Ad dominici gregis custodiam

Bull on the reorganization of the ecclesiastical provinces of Upper Germany (Freiburg, Rottenburg, Mainz, Limburg, Fulda)

Bull of Pope Leo XII ·

1 of the vacant sees of the kingdom of Germany.

2 Leo, bishop, Servant of the servants of God, for perpetual remembrance of the matter. For the custody of the Lord's flock and the care of those whom the chief of pastors has placed as shepherds to govern that flock in the ministry of sacred things and the word, the Roman pontiffs have always striven with the greatest and most constant diligence to ensure that this duty, which is commended to them above all by the prince of pastors, be properly guarded.

3 2. With this counsel, therefore, for the good of the Church, which burned with the zeal of Our predecessor of happy memory, Pius the Seventh, who deemed it of great importance to turn his solicitous care toward those who cultivate the Orthodox faith, who are subject to the dominion of the most serene princes and states of Germany, namely the kingdom of Württemberg, the Grand Duchy of Baden, the Electorate of Hesse, the Grand Duchy of Hesse, the Duchy of Nassau, the free city of Frankfurt, the Grand Duchy of Mecklenburg, the Duchies of Saxony, the Duchy of Oldenburg, the Principality of Waldeck, and the free Hanseatic cities of Lübeck and Bremen, and therefore, having most carefully considered all things which seemed more expedient, We took care to assign suitable presiders of sacred things to them. We gave therefore by apostolic letters on the seventh day before the calends of September in the year one thousand eight hundred and twenty, whose beginning is Provida sollertia, that the archiepiscopal see of Freiburg and its four suffragan sees, namely those of Rottenburg, Mainz, Limburg, and Fulda, were constituted with all things opportunely sanctioned for this work, which were to be defined for the census of the faithful, for the colleges of canons, for seminaries, for parishes, for cathedral churches; and indeed, God helping, who is the Father of lights and the author of all consolation, we are already in a position to place suitable pastors in those sees as soon as possible.

4 3. But certain things were still desired to be arranged, by which in future times, especially concerning the election of those to be constituted, provision might be made opportunely according to the nature of places, so that the complete rights of the apostolic See might remain intact in this matter and all things which were to be done there might be commended by the testimony of common opinion. We have applied Our care earnestly to this end, turning over in Our mind in this most grave and difficult matter only this, that all things might be added by which the greatest spiritual gains, procured through the dispositions of the aforesaid bull, are still hindered, and that they might finally obtain the desired outcome which had been constituted for the benefit of religion.

5 § 4. With the entire matter brought under examination, and with those counsels undertaken which the nature of the matter and all its circumstances suggested, having heard some of Our venerable brothers, cardinals of the Holy Roman Church, and from certain knowledge and mature deliberation of Ours, and from the fullness of apostolic power, We decree and command the following.

6 § 5. Whenever the see of an archbishop or bishop of that cathedral church shall become vacant, the chapter shall within a month, to be reckoned from the day of vacancy, take care to inform the supreme prince of the respective territory of the names of candidates belonging to the clergy of the diocese whom it shall have judged worthy and suitable according to the prescriptions of the sacred canons to govern the archiepiscopal or episcopal church holily and wisely. If perchance any one of these candidates should be less pleasing to the supreme prince of the territory, the chapter shall delete him from the catalogue, provided that a sufficient number of remaining candidates remains, from which a new prelate may be elected. Then the chapter shall proceed to canonical election of an archbishop or bishop of one of the candidates who remain according to the customary canonical forms, and shall take care that the document of election in authentic form be brought to the supreme pontiff within a month at the most.

7 6. The drawing up of the narrative process concerning the qualities of the person to be promoted to an archiepiscopal or episcopal church is entrusted to a man constituted in dignity of the respective province or diocese, according to the form of instruction of pious memory Urban VIII, pope, issued by his command, to one of the bishops of the province or to an ecclesiastical person of the respective diocese; which being received, if the supreme pontiff shall have ascertained that the person to be promoted is instructed in those gifts which the sacred canons require in a bishop, he shall confirm him by apostolic letters as soon as it can be done according to the forms established.

8 § 6. The preparation of the informative process concerning the qualities of the one to be promoted to the archiepiscopal or episcopal sees shall be entrusted to a bishop of the province or to a man constituted in dignity of the respective diocese, according to the form of instruction edited by order of Urban, pope of pious memory, of the Eighth. When this is received, if the supreme pontiff shall have ascertained that the one to be promoted is instructed with those gifts which the sacred canons require in a bishop, he shall confirm him as soon as possible can be done according to the established forms by apostolic letters.

9 § 8. Chapters both of the metropolitan and cathedral churches for the first time in the manner prescribed. After an archbishop or bishop respectively shall have been instituted by the authority of the Holy See, it shall be committed to him by the Supreme Pontiff, that in the name of the same Supreme Pontiff he proceed to the nomination of the dean, canons, and vicars of the chapter, and give them canonical institution; thereafter, whenever the office of dean, or canonry, or vicariate shall have become vacant, the archbishop or bishop with the respective chapter shall propose alternately within six weeks from the day of vacancy to the supreme territorial prince four candidates constituted in sacred orders, and endowed with those qualities which the sacred canons require in capitular members. If by chance any one of these candidates should be less pleasing to the supreme territorial prince, the same supreme prince shall take care to indicate this as soon as possible to the archbishop or bishop, or respectively to the chapter, so that he may be struck from the list of candidates. Then the archbishop and bishop shall proceed to the collation of the office of dean, canonry, or prebend, or vicariate, or respectively the chapter within four weeks shall proceed to the nomination of one of these candidates, to whom the archbishop or bishop shall give canonical institution.

10 § 9. In the seminary of the archbishop or bishop, the number of clerks and students shall be instituted and educated according to the form of the decrees of the sacred Council of Trent, which number shall correspond to the extent and necessity of the diocese, and shall be suitably determined by the bishop.

11 10. It shall be free to communicate with the Holy See concerning ecclesiastical matters, and the archbishop in his diocese and ecclesiastical province, and likewise the bishops each in his own diocese, shall exercise full episcopal jurisdiction, which according to the canons now in force and the present discipline of the Church belongs to them. These things, moreover, which by the tenor of these present apostolic sanction we confirm, we strictly command, that the prelates and chapters of the aforesaid sees in those matters which pertain to them shall accurately and diligently execute and observe. This we await from the most serene princes with certain and pleasant hope, that, observing with that great and lofty spirit of theirs, and intent upon bringing about the happiness of peoples, what benevolence We have shown ourselves in this whole matter, they will show themselves increasingly benevolent toward their Catholic subjects, whom certainly they will find at all times bound to them by faith and obedience and the study of obeying in the highest degree. § 11. Decreeing that these same present letters can never at any time be noted or impugned on the ground of surreption and obreption, or nullity, but shall always be firm, valid, and efficacious, and shall be so.

12 § 12. Notwithstanding general or special constitutions and ordinances, and Our rules and those of the apostolic chancery, especially concerning acquired right not to be taken away, and all other things whatsoever which merit special mention to the contrary. All and singular of which, having their tenor as if expressly and word for word inserted, otherwise remaining in their force, we specially and expressly derogate for the purpose of the aforesaid matters. 13. We will moreover that copies of these present letters, even if printed, subscribed however by the hand of some public notary, and furnished with the seal of a person constituted in ecclesiastical dignity, shall everywhere receive the same faith which would be given to these presents if they were exhibited or shown.

13 14. Let no one whatsoever be permitted to infringe this page of Our concession, approbation, derogation, statute, mandate, and will, or to dare to act contrary to it with rash presumption; if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul His apostles. Given at Rome at St. Peter's in the year of the incarnation of the Lord one thousand eight hundred twenty-seven, on the third day before the Ides of April, in the fourth year of Our pontificate.

1 sedium vacantium regni Germaniae.
