Bull restoring the office of Auditor of the Apostolic Camera

Bull of Pope Pius IV ·

of the Reverend Chamber of the Apostolic Camera. Pius, bishop, servant of the servants of God, for the record of the future.

1 To our venerable brother Flavius, bishop of Murano, greeting and apostolic blessing. To the exceptional devotion which you, with constancy of faith and sincerity of mind, 1 1 This office is most ancient, and several Pontiffs increased its jurisdictions, as I noted in the constitution ix of Innocent VIII, Apprime, vol. v, p. 320. It had been extinguished by Paul IV and united to the regency of the S.R.E. Camera, newly erected; but by this Pontiff it was restored to its former state, as may be seen in constitution xxxix, p. 123 above. The office of auditor of the Camera became vacant through the death of Francis Alberici, and this office of regent of the Camera was transformed and that office was granted to the cardinal of Naples. Paul IV issued his bull as if it were a case.

2 It became vacant afterwards through resignation and this Pontiff suppressed it;

PIUS IV

3 you and your ancestors have shown towards us and the Roman Church, as well as the nobility of your lineage, outstanding learning, and experience and skill in conducting affairs, as well as zeal for faith and justice and integrity, and singular probity, as well as other virtues with which the Almighty, the giver of those gifts, has abundantly adorned your person, directing our consideration's regard upon these things, and therefore holding sure hope that those matters which we shall deem fit to entrust to you, you will execute with the greatest providence and exact and careful diligence, we judge it worthy, or rather due, that we should honor that same person with fitting honors and favors.

4 § 1. Since therefore we recently held the office of general auditor or audience of the Court of cases of the Apostolic Camera, which previously, when it became vacant through the death of the late Francis Alberici of Rachanercl, formerly general auditor of the Court of such cases, deceased outside the Roman Curia, our predecessor of blessed memory Paul, for certain causes then expressed, with the name of auditor suppressed and extinguished in perpetuity, transformed it into the office of regent of the S.R.E. Apostolic Camera, by apostolic authority with the counsel of his brothers, and had erected and instituted it, and afterwards this office, vacant from its original erection at that time, our beloved son Alphonsus, then deacon cardinal of St. Nicholas among the Images, but now of Saints John and Paul, called Neapolitan, had granted and assigned by the said authority.

5 § 2. When the said cardinal Alphonsus had freely and voluntarily resigned the office of regency in our hands, and we had deemed this resignation to be admitted, having held mature deliberation upon these matters with our venerable brothers, the cardinals of the same S.R.E., and with 1 See above the note on p. 125, col. b (b. t.).

6 cendis:

7 their counsel and unanimous consent, the office of regency itself, with its name and denomination suppressed and extinguished by us, and its erection and institution aforesaid as well as the apostolic letters made thereupon revoked, annulled and voided, against the erection and institution nor the apostolic letters aforesaid, and to its former and that state in which it was before its suppression as well as its erection and institution, we have restored, replaced and fully reintegrated in all things and through all things, as is more fully contained in the apostolic letters made thereupon and signed by our hand and that of our said brothers.

§ 3.

8 We, after having held a lengthy and mature discussion and deliberation on this matter, fixing the eyes of our mind upon you and having no small confidence in the Lord concerning the aforesaid virtues of yours, and hoping that you, who are known to preside over the Church of Mura, and are a doctor of both laws and referendary in both our signature offices and our domestic prelate, with the propitious assistance of the right hand of the Lord, will know, will, and be able to exercise faithfully such an office, to the praise and benefit of many, and absolving you from any excommunication, suspension and interdict and other ecclesiastical sentences, censures and penalties, whether by law or by man, imposed for any occasion or cause, if you are bound by any of them in any way whatsoever, for the purpose of obtaining the effect of these presents only, by the tenor of these letters, and considering you absolved, and holding the true tenors of the aforesaid suppression, erection and institution, as well as of the aforesaid letters, as if they were inserted word for word, and the true and final manner of the vacancy of the said office of auditor, as expressed in these presents, by our own motion, not at your instance or that of another or at the petition offered to us on this matter, but from our mere liberality and from our certain knowledge, and from the fullness of apostolic power, the office of auditor or of the audience of the Camera, whether by a similar resignation of Cardinal Alphonsus, or still by the death of the aforesaid Francis, or otherwise, in whatever manner we wish to be held as expressed, being vacant, together with the office of corrector of the archive of the Roman Curia, and others annexed to it, as well as all and singular its honors, privileges, rights and regalia or otherwise called emoluments customary, and faculties and indults and decrees, even in the order and manner of proceeding in cases, which the same Francis and others who were general auditors of causes of the Curia for the time being had, even through the blessed memory of Julius II, Leo X, Clement VII, Paul III and Julius also III and any other Roman Pontiffs, our predecessors, and also we and the Apostolic See, under whatever tenors and forms, and with whatever clauses and decrees, both under lead and in the form of a brief and otherwise by use, style and custom in any manner whatsoever granted, to you, by apostolic authority, by the tenor of these presents, we grant and assign; and we constitute and depute you in our place and in that of our beloved son Guido Ascanius, deacon cardinal of St. Mary in Via-Lata, called of St. Flora, our modern and for the time being camerlengo, and general auditor of causes of the Curia aforesaid, with the honors, burdens, privileges, rights, emoluments, faculties and decrees aforesaid, and we substitute and subrogate you in the place of the said Francis, as far as this office of auditor and its exercise are concerned, for as long as you shall live.

§ 4.

9 And to you, through yourself or through another or others, suitable locum tenentes, whom you shall deem fit to assume for the time being or to be deputed as camerlengo, we grant the faculty of knowing all and singular causes in the modes and forms written above and below, and of deciding them. So that you in causes of obligations celebrated in the form of the Camera alone (except among Roman citizens, among whom we wish the motu proprio last granted by us in favor of the Roman people to be observed), but any others whatsoever, even judges of the Roman Curia, in similar causes in no way and by no manner of means may proceed, you ought to proceed. Likewise concerning all and singular obligations in the form of the Camera, made and to be made anywhere and among any persons whatsoever (these alone excepted which have been made or received in matters depending on suits and causes introduced in the same Camera or before other judges for the time being), and then, not by way of censures, but by mandate executive, you shall know.

§ 5.

10 So that whatever causes, which shall be brought henceforth, for perpetual future times, in the same Curia upon the same obligations, shall be brought in no other tribunal than yours and of the Curia of causes aforesaid (except by virtue of our special commission concerning the said obligation making special mention thereof), in their state, grade and terms in which they shall be found, by your ordinary authority (except causes in the Curia of the Capitol against the said Roman citizens for the time being, according to the form of the said motu proprio, brought), to reassume, and to inhibit the judges to whom they shall be committed, and before whom they shall hang in the future, lest in them or concerning them in any way or by any sought color, directly or indirectly, they presume to intermeddle, even under ecclesiastical sentences, censures and penalties, and also pecuniary ones, to be moderated and applied at your discretion; and whatever shall be otherwise attempted concerning these things, we decree to be null and void.

§ 6.

11 And also alone, by the force of the said obligation to promulgate ecclesiastical censures; to promulgate.

12 Year 1561. Cases of prelates, merchants, curial officials, and pensioners, etc., to be heard, and other cases indicated here, and appeals;

PIUS

§ 7.

13 Likewise all and singular spiritual and ecclesiastical and secular cases of whatsoever cardinals of the Roman Church, and of their and our servants, regular table companions and prelates of whatsoever kind, dwelling in the same Curia, and also of the emperor, kings and other princes and communities and universities, orators, and likewise of the said Curia officials and those following the same Curia and their servants and of the same Curia's auditor of cases, notaries and their servants, money-changers also and whatsoever merchants and annual pensions assigned upon the fruits, revenues and proceeds of ecclesiastical property, even if their payment is to be made not in the same Curia, but in other places.

14 § 8. And whatsoever other cases, even those committed by commission, both civil and criminal and mixed, and joined together or separately in the same Curia in whatsoever manner and however moved and to be moved, and between whatsoever parties, even by way of inquisition or ex officio, pending in whatsoever manner. And which by appeal from injuries inflicted and threatened, or by definitive or interlocutory sentences, from whatsoever ordinary judges and arbiters and arbitrators in the aforesaid Curia and City (saving only our vicar and governor and senator of the aforesaid City and the judges of the Capitol), and outside them from whatsoever ordinary or delegated judges or arbiters or arbitrators, and also of the said See's legates and their vice-legates in lands subject to the Roman Church mediately or immediately, or other their governors or officials, and whatsoever granted in fief or vicariate or otherwise in whatsoever manner, issued and promulgated for the time being, have been devolved and shall in future be devolved to the same See.

16 § 10. But those exceeding the said sum or its value and between and against others than merchants, with the terms being observed, and otherwise summarily, as in beneficiary cases; and with the same terms in whatsoever manner badly and nullly, preposterously and repeatedly attempted, for the lesser expense of the parties, even in a single proceeding, with citation and hearing reiterated, even by affixing citations to be made for the time being to the doors of the dwelling of those to be cited, as far as those obligated in the form of the Camera; and as to others otherwise obligated, where the matter does not exceed twenty ducats, to hear, know, decide and terminate with due conclusion.

17 § 11. Likewise concerning all and singular crimes, excesses and offences, both in the aforesaid City and Curia, and outside them by whatsoever persons, both officials of the same See, and those following the said Curia and others, even exempted from the jurisdiction of ordinaries and immediately subject to the aforesaid See, of whatsoever ecclesiastical or secular dignity, even episcopal or greater, and by whatsoever others, of whatsoever status, degree, order or condition they may be, perpetrated or to be perpetrated; and also the accusation of parties, or even instigation, or from mere office to inquire upon the denunciation and promotion of the procurator's office, to proceed summarily in cases of merchants, notaries and two hundred ducats and below; otherwise with the terms being observed; both civil and criminal cases of the City and of all exempted persons to be known; and upon those, both by way of inquisition, and of accusation or denunciation and instigation of this kind to proceed, and those found culpable according to the exigency and quality of their excesses to punish, provided that you do not decree monitions against bishops or their superiors to appear personally, unless by prior commission signed by our hand.

18 § 12. Likewise all apostolic letters, whether general or particular, both those executed under lead by the office of the audience of our contradicted letters, and those in the form of a brief, and those for which the signature alone has been granted to suffice, petitions signed before us or before the Roman Pontiff existing for the time being or in his or our presence, as well as letters of the chamberlain and greater penitentiary existing for the time being of ours, provided that other executors have not been appointed in those and the aforesaid apostolic letters, you alone; but in those in which executors shall have been appointed, to execute cumulatively with them and to decree the due processes thereon in the customary form, even with the promulgation of censures customarily promulgated in similar cases.

19 § 13. And yours and through your locum tenentes in the matters or any others, both ecclesiastical judges and secular judges, and both delegated and subdelegated, and also the processes of the said Apostolic Palace auditors or of the Maundy of the Lord; us or the Roman Pontiffs existing for the time being, both in specific and in general, and others in any way in the same Curia for the time being of sentences passed, as well as of any processes general and special, both on the day of the Maundy of the Lord, as well as at other times, with the promulgation of ecclesiastical censures and penalties, customarily made executions, which, even if commissioned to the aforesaid delegated or subdelegated or any others, even specially, by us and the aforesaid See, we wish and decree to be commissioned to you the auditor, cumulatively and not exclusively, the terms customarily observed in the tribunal of such auditor being observed, and also on individual days and hours, as was customary to be done in ordinary matters, and to commit those and those to due execution, even, if it should be necessary, with invocation of the aid of the secular arm.

20 § 14. And any communities, universities, colleges and chapters, as well as also persons dwelling outside the said Curia, for debts contracted by them in the same Curia, or for salary or contract entered into in the said Curia.

21 § 15. But those dwelling in the same Curia or curials, ecclesiastical, secular or regular, even absent from the Curia itself, of whatever status, degree, order, even pontifical, condition or preeminence existing, for whatever things and sums of money, at the instance of any, even of the absent, to whom it shall concern for the time being, as often as it shall be expedient, even by public edict, having been summarily and extrajudicially ascertained and access having been had to them, to admonish and cite them to satisfy their debts and to render those things to which they shall be bound for the time being.

22 § 16. And to decree whatever remissorial and compulsorial letters, both general and special, where and as often as it shall be necessary, at your discretion.

23 § 17. Likewise also, by virtue of the bull of Eugenius, issued in favor of curials, and the Leonine as well as any other extension, to inhibit.

24 § 18. And to decree monitions and citations and inhibitions to the parties, even by similar edict, and also to arrest and imprison them. And, if it shall seem good to you, to remit and relax penalties and fines, and according to the quality of offenses, excesses and crimes to inflict and impose upon them (nevertheless short of death and mutilation of limb) through you and your locum tenentes.

rum Curiae Reverendae Camerae Apostolicae.

2 Rimase vacante in seguito per dimissione e questo Pontefice lo soppresse;

§ 6.
