Decree on the faculties of local ordinaries

DECREE CONCERNING CERTAIN FACULTIES OF ORDINARIES
1 On the approaching feast of Pentecost, when the new Code of ecclesiastical laws takes effect, all local Ordinaries will be furnished by the law itself with very many faculties which they were formerly accustomed to request from the Apostolic See and to obtain through common indults. It suffices to consult canon 349 compared with 239 concerning the many personal privileges by which Bishops are enhanced, canon 386 concerning the election of examiners and synodal judges, 463 and 914 concerning papal blessing at the point of death and on the greater solemnities of the year, 534 and 1532 concerning alienations, 806 concerning the repetition of sacred rites, 822 concerning the celebration of Mass outside a church and oratory, 1006 concerning ordinations outside the prescribed times, 1043 and 1045 concerning dispensations from impediments to matrimony, 1245 concerning dispensations from abstinence and fasting, 1304 concerning the blessing of sacred vessels, without mention being made of many other matters, so that it immediately appears that Bishops, by virtue of the Code, are furnished with such power that, whenever the utility of the Church and the salvation of souls require it, they are equally able to temper the rigor of common law and to grant just dispensations opportunely and fittingly. For this reason, the indults which have hitherto been granted at the petition of Ordinaries for this purpose, and which are contained either in the Brief of twenty-five years, or in formulas printed for ten years, for five years, or even for three years, appear to be superfluous; indeed, they introduce no slight confusion, inasmuch as they differ in many respects from the new ordinances of Canon Law.
2 For these reasons, therefore, and also to remove distinctions in canonical discipline and to introduce greater unity in the Church, His Holiness Pope Benedict XV, having consulted a special committee of Cardinal Fathers, by this decree of the S. Congregation of the Consistory has established and enacted the following:
3 1) excepting places subject to the S. Congregation for the Propagation of the Faith, for which what is opportune will be determined in due time, elsewhere, namely in all dioceses subject to common law, all faculties granted to Ordinaries for the external forum, and which are contained in the Formulas and Brief mentioned above, shall cease from the 18th day of May of this year, and shall no longer be in use;
4 2) nevertheless, in remote places and others to which, whether on account of the present war or for any other reason, notice of the present decree has not arrived in timely fashion, dispensations and ordinations granted by Ordinaries by virtue of the old faculties His Holiness ratifies, provided, however, that they themselves, from the day of receiving notice, if the matter is still pending, conform themselves to this decree;
5 3) faculties for the internal forum granted by the S. Penitentiary, and other faculties granted on account of the present war, or obtained by Ordinaries for particular reasons, are not comprehended under the disposition of this decree, and therefore are not abolished;
6 4) concerning matrimonial dispensations, although by virtue of canons 1043-1045 Ordinaries are able to grant opportune dispensations "in urgent danger of death" and "whenever an impediment is discovered when all things are already prepared for the wedding, and the matrimony cannot be deferred without probable danger of grave harm," nevertheless His Holiness, having regard to the circumstances of times and places, has decreed that the following be further granted:
7 a) that local Ordinaries in America, in the Philippine Islands, in the East Indies, in Africa outside the shores of the Mediterranean Sea, and in Russia, for a period of five years from the 18th day of May of this year, be able to dispense from impediments of the lesser degree which are enumerated in can. 1042, observing the rules established in that chapter of the Code: and likewise that matrimonies nullly contracted on account of some impediment of the same lesser degree be able to be healed in their root, according to the rules established in chapter XI, title VII, book III of the Code concerning the convalidation of matrimony, with the party conscious of the impediment being admonished of the effect of the healing;
8 b) that the same local Ordinaries be likewise able to dispense for a period of five years from impediments of the greater degree, whether public or occult, even multiple, of ecclesiastical law however (excepting impediments arising from the sacred order of priesthood and from affinity in the direct line from a consummated marriage), and also from the impediment impeding mixed religion, if the petition for dispensation has been sent to the Holy See and urgent necessity for dispensing has supervened while the recourse is pending. In granting dispensations in these cases, however, the Ordinary shall always keep before his eyes the rules established in the Code, book IV, title VII, chapters 2, 3, and 4, concerning impediments in general and in particular, and likewise the clauses customarily appended in marriages with Hebrews and Mahometans; nor shall he grant a dispensation unless he has taken care concerning the full observance of all of them according to the prescriptions of the sacred canons, and shall have regard to the rights of the S. Congregation for the Discipline of the Sacraments concerning the payment of fees;
9 c) that the Ordinaries of France, of the three kingdoms of Great Britain, of Germany, of Austria and of Poland, during the war, whenever access to the Holy See is foreseen to be difficult or impossible for at least a month, may use the same faculties which are enumerated above under letters a and b. These presents being valid notwithstanding any contrary mandates whatsoever of the Most Holy Father.
10 Given at Rome, from the Secretariat of the S. C. Consistorial, on 25 April 1918.

DECRETUM CIRCA QUASDAM ORDINARIORUM FACULTATES
3 1) exceptis locis S. Congregationi de Propaganda Fide subiectis, pro quibus suo tempore quae opportuna erunt decernentur, alibi, in universis scilicet dioecesibus iuri communi obnoxiis, facultates omnes pro foro externo Ordinariis concessae, quaeque in Formulis et Brevi superius recensitis continentur, a die 18 maii huius anni cessabunt, neque amplius in usu esse poterunt;
4 2) in locis tamen remotioribus aliisque ad quae, sive praesentis belli causa, sive alia qualibet ratione, praesentis decreti notitia utili tempore non pervenerit, dispensationes et ordinationes vi veterum facultatum ab Ordinariis forte concessas Ssmus Dominus ratas habet, firmo tamen ut ipsi ab acceptae notitiae die, si res adhuc sit integra, huic decreto se conforment;
5 3) facultates pro foro interno a S. Poenitentiaria datae, aliaeque ratione praesentis belli concessae, aut peculiaribus de causis ab Ordinariis obtentae, sub huius decreti dispositione non comprehenduntur, et ideo abolitae non sunt;
6 4) circa dispensationes matrimoniales, quamvis vi canonum 1043-1045 Ordinarii opportunas dispensationes largiri queant « urgente mortis « periculo » et « quoties impedimentum detegatur cum iam omnia sint « parata ad nuptias, nec matrimonium sine probabili gravis mali periculo « differri possit », nihilominus Ssmus Dominus, attentis temporum et locorum adiunctis, haec ulterius indulgenda decrevit:
7 a) ut locorum Ordinarii in America, in Insulis Philippinis, in Indiis Orientalibus, in Africa extra Mediterranei maris oras, et in Russia, per quinquennium a die 18 maii huius anni, dispensare valeant ab impedimentis minoris gradus quae recensentur in can. 1042, servatis regulis in eo Codicis capite statutis: itemque ut matrimonia nulliter contracta, ob aliquod eiusdem minoris gradus impedimentum, in radice sanare queant, iuxta regulas in capite XI, tit. VII, lib. III Codicis de convalidatione matrimonii positas, monita parte impedimenti conscia de sanationis effectu;
8 o) ut iidem locorum Ordinarii dispensare pariter per quinquennium valeant ab impedimentis maioris gradus, sive publicis sive occultis, etiam multiplicibus, iuris tamen ecclesiastici (exceptis impedimentis provenientibus ex sacro presbyteratus ordine et ex affinitate in linea recta consummato matrimonio), nec non ab impedimento impediente mixtae religionis, si petitio dispensationis ad S. Sedem missa sit et urgens necessitas dispensandi supervenerit, pendente recursu. Concedendo tamen hisce in. casibus dispensationes, Ordinarius prae oculis semper habeat regulas statutas in Codice, lib. IN, tit. VII, cap. 2, 3 et 4, circa impedimenta in genere et in specie, itemque clausulas apponi solitas in matrimoniis cum hebraeis et mahumetanis; nec dispensationem concedat nisi caverit de plena earum omnium observantia iuxta sacrorum canonum praescriptiones, et iuribus S. Congregationis de disciplina Sacramentorum circa taxarum solutionem consulat;

3 1) eccettuati i luoghi soggetti alla S. Congregazione di Propaganda Fide, per i quali a suo tempo si decreteranno le cose opportune, altrove, cioè in tutte le diocesi soggette al diritto comune, tutte le facoltà concesse agli Ordinari per il foro esterno, e che sono contenute nelle Formule e nel Breve sopra ricordati, cesseranno dal giorno 18 maggio di questo anno, e non potranno più essere in uso;
4 2) tuttavia nei luoghi più remoti e in altri dove, sia a causa della presente guerra, sia per qualsiasi altra ragione, la notizia del presente decreto non sia pervenuta in tempo utile, le dispense e le ordinazioni concesse dagli Ordinari in virtù delle antiche facoltà Sua Santità le ratifica, fermo restando però che essi, dal giorno della ricezione della notizia, se la cosa sia ancora integra, si conformino a questo decreto;
5 3) le facoltà per il foro interno date dalla S. Penitentieria, e altre concesse a motivo della presente guerra, o ottenute dagli Ordinari per cause particolari, non sono comprese nella disposizione di questo decreto, e perciò non sono abolite;
7 a) affinché gli Ordinari dei luoghi in America, nelle Isole Filippine, nelle Indie Orientali, in Africa al di fuori delle coste del Mediterraneo, e in Russia, per il quinquennio dal giorno 18 maggio di questo anno, possano dispensare dagli impedimenti di grado minore che sono elencati nel can. 1042, osservate le regole stabilite in quel capitolo del Codice: e inoltre affinché i matrimoni nullamente contratti a causa di qualche impedimento dello stesso grado minore possano essere sanati nella radice, secondo le regole stabilite nel capitolo XI, titolo VII, libro III del Codice sulla convalidazione del matrimonio, avvertita la parte conscia dell'impedimento dell'effetto della sanazione;
8 b) affinché gli stessi Ordinari dei luoghi possano parimenti dispensare per il quinquennio dagli impedimenti di grado maggiore, sia pubblici sia occulti, anche molteplici, però di diritto ecclesiastico (eccettuati gli impedimenti provenienti dal sacro ordine del presbiterato e dall'affinità in linea retta da matrimonio consumato), nonché dall'impedimento impediente della religione mista, se la richiesta di dispensa sia stata inviata alla S. Sede e sopravvenga urgente necessità di dispensare, pendente il ricorso. Concedendo tuttavia in questi casi le dispense, l'Ordinario tenga sempre presenti le regole stabilite nel Codice, libro IV, titolo VII, capitoli 2, 3 e 4, circa gli impedimenti in genere e in specie, e inoltre le clausole solite essere apposte nei matrimoni con ebrei e maomettani; né conceda la dispensa se non avrà provveduto alla piena osservanza di tutte queste cose secondo le prescrizioni dei sacri canoni, e consulti i diritti della S. Congregazione della Disciplina dei Sacramenti circa il pagamento delle tasse;
