MOTU PROPRIO DEI PROVIDENTIS DI SUA SANTITÀ BENEDETTO XV

1 Per arcano disegno della Divina Provvidenza posti sulla cattedra del beato Pietro, Principe degli Apostoli, che il Signore Gesù designò sulla terra quale sommo ed eterno Pastore delle anime redente con il suo sangue, Noi Ci adoperiamo ad esercitare con il dovuto scrupolo il Nostro ufficio apostolico rivolgendo tutta la Nostra attenzione e la Nostra cura allo scopo non solo di conservare, ma di accrescere altresì tutte e le singole Chiese delle quali, compatto e unitario, è formato « l’unico corpo mistico di Cristo », cioè la Chiesa cattolica. Ma se abbracciamo nel Nostro paterno affetto tutte le particolari Chiese, Ci sono specialmente care quelle orientali, le quali, con le più antiche memorie della loro storia, offrono così luminosi esempi di santità e di dottrina che anche oggi, dopo tanto tempo, Ci appaiono riverberare il loro splendore su tutto il rimanente mondo cristiano.

2 E davvero non possiamo considerare senza dolore in che stato di miseria e debolezza siano cadute, così fiorenti e prestigiose quali esse erano, dopo che una serie ininterrotta di eventi deprecabili ebbe sottratto la maggior parte dei cristiani orientali all’abbraccio della Madre Chiesa.

3 Possano un giorno, per grazia divina, i Nostri diletti figli orientali tornare in possesso della loro primitiva prosperità e della loro gloria! Frattanto Noi, consci del ruolo che Ci compete, porremo il massimo impegno nel contribuire, per quanto è in Nostro potere, a risollevare le sorti della tribolata Chiesa d’Oriente.

4 A questo scopo abbiamo deliberato di istituire, a favore dei cosiddetti Orientali uniti, un’apposita Sacra Congregazione presieduta personalmente da Noi stessi, e dopo di Noi dai Nostri successori. Quella infatti che è esistita finora, decretata « per gli affari di rito orientale » dal Nostro predecessore Pio IX di felice memoria, fu collegata alla Sacra Congregazione di Propaganda Fide e, dal momento che poteva essere vista quasi come una sorta di appendice di questa, sappiamo che alcuni, prevenuti nei confronti della Sede Apostolica, ne traevano motivo per accusare i Pontefici Romani di scarsa considerazione verso i Cattolici Orientali, e della volontà di subordinarli ai Latini. E sebbene chiunque giudichi con obiettività sia in grado di vedere l’infondatezza di simile accusa, vogliamo tuttavia che la sollecitudine di questa Sede Apostolica nei confronti degli Orientali appaia con tale evidenza che a nessuno sia lecito metterla in dubbio. E quando i Nostri Orientali vedranno lo stesso Sommo Pontefice prendersi cura personalmente dei loro interessi, certamente comprenderanno come non vi possa essere modo migliore per la Santa Sede di testimoniare loro il proprio amore. Si può sperare inoltre che non vi sarà più chi rinfocolerà tra gli Orientali il sospetto nei confronti dei Latini, dato che anche questa iniziativa dimostrerà manifestamente come nella Chiesa di Gesù Cristo — la quale non è né latina, né greca, né slava, ma cattolica — non esiste alcuna discriminazione tra i suoi figli e che tutti, latini, greci, slavi e di altre nazionalità hanno tutti la medesima importanza di fronte a questa Sede Apostolica.

5 Per questo, nella pienezza della Nostra autorità apostolica, con motu proprio stabiliamo e decretiamo:

1 Dei providentis arcano consilio locum obtinentes beati Petri Apostolorum Principis, quem Dominus Iesus animarum, suo redemptarum sanguine, Pastorem in terris summum perpetuumque constituit, omnem Nos adhibere vigilantiam et curam ut universae ac singulae non modo conserventur sed accrescant ecclesiae, ex quibus compactum et coagmentatum constat unum corpus Christi mysticum, seu Ecclesia Catholica, equidem pro apostolici officii conscientia studemus. Cum autem omnes particulares ecclesias paterna caritate complectimur, tum praesertim orientales, quippe quae in vetustiore suorum temporum memoria lumina offerant sanctitatis doctrinaeque tam clara, ut eorum splendore etiam nunc, tanto intervallo, reliquas christianorum regiones collustrari videamus. Iam vero contemplari sine maerore non possumus, quemadmodum- ex florentissimis amplissimasque tam tenues ac miserae sint effectae, postquam scilicet lamentabilium series continuatioque causarum maximum orientalium numerum ab Ecclesiae Matris complexu distraxit.

2 Utinam dilectis ex Oriente filiis, divino munere, contingat in possessionem pristinae prosperitatis et gloriae aliquando restitui: Nos interea, Nostrarum partium memores, dabimus diligenter operam ut ecclesiarum orientalium afilictas res, quantum est in Nobis, relevemus. Itaque deliberatum Nobis est pro unitis, qui dicuntur, orientalibus propriam Sacram Congregationem instituere, cuius Nosmet ipsi geramus, Nostrique deinceps successores, praefecturam. Quae enim pro negotiis ritus orientalis usque adhuc fuit, Pii IX, f .r. decessoris Nostri auctoritate iussuque condita, cum S. Congregationi de Propaganda Fide adiuncta esset, ut huius quasi quaedam accessio posset videri, non ignoramus aliquos fuisse non bene erga Apostolicam Sedem animatos, a cpiibus Romani Pontifices inde arguerentur catholicos Orientales parvi pendere, eosque Latinis velle subiectos. Huiusmodi criminationes etsi quisquis res ex veritate aestimat, videt inanes esse, volumus tamen de huius Apostolicae Sedis in Orientales benevolentia constare ita ut dubitare iam liceat nemini. Et nostri quidem Orientales, cum videant Pontificem. Maximum suis utilitatibus ipsum prospicere, intelligent profecto non posse Apostolicam Sedem se eis amantiorem ostendere. E ceteris autem libet confidere iam non fore qui Latinos in suspicionem Orientalibus adducant, cum vel ex hac re sit manifestum, in Ecclesia Iesu Christi, ut quae non latina sit, non graeca, non slavonica, sed catholica, nullum inter eius filios intercedere discrimen, eosque, sive latinos, sive graecos, sive slavos, sive aliarum nationum, omnes apud hanc Apostolicam Sedem eumdem locum obtinere.

3 Quare de apostolicae potestatis plenitudine haec Motu proprio statuimus et sancimus :

4 I. Sacra Congregatio de Propaganda Fide pro negotiis ritus orientalis die XXX mensis novembris huius anni esse desinat.

5 II. Seorsum a S. Congregatione de Propaganda Fide, S. Congregatio pro Ecclesia Orientali sit a die i mensis insequentis: cui quidem praeerit ipse Summus Pontifex. Ea compietetur aliquot S. R. E. Cardinales, ex quibus unus Secretarius erit: adiunctus habebit e spectatissimis de Clero viris unum Assessorem et plures tum ex latino tum ex orientali ritu Consultores; praeterea idoneum officialium- numerum ex clericis qui rerum orientalium peritiores sint.

6 III. Huic Congregationi reserventur omnia cuiusvis generis negotia quae sive ad personas, sive ad disciplinam, sive ad ritus Ecclesiarum orientalium referuntur, etiamsi sint mixta, quae scilicet sive rei sive personarum ratione latinos quoque attingant.

7 IV. Pro Ecclesiis ritus orientalis haec Congregatio omnibus facultatibus potiatur, quas aliae Congregationes pro Ecclesiis ritus latini obtinent, salvo tamen iure Congregationis S. Officii.

8 V. Eadem Congregatio controversias dirimat via disciplinari; quas vero ordine iudiciario dirimendas iudicaverit, ad tribunal remittet quod ipsa Congregatio designaverit. Quae omnia rata et firma esse volumus in perpetuum, contrariis quibuslibet, etiam specialissima mentione dignis, non obstantibus.

ON THE SACRED CONGREGATION FOR THE ORIENTAL CHURCH.

1 Holding by the mysterious counsel of God's providence the place of the blessed Apostle Peter, Prince of the Apostles, whom the Lord Jesus constituted as the supreme and perpetual Shepherd on earth of souls redeemed by His blood, We indeed apply all vigilance and care, according to the conscience of Our apostolic office, that all and each of the churches not only be preserved but also increase, from which the one mystical body of Christ, namely the Catholic Church, is compacted and joined together. And while We embrace all particular churches with paternal charity, We do so especially the Oriental churches, which in the more ancient memory of their times offer lights of holiness and doctrine so clear that by their splendor even now, at such a distance, we see the other Christian regions illuminated. Yet We cannot contemplate without sorrow how from flourishing and most ample they have become so thin and wretched, after a lamentable series and continuation of causes drew away the greatest number of Orientals from the embrace of their Mother Church.

2 Would that it might befall Our beloved sons from the East, by divine gift, to be restored at some time to the possession of their former prosperity and glory: We meanwhile, mindful of Our duty, shall diligently strive to relieve, as far as in Us lies, the afflicted condition of the Oriental churches. Accordingly, We have determined to establish for the united, so-called, Orientals a proper Sacred Congregation, whose prefect We Ourselves shall be, and Our successors hereafter. For that which has existed until now for the affairs of the Oriental rite, established by the authority and command of Pius IX, Our predecessor of blessed memory, when it was joined to the Sacred Congregation of Propaganda Fide, so that it could be seen as a kind of accessory to it, We are not unaware that there have been some not well disposed toward the Apostolic See, by whom Roman Pontiffs have been charged with holding Catholic Orientals in little regard and wishing to subject them to Latins. Although anyone who judges these matters by truth sees that such accusations are empty, We nevertheless wish to make clear the benevolence of this Apostolic See toward the Orientals in such a way that no one may now doubt it. And indeed Our Orientals, when they see the Supreme Pontiff himself providing for their interests, will surely understand that the Apostolic See cannot show itself more loving toward them. And from others We are pleased to trust that there will now be none who bring Latins into suspicion with Orientals, since from this very matter it is manifest that in the Church of Jesus Christ, which is not Latin, not Greek, not Slavonic, but Catholic, no distinction intercedes among its children, and that they, whether Latins, or Greeks, or Slavs, or of other nations, all hold the same place before this Apostolic See.

3 Wherefore from the fullness of apostolic power We by this Motu Proprio establish and ordain:

4 I. The Sacred Congregation of Propaganda Fide for the affairs of the Oriental rite shall cease to exist on the 30th day of the month of November of this year.

5 II. Separate from the Sacred Congregation of Propaganda Fide, the Sacred Congregation for the Oriental Church shall exist from the 1st day of the following month: which shall be presided over by the Supreme Pontiff himself. It shall be completed by several Cardinals of the Holy Roman Church, of whom one shall be Secretary: it shall have attached to it one Assessor from the most distinguished men of the Clergy and several Consultors both from the Latin and from the Oriental rite; moreover, a suitable number of officials from clerics who are more expert in Oriental affairs.

6 III. To this Congregation shall be reserved all business of whatever kind which pertains either to persons, or to discipline, or to the rites of the Oriental Churches, even if they be mixed, that is, which by reason either of the matter or of the persons also touch Latins.

7 IV. For the Churches of the Oriental rite this Congregation shall possess all the faculties which the other Congregations possess for the Churches of the Latin rite, saving however the right of the Congregation of the Holy Office.

8 V. The same Congregation shall settle controversies by the disciplinary way; but those which it shall judge must be settled by judicial order, it shall refer to the tribunal which the Congregation itself shall designate. We will that all these things be ratified and firm in perpetuity, any contrary provisions whatsoever, even those worthy of most special mention, notwithstanding.
