Bull on the excommunication of King Philip IV of France

Bull of Pope Boniface VIII ·

of the same declares: — And he invalidates all confederations entered into with him — 9. He says he will publish this process.

Boniface, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 Sitting upon the throne of Peter, the exalted seat, by divine disposition, we exercise the office of Him to whom it is said by the Father: Thou art my son, this day have I begotten thee: Ask of me, and I will give thee the gentiles for thy inheritance, and the uttermost parts of the earth for thy possession: Thou shalt rule them with an iron rod, and shalt break them in pieces like a potter's vessel. By which we are admonished that kings may understand discipline and learn wisdom, being instructed in judging the earth, that they may serve the Lord with fear, and rejoice unto him with trembling; lest if he be angry at any time, they perish, when his wrath is kindled. And therefore we judge the great as the small, because we are his vicars, before whom the acceptance of persons is found unworthy. This the truth of the Old and New Testament holds; this the authority of venerable councils proves; this the opinion of holy Fathers maintains; this even natural reason manifests. But, although the See of Peter is endowed with such great power and possesses such dignity, yet, as a pious father, tempering severity with gentleness, and softening the rigour with equity, we do not assume the iron rod of direction to break, although we could justly do so, but to direct into the way of salvation, and we embrace the rod of correction. There is nothing new in this; just as we have not caused grain to be beaten from the ears, namely, we perform the work of one judging simply. Nay, rather, using the office of those who make denunciation, we impose no penalties upon Philip, king of the French; but to him, already notoriously excommunicated on account of his excesses, we rather make known those inflicted by law.1

2 § 1. A good physician, therefore, if certain remedies are harmful to diseases, turns himself to others by grace, not immediately subjecting him to harsher ones, but administering milder ones, unless the acuteness of the diseases should require otherwise: thus we first examined the wounds of sin of the same afflicted king, we soothed them with lenient remedies, and we cherished him with paternal compassion: nay, such lenient measures became a seedbed of contumacy and hatreds; they raised him up in pride, and persistently provoked him to contempt. Whence we turn to other remedies, not grave however, so that we may at least try whether, being touched gently, not broken, he may correct himself (as Nebuchadnezzar, the most renowned king of the earth before others), which we desire, lest, being obstinate, he see him into whom he has pierced; and we are compelled to cut off with the sword the wounds which do not feel the medicine of fomentation; let him do penance; or (which God forbid) being plunged into the depths of evils, let him become filthy with filthiness all the more, and like Pharao let him be hardened.

3 § 2. Indeed, formerly, when the same king sinned gravely in various matters against the clergy and the Gallican Church, first through a communication sent to us by the king's messengers against Rome itself concerning such salutary warnings, we incurred [censure]; then we sent to him our beloved son James of Normandy, our notary, bearing our letters to him, which contained chapters exceeding [the matter], although he treated [them] imprudently, with an unfeeling mind and irreverently (not considering that according to evangelical truth, he who despises the one sent despises the one who sent him; therefore he is worthy of the sentence which Pope Constantine once pronounced against Justin, the son of the Emperor Justinian, for a similar cause): those who were nearby know this clearly, and the same became evident from afar; nor considering that it was anciently sanctioned by the holy Fathers and promulgated in the canons (2), that if anyone presume to despoil those seeking Rome of the things they carry, let him be deprived of Christian communion: and that those who approach the presence of the Roman Pontiff ought to be secure under apostolic protection with their possessions; and making light of the sentence of excommunication, which, following in the footsteps of the Roman Pontiffs, and especially of Pope Nicholas, our predecessors, who, supported by the authority of the aforesaid canons, have proceeded to excommunication against those doing such things, added by the same Nicholas to the proceedings themselves, even if those committing these things shine with imperial or royal dignity. We also, with the same privilege excluded, against all even if the aforesaid things shine with dignity, who, coming to or departing from the Apostolic See, seize, despoil, or presume to detain, or exhibit any impediment, lest they come freely to the same See with their own goods and things and depart from it, on the day of Coena Domini recently past, declaring in such manner: also those who through themselves or through their officials or ministers, or in the territory of their empire, kingdoms, or lands, or to those passing through them, from wherever they come, coming to the See or departing from the same, limit the provision of horses; or subtract what they carry or bring back for their conveniences or expenses, or any other things and goods; or open letters, or take away, or reduce the number of persons or conveyances, or in any other way directly or indirectly presume to offer impediment or obstacle to such coming or departing, are obstructers of those coming to and departing from the said See, and incur the aforesaid sentence of excommunication. To such a degree in our times, as it had done before, notoriously the bishops of his kingdom [are] in transgressors with gravest internal Roman penalties, and with blasphemies hurled against us [are] appointed to strict custody, despoiling contrary to the said sentence of ours not only natives, but also those coming to the same See through his kingdom from elsewhere of their things, or unjustly reduced, indeed but altogether subtracted, and letters which they carry opened by the guards of the passes, or retained so that no one can freely approach the aforesaid See: nor could the prelates of France be summoned to our presence by us, so that we might deliberate with them on the aforesaid matters, as is evident from their letters on this matter, which we cause to be preserved in the archive of the Roman Church. Thus also the bishops of Noyon, Constance, and Bourges, their nuncios, with the same king hindering, could not come3; for which reason, even if any prince had been the one who prohibited this, the canon deems him to be deprived of communion. For who will say he can freely proceed to the aforesaid See, who is thus treated, and that he be retained, or that the kingdom permit him to depart, depends on the power of another? Certainly no one who understands soundly, and who knows the force of written law in this matter, has any truth [in denying this].

§ 3. But wishing according to the teaching of the sacred

4 canons to preserve the bond of peace, to bear it with equity and firmness, nor were we thus moved. Rather, weighing evangelical matters, we strove to bring back the erring sheep, so dear and so beloved by us, as if on our own shoulders lest it perish to the fold, to place it in the abundance of pastures, and to cherish it with the sweetness of food. For thinking according to the parable of the Gospel, that he who had despised our notary would at least fear our son, to bring him back, we took care to send our son John, and the holy Marcellus and Peter, a presbyter cardinal from his kingdom, who, as his friend, was zealous for his salvation, offering among other things on our behalf to him absolution from the sentences of excommunication by which he was notably ensnared.

§ 4. Yet such a thought has not seized us in vain, for if he conducted himself towards the aforesaid notable persons, as is premised, he has restrained our son more ignominiously, because as the cardinal himself reported to us, he scorned the offered absolution, and by the custodies assigned to him, so that he could not go freely where he wished, nor receive those who came to him from his kingdom, not to return without permission, and thus in some manner, to use the cardinal's own word, he produced and uttered him as subjected to royal banishment. And moreover beyond the parable, he did not leave us, the Father of the family, untouched, but lacerated the King with blasphemies and injuries, forgetting what is read: Honour thy father and thy mother, that thou mayest be long-lived upon the earth, and that to a son the honest and holy complaint of the Father should always seem fitting, and thus he should not become his chastiser: having made confederations and alliances with certain prelates and other persons of his kingdom, he broke the bond of peace, which we strove with all our affections to keep safe, disturbed ecclesiastical unity, and did not fear to rend the seamless tunic of the Lord, and to adhere to his frivolous appeal against us.

6 Therefore he ought to fear the sentences of the Canons.

7 He then perpetrated worse deeds against the Colonna family publicly.

8 wrongly compelled and compels the unwilling, and perniciously leads them to ruin with him. Surely let the parable-maker fear lest the vineyard be let out to other husbandmen, who shall render fruit in their seasons. Let him fear the censure of the canons, which is known to be prepared against such men, and lest from such strict custody of the aforesaid cardinal he incur the canon (excommunication) of latae sententiae (which passes to those by interpretation who detain clerics without injury in public or private custody; since they differ not much from the form of words by which, as they wish, the faculty of departing is not given), let him diligently attend.

§ 5. To this, that we omit the matter of our beloved son the abbot of the Cistercian order detained, and many other religious men especially Italians, because the king's command pressed, departing the kingdom, captured by his connivance, and for some time kept in the castelletto, because they were unwilling to adhere to the aforesaid appeal, and concerning what was recently done against the person of our venerable brother B., bishop of Apamea, and Nicholas of Bonfractu, chaplain of the aforesaid cardinal, carrying our letters to him, by which we commanded the king excommunicated by the same cardinal to be publicly announced, he caused to be seized, and the same cardinal, when he repeated the request from prison, was unwilling to release him, as the same cardinal made known to us by his own letters; whence it is said he has the same effect, since the king himself provided the impediment, as if he had ordered the aforesaid renunciation to be proclaimed.

9 § 6. Moreover, Stephen of Columna, our enemy and the enemy of the Church, he openly received in his kingdom, not fearing the sentence of excommunication, which after the flight of the Colonnas from Tivoli we promulgated publicly to all, no privileges notwithstanding, even if they shine forth with imperial or royal dignity, who should receive the said Stephen, or the other former sons of John of Columna, and James brother of the said John, Richard and Peter of Monte Nigro of the said John from excommunication by canon, or conduct them, or cause them to be received or conducted, or to them or to any of them publicly or secretly exhibit aid, favour or counsel, and that against the helpers, supporters and receivers of the aforesaid James and daughters of the said John we have long since commanded by our letters to proceed, as against heretics, receivers, supporters, and helpers of them. In no way does the king of the French serve God in fear, or exult in Him with trembling, lest He be angered against him through His vicar; namely he offends so much more gravely, as he sins more perniciously, transmitting to others examples of his own perdition.

10 § 7. Alas, evil counsels stain him, and the Sirens, nor do they cease sweetly to beguile him to his ruin, dangerously agitate the royal mind, and deceive him without ceasing: for we cannot and ought not to free him on account of these things. For the suggestion of the devil's sin did not first excuse man, inasmuch as he became a transgressor of the divine commandment and incurred the penalty of death, and our silence would be nothing other than an occasion for sinning and a dissolution of all ecclesiastical discipline; since it is notorious from the continuous fact that, he himself acting and coming against our said sentence, there is no freedom through his kingdom of coming to the Apostolic See, and that if the said Nicholas has been captured, and the aforesaid Stephen is received in the kingdom, and our aforesaid sentences pronounced and confirmed are and have been publicly preached, so that the excommunication of the canons is clearly evident from the foregoing (to say nothing for the present of the custody already imposed on the said cardinal, the detention of the abbot, the capture of the said religious and the rash actions committed against the aforesaid), the same king himself is bound by manifest excommunications, and consequently ecclesiastical benefices, personates, and dignities, if any of them pertain to him by some legitimate title, and from which he has received them, he is an invader of the same benefices; and all confederations entered into with him we declare to be null by right, in the meantime he cannot confer, empire or jurisdiction either by himself or through others, or perform common or legitimate acts, and the conferral and exercise itself of no dignity; and his vassals are absolved from fidelity, even from the oaths by which they are bound to him, and from such debt of entire obedience, by the authority of the canons; this we declare especially to all those who are of his kingdom, or remain in it, announcing that they accompany him who is excommunicated with these penalties: and like a skilled physician, when admonitions have not availed, beginning from lighter measures, and holding to the statutes of our holy Fathers, we absolve by apostolic authority all the faithful and his vassals, and those sworn to him, from fidelity and oaths, so long as the same king remains in excommunication, and lest they observe or keep fidelity to him in any way whatsoever, under the threat of anathema (because it is fitting to serve God rather than men, and fidelity to a Christian prince opposing God and trampling upon his precepts is bound by no authority to be rendered), we prohibit.

11 § 8. And lest the king himself should find some who, setting aside the fear of God, would receive such benefices from him, we strictly command, under the penalty of excommunication, loss of benefices which they otherwise would have, and perpetual incapacity to obtain ecclesiastical benefices hereafter, which they incur by the very fact if they act otherwise, that they do not receive them in any way from him thus remaining excommunicate; strictly, under such penalties to be inflicted by us, we inhibit the chapters of churches in which benefices themselves are conferred by the king during the excommunication, lest they receive or admit those to whom they are granted by him. Moreover, since it is written: Loose the bonds of wickedness, undo the bundles that oppress, we dissolve the aforesaid confederations, even with whatsoever kings or princes of the earth, which we do not believe have been entered into, and annul the oaths, if any have been taken: and also announcing to the king himself, that he flee from before the bow; let him repent, return to obedience, and turn to the Lord, lest, what we shall not be able to pass over, we be compelled to visit upon him with just judgment.

12 § 9. But in order that this our process, which we make by the counsel of our brethren, may be brought to the knowledge of all, we shall cause the charters or parchments containing the same process to be affixed in the cathedral church of Anagni, or on the doors, or upon the thresholds, which shall publish our process by its own sonorous proclamation and open declaration, so that the same king and others, whom the process itself concerns, can offer no excuse that such process did not reach them, or that they were ignorant of it, since it is not likely to remain unknown or hidden to them, what is now so openly published to all.

13 Done at Anagni in the hall of our palace on the sixth day before the Ides of September, in the ninth year of our pontificate 4.
