FROM THE ARCHDIOCESE OF OLINDA AND RECIFE AND FROM THE DIOCESES OF NAZARETH AND PESQUEIRA TERRITORIES ARE WITHDRAWN, FROM WHICH A NEW DIOCESE OF CARUARU IS CONSTITUTED. PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER

1 Those things which make for the greater spiritual good of the Christian faithful and for more easily obtaining their utility, the Apostolic See strives to provide with diligent care, dividing dioceses that overflow with excessive territory and erecting others, so that, with the number of Pastors increased, the Lord's flock may be cared for with greater diligence and zeal. Now since the archdiocese of Olinda and Recife extends over a most ample territory, our venerable Brother Michael de Lima Valverde, its Archbishop, has most opportunely petitioned Us that a new diocese be erected there, by separating parts of territory, whether from his archdiocese or from the neighboring dioceses of Nazareth and Pesqueira, his suffragans. We, having first obtained the favorable vote of our venerable Brother Charles Chiarlo, Archbishop with the title of Amida and Apostolic Nuncio in the Brazilian Republic, and having taken counsel with our venerable Brothers the Cardinals of the Holy Roman Church placed in charge of Consistorial Affairs, and having maturely weighed the opportuneness of the matter, and having supplied, insofar as it is necessary, the consent of others whose concern it is or who presume it to be their concern, with certain knowledge and from the fullness of our apostolic power, we withdraw from the archdiocese of Olinda and Recife a territory comprising eleven parishes, which are commonly called: Nossa Senhora das Dores de Garuarú, Nossa Senhora do Rosario de Garuará, Sao Gaetano, Santo Antonio de Cachoeirinha, Nossa Senhora do O de Altinho, Santo Antonio de Behedouro, Sao Joaquim, Nossa Senhora da Gonceiçào do Bonito, Sao Felix de Gamocim, Sao José dos Bezerros, Sao Miguel dòs Bezerros; from the diocese of Nazareth we separate the parish of Santa Cruz and from the diocese of Pesqueira a part of the parish of Riacho das Almas. From all these territories we erect and constitute a new diocese, which shall be called the Diocese of Caruaru. We establish the episcopal seat of this new diocese in the city of Garuará, from which the diocese itself takes its name, and we accordingly raise it to the rank of an episcopal city, with all the rights and privileges pertaining to episcopal cities; and we establish the Bishop's cathedral chair in the church dedicated to God in honor of the Blessed Mary Virgin of Sorrows, standing in the same city, and we accordingly exalt it to the dignity and honor of a cathedral church; and to it and to the Bishops of Caruaru for the time being we grant all rights, honors, insignia, privileges, favors and graces, which other cathedral churches throughout the world and their Bishops enjoy and possess by common law, and we likewise bind them to the same burdens and obligations to which others are bound. We constitute this cathedral church itself as suffragan to the metropolitan church of Olinda and Recife, and we subject its Bishops for the time being to the metropolitan authority of the Archbishop of Olinda and Recife. We will moreover that, until a Chapter of Canons of the cathedral can be constituted according to law, diocesan consultors shall meanwhile be elected and employed. We further command that, as soon as it can be done, at least a small diocesan seminary be erected according to the sacred canons and the norms handed down by the Sacred Congregation for Seminaries and University Studies; and likewise that the new diocese of Caruaru at its own expense shall send two chosen young men, or at least one, to the Pontifical Brazilian Seminary in the City without interruption, so that under our watchful eye they may be trained for the good of the Church. As to the governance and administration of this diocese, the election of a Vicar Capitular or Administrator, sede vacante, the rights and duties of clergy and faithful and other such matters, we command that what the sacred canons prescribe be observed. As to what particularly concerns the clergy, we decree that, as soon as these Our Letters are committed to execution, by that very fact the clergy shall be considered enrolled in that Church in whose territory they legitimately dwell. We further decree that the episcopal table of the new diocese shall be constituted from the revenues and offerings of the Curia, which are accustomed to be provided by the faithful, for whose good the diocese itself has been erected, besides what has already been collected for this purpose. We finally will that all documents and acts, which concern the new diocese and its clergy and faithful, shall as soon as possible be handed over by the Chancelleries both of the archdiocese of Olinda and Recife and of the dioceses of Nazareth and Pesqueira to the Chancellery of the new diocese, so that they may be religiously preserved in its archive. For the execution of all these things as disposed and constituted above, we appoint the venerable Brother Charles Chiarlo mentioned above, Apostolic Nuncio with the Brazilian Republic, or he who presides over the same Nunciature in the act of execution, and we grant to him the necessary and opportune faculties, even of subdelegating, for the effect in question, any man constituted in ecclesiastical dignity, the same—

2 which burden We impose upon the Sacred Consistorial Congregation to transmit as soon as possible an authentic copy of the acts of the execution performed. Moreover, these present Letters and whatever is contained in them, even from the fact that anyone to whom it pertains, or who presumes it pertains to him, even if worthy of specific and individual mention, has not been heard, or has not consented to the foregoing, can never at any time be noted, impugned or called into question on account of the vice of subreptitiousness or obreption or nullity, or of Our intention or any other defect, however substantial and unforeseen; but these Letters, as made and emanated from certain knowledge and fullness of power, shall exist perpetually valid and shall be, and shall obtain and secure their full and complete effects, and ought to be inviolably observed by all to whom it pertains; and if otherwise anything contrary to these should happen to be attempted by anyone whatsoever, by whatever authority, knowingly or unknowingly, We will and decree that it be entirely null and void and shall be null and void, notwithstanding, insofar as it is necessary, the rules issued in synodal, provincial, general and universal Councils, general or special Apostolic Constitutions and Ordinances, and any other dispositions of the Roman Pontiffs, Our Predecessors, and other contrary matters, even those worthy of special mention, all of which We derogate from by these presents. We will, moreover, that to copies or excerpts of these Letters, even printed ones, subscribed by the hand of some public notary and furnished with the seal of a man constituted in ecclesiastical dignity or office, the same faith be given as would be given to these Letters themselves, if they themselves were exhibited or shown. Let no one infringe upon this page of dismemberment, erection, constitution, concession, subjection, statute, mandate, decree, delegation, derogation and Our will, or act contrary to it. If anyone, however, should presume to attempt this with rash boldness, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul. 1 Quelle cose che conducono al maggior bene spirituale dei cristiani fedeli e alla loro più facile utilità, la Sede Apostolica si sforza di procurare con sollecito studio, dividendo le diocesi che ridondano di territorio eccessivo e erigendone altre, affinché, aumentato il numero dei Pastori, il gregge del Signore possa essere curato con maggiore diligenza e zelo. Ora, poiché l'arcidiocesi di Olinda e Recife si estende su un territorio vastissimo, il venerabile Fratello Michele di Lima Valverde, suo Arcivescovo, opportunamente ha esposto a Noi che si erigesse una nuova diocesi in quel luogo, staccando parti del territorio, sia dalla sua arcidiocesi sia dalle diocesi confinanti di Nazareth e Pesqueira, sue suffraganee. La sede episcopale di questa nuova diocesi la fissiamo nella città di Garuará, dalla quale la diocesi stessa prende il nome, e la eleviamo perciò al grado di città episcopale, con tutti i diritti e i privilegi che appartengono alle città episcopali; la cattedra del Vescovo poi la costituiamo nella chiesa dedicata a Dio in onore della Beata Vergine Maria Addolorata, che esiste nella medesima città, e la eleviamo perciò alla dignità e all'onore di chiesa cattedrale; e a essa e ai Vescovi di Caruaru pro tempore attribuiamo tutti i diritti, gli onori, gli insegni, i privilegi, i favori e le grazie, di cui per diritto comune godono e si gloriano le altre chiese cattedrali nel mondo e i loro Vescovi, e li assoggettiam parimente ai medesimi oneri e obbligazioni ai quali gli altri sono assoggettati. La medesima chiesa cattedrale la costituiamo suffraganea della chiesa metropolitana di Olinda e Recife, e i suoi Vescovi pro tempore li assoggettiam al diritto metropolitico dell'Arcivescovo di Olinda e Recife. Vogliamo inoltre che, finché il Capitolo dei Canonici cattedrale potrà essere costituito secondo la norma del diritto, nel frattempo si eleggano e si adoperino i consultori diocesani. Ordiniamo inoltre che, non appena sarà possibile, almeno un piccolo Seminario diocesano sia eretto secondo i sacri canoni e le norme tramandate dalla Santa Congregazione dei Seminari e delle Università di Studi; e parimenti che la nuova diocesi di Caruaru a sue spese mandi con continuità due giovani eletti, o almeno uno, al Pontificio Seminario Brasiliano di Roma, affinché sotto quasi i Nostri occhi siano formati per il bene della Chiesa. Per quanto riguarda il governo e l'amministrazione di questa diocesi, l'elezione del Vicario Capitolare o dell'Amministratore, sede vacante, i diritti e gli oneri dei chierici e dei fedeli e altre cose di questo genere, ordiniamo che si osservino le cose che i sacri canoni prescrivono. Per quanto riguarda particolarmente il clero, stabiliamo che, non appena queste Nostre Lettere saranno mandate all'esecuzione, per ciò stesso i chierici si considerino ascritti a quella chiesa nel cui territorio legittimamente dimorano. Stabiliamo inoltre che la mensa episcopale della nuova diocesi sia costituita dagli emolumenti della Curia e dalle oblazioni, che i fedeli, per il cui bene la diocesi stessa è stata eretta, sono soliti offrire, oltre a quelle che già sono state raccolte a questo fine. Vogliamo infine che tutti i documenti e gli atti, che riguardano la nuova diocesi e i suoi chierici e fedeli, non appena sarà possibile, siano consegnati dai Cancellieri tanto dell'arcidiocesi di Olinda e Recife quanto delle diocesi di Nazareth e Pesqueira alla Cancelleria della nuova diocesi, affinché siano conservati religiosamente in questo archivio. Queste Nostre Lettere e tutto ciò che in esse è contenuto, anche per il fatto che chiunque vi abbia interesse, o presuma di averne, anche se degno di specifica e individuale menzione, non sia stato ascoltato, o non abbia consentito alle premesse, non potranno mai in alcun tempo essere impugnate, contestate o messe in discussione per vizio di subreptizio o di obreptizio o di nullità, o per difetto di Nostra intenzione o per qualsiasi altro difetto, benché sostanziale e inaspettato, ma esse, come fatte e emanate da Nostra certa scienza e dalla pienezza del Nostro potere, esisteranno perpetuamente valide e saranno, e produrranno i loro pieni e interi effetti e li otterranno, e dovranno essere inviolabilmente osservate da tutti coloro ai quali spetta, e, se diversamente su queste cose da chiunque, con qualsiasi autorità, consapevolmente o inconsapevolmente fosse tentato, vogliamo e decretiamo che sia completamente nullo e vano e sarà, non ostante, per quanto sia necessario, le regole edite nei Concili sinodali, provinciali, generali e universali, le Costituzioni e Ordinazioni Apostoliche generali o speciali, e qualsiasi altra disposizione dei Romani Pontefici, Nostri Predecessori, e altre cose contrarie, anche degne di speciale menzione, a tutte le quali per mezzo di queste Nostre Lettere deroghiamo.
