In supremo
Bull transferring the episcopal see from Castro to Acquapendente
bishopric of Aquapendente.
Innocent, Bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 In the supreme throne of the Church militant and in the fullness of apostolic power, constituted by no merits of our own, but by the sole benignity of God, thinking carefully about the prosperous and happy state of all churches and especially of cathedral churches, and about the salvation of the Lord's flock committed to us from on high, we willingly turn our attention to those things by which these same cathedral churches may be happily directed, and the flock itself, by the continual residence of its shepherds with it, may be preserved from harm, and, falling away into error, may be brought back to the path of rectitude, and, so that the shepherds themselves may be able to reside more conveniently and also more usefully in their own cathedral church or diocese, to watch over the flock more fervently, and to fulfill their ministry, we extend effective aid and effort, as, having weighed the quality of things and times, we perceive in the Lord to be salutarily expedient.
2 § 1. Since therefore the city of Castro in the Roman province, whose last bishop was recently killed by a horrible and unheard-of crime, has been reduced by reason both of the unhealthiness of the air and the narrowness and inconvenience of its situation, and the small number of its inhabitants, to such a state that it does not present the appearance of a city, and consequently the bishops have remained outside the diocese for the greater part of the year not without grave detriment to the salvation of souls, nor have there been lacking those who, in the function of visiting the thresholds of the Apostles, have reported by word and writing that provision ought to be made by the Apostolic See concerning the aforesaid matters and other necessities; whereas the town of Aquapendente, not very distant from the said city of Castro, is more healthful both in situation and in the pleasantness of its air, and is abundantly filled, by the blessing of God, not only with inhabitants, but also with monasteries and parish churches, hospitals, confraternities and other churches and pious places, and is known to be worthy of being adorned with the prerogative and title of a city, and with a cathedral and episcopal residence, and among the other churches of the said town, the parish church under the invocation or denomination of the Holy Sepulchre, by its structures and buildings sufficiently spacious, and suitable and fit for the state of a cathedral church: We, having taken mature deliberation upon these matters with our venerable brothers the cardinals of the Holy Roman Church in our secret consistory, and by their counsel and assent, and from the fullness of apostolic power, for the aforesaid and other just causes moving our mind, the name and title or quality of city, with which the aforesaid city of Castro in the Roman province has hitherto been adorned, and its cathedral church, and in it the dignity of bishop, we do by apostolic authority, by the tenor of these presents, perpetually suppress and extinguish, so that from now on it shall in no way be able to use or enjoy any dignity of bishop and city by name, title, denomination, honour, privilege, and prerogative; and the aforesaid town of Aquapendente, with all its county and territory, as well as its clergy and people, churches, monasteries and pious places, from the diocese of Orvieto, to which it is subject in spiritual matters, we do by the authority, counsel, assent and tenor aforesaid, perpetually separate and dismember, and from all superiority, jurisdiction, visitation, dominion and power of the modern and for the time being existing bishop of Orvieto we do perpetually exempt and wholly free; and the same town of Aquapendente we do erect into a city to be called the city of Aquapendente, with the rights, honours and preeminences, which other cities and their citizens use, enjoy, possess and have, and are able and shall be able in any way in the future to use, enjoy, possess and have, and the aforesaid parish church of the Holy Sepulchre, to the praise and glory of almighty God, and of His most glorious Mother the Virgin Mary, and of the same Holy Sepulchre, and the honour of the whole heavenly court, and the exaltation of the Catholic faith, into a cathedral immediately subject to the Apostolic See, under the same invocation of the Holy Sepulchre of our Saviour Jesus Christ, and in it a episcopal seat for one bishop of Aquapendente to be named, who shall preside over the same church and its city and diocese as shall be marked below,1 and shall order and reduce it into the perfect form of a cathedral church, shall convoke abbots, prelates and others to synod, shall uproot, destroy, build, plant, and shall have and exercise all and singular the offices and rights of a bishop, with his episcopal and capitular mensa, and all other cathedral and pontifical insignia, as well as rights, jurisdictions, faculties, prerogatives, privileges, honours, graces, favours and indults real and personal and mixed, which other cathedral churches, and their prelates, chapters and persons in any way use, enjoy, possess and have, and are able and shall be able in the future to use, enjoy, possess and have, and in the same church of the Holy Sepulchre a perpetual vicariate (which the modern rector of the same church by virtue of his former title, without any other provision being made to him thereupon, as before, so long as he shall live, may freely and lawfully retain, and concerning which upon the occurrence of its vacancy for the time being, after previous competition according to the form of the sacred Council of Trent, provision ought to be made) for one perpetual vicar, who shall be bound to exercise the care of souls of the parishioners of the church of the Holy Sepulchre, together with all fruits, revenues, proceeds, rights, and emoluments whatsoever, certain and uncertain, in any way pertaining to the same church of the Holy Sepulchre, the name and denomination of parish church and rector therein perpetually suppressed remaining, we do likewise perpetually erect and institute, and moreover we do adorn the church of the Holy Sepulchre aforesaid with the honour, name, title and insignia of a cathedral church, and to the same church of the Holy Sepulchre, and its episcopal dignity, and the jurisdiction of the bishop, for the city, the same city of Aquapendente thus erected, and for the territory and diocese, the whole of its territory and district, as well as the said land of Castro, and other lands, castles and villages, with all and singular their districts, which existed within the bounds of the diocese of Castro, we do perpetually constitute and assign, and subject and subordinate, and for the endowment all and singular fruits, revenues, proceeds, rights, obventions and emoluments whatsoever, wherever existing, and consisting in whatsoever things, pertaining and belonging in any way to the mensa of the bishop of Castro, as aforesaid suppressed, so that it shall be lawful for the bishop of Aquapendente for the time being to apprehend the corporeal, real and actual possession, or quasi-possession, of all and singular thereof, by himself, or by another or others in his name, by his own authority, and having apprehended to retain perpetually, and moreover to receive, exact and levy the fruits, revenues, proceeds and emoluments arising therefrom lawfully; we do likewise perpetually apply and appropriate. Furthermore, the chapter, archdeaconry, canonries and prebends, and ecclesiastical benefices, having the service of the choir annexed, of the said suppressed church of Castro, and the whole mensa and residence of the chapter, together with all honours, burdens, privileges, prerogatives, goods, revenues, rights and emoluments whatsoever, together with the episcopal, and whatsoever other ornaments and ecclesiastical vestments, relics of Saints and Saintesses, and all other both sacred and profane furnishings, from the same suppressed church of Castro to the said church of the Holy Sepulchre thus erected into a cathedral, so that henceforth the chapter, nor the dignity and canonries, and benefices of the church of Castro, but the cathedral church of Aquapendente shall be named and denominated, and at the same church of the Holy Sepulchre shall reside, and in it shall celebrate divine offices and other ecclesiastical duties, as they were bound to do in the said suppressed church of Castro, we do likewise and perpetually transfer.
A decree rendering null and void.
3 § 3. We decree that these present letters and all things contained therein, even on the ground that whosoever, of whatever dignity, rank, status, quality and condition, even those requiring special mention, having or in any way pretending to have an interest in the foregoing, shall not have consented to them, nor been called and heard thereon, and the causes on account of which those things were issued shall not have been sufficiently adduced or justified, and on any other whatsoever juridical and legitimate cause, title and ground, even one closed in the body of law, by reason of the vice of subreptiousness or obreption, or of our intention, or any other whatsoever substantial defect, may be impugned, contradicted, brought into question or controversy, reduced to the terms of law, or against them the remedy of opening of the mouth, restitution in full, or any other whatsoever remedy of law, fact or grace may be sought, or even by similar motion granted, no one may be able to use or avail himself thereof in judgment or outside it; and thus and not otherwise in the foregoing by whatsoever ordinary and delegated judges, even auditors of the causes of the palace, and cardinals of the Holy Roman Church, even legates a latere, and any others whatsoever exercising any authority, with the faculty and authority of judging and interpreting otherwise taken away from them and from each of them, ought judgment to be rendered and the matter defined, and we decree that it shall be null and void, if otherwise anything contrary to these things shall happen to be attempted by anyone whatsoever, by whatsoever authority, knowingly or unknowingly.
4 § 3. Notwithstanding our and the apostolic chancery's contrary rules, and especially that concerning not taking away acquired right, and that they are bound to express the true annual value according to common estimation, both of the benefice to be united and of that to which union is sought, otherwise the union shall not be valid, and that in unions a commission shall always be made to the parties, with those interested being called, and we wish this also to be observed in whatever suppressions, perpetual concessions, dismemberments and applications; and the most recently celebrated Lateran Council, prohibiting perpetual unions except in cases permitted by law, and of our predecessor Pope Boniface V, of blessed memory, and other apostolic constitutions, and those issued in universal, provincial and synodal councils, general or special, as well as those of the diets, even of Urbs and Velana, of the churches, confirmed by oath, apostolic confirmation, or any other firmness, statutes and customs, privileges also, indults and apostolic letters, granted to the said city of Castrum suppressed, and to the churches, prelates, their inhabitants and persons, under whatsoever tenors and forms, and with whatsoever derogatory clauses of derogations, irritant and other decrees, even granted, approved and renewed at the instance or supplication of the emperor, kings and other princes, or in their regard, and even by similar motion, and even in consistory, and otherwise in any way whatsoever, to the contrary; all and singular of which, even if special, specific and express mention of them and their whole tenors ought to be made, not however through general clauses importing the same, or other exquisite form to be observed, we holding the tenors of all of them as expressed in these presents, which otherwise would remain in their force, for the purpose of the foregoing alone, specially and expressly we derogate; and all other things whatsoever to the contrary; § 3. Likewise concerning provisions to be made of dignities, and canonries and prebends, and ecclesiastical benefices of the said suppressed church of Castrum, if anyone shall have obtained special or general letters of the said See or of its legates, even if by them there shall have been proceeded to inhibition, reservation and decree or otherwise in any way whatsoever, which letters indeed and the processes had by the same, and whatsoever shall have followed therefrom, concerning dignities and canonries and prebends, as well as benefices of this kind, we wish not to extend, but no prejudice whatsoever to be generated to them regarding the obtaining of dignities and canonries and prebends or other benefices, and by any other indulgence of the said See, general or special, of whatsoever tenor it may be, by which the effect of these presents, not expressed or wholly not inserted therein, may be hindered or deferred in any way whatsoever, and of which the whole tenor of each ought to be had in our letters with special mention.
5 § 5. Let no man whatsoever be permitted to infringe this page of our suppression, extinction, institution, separation, dismemberment, exemption, liberation, erection, constitution, assignment, subjection, supposition, application, appropriation, translation, indult, decree and derogation, or to act against it with rash presumption; if anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
