Decree separating the Archdiocese of Washington from Baltimore
BALTIMORE IS SEPARATED AND IMMEDIATELY SUBJECTED TO THE APOSTOLIC SEE, AND THE LIMITS OF THEIR TERRITORY ARE MEANWHILE EXTENDED. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER
1 The governance of the universal flock of the Lord, divinely committed to the Roman Pontiffs, requires that ecclesiastical circumscriptions be constituted otherwise, whenever the good of souls appears to demand it. Hence We, through Apostolic Letters under lead, given by the Supreme ecclesiastical power on the twentieth day of July in the year one thousand nine hundred thirty-nine, dismembered from the territory of the metropolitan Church of Baltimore the territory contained within the boundaries of the District of Columbia, and from it a new archdiocese was erected from the city of Washington, which is the civil capital of the United States of North America, called the Archdiocese of Washington, and equally principally united to the aforesaid Church of Baltimore. But for the greater increase of the Catholic cause and for the adornment of the city of Washington itself, it now appears to contribute greatly if the Sacred Prelate should have a permanent residence there and the Archdiocese of Washington should exercise such care. Considering these matters with attentive mind, We have deemed it opportune to separate the Archdioceses of Baltimore and Washington, now vacant, and to alter their territory somewhat. Wherefore, having obtained the favorable vote of Our venerable Brother Hamlet John Cicognani, Archbishop with the title of Laodicea in Phrygia and Apostolic Delegate in the United States of North America, by the counsel of Our venerable Brothers the Cardinals of the Holy Roman Church placed in charge of Consistorial Affairs, and having supplied, insofar as it is necessary, the consent of those to whom it pertains, or of those who presume it to pertain to them, with certain knowledge and all things maturely weighed, from the fullness of Our Apostolic power, We perpetually separate and sever the Archdiocese of Washington from the metropolitan Church of Baltimore. But since the Archdiocese of Washington is at present confined within narrow limits and the number of the Christian faithful in it is less frequent, We dismember from the territory of the metropolitan Church of Baltimore five civil districts commonly called Montgomery, Prince Georges, Charles, Calvert and St. Mary's and annex them to that Archdiocese of Washington. We further decree that the Archbishop for the time being of Washington shall be immediately subject to Us and the Apostolic See; nevertheless he shall participate in the episcopal assembly of the ecclesiastical Province of Baltimore. To him moreover We grant that he may be decorated with the Sacred Pallium, provided however that he shall have duly petitioned for it in the Consistory and obtained it. We further decree that the name and office, hitherto held by the Archbishop of Baltimore, of Chancellor of the Catholic University of Washington shall henceforth be held by the Archbishop of Washington. But since the circumstances of the present time do not permit that a Chapter of Canons of the Cathedral be constituted there now, We grant that in the meantime Diocesan Consultors be chosen and employed according to the rule of law. But as to what pertains particularly to the clergy, We decree that as soon as these Letters of Ours shall be carried into execution, by that very fact the clergy inscribed shall be considered as belonging to that Church in whose territory they legitimately reside. We further command that all documents and acts which pertain to the Archdiocese of Washington be delivered as soon as possible from the chancery of the metropolitan Church of Baltimore to the curia of the Archdiocese of Washington, so that they may be carefully preserved in its archive. To carry out all these things as above disposed and constituted, We appoint the venerable Brother Hamlet John Cicognani whom We mentioned above and grant to him the faculties necessary and opportune for this purpose, even to subdelegate, for the effect in question, any man constituted in ecclesiastical dignity, and We impose upon him the duty of transmitting to the Sacred Consistorial Congregation, as soon as it shall be possible, an authentic copy of the acts of the execution performed. But these present Letters shall be firm, valid and effective and shall produce and obtain their full and complete effects, and ought to be inviolably observed by all to whom it pertains; and if it should happen that anyone, by whatever authority, knowingly or unknowingly, should attempt anything contrary to these things, We will and declare that to be null and void entirely, notwithstanding any contrary provisions whatsoever, even those worthy of special mention, which We derogate. To transcripts or excerpts of these Letters, even printed ones, subscribed however by the hand of some public notary and furnished with the seal of a man constituted in ecclesiastical dignity, the same faith shall be given entirely as would be given to these presents if they were exhibited or shown. Let no one infringe upon this page of dismemberment, separation, constitution, subjection, statute, mandate, decree, delegation, derogation and Our will, or act contrary to it. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul.
