Decet Romanum Pontificem

Erection of the Particular Congregation on the State of Churches

Bull of Pope Benedict XIV ·

ERECTION

1 Of a Particular Congregation of Certain Prelates of the Roman Curia, Attached to the Congregation of Cardinals Interpreters of the Council of Trent; for Receiving, Examining, and Considering the Reports of Bishops, Abbots, &c. concerning the Condition of their respective Churches.

BENEDICT, BISHOP, SERVANT OF THE SERVANTS OF GOD.

2 For perpetual remembrance of the matter.

3 Beginning with the care for the proper execution of what has been decreed.

4 It befits the Roman Pontiff, on account of the care of the Lord's flock divinely entrusted to him, not only to establish those things which are useful and salutary to the Catholic Church, and consonant with the Sacred Canons and Apostolic Constitutions; but also, following the example of the Evangelical Patriarch of the household, distributing talents according to the ability and strength of each one's talent, to hasten also to the swift execution of those things which have been decreed.

5 § I. Indeed, our blessed predecessor Pope Sixtus V, by his Apostolic letters, whose opening words are: Romanus Pontifex, decreed that all Patriarchs, Primates, Archbishops, and Bishops should promise by oath that they would personally and by themselves visit the Thresholds of the blessed Apostles Peter and Paul at certain prescribed times; and those detained by legitimate impediment would accomplish this through a certain Nuncio, and would render an account to the Roman Pontiffs existing at the time concerning their entire pastoral office, and concerning all things pertaining in any way to the condition of the Churches over which they preside; and the same Sixtus, our Predecessor, then by similar letters, which begin: Immensa, entrusted to the Congregation of the Holy Roman Church of Cardinals over the interpretation and execution of the Council of Trent, that they should hear the petitions of those Patriarchs, Primates, Archbishops, and Bishops, and should dispatch those matters which they could by charity and the norm of justice; and should refer the greater matters to himself and his Successors. We, however, moved by necessary and legitimate causes, by our letters recently issued, have confirmed and renewed the letters of the aforesaid Sixtus, our Predecessor, concerning the visiting of the sacred Thresholds of the blessed Apostles, and all things contained in them; and we further command and order all Abbots, Priors, Provosts, and others whatsoever, even those distinguished by the honor of the Cardinalate dignity, both Regular and Secular, who are placed over Monasteries or Churches which are called Nullius, with spiritual jurisdiction and separate Territory, by whatever right and title, that before they obtain profession of their Monasteries and respectively Churches, they bind themselves by oath in the hands of the Deacon Cardinal of the Holy Roman Church in the order of Prior, if they are present in Rome, but if absent, in the hands of a Nuncio or Legate of the Apostolic See, or of some Catholic Bishop chosen at their discretion, that they will personally and by themselves visit the sacred Thresholds of the blessed Apostles Peter and Paul, or, if legitimately impeded, through a certain Nuncio of their own; and moreover at certain prescribed times they will render an account of the administration of the Monasteries or Churches committed to them, and of all other things which pertain to the condition of those Churches and Monasteries, to ecclesiastical discipline of Clergy and People, to the salvation of souls, and to divine worship and glory, as is more fully contained in the individual letters respectively of the same Sixtus, our Predecessor, and of Ourselves aforesaid, whose complete texts we wish to be held here as fully and sufficiently expressed and inserted.

6 § 2. Since, however, as has been made known to Us while We were still in minor orders, Our Venerable Brothers the Cardinals of the Holy Roman Church, interpreters of the Decrees of that same Council of Trent, are so occupied with such weighty business matters, the multitude of cases, and the burden of most grave occupations, that they are compelled to hear petitions, which are customarily made on the occasion of visits to the Sacred Thresholds, and to provide responses more slowly than they would wish, not without some detriment to the Churches and complaint from some, by letters from Patriarchs, Primates, Archbishops, and Bishops, who, detained by legitimate impediments from being able to come to this City, whether absent or present in Rome, fulfill the duty of reporting on their own Churches in writing, as is customary: We, endeavoring to apply a suitable remedy to such inconvenience, and to afford opportune relief to that same Congregation of the Cardinals of the Holy Roman Church, interpreters of the aforesaid Decrees, and desiring to satisfy, as much as We can in the Lord, the wishes and desires of Our Venerable Brothers the Patriarchs, Primates, Archbishops, and Bishops, whom We cherish in the depths of charity, and wishing to provide for the diligent dispatch of such letters and responses, and also following the examples of Our Holy Predecessors, among whom the Blessed Jerome affirms that the Blessed Damasus, Our Predecessor, aided the ecclesiastical affairs and responded to the consultations of the East and West, by certain knowledge and from the fullness of Our Apostolic power, by the tenor of these presents, We perpetually erect, institute, and decree a Particular Congregation of certain Prelates of the Roman Curia to be appointed by Us and by the Roman Pontiffs, Our Successors, from time to time, whose duty and office We will to be solely this: that they diligently inspect the petitions of those same Venerable Brothers the Patriarchs, Primates, Archbishops, and Bishops, as well as of Our beloved sons the Abbots, Priors, Prepositi, and others, both Secular and Regular, having separate territory and exercising quasi-episcopal jurisdiction in places subject to them, which shall have been presented in writing, and the letters directed to that same Congregation of Cardinals, interpreters of the aforesaid Decrees, or to Us and by Us remitted to the aforesaid Congregation, and accurately set forth all things contained in them in their Convocations and Particular Congregations, the first of which shall be held before Us, so that by common counsel all things being considered and weighed, those which shall appear to be of greater moment may be referred to the aforesaid Cardinals of the Holy Roman Church, interpreters, and then through the Secretary of that same Congregation to Us, as often as the aforesaid Particular Congregation shall not have been held before Us, and to the Roman Pontiff existing from time to time; so that, having heard the wishes of those same Cardinals and Prelates, concerning the more serious matters from all Provinces and parts of the Orb of Lands, which have been customarily referred to the Apostolic See from the earliest times of the Church, as shall seem expedient in the Lord, We may be able to decree and to comply with the petitions and desires of Bishops and other Prelates, as much as is granted from on high.

7 § 3. And since it is Our desire that suitable men be chosen to undertake such a duty; therefore We, the Venerable brother Joseph of Saporitis, Archbishop of Anazarbus, and the beloved sons, Masters in both Our Signature, Referendaries Anthony Mary Erba, Bartholomew Olivatius, Joseph Mary Castell, Nicholas Antonellus, in the aforesaid Particular Congregation erected and instituted by Us, as aforesaid, as Prelates thereof by the tenor of these presents do appoint, name, and constitute; and the same Prelates appointed by Us, as above, and to be appointed by the Roman Pontiff for the time being, to the aforesaid Congregation of the Cardinals of the Holy Roman Church, interpreters of the same Tridentine Synod Decrees, by the Apostolic authority aforesaid, do thus adjoin and subjectively aggregate, so that to the same Congregation as members to the head in the aforesaid matters they may obey, and in the duty committed to them may assist; For which reason We of the same Prelates to the Particular Congregation as Prefect the beloved son of Ours Anthony Xavier, of the Title of St. Stephen on the Caelian Hill, of the same Holy Roman Church, a Presbyter Cardinal, called of Gentilibus, the present Prefect likewise of the aforesaid Congregation of Cardinals, Interpreters of the Decrees of the Council, and as Secretary the Venerable Brother Charles Albert Guidobono Cavalchini, Archbishop of Philippi, also the present Secretary of the same Congregation, and their Successors likewise in the Prefecture and in the office of Secretary respectively, do perpetually constitute and appoint. Furthermore, because We judge it opportune and fitting that he who to the same Congregation of the Cardinals of the Holy Roman Church, Interpreters of the Decrees of the Council, labors in Latin letters to be referred to Bishops, be fully instructed concerning the matters to be handled in the particular Assemblies or Congregations of the aforesaid Prelates, to this end, that through him the aforesaid Cardinal Prefect of the Congregation to the same Brother Bishops and other Prelates aforesaid, and especially to their requests, may more diligently and conveniently be able to satisfy, We will, and by the same Apostolic authority do ordain, that the beloved son also, Master Aeneas Silvius Piccolomini, who now is and who shall be hereafter, to the same Congregation of Latin Letters of this kind from the Secretariat, in the Assemblies or Congregations of the same Prelates, may have a place and be able to attend personally, yet not to cast a vote therein.

8 § 4. Notwithstanding any contrary custom, which for the effect of the aforesaid matters, insofar as it is necessary, We abrogate and abolish, and do will to be abrogated and abolished, as well as by any Constitutions and Apostolic Ordinances, and all other things whatsoever to the contrary. But that these may be known to all, We will and command that copies of these presents, even printed and subscribed by the hand of the Cardinal Prefect aforesaid, and furnished with his Seal, shall have the same force everywhere as these would have if exhibited or shown in person. Let no man whatsoever be permitted to infringe this page of Our will, Constitution, Ordinance, Decree, Statute, Erection, or to dare to act contrary to it; but if anyone shall presume to attempt this, let him know that he shall incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul His. Given at Rome at St. Mary Major in the year of the Incarnation of the Lord one thousand seven hundred and forty-nine, on the twenty-third day of November, in the first year of Our Pontificate.

EREZIONE
