Bull on the privileges and statutes of the Carmelite confraternities

Bull of Pope Clement VII ·

of the Order 3.
Clement, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 From the clement provision of the Apostolic See, and likewise from the devoted piety of persons serving the Lord under the yoke of Religion and regular chastity, it is recognized that the Roman Pontiff, sometimes through his predecessors the Roman Pontiffs, for the happy success and peace of those same persons and their places and for the salvation of the souls of Christ's faithful occupied in pious works, approves and renews what has been granted, and communicates what has been renewed, and grants other things anew, as he perceives to be salutarily expedient in the Lord.

2 § 1. Indeed, on behalf of the beloved sons Nicholas Audet, general, and the provincial and prior brothers of the houses of the Order of the Blessed Mary of the Virgin of Mount Carmel, as well as brothers and sisters of both sexes of the confraternities instituted in the churches of the houses of the same Order, a petition was recently presented to us containing that formerly John XXII and Alexander V, of blessed memory, Roman Pontiffs our predecessors, granted to all and each of the Christ's faithful who wished to enter the confraternity of Mount Carmel, or to be enrolled in the number of the brothers of such confraternities, and to observe the statutes of the Order itself, and to wear the habit of the said Order, and to call themselves brothers and sisters of the said Order, in such a way that if a virgin woman promised to keep chastity inviolably, a widow continence, and a married woman the rights of matrimony, as holy Church prescribes, at the time of their entry and observed these things, they remitted the third part of their sins in the Lord; and that most glorious Mother of God, ever virgin Mary, would aid the souls of those same brothers or religious and sisters, after their passing, with her continuous intercessions, pious suffrages and special protection. And that those brothers themselves, wishing to become partakers of the same graces of those predecessors, should recite the canonical hours according to the form granted to this Order by Albert the patriarch and ordained; but those ignorant of letters, on the days on which holy Church prescribes fasting, should fast, and likewise on Wednesday and Saturday throughout the whole time of their life, except on the day when any of the aforesaid weekdays should happen to fall on the Nativity of Our Lord Jesus Christ, they should abstain from meat.

3 § 2. And also certain other Roman Pontiffs, even our predecessors, granted to the brothers and sisters of the said Order very many and diverse privileges, immunities, exemptions, especially the fourth part of funeral fees not to be paid to secular priests, and indults, indulgences and remissions of sins and graces to the said Order, and to its brothers, nuns, sisters and persons of both sexes and to the monasteries of nuns and houses of sisters and their churches and places whatsoever, even by way of extension or communication, and otherwise, as is said to be more fully contained in the various letters of those same predecessors made concerning this matter.

4 § 3. Wherefore, on behalf of the general, provincial, priors, and brothers and sisters of both sexes aforesaid, asserting that with devotion of the faithful growing cold day by day, the houses of brothers and sisters and monasteries of this kind require no small repair, and therefore it is necessary to invite the faithful themselves to grant temporal goods for such repair by spiritual gifts and graces, and to induce them to do so, we were humbly supplicated that we would deign, from apostolic benignity, to approve and renew the aforesaid privileges, indults, immunities, exemptions and graces and other things, and to command them to be inviolably observed, and to grant them anew for greater security.

5 § 3. Wherefore, on behalf of the provincials, priors of either sex, and the confirmation of the aforesaid brothers, asserting that, with devotion to their religion growing cold day by day, the houses of the brothers and sisters and monasteries of this kind stand in need of no small repair, and therefore that it is necessary to invite the faithful themselves to grant temporal goods for such repair by means of spiritual gifts and graces, and to induce them to do so, we were humbly petitioned that we would deign, out of apostolic benignity, to approve and renew the aforesaid privileges, indults, immunities, exemptions and graces and other matters, and to command that they be inviolably observed, and to grant them anew for greater security.

6 § 4. We therefore, of the said Order, which we cherish above others in the bowels of charity, zealously desiring its prosperous and tranquil state and the salvation of souls with paternal affection, inclined by these supplications, the letters of John and Alexander and other predecessors, and through those same predecessors, all and singular privileges, immunities, exemptions, even of not paying the fourth part of funeral expenses to secular persons (as regards the brothers of houses in possession of not paying the fourth part itself only), and indults, indulgences, apart from plenary ones, remissions of sins and graces granted to the Order and its brothers, nuns, sisters and confraternity members of either sex and persons, houses, monasteries, churches and places whatsoever, even by way of extension or communication and otherwise howsoever, even by us and the Apostolic See, whose tenors we wish to be held as sufficiently expressed and inserted in the present, we approve and renew by apostolic authority, by the tenor of the present, and ought to obtain the strength of perpetual firmness and be inviolably observed.

7 § 5. And the same brothers, nuns, sisters, persons, monasteries, houses and churches and other places of this kind we decree ought to be able to use, enjoy and possess all and singular privileges, immunities, exemptions, indults, indulgences (apart however from plenary ones), remissions of sins and graces, granted and to be granted in general to any congregations of the said and other Orders, even Mendicant ones, to brothers and persons and confraternities not contrary to their profession, and to other Orders whatsoever, even non-Mendicant ones, howsoever granted, in all things and through all things, just as if they had been granted to them.

8 § 6. And anew, for greater caution, we also grant all these things anew.

9 § 7. And the brothers of the said Order we exempt entirely from the jurisdiction of inquisitors of heretical depravity, and we take them under our protection and that of the said See, and to the same inquisitors we

10 strictly forbid:

11 under the penalties of excommunication latae sententiae and deprivation of their offices, that they presume in any way to concern themselves with the said brothers, even on account of the crime of heresy. Decreeing null and void whatever may be attempted by them knowingly or unknowingly.

12 § 8. And to all and singular confraternity members of either sex and to each of them, they may choose for themselves some suitable secular priest or regular of any Order, even Mendicant and of the Observance, who may absolve them and each of them from any, even major excommunication, suspension and interdict and other ecclesiastical sentences, censures and penalties, from law or from man, imposed for any occasion or cause at any time, and from whatever they may be entangled in, even if their absolution were specially or generally reserved to the aforesaid See (except through the letters customarily read in Coena Domini), and from transgressions of any vows and oaths as well as Church precepts; from the guilt of perjuries, simony and mental or causal homicide; from the laying on of violent hands against any ecclesiastical persons, not however bishops or their superiors, in the past; from omissions of fasts, canonical hours, divine offices and imposed penances in whole or in part, and from all their other sins, crimes, excesses and offenses, however grave and enormous, even such as on account of which the aforesaid See would merit to be consulted, in cases reserved in any way to the said See (except those contained in the said letters of Coena Domini), once in life and at the point of death; but in other cases not reserved to the said See, as often as it shall be opportune, having diligently heard their confessions, to absolve them and to impose salutary penance for their offenses. But any vows of visitation whatsoever (overseas, to the thresholds of the blessed Apostles Peter and Paul of the City and of St. James in Compostela, as well as of Religion and chastity vows only excepted) to commute into other works of piety, and to relax any oaths whatsoever, without prejudice to a third party; and to all their sins, once in life and at the point of death, as aforesaid, even if absolution does not then follow, to impart full remission and absolution by apostolic authority.

13 Having heard them, to absolve them, and to impose upon them salutary penance for their offences committed. Moreover, he is able to commute whatever vows of visitation (excepting only those of pilgrimage overseas, of the thresholds of the blessed Apostles Peter and Paul of the City and of St. James in Compostela, as well as vows of religious life and chastity) into other works of piety, and to relax whatever oaths, without prejudice to a third party; and he is able to bestow, by apostolic authority, full remission and absolution of all their sins, once in life and at the point of death, as aforesaid, even if it does not follow at that time.

14 § 9. And let it be permitted to all and each of the aforesaid confraternity members of either sex to use a portable altar, on which Mass may be celebrated and each of them may have a portable altar even at a time of interdict; with due reverence and honour, upon which, in places suitable and fitting for this purpose and honest, even if not sacred, and by any, even apostolic, authority interdicted or at a time of cessation from divine services, provided they have not given cause for such interdict or cessation, and it does not depend on them that apostolic interdict is not obeyed, even before daylight breaks, yet concerning daytime around light or around midday, when the nature of business pressing at the time shall have required it, in their presence, with doors closed, excommunicated and interdicted persons excluded, bells not rung and in a submissive voice, Masses and other divine offices may be celebrated by secular or regular priests of this kind, and at any time the Eucharist and other ecclesiastical sacraments from whichever priest they shall have preferred, suitable and competent, and anywhere, without prejudice to the rector of the parish church, they may freely and lawfully receive and administer. And if it should happen that they or any of them die at the time of such interdict, their bodies may be committed to ecclesiastical burial with some honest funeral ceremony. 1 Concerning the observance of interdict, see Concil. Trid., sess. xxv, De Regulur. cap 12,

15 Vii PP. iil An. C. ISSO

16 § 10. And that without the Lenten stations and at other times of any year, on the days of the stations of the basilicas and churches of the blessed city of Rome, outside its walls one or two churches, or one, two or more altars in those regions where they or any of them shall happen to reside or to turn aside, which they or any of them shall have chosen or shall choose, devoutly visiting, they may obtain so many and individual and similar indulgences and remissions of sins as they would obtain if they personally visited each and every one of the said churches of the city and outside it appointed for such stations on individual days.

17 § 11. Moreover also to all faithful Christians of either sex, who shall have extended a helping hand for the repair of monasteries and houses and the sustenance of the brothers of this kind, so that they may obtain and do obtain the aforesaid indulgences; and to all and each of the other faithful Christians of either sex, who shall have aided and maintained the said Order and its houses and monasteries, brothers, sisters, nuns of this kind with their alms and subsidies for the time being, so that they and each of them may become in perpetuity participants of all prayers, suffrages, alms, fastings and prayers, Masses, canonical hours, disciplines, pilgrimages and other spiritual goods, which for the time being are performed in the universal holy Church militant, and may rejoice in all its benefits; and to all others, who shall have wished to rejoice in the graces of the same confraternity members, giving and bestowing some alms or charity, as it shall seem fitting to them and to the president

18 of such confraternities, we grant that they become participants of such graces.

19 § 12. Notwithstanding the constitutions and ordinances of the council and apostolic ordinances and the statutes and customs of the said Order, even confirmed by oath, apostolic confirmation or any firmness, as well as privileges and indults and letters apostolic by whichever Roman Pontiffs, our predecessors, and we and the aforesaid See, even by our own motion and from certain knowledge and from the fullness of apostolic power and with whatsoever irritant, annulling, cassatory, revocatory, modifying, preservative, exceptive, restitutive, declarative, attestative of intent and derogatory clauses with derogations of derogations and other more efficacious, most efficacious and unusual clauses in any manner whatsoever, even repeatedly, granted and confirmed and renewed, all of which, even if, for their sufficient derogation, special and individual mention or any other expression of them and their whole tenors word for word and not through general clauses importing the same, and if it be provided expressly in them that they may in no way be derogated from, and of all of them, as well as of whatsoever, even in the form of a brief, letters, on the occasion of the aforesaid matters made in any manner whatsoever, and of whatsoever contained in them, the tenors of which are present for sufficiently expressed and inserted word for word, as well as the modes and forms to be observed for this purpose individually observed, we on this occasion only, otherwise remaining in their force, by the tenor of these letters specially and expressly derogate, as well as from all those which the aforesaid predecessors in their letters wished not to stand in the way, and from all other things contrary whatsoever.

20 § 13. We will, however, that the present [document], with transcripts made by the hand of an alien public notary subscribed and furnished with the seal of some person constituted in ecclesiastical dignity, shall receive the same full faith in judgment and outside of judgment as would be given to the present originals, if they were exhibited or shown.

21 To no one whatsoever of mankind, therefore, etc.

22 If anyone, etc.

23 Given at Rome at St. Peter's, in the year of the Lord's Incarnation one thousand five hundred thirty, on the day before the Ides of August, in the seventh year of our pontificate. Given on 12 August 1530, pontificate year vii.

dell'Ordine 3.

13 genter auditis, absolvere, illisque prò commissis poenitenliam salutarem iniungere.
