Sollicitudo pastoralis

Bolla sull'osservanza degli accordi conclusi in conclave

Bolla di papa Innocenzo VI ·

1 dinali nel deliberare. — 14. Sull'osservanza di questi patti. — 15. Sui cardinali da consultarsi in materie dubbie. — Clausole.

1 of cardinals in deliberation. — 14. Concerning the observance of these pacts. — 15. Concerning the cardinals to be admitted to counsel in doubtful matters. — Clauses.

2 Innocent, bishop, servant of the servants of God, for perpetual memory of the matter.

3 The solicitude of pastoral office, as it requires that we provide lest the Church suffer diminishment in her rights, so truly it requires that the honours, liberties and rights of the Roman Church, over which, by the authority of the Lord, we preside, we preserve undiminished by the study of more careful diligence.

4 § 1. Formerly indeed, upon the death of our predecessor of blessed memory Clement VI, the Apostolic See being vacant, our venerable brothers, the cardinals of the Holy Roman Church, of whose number we then were, being gathered together in the apostolic palace at Avignon, where the aforesaid predecessor had died, to treat of those matters which pertained to the election of the Roman Pontiff, agreed in a certain writing, the tenor of which we have caused to be inserted word for word in the present document: and afterwards some of them simply swore an oath, and we and certain others swore under this condition: namely, that if and insofar as such writing proceeded by right; that he from among them who should happen to be assumed to the papacy would inviolably observe all things contained in the same writing, and that on the same day on which he would be, as aforesaid, assumed, he would profess that he would faithfully observe all and singular things therein, and would hold as ratified the oaths taken thereupon.

5 § 2. Afterwards, however, we, to the office of such kind, although with insufficient ability of mind, being called by such disposition, having considered all things aforesaid, and attending to the fact that although the same cardinals had right zeal for doing these things, and it seemed to some that we ought to observe those things and the oaths taken thereupon, as is aforesaid; yet since the said cardinals, the constitutions of our predecessors of blessed memory Gregory X and Clement V, Roman Pontiffs, forbidding it, by which it is provided that cardinals, the same See being vacant, concerning whatsoever matters, except the provision of the Roman Church to be made, in certain cases only excepted, concerning which however no one is contained in the writing aforesaid, could not intermeddle, were unable to proceed to those things: and considering carefully that the writing itself is perceived without doubt to redound to the diminishment and prejudice of the fullness of power conferred from the mouth of God upon the Roman Pontiff alone: since by the same writing manifest great and perpetual prejudice threatens the aforesaid See, while such power is taken from the same Roman Pontiff, and is confined by certain rules and limits prescribed to him by man: and no less considering that it would be rash and insane among Catholics to assert or hold that the Roman Pontiff, successor of Peter and vicar of Jesus Christ, is not called and assumed to the fullness of power: which power assuredly would not be in him, if it depended upon the consent or judgment 1 of others: and that those oaths are not canonical, but rather rash

6 The power of the Roman Pontiff is harmed.

7 of cardinals, and their number to be reckoned, which are made not only to the prejudice and injury of the Roman Church, but also of any other Church whatsoever; having held deliberation upon these and certain other matters which reasonably moved our mind to this, with some of the same cardinals and many other doctors and jurists, mature deliberation being had, to remove every scruple and doubt in this part, by apostolic authority, by the tenor of the present we declare the same cardinals to have been unable to do the things contained in the writing aforesaid, and those things and all their effect to have been and to be of no force or moment whatsoever; and we or our successors, the Roman Pontiffs, or the cardinals themselves to have not been and not to be bound or constrained in any way to the observance of those and the aforesaid oaths.

8 § 3. The tenor moreover of the said writing is as follows below.

9 § 4. Full deliberation having been held for the creation of a public concordat, all the lord cardinals agree, with no one dissenting, in the first place that the Supreme Pontiff, the Lord providing, to be created, at no time whatsoever, for any cause, shall proceed to the creation of cardinals, except according to the manner and form noted below: namely that he shall not create or make any cardinals, until the number of cardinals shall have come to the number of sixteen cardinals, the others who would be above the number of sixteen having already been removed from office, and then let him assume, if it shall seem good to him, as many as shall amount to up to the number of twenty, and not beyond, the aforesaid sixteen or fewer, if perchance then there should remain, being counted in the number of twenty. Concerning the consent of the cardinals in creating cardinals. § 5. Which cardinals indeed to be created through the peace of the cardinals, he himself shall have to create and ordain with the counsel and consent of all the cardinals then existing or of two parts of the same: this however being saved, that, the number which now exists remaining, or perhaps fewer, let the Pope assume, if he shall wish, two cardinals, with the counsel of all the brethren or the greater part of them, being required.

10 Concerning the consent of the brethren in the punishment of cardinals.

11 § 6. Likewise that the Pope shall not proceed to the deposition or seizure of the person of any cardinal, without the counsel and consent of all the brethren, with no one dissenting, nor to excommunication or other ecclesiastical censure, or suspension of voice or cutting off, or carrying of the hat, nor to deprivation, nor even to suspension of benefices of the cardinals themselves, without the consent of all the brethren or of two parts of the same.

12 § 7. Likewise that the Pope in no way shall lay hands upon the goods of any cardinals whatsoever, them living and dead. Concerning the alienation of the goods of the Roman Church by the Pope and the consent of the cardinals. Item that the Pope shall not alienate the provinces, cities, castles or other lands of the Roman Church, or concede them in fee or in perpetual lease, or under a certain census: and where the aforesaid alienation or concession should be expedient to be made for a just and reasonable cause, let him proceed to the aforesaid with the counsel and consent of all the brethren or of two parts of the same.

13 § 9. Likewise that the college of cardinals ought to perceive and have by its right the fruits of the Roman Church. Concerning the fruits of the Roman Church to be divided among the cardinals. The college of cardinals shall have and perceive by its right all the fruits, revenues, proceeds, fines, condemnations and censuses and all other emoluments and revenues pertaining to the Roman Church, in whatsoever provinces and lands and places of the Roman Church, as is more fully contained in the privilege granted on this matter by Nicholas, Pope of blessed memory, Pope IV.

14 § 10. Likewise that both in the Roman Curia and in the lands and provinces of the Roman Church, officials in temporal matters, greater ones, shall be instituted and removed with the counsel and consent of all the cardinals or of the greater part of the same, as is known to appear in the aforesaid privilege or constitution of the aforesaid lord Nicholas, Pope IV.

15 § 11. Likewise that to the office of marshal of the Roman Curia and rectors of lands or provinces of the Roman Church, no one shall be assumed who is related by blood or affinity to the Roman Pontiff.

16 § 12. Likewise that the Supreme Pontiff shall grant to no king or prince or any other person tithes in their kingdoms, provinces or lands, nor thirds of tithes or other subsidies, nor even shall he reserve to his Camera without the counsel and consent of all the brethren or at least of two parts of the same, and then a just and reasonable cause urging.

17 § 13. Likewise that the Pope shall not hinder, concerning the liberty of the cardinals in consulting. Item that all and each of the cardinals in consulting and consenting shall have free judgment in the matters aforesaid.

18 § 14. Likewise that all the lord cardinals, who survive today, shall have to swear that he of the said cardinals, who shall be assumed to the papacy, the Lord granting, shall diligently and inviolably observe the aforesaid: and nevertheless he who shall be assumed to the papacy, whether a cardinal or another assumed, and received by the cardinals, on the same day shall faithfully profess all and each of the aforesaid to observe, and shall ratify the oath given.

19 § 15. Likewise that if any doubt shall occur or fall upon the matters aforesaid, or it shall seem good to the Pope in the doubtful matters, let the lord Pope with the counsel and consent of at least two parts of the cardinals have to declare. Let it be lawful for no one whatsoever to infringe this page of our declaration, etc.

20 Given at Villanova in the diocese of Avignon, on the second day before the Ides of July, in the first year of our pontificate.

21 Given on 6 July 1353, pontificate year 1.
