SACRED CONGREGATION FOR THE DISCIPLINE OF THE SACRAMENTS DECREE ON THE ADMINISTRATION OF CONFIRMATION TO THOSE WHO ARE PLACED IN DANGER OF DEATH FROM GRAVE ILLNESS.

1 Catholic doctrine proclaims that the gifts of the Holy Spirit are conferred through the sacrament of Confirmation. Hence the Church's earnest care that children, washed in the waters of baptism, be refreshed with such a sacrament, by which they may obtain the charisms of the heavenly Paraclete to add strength to the faith received in baptism, so that, suffused with the abundance of grace and marked with the character of a soldier of Christ, they may be equipped for every good work and may persevere.

2 Although it is established law that Confirmation is not required for the salvation of souls as a means of necessity (can. 787 of the Code of Canon Law), yet on account of its excellence and the splendid gifts which it brings with it, every effort must be made by parish priests and other pastors that no Christian, when the occasion is given, neglect so excellent a mystery of salutary Redemption; since it is a wonderful aid for striving vigorously against the wickedness of the devil, the allurements of the world and the flesh; and for obtaining a greater increase of grace and all virtues on earth, and of glory in heaven. Although vigilant shepherds of souls leave nothing untried so that, as far as possible, all the baptized be properly furnished with this sacrament, and indeed scarcely when they have reached the age of reason, namely about seven years: which age can indeed be anticipated, as is expressly provided in canon 788, "if an infant be placed in danger of death, or if it seem expedient to the minister for just and grave causes"; nevertheless from the accounts received on this matter it is clear that very many children, as being more subject to death, even long before they have reached the age of reason, depart from this life without being anointed with sacred chrism, especially in these our times after the most grievous scourge of war; which is also testified by daily experience regarding not a few adults, who in childhood for various reasons could not be confirmed.

3 This inconvenience is indeed prevented in the Eastern Church, where it is the custom to confirm infants immediately after they have received baptism. This same discipline was indeed in use in the first centuries of the Church even among the Latins, and is still observed by legitimate custom among certain nations: the common law of the Latin Church, however, received in the cited canon 788, provides that the administration of this sacrament be deferred to about the seventh year of age, so that, with suitable catechetical instruction having been given beforehand, children may obtain the more abundant effects of the sacrament.

4 Moreover, the principal reason why so immoderate a number of Christians depart from this life without receiving this sacrament is to be found in this, that to those placed in the crisis of life, opportunity is not afforded them to receive this sacrament on account of the absence of the Bishop. It is established doctrine that the Bishop alone is the ordinary minister of confirmation (can. 782 § 1): and therefore the Apostolic See has constantly and diligently striven that the conferral of this sacrament be reserved to the Bishop, as his own right and office, as far as it could be. This Sacred Congregation has always religiously taken care that the reverence due to this sacrament should not suffer and that the expectation of the pious people should not be offended by the absence of the person of the Bishop, nor that the conspicuous splendor of its administration and the solemn ceremony which is fitting should be diminished. But, necessity and the good of the faithful demanding it, the Apostolic See has not seldom been compelled to permit that a simple priest constituted in some ecclesiastical dignity should suffice for the Bishop, who could not be present in certain circumstances of things and persons, as an extraordinary minister of this sacrament (can. 782 § 2); who would perform its administration with appropriate solemnity, the faithful always being forewarned that the Bishop is the exclusive ordinary minister of this sacrament and that it is being conferred by that priest from the faculty of the Apostolic See; as very many pontifical indults clearly show.

5 In order therefore to provide also for the spiritual condition of so many infants, children, and adult faithful, who are brought into danger of life by grave illness, and certainly face death, without being anointed with sacred chrism, if the observance of common law regarding the ordinary minister be strictly enforced; it seemed necessary to this Sacred Congregation to seek out and provide some remedy on account of this most grave matter, so that to so notable a number of the faithful the opportunity of receiving Confirmation might be offered.

6 Weighing the importance of this matter, His Holiness Pope Pius XII, being desirous of providing more fully for the salvation of souls, with the greatest solicitude which he bears for the universal Church, has deigned to entrust to this Sacred Congregation, according to its power in resolving this question, that it should carefully and earnestly consider the matter in plenary sessions, and propose to Him the resolution which should seem opportune to it.

7 This Sacred Congregation, having first obtained the votes of several consultors, distinguished for learning and prudence, and having moreover subjected all documents and acts previously prepared concerning the discipline of Confirmation to careful examination, submitted the entire matter to diligent examination by the Cardinal Fathers in several plenary meetings.

8 When, however, the opinion that resulted from this had been maturely considered, the same Supreme Pontiff, in an audience granted to the Most Excellent Secretary of this Sacred Congregation on 6 May 1946, commanded this sacred Dicastery to issue a decree which would regulate the discipline concerning the administration of Confirmation in the particular circumstances set forth above in accordance with laws approved by Him with certain knowledge and mature deliberation and benignly declared. Therefore, obedient to this Apostolic mandate, this Sacred Congregation of the Discipline of the Sacraments has decreed that the following provisions, which are enumerated below, should be established:

9 1. - By a general indult of the Apostolic See, the faculty is granted to the following priests, and to them alone, as extraordinary ministers (can. 782 § 2) of conferring the sacrament of Confirmation, in the cases only and under the conditions enumerated below:

10 a) to pastors enjoying their own territory, thus excluding personal or family pastors, unless they themselves also enjoy their own, albeit cumulative, territory;

11 b) to vicars, of whom mention is made in canon 471, and to vicars economic; c) to priests to whom the full care of souls in a certain territory and with a determined church has been committed exclusively and stably, with all the rights and duties of pastors.

12 2. - The aforesaid ministers are able to confer Confirmation validly and licitly through themselves personally, to the faithful only dwelling in their own territory, with no persons excepted who are dwelling in places withdrawn from parochial jurisdiction; thus not excluding seminaries, hospices, hospitals, and other institutions of every kind, even religious ones, exempted in any manner whatsoever (cfr. can. 792); provided that these faithful are placed in grave illness or true danger of death, from which death is foreseen. If these same ministers transgress the limits of such a mandate, let them know well that they act improperly and effect no sacrament, the statute of canon 2365 remaining moreover intact.

13 3. - They are able to use this faculty both in the episcopal city itself and outside it, whether the see be full or vacant, provided that the diocesan Bishop cannot be had or is legitimately impeded from being able to confer Confirmation through himself, and no other Bishop is at hand in communion with the Apostolic See, even if only a titular one, who could suffice to him without grave inconvenience. 4. - Confirmation shall be conferred with the discipline introduced by the Code of Canon Law and adapted to the matter, and with the rite taken from the Roman Ritual, which are transcribed fully and entirely below: it is to be conferred, however, gratuitously under any title whatsoever.

14 5. - If those to be confirmed have attained the use of reason, besides the state of grace, some disposition and instruction is required so that they may fruitfully receive this sacrament. It is therefore the duty of the minister to teach each of the sick according to their capacity concerning those things which are necessary to know, arousing in them some intention of receiving this sacrament for the strengthening of the soul. Care must be taken by those to whom it pertains that if they subsequently recover, they be diligently instructed by suitable instruction concerning the mysteries of the faith, the nature and effect of this sacrament. (Cfr. can. 786). 6. - According to the norm of can. 798, the extraordinary minister shall make a note of the sacrament conferred in the parochial book of those confirmed, writing therein his own name and the names of the confirmed person (and if he be not his subject, also of his diocese and parish), the parents and godparent, the day and place, finally adding the words: "confirmation was conferred by Apostolic indult, with death impending on account of grave illness of the confirmed person". A note shall also be made in the book of the baptized according to the norm of can. 470 § 2. If the confirmed person be of another parish, the minister himself shall as soon as possible inform the proper pastor of the confirmed person of the sacrament conferred by an authentic document, which shall contain all the information mentioned above.

15 5. - If those to be confirmed have attained the use of reason, besides the state of grace, some disposition and instruction are required so that they may fruitfully receive this sacrament. It is therefore the duty of the minister to teach each sick person according to his capacity concerning those things which are necessary to know, arousing in him some intention of receiving this sacrament for the strengthening of his soul. Care must be taken by those to whom it pertains that if they subsequently recover, they be diligently instructed by suitable teachings concerning the mysteries of the faith, the nature and effect of this sacrament. (Cfr. can. 786). 6. - According to the norm of can. 798, let the extraordinary minister make a record of the sacrament conferred in the parochial book of the confirmed, writing therein his own name and the name of the confirmed person (and if he be not his subject, also that of his diocese and parish), the names of the parents and godparent, the day and place, finally adding the words: "confirmation was conferred by Apostolic indult, the danger of death being urgent on account of grave illness of the confirmed person." A record must also be made in the book of the baptized according to the norm of can. 470 § 2. If the confirmed person be of another parish, let the minister himself as soon as possible inform the proper pastor of the confirmed person of the sacrament conferred by means of an authentic document, which shall contain all the particulars mentioned above.

16 8. - It is the duty of the local Ordinary to instruct the extraordinary ministers mentioned above in the prescriptions of this decree in the better manner which he shall judge, and to explain them to them individually so that they may be found altogether equal to the performance of so grave a matter.

17 8. - It is the duty of the Ordinary of the place to instruct the extraordinary ministers mentioned above according to the manner which he shall judge better, in accordance with the prescriptions of this decree, and to explain to them individually so that they may be found altogether equal to the performance of so grave a matter.

18 9. - It is the duty of the Ordinary of the place to send to this Holy Congregation each year, at the beginning of the following year, a report on the number of those confirmed, as well as on the method employed by the extraordinary ministers of his jurisdiction in performing so excellent a duty. Our Most Holy Lord Pius, by Divine Providence Pope XII, in an Audience granted to the Excellent Secretary of this Sacred Congregation on 20 August 1946, deigned to approve the decree mentioned above and to invest it with Apostolic Authority, notwithstanding any contrary provisions, even those worthy of special mention; and he commanded that the same decree, to be published in the official commentary of the Acta 1

19 Apostolicae Sedis, shall have the force of law beginning on 1 January 1947.

20 Given at Rome, from the offices of the Sacred Congregation for the Discipline of the Sacraments, on 14 September in the year 1946.

SACRA CONGREGATIO DE DISCIPLINA SACRAMENTORUM DECRETUM DB CONFIRMATIONE ADMINISTRANDA IIS, QUI EX GRAVI MORBO IN MORTIS PE- RICULO SUNT CONSTITUTI.

1 Spiritus Sancti munera sacramento Confirmationis conferri catholica doctrina proclamat.

10 1. - Ex generali Apostolicae Sedis indulto, tamquam ministris extraordinariis (can, 782 § 2) facultas tribuitur conferendi sacramentum Confirmationis, in casibus tantum et sub conditionibus infra enumeratis, sequentibus presbyteris, iisdemque dumtaxat :

11 a) parochis proprio territorio gaudentibus, exclusis igitur parochis personalibus vel familiaribus, nisi et ipsi proprio, licet cumulativo, fruantur territorio;

13 2. - Praefati ministri Confirmationem valide et licite conferre valent per se ipsi, personaliter, fidelibus tantummodo in proprio territorio degentibus, personis non exceptis in locis commorantibus a paroeciali iuris dictione subductis ; non exclusis igitur seminariis, hospitiis, valetudinariis, aliisque omne genus institutis etiam religiosis quoquo modo exemptis (cfr. can. 792) ; dummodo hi fideles ex gravi morbo m vero mortis periculo sint constituti j ex quo decessum praevideantur. Si huiusmodi mandati limites iidem ministri praetergrediantur, probe sciant se perperam agere et sacramentum nullum conficere, incolumi praeterea manente statuto canonis 2365.

(Cfr. can. 786). 6. - Ad normam can.

16 7. - Ministri extraordinarii tenentur praeterea singulis vicibus statim ad Ordinarium dioecesanum proprium authenticum nuntium mittere collatae a se Confirmationis, additis adiunctis omnibus in casu concurrentibus.

17 8. - Ordinarii loci est ministros extraordinarios, de quibus supra, huius decreti praescriptiones meliore, quem censuerit, modo edocere, iisdemque singillatim explanare ut pares omnino inveniantur tam gravi negotio obeundo.

18 9. - Eiusdem Ordinarii loci officium est quolibet anno, sub initio anni proxime insequentis, relationem mittere ad hanc S. Congregationem de numero confirmatorum, necnon de ratione a ministris extraordinariis suae dicionis in tam praeclaro munere perfungendo adhibita. Ssmus Dominus Noster Pius divina Providentia Pp.

11 a) ai parroci che godono di proprio territorio, esclusi quindi i parroci personali o familiari, a meno che non godano anch'essi di proprio, sebbene cumulativo, territorio;

(Cfr. can. 786). 6.

21 D. Card. JORIO, Prefetto.
