Sancta Romana
Bull against the Fraticelli and other pseudo-religious
12 January, in the second year.
297. He orders proceedings against the Fraticelli and others of that kind of pseudo-religious. 6 1317, 30 December, at Avignon.
To the perpetual memory of the matter.
1 The holy Roman and universal Church, which by the grace of the Lord we, though unworthy, preside over, just as it pursues religious and pious vows with benign favor, so it abhors the superstitious attempts of insolent men; namely, lest under the fleece of sheep the flock of the Lord be invaded by the ferocity of a rapacious wolf, lest under the image of piety the poison of heretical depravity cry out, and lest under the pretext of angelic conversation the evil spirit deceive unwary minds. For this reason, it is forbidden by the sacred canons that anyone establish a new 1 The Genoese appear to have been those whom Fr. Bertrandus de Turre attempted to absolve from the sentences of which there is mention, when, at the command of John XXII, he strove to restore peace between the citizens of Genoa, both those within and without. 3 order or religion, nor assume the habit of a new religion; but whoever wishes to come to a religion should enter one of the approved religions. Nevertheless, certain men of the profane multitude, who are commonly called "fraticelli" or "brothers of the poor life" or "bizzochi" or "beghini" or by other names, in the regions of Italy and also in the island of Sicily, in the county of Provence, in the cities and dioceses and provinces of Narbonne and Toulouse, and in other various regions on this side of the sea and beyond the sea, contrary to the aforesaid canons, have presumed and do presume continually with damnable temerity to assume the habit of a new religion, to make congregations and conventicles, and to elect superiors for themselves, whom they call ministers or custodians or guardians or by other names, to receive many into their sect, and to build new places or to receive those already built, in which they dwell in common, to beg publicly, as if their sect were one of the religions approved by the apostolic see. And so that their error may be reputed "truth" and their impiety "religion," many of them feign that they profess the rule of the order of the Friars Minor, which St. Francis instituted, and that they observe it to the letter, although they do not remain under the obedience of the general or provincial ministers of that order itself, claiming that they had this privilege of status or way of life from our predecessor of blessed memory, Pope Celestine the Fifth; which, however, even if they were to show it, would not avail, since our predecessor of good memory, Pope Boniface VIII, for certain reasonable causes, completely voided all privileges granted by the aforesaid Celestine, which were not approved by the same Boniface, and the aforesaid privilege of this way of life is not found to have been approved by the same Boniface. Some of them, however, claim to have received the aforesaid habit and manner of living from certain bishops or their superiors or other prelates of the churches, which it was neither permitted for them to receive nor for the aforesaid bishops or their superiors or other church prelates to grant contrary to the form of the general council. Some also of them, asserting that they are of the third order of blessed Francis called of penitents, endeavor to conceal the aforesaid status and way of life of theirs under the veil of such a name, although in the rule of that third order such a manner of living is in no way granted. And because those who place their own concepts before the definitions of the fathers easily rush into their abyss, many of them, as we have learned from trustworthy report, deviating from the truth of the Catholic faith, despise the ecclesiastical sacraments and strive to sow other errors in manifold ways. Since, therefore, the damnable temerity of such persons is known to redound to the detriment of the same faith, to the scandal of the faithful, to the reproach of the aforesaid Friars Minor and other orders, and also to the ruin of their own and many other souls: we, by the counsel of the brothers and by apostolic authority, decree that such a sect, manner and status (notwithstanding the aforesaid excuses of theirs, which we repute frivolous, and whatever has been or is attempted by them jointly or severally under the name or color of religion, convent, college or congregation) has been and is of no force whatsoever, and, insofar as they have proceeded in fact, we revoke it entirely by the aforesaid counsel and authority and subject it to perpetual prohibition and utterly abolish it from the Church of God, enjoining expressly upon the same persons and all others whatsoever, under pain of excommunication, which we will that they incur ipso facto if they act otherwise, that they shall not henceforth follow the status or sect and manner of living thus assumed by them, nor presume in any way to assume it anew; we also decree that bishops and their superiors and also any other prelates whatsoever, who shall henceforth grant to the aforesaid persons or others the manner of living and habit aforesaid without special authority of the apostolic see, shall ipso iure be subject to the aforesaid penalty of excommunication. For it is fitting that adulterous plantings, which not the heavenly Father but the audacity of human temerity plants, should be torn up by the censure of the apostolic office, and that it should not suffer the thorns of a perverse congregation to grow in the field of the Lord, to which it is proper, with divine grace assisting, to sow virtues and to root out vices utterly. Let no one therefore, etc., [alter] our revocation, subjection, abolition, will, injunction and constitutions, etc. Given at Avignon, on the third day before the Kalends of January, in the second year.

Datum Avinione, III kalendas ianuarii, anno secundo. 1

297. Contro i Fraticelli e altri pseudo-religiosi di tal genere ordina di procedere. 6 1317, 30 dicembre, Avignone.
Cfr. supra p. 110, not. 1. * Reg. Vat. t. 67, ep. 789, apud Wadd. 1. c. reg. pont. n. 29. * Postmodum catalogo sanctorum adscripta. 4 Reg. Vat. t. 67, ep. 788, apud Wadd. 1. c. reg. pont.
2 GIOVANNI XXII (An. II - 1317)
