force, we derogate from them on this occasion only, specially and expressly, and from all others contrary in any way whatsoever. Let no man whatsoever be permitted to infringe this page of our absolution, erection, institution, statute, ordinance, concession, indult, derogation and will, or to dare to act contrary to it with rash presumption.

10 If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Peter and Paul, His Apostles. Given at Rome at St. Peter's in the year of the Incarnation of the Lord one thousand five hundred thirty-eight, on the twenty-eighth day of October, in the fourth year of our Pontificate.

1 1538-10-28- Paolo III – Bolla 'In apostolatus culmine'
