Brief to the Archbishop of Cologne and the Bishops of Trier, Paderborn and Münster on mixed marriages
XXI.
1 a) Brief of Pius VIII to the Archbishop of Cologne and to the Bishops of Trier, Paderborn and Münster, given 20 March 1830.
2 Venerable Brethren, greetings and Apostolic Blessing. In letters sent a year ago to Leo XII, of glorious memory, Our Predecessor, you have set forth diligently the grave difficulty in which you find yourselves, because a civil law enacted in that region a few years ago prescribes that in mixed marriages children of both sexes are to be educated in the religion of the father, or at his discretion; and at the same time priests are forbidden to exact from persons about to contract such marriages any pledge concerning the religious instruction of the offspring to be born. And indeed from that very time we have shared in the deep sorrow which that most excellent Pontiff felt on account of these straits of yours, which those letters explained more fully. But we are now troubled by even graver distress, since by the inscrutable judgment of God it has been reserved to our unworthiness to give you those responses which our Predecessor, prevented by death, was unable to provide. For indeed this holy See is in no way permitted to allow all those things which you have signified are demanded in those regions for the execution of that law. Yet there are two things which greatly comfort us, namely your zeal and that of the priests who are under you for maintaining the doctrine of the Church and observing its rules, which you demonstrated also in the letters sent to Leo XII, and the indulgence of the Most Serene King of Prussia, who, as you have likewise made known, was in a manner the author for you, so that, explaining the full state of affairs frankly to this Apostolic See, you might consult it concerning your anxieties. Hence we have good reason to trust that not only will you fully obey these rescripts of ours, but that the Most Serene Majesty himself will not be displeased with you if, while heartily complying with him in civil matters, you nevertheless observe the sacred rules of the Catholic religion in those things which concern not the civil effects of marriage, but the sanctity of marriage itself and the religious duties of the married, Proceeding therefore more directly to the matter, we have no need to instruct your Fraternities, most learned in all sacred doctrine, what the position of the Church is regarding mixed marriages, of which we are treating. It is not unknown to you that the Church itself abhors such unions, which carry with them no small deformity and spiritual danger, and that therefore this Apostolic See has always taken the greatest and most constant care that the canonical laws prohibiting such marriages should be religiously observed. And if the Roman Pontiffs are found to have sometimes dispensed from that most holy canonical prohibition, they certainly did so for grave reasons and with great reluctance, and were accustomed to attach to their dispensations an express condition that suitable precautions should be premised before the marriage, not only so that the Catholic spouse could not be perverted by the non-Catholic, but rather so that he might know himself bound to draw the latter away from error as far as possible, but also so that the offspring of both sexes procreated from the same marriage should be educated entirely in the sanctity of the Catholic religion. You know, venerable Brethren, that all these precautions aim at this, that in this matter the natural and divine laws should be kept intact; since it is established that Catholic persons, whether men or women, who contract marriages with non-Catholics in such a way as to expose themselves or their future offspring recklessly to the danger of perversion, not only violate canonical sanctions, but also directly and most gravely sin against the natural and divine law. And from this you already understand that we too would be guilty of a most grave crime before God and the Church if we should assent to those things being done by you or by the parish priests of your dioceses regarding mixed marriages to be contracted in these regions, by which, if not in words, yet by the very deeds themselves they would be indiscriminately approved. Wherefore, while we most earnestly commend that zeal of yours by which you have hitherto labored to turn away the Catholics committed to your care from mixed marriages, we earnestly exhort you in the Lord that henceforth you apply yourselves equally diligently to the same end with all patience and doctrine, being about to receive the abundant reward of these labors in heaven. According to these principles, therefore, whenever especially any Catholic woman wishes to marry a non-Catholic man, she should be carefully instructed by the Bishop or by the parish priest as to what the judgment of the canons is concerning such marriages, and seriously warned of the grave crime by which she will be guilty before God if she presumes to violate them; and it will be most opportune to exhort her to remember that most firm dogma of our religion, that outside the true Catholic faith no one can be saved; and therefore let her acknowledge that she will be acting most cruelly toward the children whom she expects from God if she contracts such marriages, in which she knows that their education will be in the power of a non-Catholic husband. These salutary admonitions should also, as prudence may suggest, be repeated, especially at that time when the day of marriage appears to be approaching, and while the customary proclamations are being made to inquire whether there are other canonical impediments that stand in the way. If in some cases it should happen that the paternal efforts of these sacred pastors fall in vain, then indeed the Catholic person should refrain from being corrected by censures expressly named against her, lest some tumult be stirred up and greater evils befall the Catholic cause; but on the other hand the Catholic pastor must also refrain not only from solemnizing with any sacred rite the marriages which then take place, but also from any act by which he might appear to approve them. Regarding this matter, it has been tolerated only in some places that parish priests, who were compelled to be present at the contracting of these marriages in order to avert graver inconveniences to the Catholic cause, should allow them to be contracted in their presence (if namely no other canonical impediment stood in the way), so that, having heard the consent of both parties, they might thereafter, according to their office, validly record the transaction in the marriage register, but they should always beware of approving such illicit marriages by any act of theirs, and much more from mixing sacred prayers and any ecclesiastical rite with them. It follows now that we answer concerning those who have dared to contract mixed marriages without the Catholic pastor being present. And indeed on this matter we have thus determined to establish, so that the scandals which you have reported arise from such marriages may be averted as far as possible, and so that those Catholics who live in a union thus initiated may be more easily induced to expiate their sin with the salutary tears of penance, and finally so that in the future there may be a certain rule for all by which they may judge concerning the validity of marriages contracted in that manner. Now as regards the unions which have been contracted up to the present time in that region without the presence of the parish priest, we shall shortly delegate to your Fraternities the necessary faculties, by virtue of which you will be able to remedy the evils arising therefrom at least in great part. Now however by these letters of ours we will and command that mixed marriages which henceforth (namely from the day of 25 March 1830) happen to be contracted in your dioceses, the form prescribed by the Council of Trent not being observed, if no other canonical diriment impediment stands in the way of them, shall be held as valid and true marriages; as we by our Apostolic authority declare and decree that those marriages shall be valid and binding, notwithstanding any contrary provisions whatsoever. Wherefore Catholic persons who henceforth contract marriages in this manner, provided no other diriment canonical impediment stands in their way, should be instructed by the sacred pastors that they have entered into a true and valid marriage. Moreover it shall be the duty of the pastors to admonish any Catholics whatsoever, and especially Catholic women who have contracted valid indeed, but nevertheless illicit marriages with non-Catholics, at an opportune time in the charity of God and the patience of Christ, that they do penance for the grave crime committed, and satisfy their obligations, and especially that obligation by which they are always bound toward their children, namely to take care with all their strength and diligence for the Catholic education of all of them. After this we deem it superfluous, venerable Brethren, to urge you to attend to how much prudence must be exercised in these cases, lest the Catholic religion incur ill-will, since we have ascertained and verified that your Fraternities know this well. Act therefore in this manner, and let the parish priests, admonished by you, act in the same way, so that all may see that Catholic priests are animated by no other spirit than that of fulfilling their duty, so that in those things which are of religion they observe the rules of the Church, and are guided by the same spirit so that in those things which are of civil order they observe the royal laws not from servile fear but from conscience. It grieves us greatly that we have not been able to free you entirely from these straits in which you are. But do not lose heart. The Most Serene King himself, who has solemnly made manifest his favorable disposition toward the Catholics subject to him and has proved it by his deeds on other occasions, will not permit (as we are fully confident) that you be longer harassed in this matter, which directly affects your religious duties, but moved by your anxieties through his clemency and complying likewise with our prayers, will grant you that you may freely be able to observe and execute the rules of the Catholic religion also in this matter. That this may happily come to pass, it must be humbly implored from God, in whose hands are the hearts of kings: as we do by constant prayers, and we do not doubt that you will likewise do earnestly. Meanwhile we wish to be a witness of the principal charity with which we embrace you by the Apostolic blessing, which we most lovingly impart to your Fraternities, and likewise to all the clergy and faithful people committed to your care.

1 a) Breve Pii VIII. ad Archiepiscopum Coloniensem atque ad Episcopos Trevirensem, Paderbornensem et Monasteriensem d. d. 20. Martii 1830.
2 Venerabiles Fratres, salutem ct Apostolicam Benedictionem.

2 Venerabili Fratelli, salute e Benedizione Apostolica.
