DELLA SMEMBRAZIONE DELLA DIOCESI DI BOTUCATU E DELL'EREZIONE DELLA DIOCESI DI CAFAELANDENSE PIO VESCOVO SERVO DEI SERVI DI DIO A PERPETUA MEMORIA DELLA COSA

1 Tale è attualmente la condizione della diocesi di Botucatu che, a causa del numero di fedeli che cresce ogni giorno, in confini così vasti, la cura e l'ispezione di un solo Vescovo non sono sufficienti a provvedere a così numerose e grandi necessità dei fedeli. Per questo il venerabile fratello Carlo Duarte Costa, attuale Vescovo di quella diocesi, con il consiglio del venerabile fratello anche Leopoldo Duarte Silva, Arcivescovo della Chiesa metropolitana di San Paolo in Brasile, umilmente ha proposto e ha chiesto che la diocesi fosse divisa, e che un'altra nuova diocesi fosse eretta presso la città di Cafaelandense.

2 Ora Noi, di concerto con gli Eminentissimi Padri della Sacra Congregazione Concistoriale, avuto anche il voto favorevole della Nunziatura Apostolica presso la Repubblica Brasiliana;

3 supplito, per quanto sia necessario, il consenso di coloro che vi hanno interesse, o che presumono di avere interesse, e tenendo presenti le cose che nelle Lettere Apostoliche munite di piombo Ad universas orbis Ecclesias del ventisettesimo giorno del mese di aprile dell'anno del Signore milleottocentonovantadue furono riservate alla Santa Sede in questa materia: dalla pienezza della potestà apostolica, Noi dal territorio della predetta diocesi di Botucatu separiamo una parte, e tra i suoi confini erigiamo una nuova diocesi da chiamarsi Cafaelandense.

4 I cui confini saranno gli stessi confini delle parrocchie, che a essa, come di seguito, assegniamo e attribuiamo. Queste parrocchie sono: Cafelandia, Araçatuba, Avahy, BataTha, Biriguy, Calmon, Glyeerio, Iaeanga, Lins, Pennapolis, Pirajuhy, Presidente Alves, Promissae, Soturna. La sede e la cattedra della nuova diocesi abbiamo stabilito nella città di Cafelandia, e contemporaneamente erigiamo da costruirsi una chiesa cattedrale da chiamarsi di Santa Elisabetta d'Ungheria, e concediamo, finché essa sia costruita, che nel frattempo sia adoperata come cattedrale la chiesa ivi dedicata alla Beata Vergine Maria del Monte Carmelo e a Santa Elisabetta d'Ungheria. Alla Chiesa cattedrale così novellamente eretta e ai suoi Vescovi pro tempore attribuiamo gli onori, gli insegni, i favori, i diritti e i privilegi, di cui le altre chiese cattedrali e i loro Presuli in America Latina per diritto comune, o per legittima consuetudine godono e fruiscono. La costituiamo suffraganea della Chiesa metropolitana di San Paolo in Brasile, e i suoi Vescovi pro tempore sottoponiamo al diritto metropolitico dello stesso Arcivescovo di San Paolo, riservata tuttavia a Noi e alla Sede Apostolica la facoltà di liberamente decretare una nuova smembrazione di questa diocesi, tutte le volte che ciò nel Signore sarà sembrato opportuno. Poiché però le circostanze dei tempi impediscono che al presente nella diocesi sia istituito un Capitolo di canonici, Noi ordiniamo che, al posto dei canonici, siano eletti Consultori diocesani secondo la norma can. 423 e segg. del Codice di diritto canonico. Ordiniamo inoltre che, al più presto che sia possibile, almeno un piccolo Seminario diocesano, secondo i decreti del Codice e le norme della Sacra Congregazione dei Seminari, sia eretto, e che, a spese della stessa diocesi, al presente almeno uno, due giovani scelti, siano mandati al Pontificio Seminario Pio Latino Americano dell'Urbe, senza interruzione di turno. Per quanto riguarda il governo e l'amministrazione di questa diocesi, l'elezione del Vicario Capitolare, o dell'Amministratore, sede vacante, i diritti e i doveri dei chierici e dei fedeli e altre cose di questo genere, ordiniamo che siano osservate le cose che i sacri canoni decernono. Per quanto riguarda il clero in particolare, stabiliamo che non appena sia fatta l'erezione della diocesi, per ciò stesso i presbiteri siano considerati ascritti a quella chiesa, nel cui territorio legittimamente esistono. Inoltre tutti i documenti e gli atti riguardanti la nuova diocesi, al più presto che sia possibile, siano consegnati dalla cancelleria della diocesi di Botucatu alla cancelleria della diocesi di Cafaelandense, affinché siano conservati nel suo archivio. La mensa episcopale costituiranno i proventi della Curia e le altre oblazioni, che dai fedeli, per il cui bene la diocesi è stata eretta, sono soliti essere offerte, eccetto quelle che già a questo fine sono state offerte e raccolte.

5 A mandare queste cose all'esecuzione deputiamo il predetto venerabile fratello Leopoldo Duarte Silva, Arcivescovo di San Paolo in Brasile, a lui attribuendo le facoltà necessarie e opportune anche di subdelegare, Acta Apostolicae Sedis - Commentarium Officiale a effetto di cui si tratta, qualunque uomo costituito in dignità ecclesiastica, con l'onere a lui imposto di trasmettere alla Sacra Congregazione entro sei mesi un esemplare autentico dell'esecuzione compiuta. Vogliamo però che ai transunti di queste Lettere, anche stampati, sottoscritti però da mano di qualche notaio pubblico e muniti del sigillo di qualche uomo costituito in dignità ecclesiastica, sia attribuita la medesima fede interamente in giudizio e fuori di esso, quale sarebbe attribuita a queste Nostre Lettere, se fossero esibite o mostrate nell'originale.

6 Decerniamo infine che queste presenti Lettere avranno valore, non ostante qualsiasi cosa contraria, anche se degna di particolare e espressa menzione. Quanto poi è stato da Noi decretato con autorità Apostolica per mezzo di queste Lettere, a nessun uomo, in nessun tempo e per qualsiasi ragione, è lecito infrangere, o contravvenire, o in qualunque modo opporsi. Se qualcuno invece, che Dio non voglia, avesse la presunzione di tentare ciò, sappia che incorrerà nelle pene stabilite dai sacri canoni contro coloro che si oppongono all'esercizio della giurisdizione ecclesiastica.

1 Ea est in praesenti Botucatuensis dioecesis conditio ut, ob crescentem in dies fidelium numerum, in tam latis finibus, unius Episcopi cura et inspectio non sufficiat ad subveniendum tot ac tantis fidelium necessitatibus. 5 Ad haec autem exsecutioni mandanda deputamus praefatum venerabilem fratrem Leopoldum Duarte Silva,Archiepiscopum SanctiPauli in Brasilia, eidem tribuentes necessarias et opportunas facultates etiam subdelegandi, ActaApostolicaeSedis-CommentariumOfficiale ad effectum de quo agitur, quemlibet virum in ecclesiastica dignitate constitutum, onere eidem imposito ad Sacram Congregationem intra sex menses transmittendi authenticum exemplar peractae exsecutionis. OF THE DISMEMBERMENT OF THE DIOCESE OF BOTUCATU AND THE ERECTION OF THE DIOCESE OF CAFAELANDENSIS PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 The Diocese of Botucatu is in such a condition at present that, on account of the number of the faithful increasing daily, in so wide boundaries, the care and oversight of one Bishop is not sufficient to meet so many and such great needs of the faithful. Wherefore the venerable brother Charles Duarte Costa, the present Bishop of the same diocese, with the counsel also of the venerable brother Leopold Duarte Silva, Archbishop of the metropolitan Church of St. Paul in Brazil, humbly proposed and petitioned that the diocese be divided, and that another new one be erected near the city of Cafaelandensis.

2 Moreover We, by the deliberation of the Most Eminent Fathers of the Sacred Congregation of Consistorial Affairs, having also obtained the favorable vote of the Apostolic Nunciature with the Brazilian Republic;

3 having supplied, insofar as it is necessary, the consent of those to whom it pertains, or who presume that it pertains to them, and having before Our eyes those things which were reserved to the Holy See in this matter in the Apostolic Letters under lead Ad universas orbis Ecclesias on the twenty-seventh day of the month of April in the year of Our Lord one thousand eight hundred and ninety-two: from the fullness of Apostolic power, We sever a part from the territory of the aforesaid Diocese of Botucatu, and erect a new Diocese to be called Cafaelandensis within its boundaries.

4 The boundaries of which shall be the same as the boundaries of the parishes which We assign and attribute to it, as follows. These parishes are: Cafelandia, Araçatuba, Avahy, BataTha, Biriguy, Calmon, Glyeerio, Iaeanga, Lins, Pennapolis, Pirajuhy, Presidente Alves, Promissae, Soturna. We establish the seat and cathedral of the new diocese in the city of Cafelandia, and at the same time We erect to be built a cathedral church to be named after St. Elizabeth of Hungary, and We grant that, until it itself shall be built, the church dedicated there to the Blessed Virgin Mary of Mount Carmel and St. Elizabeth of Hungary shall meanwhile be used as the cathedral. To this newly erected cathedral Church and to its Bishops for the time being We grant the honors, insignia, favors, rights and privileges which other cathedral Churches and their Prelates in Latin America enjoy and possess by common law or legitimate custom. We constitute it suffraganean to the metropolitan Church of St. Paul in Brazil, and subject its Bishops for the time being to the metropolitan jurisdiction of the same Archbishop of St. Paul, with this reservation however to Us and the Apostolic See of the faculty freely to decree a new dismemberment of this diocese whenever it shall seem opportune in the Lord. Since, however, the circumstances of the times prevent the institution of a Chapter of Canons in the diocese at present, We command that, in place of canons, diocesan Consultors be elected according to the norm of can. 423 and following of the Code of Canon Law. We further command that, as soon as it can be done, at least a small diocesan Seminary be erected, according to the decrees of the Code and the norms of the Sacred Congregation of Seminaries, and that, at the expense of the diocese itself, at least one or two chosen young men be sent, without interruption of turn, to the Pontifical Pius Latin American Seminary of the City. As to the governance and administration of this diocese, the election of a Vicar Capitular or Administrator, during a vacant see, the rights and duties of clergy and faithful and other such matters, We command that those things be observed which the sacred canons decree. As to the clergy in particular, We establish that as soon as the erection of the diocese shall have been made, by that very fact presbyters shall be considered ascribed to that church in whose territory they legitimately exist. Moreover, all documents and acts concerning the new diocese shall, as soon as it can be done, be handed over from the chancery of the Diocese of Botucatu to the chancery of the Diocese of Cafaelandensis, that they may be preserved in its archive. The episcopal mensa shall be constituted by the emoluments of the Curia and other offerings which are customarily provided by the faithful, for whose good the diocese has been erected, apart from those which have already been offered and collected for this purpose.

5 To commit these things to execution We appoint the aforesaid venerable brother Leopold Duarte Silva, Archbishop of St. Paul in Brazil, granting to him the necessary and opportune faculties and also to subdelegate, imposing upon him the burden of transmitting to the Sacred Congregation within six months an authentic copy of the execution completed. We will, however, that to copies of these Letters, even printed ones, subscribed by the hand of some public notary and furnished with the seal of some man constituted in ecclesiastical dignity, the same faith be given entirely in judgment and outside of it as would be given to these Our Letters, if they were exhibited or shown in the original.

6 We decree finally that these present Letters shall be valid, notwithstanding any contrary provisions whatsoever, even those worthy of special and express mention. And it shall be lawful for no man, at no time whatsoever, and for no reason whatsoever, to infringe upon, or to contravene, or in any way to act contrary to those things which have been decreed by Us through Apostolic authority in these Letters. If anyone, which God forbid, shall presume to attempt this, let him know that he shall incur the penalties established by the sacred canons against those who resist the exercise of ecclesiastical jurisdiction.
