Sempiternum humani generis

1 La salvezza eterna del genere umano procurare con ogni studio e con ogni sforzo, e perciò moltiplicare e aumentare opportunamente secondo i tempi e i luoghi tra i popoli tanto gli aiuti della fede e della pietà, quanto i vincoli della carità e della disciplina, è stata sempre e rimane la massima sollecitudine della Chiesa cattolica. Sebbene invero di questa sollecitudine innumerevoli indizi si manifestino dovunque, tuttavia la principale si riconosce nell'erezione delle diocesi e delle province ecclesiastiche, le quali i Romani Pontefici hanno cura di istituire specialmente in quelle regioni che negli ultimi tempi sono state prescelte e presentano rispetto alle altre maggiori e più rapidi incrementi di cittadini e di beni. Oltre a queste regioni, la Repubblica Brasiliana in questi recentissimi tempi si è meritata particolari cure della Sede Apostolica. Infatti, dopo che Leone PP. XIII con le Lettere Apostoliche, il cui inizio è «Ad universas orbis ecclesias», date il ventisette aprile dell'anno del Signore milleottocentonovantadue, con quattro nuove diocesi erette e un'altra provincia ecclesiastica costituita, restaurò l'intera gerarchia ecclesiastica nella Repubblica Brasiliana, molte altre diocesi nella medesima Repubblica furono erette e costituite, cioè quella dello Spirito Santo di Belem, quella del Pará e quella di Maranhão, nell'anno milleottocentoottantacinque, quella di Pouso Alegre nell'anno millenovecentouno, quella di Alagoas nell'anno millenovecentouno, quella del Piauì nell'anno millenovecentodue, e infine nell'anno millenovecentoquattro la Prelatura di Santa Maria o diocesi nullius. Ma aumentato il numero delle diocesi, opportuno, anzi assolutamente necessario è parso costituire nuove sedi arcivescovili. Poiché però la Repubblica Brasiliana si estende per territorio vastissimo, e soltanto due sedi arcivescovili in esso ora esistono, non solo gli Arcivescovi delle Sedi suffraganee difficilissimamente possono provvedere alle necessità che li riguardano, ma anche le cause ecclesiastiche, specialmente matrimoniali, che non possono differirsi se non con massimo pericolo delle anime, si protraggono troppo a lungo, e molti altri inconvenienti ne conseguono.

2 Poiché dunque in questi ultimi tempi preghiere a questo fine sono state presentate alla Sede Apostolica, il Santissimo Signor Nostro Pio PP. X, considerate maturely tutte le cose che dovevano considerarsi, riconosciuta l'utilità della cosa, e consultato il parere della Sacra Congregazione preposta all'espedizione degli affari ecclesiastici, ha ritenuto di dover condiscendere ai voti dei Vescovi e dei fedeli.

3 Affinché dunque questo sia buono, favorevole e felice, a gloria di Dio e ad incremento della Religione nella Repubblica Brasiliana, la Sua Santità, usando della potestà a sé e alla Sede Apostolica espressamente riservata nelle ricordate Lettere Apostoliche «Ad universas orbis ecclesias» di intraprendere nella Repubblica Brasiliana una nuova circoscrizione di diocesi, ogni volta che nel Signore opportuno fosse parso, e supplito, per quanto fosse necessario, il consenso di quanti in questa materia interesse avessero o avere si presumesse, le sedi episcopali di Belem del Pará e di Maranhão, delle quali l'una è situata a settentrione, l'altra a meridione della Repubblica Brasiliana, e che rispetto alle altre più apte e degne sono parse di essere elevate alla dignità di sedi metropolitane, ha decretato di erigere e costituire in metropolitane nel modo che segue.

4 Dalla S. Congregazione Concistoriale

5 I. Anzitutto dunque la Sua Beatitudine, dalla pienezza della potestà apostolica, l'una e l'altra sede episcopale di Belem del Pará e di Maranhão, dal diritto metropolitico della chiesa arcivescovile del Santissimo Salvatore di Bahia e della chiesa arcivescovile di San Sebastiano del Rio di Janeiro rispettivamente sciolse e esentò, e le medesime, sotto il medesimo titolo che portano, nelle medesime condizioni in cui ora si trovano, alla dignità e all'onore arcivescovile elevò ed eresse per un Arcivescovo d'ora innanzi di Belem del Pará e di Maranhão, e ordinò e decretò che l'ordine dei Canonici del tempio massimo di ciascuna diocesi il Metropolita ascolti perpetuamente.

Quindi agli Arcivescovi di Belem del Pará e di Maranhão, dopo che sia stata debitamente fatta la postulazione in Concistoro, la medesima Sua Beatitudine l'uso del pallio e della croce da portarsi innanzi a sé, secondo il costume degli altri Vescovi e la prescrizione dei sacri canoni, entro i limiti di ciascuna arcidiocesi, e non altrove assolutamente concede, e parimenti tutti gli insegni arcivescovili, i privilegi, gli onori e i diritti, di cui le altre chiese arcivescovili per il Brasile e i loro Presuli in qualunque modo, non però a titolo oneroso o da indulto o da privilegio particolare, fruiscono, godono e si gloriano.

7 III. A queste due sedi arcivescovili, come sopra costituite, la Sua Santità assegna e attribuisce alla chiesa metropolitana di Belém do Pará le sedi episcopali di San Luigi di Maragnano, delle Amazzoni e del Piauhy, che a questo fine sottrae ed esonera dal diritto metropolitico della chiesa arcivescovile del Santissimo Salvatore di Bahia, la stessa Prelatura di Santarém, benché nullius dioecesis, derogando pertanto al diritto di esenzione o di immediata soggezione alla Sede Apostolica, di cui la medesima Prelatura di Santarém, in quanto nullius dioecesis, dovrebbe godere; alla diocesi di Mariannes invece la diocesi di Coyás, che parimenti sottrae dal diritto metropolitico della medesima chiesa arcivescovile del Santissimo Salvatore di Bahia, e a Belém, do Pará e Mariannes, le sedi episcopali di Adamantina e di Pouso Alegre, che separa e distacca dalla provincia ecclesiastica di San Sebastiano del Rio di Janeiro.

8 IV. Poiché per reggere la chiesa cattedrale di Belém do Pará è stato di recente per Lettere Apostoliche in forma di Breve date il 23 aprile di questo anno eletto il R. P. D. Giuseppe Marcondes Homen de Mello e la diocesi di Mariannes è da molti anni retta dal Vescovo R. P. D. Silverio Gomez Pimenta, la medesima Santità Sua ha ordinato che gli stessi, ora costituiti Arcivescovi, reggano le archidiocesi loro affidate con lo stesso diritto con cui finora le hanno rette, e li ha assolti e dispensati dall'ottenere Lettere Apostoliche da spedirsi sotto piombo o sotto l'Anello del Pescatore per la dignità accresciuta.

9 V. Ha parimenti decretato la Beatitudine Sua che le medesime chiese di Belém do Pará e di Mariannes, erette alla dignità metropolitana, siano tassate ciascuna separatamente in fiorini d'oro della Camera sessantasei con la terza parte di un fiorino, e queste tasse siano descritte nei libri della Camera Apostolica secondo l'uso.

10 VI. Per eseguire quanto sopra la medesima Beatitudine Sua ha degnato di deputare il R. P. D. Giulio Tonti Arcivescovo Tit. di Ancira e Nunzio Apostolico nella Repubblica del Brasile con le facoltà necessarie e opportune, anche di subdelegare a effetto di cui si tratta qualsiasi altra persona costituita in dignità ecclesiastica, nonché di pronunciare definitivamente su qualsiasi opposizione che sorga in qualunque modo nell'atto dell'esecuzione, imponendogli l'obbligo di trasmettere a questa Sacra Congregazione entro sei mesi gli atti dell'esecuzione redatti in forma autentica, affinché possano conservarsi nell'archivio di questa Sacra Congregazione.

11 VII. Infine la Santità Sua ha voluto che questo presente Decreto consistoriale sia valido allo stesso modo come se su questi argomenti fossero state spedite Lettere Apostoliche sotto piombo o sotto l'Anello del Pescatore, e ha ordinato che il Decreto stesso sia riferito negli atti di questa Sacra Congregazione Consistoriale. Dato a Roma questo giorno 1° maggio dell'anno del Signore 1906.

1 The eternal salvation of the human race to care for with all zeal and all effort, and therefore among peoples both the aids of faith and piety, and the bonds of charity and discipline aptly adjusted to times and places to be multiplied and increased has always been, and this is the greatest solicitude of the Catholic Church. But although of this solicitude innumerable signs appear everywhere, the principal one is held to be in the erection of dioceses and ecclesiastical provinces, which the Roman Pontiffs are accustomed to establish especially in those regions which in recent times have been chosen, and have greater and more ready increase of citizens and goods than others. Besides these regions, however, the Brazilian Republic in these most recent times has merited particular cares of the Apostolic See. Indeed, after Leo PP. XIII by Apostolic Letters, whose beginning is Ad universas orbis ecclesias, given on the third day before the Kalends of May in the year of Our Lord 1892, having restored the entire ecclesiastical hierarchy in the Brazilian Republic by four newly erected dioceses and another constituted ecclesiastical province, several other dioceses have been erected and constituted in the same Republic, namely of the Holy Spirit Belem, of Para and Mariannen, in the year 1895, of Pouso Alegre in the year 1900, of Alagoas in the year 1901, of Piahuy in the year 1902, and finally in the year 1904 the Prelature of Santemerensis or Nullius diocese. But with the number of dioceses increased, it seemed opportune, indeed altogether necessary, to constitute new archiepiscopal sees. Since, however, the Brazilian Republic extends its territory most widely, and only two archiepiscopal sees now exist in it, not only can the Archbishops of Suffragan Sees with the greatest difficulty meet the necessities in those matters which pertain to them, but also ecclesiastical causes, especially matrimonial ones, which can only be deferred with the greatest peril to souls, are protracted too long, and many other inconveniences follow.

2 Since therefore in these most recent times prayers have been offered to the Apostolic See for this purpose, His Holiness Our Lord Pius X, having weighed with mature deliberation all things which are to be considered, having perceived the utility of the matter, and having sought the opinion of the Sacred Council placed over the dispatch of ecclesiastical business, deemed it right to comply with the wishes of the Bishops and the faithful.

3 That therefore this be good, auspicious and happy, may it turn to the glory of God and the increase of Religion in the Brazilian Republic, His Holiness, using the power expressly reserved to himself and the Apostolic See in the aforesaid Apostolic Letters Ad universas orbis ecclesias for undertaking a new circumscription of dioceses in the Brazilian Republic, whenever it shall seem opportune in the Lord, and having supplied, insofar as it is necessary, the consent of all those who have or are presumed to have an interest in this matter, has decreed to erect and constitute the episcopal sees of Belem of Para and Mariannen, of which the one is situated to the north and the other to the south of the Brazilian Republic, and which have appeared more apt and worthy than others to be raised to the dignity of archiepiscopal sees, into metropolitan sees in the manner which follows.

4 From the S. Consistorial Congregation

5 I. First therefore His Holiness both episcopal sees of Belem of Para and Mariannen, from the fullness of Apostolic power, has released and exempted from the metropolitan right of the archiepiscopal church of the Most Holy Saviour of Bahia and the archiepiscopal church of St. Sebastian of the River of January respectively, and raises and erects them under the same title which they bear, under the same conditions in which they now are, to archiepiscopal dignity and honour for one henceforth Archbishop of Belem of Para and Mariannen, and he has constituted and decreed that the order of Canons of the principal church of each diocese shall hear the Metropolitan perpetually.

6 II. Then to the Archbishops of Belem of Para and Mariannen, after postulation duly made in Consistory, the same His Holiness grants the use of the pallium and the cross to be borne before them, after the manner of other Bishops and according to the prescription of the sacred canons, within the limits of each archdiocese, and nowhere else at all, and likewise all archiepiscopal insignia, privileges, honours and rights, which other archiepiscopal churches throughout Brazil and their Prelates enjoy, possess and have in any way whatsoever, not however by burdensome title or from indult or particular privilege.

To these two archiepiscopal sees, as above established, His Holiness assigns and attributes to the metropolitan church of Belém of Pará the episcopal sees of St. Louis of Maragnão, of the Amazons, and of Piauhy, which for this purpose he withdraws and exempts from the metropolitan jurisdiction of the archiepiscopal church of the Most Holy Saviour of Bahia, and the same Santarém Prelature, although of no diocese, the right of exemption or immediate subjection to the Apostolic See being derogated, by which the Santarém Prelature itself, as a nullius diocese, ought to enjoy; and to Marianná the diocese of Goiás, which he likewise withdraws from the metropolitan jurisdiction of the same archiepiscopal church of the Most Holy Saviour of Bahia, and to Belém, Pará and Marianná, the episcopal sees of Adamantina and of Pouso Alegre, which he separates and detaches from the ecclesiastical province of St. Sebastian of the River of January.

8 IV. Since, however, for the governance of the cathedral church of Belém of Pará there was recently elected by Apostolic Letters in the form of a Brief given on 23 April of this year the Reverend Father Doctor Joseph Marcondes Homen de Mello, and the diocese of Marianná has for many years had as Bishop the Reverend Father Doctor Silverius Gomez Pimenta, the same His Holiness commanded that these same, now constituted Archbishops, shall govern the archdioceses committed to them by the same right by which they have hitherto governed them, and he absolved and dispensed them from the expedition of Apostolic Letters under lead or under the Fisherman's Ring on account of the increased dignity.

9 V. His Beatitude likewise decreed that the same churches of Belém of Pará and Marianná, erected to metropolitan dignity, be taxed each separately in gold florins of the Camera at sixty-six and one-third parts of a florin, and these taxes be inscribed in the books of the Apostolic Camera in the customary manner.

10 VI. For the execution of the foregoing, the same His Beatitude deigned to depute the Reverend Father Doctor Julius Tonti, Archbishop Titular of Ancyra and Apostolic Nuncio in the Brazilian Republic, with the necessary and opportune faculties, and also to subdelegate for the purpose in question any other person constituted in ecclesiastical dignity, and likewise to pronounce definitively upon any opposition arising in any way in the act of execution, with the obligation imposed upon him to transmit to this Sacred Congregation within six months the authentic acts of execution drawn up in proper form, so that they may be preserved in the archives of this Sacred Congregation.

11 VII. Finally, His Holiness willed that this Consistorial Decree be published concerning these matters, to have the same force as if Apostolic Letters under lead or under the Fisherman's Ring had been expedited concerning the same, and he commanded that the Decree itself be entered among the acts of this Sacred Consistorial Congregation. Given at Rome on this day 1 May in the year of Our Lord 1906.
