XXI.
The town of St. Louis of Maragnano is dismembered from the diocese of Brazil, and is declared to be a city, and its church of Our Lady of Victory dedicated is constituted cathedral.
Innocent, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 Over all the churches of the world, God disposing, who commands all things and to whom all things obey, although constituted without merit, we lift the eyes of our mind in circuit around the field of the Lord, after the manner of a watchful shepherd, to inspect what may befit and ought to be arranged for the state and dignity of provinces and places of any kind, and for the salvation of the souls of their inhabitants; and strengthened by divine protection, we judge it worthy, nay rather incumbent upon us, to plant new episcopal sees in the watered field of the militant Church, so that through such new plantings popular devotion may be increased, divine worship may flourish, ecclesiastical sacraments may be administered, and the salvation of those very souls may follow, and those places themselves may be illustrated with more dignified titles, and the peoples, by the assistance, governance and teaching of their prelates, may always make progress in the Lord with the fullness of apostolic authority and the increase of orthodox faith, and may not lack in spiritual things what they have obtained in temporal things, especially since the devotion of pious and noble princes demands this.
2 § 1. Since therefore our beloved son, the noble man Peter, prince and governor of Portugal and the Algarves, moved by pious affection (with preponderant zeal for the dismemberment of the aforesaid) that the people of that part of Brazil, which is called the province of Maragnano, on account of the very great distance from the city of Bahia of All Saints, the residence of the bishop of Brazil, whose diocese it is, and the most difficult access to it, have already suffered and daily suffer many inconveniences, especially concerning the preparation of Holy Oil, the administration of the sacrament of Confirmation, and the exercise of the office of pastoral care, and by the work and ministry of various religious and other men distinguished in learning and approved in life, whom the same Prince Peter, following the footsteps of his forebears, sparing no labors and expenses, has most diligently sent to preach the word of God there and to lead the inhabitants and dwellers of those parts to the Catholic faith, outside which there is no salvation, with divine grace cooperating, almost infinite peoples, hitherto lacking divine and human law, the darkness of Satan having been dispelled, have come and daily come more to the knowledge of the true light and the holy washing of Baptism and the bosom of holy Mother Church, and by these means Christian religion has been so far and widely propagated in those parts that the bishop of Brazil existing for the time cannot cross to it and its borders without grave danger, and cannot inspect the faces of individuals, as befits a bishop, 1 nor otherwise exercise the parts of a good shepherd in general), § 2. Considering that in the said province of Maragnano, beyond other notable places, there is found one town called the city of St. Louis, inhabited by two thousand Christian faithful, and subject to the dominion of the kings of Portugal, distinguished by the healthfulness of the air and the frequency and commerce of the people, and by several monasteries of men, whose inhabitants are adorned with nobility of birth and the degrees of letters and arms, and in the said town of St. Louis there is one mother and principal church, greater than the others existing there, under the invocation of Our Lady of Victory, in which by a vicar and some priests, living on their own revenues from the royal treasury, Mass and other divine offices are celebrated, and ecclesiastical sacraments are administered, long since erected and founded, for which reason the said town of St. Louis ought to be dismembered from the diocese of Brazil, and erected into a city, and the said church into a cathedral, and in it a Catholic bishop and proper pastor instituted, who may be able and ought to confirm those still weak in the same faith, and plant greater ecclesiastical seminaries, and build folds for the Lord's sheep, and exercise all other pontifical functions in those parts (especially since in several towns and places of the same province of Maragnano many and diverse churches, and monasteries of men, and other sacred places are found founded and erected), led by the zeal of his devotion and most earnestly desiring to provide for the peoples dwelling in those parts:
3 § 3. We, having taken mature deliberation upon these matters with our venerable brothers, the remarkable cardinals of the Holy Roman Church,2 with the said Peter, prince and governor, humbly petitioning us by letter for this purpose, judging the aforesaid town worthy to be elevated to the dignity of a city with episcopal and civil jurisdiction, willingly acceding to the wishes of the said prince, by the counsel and consent of our said brothers and by the fullness of apostolic power, do perpetually segregate, divide and separate the aforesaid town of St. Louis, with the said province of Maragnano, and all its castles, towns, villages, territories and ecclesiastical districts and persons both secular and ecclesiastical, from the ordinary jurisdiction of the Bishop of Brazil, and do entirely exempt and free all these things, as regards diocesan law, from the superiority, jurisdiction, power, subjection, visitation and correction of the Bishop of Brazil; and we adorn the aforesaid town of St. Louis with the name, title and honour of a city and its inhabitants with the name of citizens, and we erect it into a city, which shall be denominated St. Louis, and in it the said church, dedicated to Our Lady of Victory, into a cathedral church, under the invocation of the same Our Lady of Victory, for one bishop to be named of St. Louis, who shall preside over it, and he shall perfect the church itself or cause its structures to be brought into the form of a cathedral church, and moreover in it and in the said city and in the diocese of the same church, as many dignities, canonries and prebends, and other ecclesiastical benefices, with cure and without cure, as shall seem to him fitting for divine worship and the service of the said church and the honour of the ecclesiastical clergy, by the counsel and consent of the aforesaid Peter, prince and of the King of Portugal and the Algarves for the time being, and with their previous suitable endowment to be made by the same Peter, prince and by the Kings of Portugal for the time being, as soon as it can be done, he shall erect and institute; and moreover he shall be able and ought freely and lawfully to exercise episcopal jurisdiction, authority and power, and to do all and singular things which are of the order, which are of jurisdiction and of any other episcopal office, and which other bishops constituted in the kingdoms and dominions of Portugal and the Algarves in their churches, cities and dioceses can and ought to do,3 and in the same church thus erected we do perpetually erect and institute episcopal dignity with seat, preeminences, honours, privileges and faculties, which other cathedral churches of this kind use, possess and enjoy by right or custom or otherwise, and which can and shall be able to use, enjoy, possess and enjoy in any manner whatsoever in the future, as well as episcopal and capitular mensa and other cathedral insignia, to the praise of almighty God, and to the glory of his most glorious mother the Virgin Mary and of the whole triumphant Church, and to the exaltation of the Catholic faith, by like counsel and by the fullness of apostolic power, by apostolic authority, by the tenor of these presents, perpetually. § 4. And to the same church thus erected, and the aforesaid town of St. Louis, erected into a city, for a city, and the other towns, castles, villages, territories and districts of the said province of Maragnano, from Cape Horn by the seacoast and inland to the Fort of Scata exclusive, for a diocese, as well as the aforesaid ecclesiastical persons4 for the clergy, and secular persons dwelling in this city and diocese for the time being, for the people, by like counsel, power and authority, we do also perpetually grant and assign; and the city, diocese, clergy and people we subject to the Bishop of St. Louis as regards episcopal ordinary jurisdiction, but as regards metropolitan jurisdiction and superiority (inasmuch as from the aforesaid church of St. Louis the journey is far easier and more expeditious to Lisbon than to Bahia of All Saints, having regard especially to the greater convenience of commerce, whence follows greater opportunity for the governance of souls) to the Archbishop of Lisbon, by the counsel of the said brothers and by like fullness of power, also perpetually; and moreover to the episcopal mensa of St. Louis, with its endowment, annual revenues of two thousand five hundred cruzados of Portuguese currency to be assigned by the same Peter, prince (which sum the same Peter, prince has graciously and irrevocably donated and offered from his own resources and from the revenues of the Kings of Portugal and the Algarves for the time being, and specially from those which are received from the same region of Brazil, and has promised, or promises, to pay annually), we likewise perpetually apply and appropriate. § 5. And moreover to Peter, prince and to the Kings of Portugal and the Algarves for the time being, we grant the right of patronage and of presenting annually a suitable person to the said church of St. Louis, namely, to us and to the Roman Pontiff for the time being, to be appointed by such presentation and not otherwise as bishop and pastor of the same church of St. Louis,5 and as to the other principal and other dignities, canonries and prebends as well as benefices to be erected, and to be suitably endowed by Peter, prince and by the Kings for the time being, both from their first erection after they shall have been erected and endowed, and from then onwards as often as they shall happen to become vacant in any manner whatsoever and to any persons whatsoever even at the same See, to the Bishop of St. Louis for the time being aforesaid, likewise6 by him, upon the presentation made by the aforesaid Prince Peter and by the Kings of Portugal and the Algarves for the time being, within the term fixed by law, to be instituted in the same dignities, canonries and prebends and7 benefices,8 by the same authority we likewise perpetually reserve and grant.
§ 6.
4 And the right of patronage and of presentation to this church founded... ought to belong to Peter the Prince and to the aforesaid king existing for the time being from the mere foundations and endowments, and indeed by that same See, even by consistorial judgment in any manner whatsoever, it cannot be derogated, nor shall it be deemed derogated, unless the express assent of Peter the Prince himself and of the aforesaid king existing for the time being shall be given thereto, and, if it be derogated in any other manner whatsoever, such derogations, with the consequences flowing therefrom, shall be of no force, efficacy and moment; and thus by whatsoever judges and commissioners exercising any authority, even cardinals of the same Holy Roman Church, even legates a latere, and nuncios of that See, even auditors of the causes of the apostolic palace, with all and each of them deprived of any other faculty and authority of judging and interpreting, it ought to be judged, and, if otherwise anything contrary to these things shall be attempted by anyone whatsoever with any authority, knowingly or unknowingly, we decree it to be null and void.
§ 7.
5 Notwithstanding the Lateran Council most recently celebrated, prohibiting the members of the Church from being distinguished and divided, and our and the apostolic chancery's rule concerning not taking away acquired right, and other apostolic constitutions and ordinances; all and each of which, those otherwise remaining in their force, on this occasion only, by the tenor of these presents, we specially and expressly derogate; and all other things contrary whatsoever.
§ 8.
6 Let no one whatsoever presume to infringe this page of our segregation, division, separation, exemption, liberation, honour, erection, institution, concession, assignment, subjection, application, approbation, reservation, concession, decree and derogation, or to contravene it with rash presumption: but if anyone shall presume to attempt this, let him know that he shall incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
