Bull erecting the Diocese of Pasto and dividing the Diocese of Popayán

Bull of Pope Pius IX ·

1 OF THE SEE OF POPAYÁN AND THE ERECTION OF A NEW EPISCOPAL SEE OF PASTOPOLITANA. PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER

2 I. Placed by divine mercy at the lofty watchtower of the Church Militant, from the office of Apostolic solicitude entrusted to Us, We care for all the Christian faithful throughout the entire circle of the earth, and We leave nothing untried, so that, with God the best and greatest assisting, We might satisfy in the best manner possible so grave and great a burden.

3 Therefore, as soon as, in most difficult times indeed, We ascended the Chair of Peter, We deemed it to be the duty of Our office to turn the gaze of Our eyes and mind even to the distant regions of America, and to aid them with counsel, vigilance and assistance. With great pleasure of Our heart We have seen the number of Christians increasing day by day, and We have erected new Bishoprics, as the need was, lest the Sheep entrusted to Us be destitute of the aid and assistance of prelates. By this counsel indeed in the Apostolic Letters given in the year one thousand eight hundred and forty-two, when Our beloved brother Ferdinand Cuero y Caicedo of blessed memory was appointed Bishop to the vacant Church of Popayán, there was reserved to this holy See a new circumscription of the same Diocese to be made at whatever time and in whatever manner. This same Prelate, some years ago, together with his Cathedral Chapter most earnestly consenting, sent urgent prayers and supplications to Us, that from the circumscription to be made of the Popayán Diocese, another Bishopric be composed, having its Cathedral and See conveniently and opportunely in the civic town of Pastopolitana. For it has been ascertained by Us that the present Diocese of Popayán is extended most widely, containing very many parishes scattered through those places, for the most part impassable, rough and subject to inclement air, and an immense number of inhabitants. From which it comes about that its Prelate for the time being, unequal to so many cares and labors, although he provides strenuous and diligent effort, cannot complete the care of the whole Diocese where it ought, or at least cannot sufficiently exhaust it according to human strength. It was therefore expedient that another Prelate be added, who by work, word and vigilance might more presently meet the spiritual necessities of the same Christian faithful, and thus might strive to avert or to remedy salutarily whatever worse things may have crept in, and to do all things which shall appear more useful and opportune in the Lord. But above all he must labor in order to establish a Seminary of Ecclesiastical Students; so that boys called to the lot of the Lord, instructed in letters and good discipline, may render more useful labor in cultivating the Lord's vineyard, and may propagate the Catholic Religion especially in those Coquetan Regions, where nomadic tribes still sit in the darkness of gentility and errors, having no means from which to draw the evangelical light, and thus may at length sometime arrive at the gate of eternal beatitude.

4 All these things having been maturely weighed, and receiving with benign mind the prayers of Our Venerable Brother Peter Anthony of Torres, the present Bishop of Popayán, who, following in the footsteps of his Predecessors, once and again besought Us concerning this dismemberment of his most ample Diocese to be made for the more useful good of his Sheep, to the greater glory of the Divine name, to the increase of the Catholic religion, with mature deliberation, no contrary matters whatsoever, even those worthy of special mention, standing in the way, or with peculiar derogation inflicted in this case, from certain knowledge and by Our own motion, all those having an interest or presumed to have one in any way being heard, and supplying insofar as it may be necessary from the fullness of Apostolic power the aforementioned reservation made in the Apostolic Letters in the Year One Thousand Eight Hundred and Forty-two, We hold as ratified, and We have deemed it time, according to the judgment also of the modern Bishop of Popayán, to whom again that Cathedral Chapter also obsequently and properly assented, that at length this new Diocese be constituted in South America. From the ordinary jurisdiction and administration therefore of any Bishop of Popayán, let there be completely, absolutely and perpetually exempted not only those Provinces which are called Pasto, Iguarres, and Barbacoas in the vernacular, but also that other territory called Mocoa, or Coquetá, so that together removed and dismembered are all and singular towns or even cities, villages, rural areas, parishes found in those places, namely together with all and singular churches, oratories, ecclesiastical benefices, pious institutions, and customary accessories whatsoever, likewise all and singular inhabitants of either sex, provided they have not otherwise been specially exempted.

5 Since, however, the town of St. John the Baptist, commonly called Pasto, is reported to excel before all other surrounding places with indeed greater prerogatives and with more opportune aids for the matter, we raise it to the dignity of a cathedral city as well, and we command that it be increased with a more worthy title, to enjoy all and singular honors, rights, graces, privileges, favors and indults by which at present the other cities with episcopal residence are adorned in that dominion of the New Granadian Republic and enjoy and possess by ordinary law. We also raise to the dignity and honor of a cathedral that parochial and mother church, which stands out among others there both by the amplitude and solidity of the building and by sacred furnishings also for performing pontifical functions, preserving the original invocation of its title, and indeed the parochial status with the same care of souls, which shall continue to be exercised there just as before.

6 There therefore shall be erected and perpetually established a See, Cathedra and Episcopal Dignity for one Bishop henceforth to be called the Bishop of Pasto, who shall preside over the same Cathedral Church, City and Diocese, and thus over all its Clergy and people in the Lord, shall convoke a diocesan Synod, and shall obtain and exercise all and singular rights and duties of the Episcopate, shall have a Cathedral Chapter, shall possess and enjoy all Cathedral and Pontifical insignia whatsoever, honors, preeminences, graces, favors, indults, prerogatives, jurisdictions, and all other things by which today the Cathedral Churches existing in South America and their Prelates possess and enjoy, provided they have not been attributed by special indult or privilege. We constitute and perpetually adjudge to this new Church of Pasto as a separate and proper Diocese the three Provinces mentioned above, namely Pasto, Iguerre, and Barbacoas, as well as another Territory of Macoa or Coquetá together with all cities, towns, villages and rural areas or parishes which are found within their territorial boundaries, and likewise with all churches built there, whether parochial, succursal, or simple, as well as Oratories, Monasteries of regular Friars, Monasteries of women, any pious Institutions and Benefices, if any exist, together with all persons of either sex, in no way enjoying particular exemption, we subject perpetually and completely to the ordinary jurisdiction, governance and power of the Bishop of Pasto for the time being, and we constitute and assign all these things to his Episcopal City, See, Diocese, Clergy and People. All individual documents, whether books, or wills for pious causes, or finally any writings whatsoever, which concern the Ecclesiastical persons, things, rights and accounts of the whole new Diocese of Pasto, shall be carefully examined and separated from the Episcopal Chancellery of Popayán, and for any future convenience of the Bishop of Pasto shall be faithfully placed in the Chancellery of Pasto and perpetually preserved.

7 Concerning the Senate of the Bishop, as is fitting, or concerning the erection and form of the Cathedral Chapter to be made at some time, consideration shall then be had when from this Holy Apostolic See the arrangement of all the Cathedral Chapters of New Granada shall be made, and their status shall be provided for more suitably and firmly. We commend in the meantime, and earnestly beseech the Municipality of Pasto, that, since it has been promised, necessary buildings sufficiently suitable and as close as possible to the Cathedral Church for the decent residence of the Bishop of Pasto and his Ecclesiastical Curia and Chancellery be procured as soon as possible, adorned, and constituted and adjudged to this Bishop and his Successors with free and perpetual ownership. If they cannot have them immediately at hand, and thus it should be necessary to rent them in the meantime, the Municipality of Pasto shall see that the price of this rental and lease is supplied and paid in full each year. So that a Diocesan Seminary, after the manner of other Dioceses according to the prescription of the sacred Council of Trent, may be erected in this new Diocese of Pasto, we command the Executor of these Apostolic Letters named below, that by prudent judgment he select it especially from those places willingly offered for this purpose by the Municipality of Pasto, and constitute it as a Seminary of Ecclesiastical Students, which he shall judge to be more opportune and convenient in the Lord.

8 Furthermore, in order that the erection of the new Diocese of Pastopolis may be properly accomplished, and that We may provide for its preservation and growth, We hold as ratified and fully accepted the pledge already made to Us by the Municipality of Pastopolis itself, by which it has voluntarily and spontaneously promised that it will furnish all those things which are customarily required for any newly established Diocese according to the norm of the other Churches in those Regions, and that it will do all these things with the greatest diligence and care. In the meantime, however, until such endowments are established in stable property, having regard to the particular circumstances, We grant and permit that they be constituted for the present in the revenues of ecclesiastical tithes. But if it should happen, which God forbid, that these revenues should at some time fail, it will greatly concern the zeal and piety of the same faithful to supply the deficiency until a more opportune time. Moreover, upon the aforesaid tithe revenues, the respective endowment of the Episcopal Mensa, the Cathedral Chapter and its Fabric, the Diocesan Seminary, and divine worship shall be established, as shall be judged more opportune by Our Executor from the division of the same revenues.

9 We constitute the Diocese of Pastopolis as a Suffragan Church of the Holy Faith of Bogotá, and We subject it to its Archbishop Metropolitan by all and singular rights, honors, prerogatives, graces, indults, privileges, and all other things whatsoever, which likewise the other Suffragan Churches of that Metropolitan Archbishopric are accustomed to enjoy and which they protect by legitimate use and right.

10 Since, however, the Church of Pastopolis, thus separated and divided from the Diocese of Popayán, is still sufficiently extensive, as are the other Dioceses of the New Granada Republic, We reserve to this Apostolic Holy See and to Ourselves and Our successors free faculty to circumscribe and divide both the Church of Pastopolis itself and the other Churches existing in that government, in whatever manner and at whatever time shall be expedient in the Lord.

11 We decree that the tax to be imposed upon the Episcopal Church of Pastopolis ought to be thirty-three and one-third gold florins of the Camera, which tax We order to be inscribed in the books of the Apostolic Camera and the Sacred College in the customary manner. But in order that all things established above may be carried out rightly, happily, and speedily to the most desired conclusion, We choose, constitute, and appoint as the executor of these Our Letters Our beloved Son Mieczysław, of the Counts Ledóchowski, Our Apostolic Delegate with the Government of the New Granada Republic, and We grant to him all opportune and necessary faculties, so that he may freely and lawfully be able and empowered to carry out, establish, and decree all things disposed above by the delegated Apostolic authority; and moreover We grant to the same Mieczysław the faculty of subdelegating for the full execution of all matters a worthy man distinguished by faith, religion, and integrity, and constituted in ecclesiastical dignity, and both the Delegate himself and his subdelegated may freely and lawfully be able and empowered to pronounce definitively and with any appeal removed upon any question that may perhaps arise in the course of such execution, with those things being observed which ought to be observed by law. To the same Executor We expressly command and enjoin that copies of each of the Acts which both he himself and his subdelegated shall have made, together with the natural boundaries of this entire Diocese of Pastopolis, and each of the towns and parishes individually named, with a topographical map added thereto, within six months from the completion of the execution, he transmit to this Apostolic See in authentic form, which shall be preserved in the archive of Our Congregation presiding over Consistorial Matters in the customary perpetual manner. These present Letters, moreover, and whatever is contained and established in them, even if any others having or pretending to have an interest in the matter were not called and heard, and did not consent to the foregoing, can never at any time be noted, impugned, or called into question on account of the vice of subreptitiousness or obreption or nullity, or of Our intention, or any other, even substantial, defect, but they shall always and perpetually remain valid and efficacious, and shall produce and obtain their full and complete effects, and shall be inviolably observed by all to whom it pertains; and thus and not otherwise by any judges, whether Ordinary or Delegate, exercising any authority whatsoever, even by the Auditors of the Causes of the Apostolic Palace, and by the Cardinals of the Holy Roman Church, even Legates a latere, Vicelegates, and Nuncios of the said See, ought judgment to be rendered and the matter defined, and if anything contrary to these things should be attempted by anyone whatsoever, with any authority, knowingly or unknowingly, We will and decree that it be null and void.

12 Notwithstanding, insofar as it may be necessary, Our rules and those of the Apostolic Chancery concerning acquired right not to be taken away, and concerning favours not to be granted in like manner, and the perpetual dismemberments prohibited by the most recently celebrated Lateran Council, except in cases permitted by law, and also other constitutions and ordinances, whether special or general, enacted in Synodal, Provincial, General, and Universal Councils, and other dispositions of Our Predecessors, the Roman Pontiffs, all and singular of which—even if for their sufficient derogation special, specific and individual mention of them and their entire tenor would have to be made, rather than through general clauses importing the same—We, holding these to be fully and sufficiently expressed by the present, and which would otherwise remain in their force, do derogate from most broadly and fully, specially and expressly, for this occasion only, by this series of letters, and from all other things contrary thereto, even those worthy of special mention, whatsoever.

13 We further will that copies of these Our Letters, even if printed, provided they are subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, shall receive everywhere the same credence as would be given to these presents themselves, if they were exhibited or shown. Let no one whatsoever be permitted to infringe this page of Our Absolution, Dismemberment, Suppression, Erection, Constitution, Assignment, Union, Institution, Concession, Attribution, Indult, Mandate, Precept, Deputation, Decree, Derogation and Will, or to act against it with rash presumption; but if anyone should presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul. Given at Rome at St. Peter's in the year of Our Lord's Incarnation one thousand eight hundred fifty-nine, on the fourth day before the Ides of April, in the thirteenth year of Our Pontificate.

1 SEDIS POPAYANENSIS ET ERECTIO NOVAE SEDIS EPISCOPALIS PASTOPOLITANAE. PIVS EPISCOPVS SERVUS SERVORUM DEI AD PERPETVAM REI! MEMORIAM
