Bull establishing a particular congregation for the economic affairs and Fabric of St. Peter's Basilica

Bull of Pope Benedict XIV ·

gregatio Particularis super rebus oeconomicis ejusque Fabricae instituitur.

BENEDICT. BISHOP.

Servant of the Servants of God.

1 For future remembrance...

2 How great a burden of cares and expenses our predecessors, the Roman Pontiffs, have undertaken—some indeed to rebuild the Basilica of Blessed Peter, others to perfect and adorn it, and still others to preserve and opportunely restore it—the whole world knows, which has been pervaded by the fame of this august and most beautiful temple and of the magnificence of those same Pontiffs. For all these things to be done and completed in honour of God and in veneration of the most blessed Prince of the Apostles, it was necessary for them to watch with equal diligence and care both for the collection of revenues and income assigned to the work of the Fabric of that same Basilica, and for the faithful and prudent expenditure of the same for that work to which alone they are destined. And We indeed throughout this whole course of Our Pontificate have not allowed Our labour and zeal in these matters to be wanting; knowing well that such a burden is not only joined with the office of Roman Pontiff, which We bear according to the measure of Our strength, but also pertains to Us in a particular manner, since We once held a Canonry and Prebend in that same Vatican Basilica for fourteen years, so that We can apply to Ourselves those words which our great predecessor Pope Innocent once wrote of himself, namely: Among the other Churches spread throughout the whole world, the Basilica of the Prince of the Apostles, as being Our See, We are bound to love and honour more specially; it is sufficiently evident that We hold an Advocate; just as We who once obtained a Benefice as a Canon in that same place, have now by Divine mercy been promoted from son to father of it.

3 § 1. Indeed, when our predecessor of happy memory, Pope Julius II, had conceived in his great mind this immense work of rebuilding the Vatican Temple and scarcely began to undertake it, and his successors Leo X and Adrian VI, on account of the difficulties of the times, were able to afford little assistance, it was given to Pope Clement VII to promote greatly the work begun by all, and to establish by a certain method what would be necessary for the construction, and also for the future enlargement and preservation of the Fabric itself; for which reason he instituted and appointed a College of sixty men chosen from all nations, and subjected it and the persons inscribed to it, exempting them from the jurisdiction and superiority of any, even the Cardinal Archpriest of that same Basilica, and subjected them immediately to himself alone and to the Apostolic See; as is more fully and completely contained in the letters of the said Clement, beginning: Admonet Nos, Given at St. Peter's in the year of Our Lord's Incarnation 1522, on the day before the Ides of November. § 2. This College remained in force until it was opportune and the mass of the building had been brought to the form and extent designated at the beginning. But when circumstances changed, our predecessor of happy memory, Pope Clement VIII (as We have found it asserted by those who were most skilled in the affairs of the Roman Curia), in place of this extinct College, instituted a particular Congregation called the Fabric of St. Peter, in which, besides a Cardinal Prefect, certain Prelates and Officials of the Curia, namely the General Auditor of Cases of the Apostolic Camera, as well as the General Treasurer of the same Camera, and the Prefect of the Apostolic Palace, and the Dean Auditor of Cases of the same Apostolic Palace, and one of the Clerks presiding over the said Camera, and the Ordinary Judge of the Fabric itself and its General Oeconomus, who is also the Secretary of this same Congregation, to whom Clement VII, who greatly promoted the Fabric of the Basilica and instituted the College of sixty men over that Fabric, and Clement VIII, who erected the Congregation of the Fabric composed of Cardinals and Prelates, attributed place and vote perpetually in this Congregation.

4 from those who were most thoroughly acquainted with the affairs of the Roman Curia, we found it asserted that in place of this extinct College, he instituted a special Congregation called the Congregation of the Fabric of St. Peter, in which, besides a Cardinal Prefect, certain Curial Prelates and Officials, namely the General Auditor of Cases of the Apostolic Chamber, as well as the General Treasurer of the same Chamber, and the Prefect of the Apostolic Palace, and the Dean Auditor of Cases of the same Apostolic Palace, and one of the Clerks Presiding over the said Chamber, and the Ordinary Judge of the Fabric itself and the General Oeconomus of the same Fabric, who is also the Secretary of this Congregation, as well as of the Fabric itself, to whom in this Congregation he perpetually assigned a place and vote, Clement VII, who greatly promoted the Fabric of the Basilica, Colleg. LX.

5 afterwards subjected the College of sixty men of the Basilica.

6 From that time the Prefects of the Congregation of the Fabric were appointed.

7 The Pontiff, who commended the Archpresbyteriate of the Basilica to the Cardinal Archbishop of York, constituted him Prefect of the same Congregation of the Fabric.

8 He had subjected to his will.

11 several other Cardinals of the Holy Roman Church, and likewise Prelates of the same Curia, to be chosen at the discretion of the Roman Pontiff for the time being, to have a similar place and vote respectively; but the office of the aforesaid Oeconomus and Judge for the time being he reserved to himself and to his Successors, the Roman Pontiffs. § 3. Although indeed the aforesaid Predecessor of ours, Clement VII, decreed that the first-mentioned College of LX. Deputies of the Fabric of St. Peter be exempted from the jurisdiction and superiority of the Archpriest of the Basilica of the Vatican, as we have also intimated; yet when another Predecessor of ours, Sixtus, Pope V, afterwards granted this right and superiority over the same College of Deputies to the good memory of the Cardinal Pallotta, called the Evangelist, Archbishop of Consentino, and Archpriest of the said Basilica; as may be seen in his Letters beginning: Cum ea debito; Given at St. Peter in the Year of the Incarnation of the Lord MDXC, on the fourth day before the Nones of March, in the fifth year of his Pontificate, where it is read: Nevertheless it is very expedient that thou shouldst apply thyself to the aforesaid Fabric with thy authority, counsel, and praiseworthy zeal; and therefore he proceeds: Thee, as long as thou shalt live and shalt hold the aforesaid Archpriesthood; the Fabric and its aforesaid College, Protector and Superior, by Apostolic authority by the tenor of these presents we commit and depute: And since this same thing has been done thereafter even to these our times, even after that by Clement VIII, as aforesaid, a Congregation composed of several Cardinals of the Holy Roman Church and Prelates of the Roman Curia was substituted, just as these same have always been constituted Prefects of such Congregation and of the aforesaid Fabric, who held the Archpriesthood of the Basilica of the Vatican for the time being; as has been recognized from the monuments of deeds sought out by our command, and has also been observed by those who illustrated the cited Letters of Sixtus V published in the Bullarium of the Basilica of the Vatican with diligent Notes, whose words are these: Following the example of Sixtus V, however, as many Roman Pontiffs as succeeded him conferred the Prefecture of the College of the Rev. Fabric upon Cardinal Archpriests; Hence it is that when the good memory of Annibale, while he lived, Cardinal of the Holy Roman Church, called Albanus, who held the Archpriesthood of the said Basilica of the Vatican in Commendam for the duration of his life by Apostolic concession and dispensation, and at the same time was Prefect of the aforesaid Fabric and Congregation, in the upper month of October departed from this life, and We recently commended the said Archpriesthood to Our Beloved Son Henry Benedict Mary Clement, of the same Holy Roman Church, Presbyter Cardinal, Duke of York, to be held as long as he shall live, by Apostolic authority through Apostolic Letters, now the same Henry Benedict Mary Clement Cardinal, Prefect of the aforesaid Fabric and of the same Congregation of the Fabric, as long as he shall also live and shall hold the Commendam of the aforesaid Archpriesthood, with all the rights and honors annexed to such Prefecture; which the said Annibale, while he lived, enjoyed, by the same Apostolic authority and by the tenor of these present Letters, we constitute and depute.

12 § 4. Moreover, there are two kinds of matters about which such Congregation of the Fabric, substituted for the first-mentioned College of LX. Deputies, as aforesaid, is occupied. Some indeed respect the judicial course of cases and lawsuits, in which the ordinary Judge of the Fabric itself rendered sentence or decreed definitively, whenever the party unsuccessful in the first instance appeals against such sentence or definitive decree; concerning which we found nothing that required some new ordinance. Wherefore that same thing in contentious Cases shall be done in the future by the College of the said LX. Deputies, by this Congregation of the aforesaid Fabric, which was accustomed to be done by the same in former times. But because we have learned that it has sometimes happened that such General Congregation has not been convoked for the entire course of several years; we will and decree that to the aforesaid Cardinal Prefect, by Us, as aforesaid, deputed, and to his successors in the future, such General Congregation be convoked at least twice in each year, and in it let it be seen, and as the law shall be, let it be rescribed in Cases pertaining to its jurisdiction; the laws otherwise being observed by Us for the confirmation of the Decrees issued by our Predecessors, the Roman Pontiffs, or by their authority, established and promulgated by our Letters, whose beginning is: Romanae Curiae, given at St. Mary Major in the Year of the Incarnation of the Lord, commanding that the General Congregation of the Fabric be held twice in any year in contentious Cases.

13 As to the economic affairs of the Fabric, he determined to renew the old custom and method of proceeding.

14 Therefore he instituted a particular Congregation of four

15 Cardinals of the Holy Roman Church.

16 nice MDCCXLIV, on the twelfth day before the Kalends of January, in the fifth year of Our Pontificate. § 5. Matters of another kind, which pertain to the governance of the aforesaid Fabric itself, have seemed to require the care of Our providence. For since it is sufficiently evident that such matters cannot be conveniently and diligently handled in the General Congregation, as is fitting; and for this reason for some time past the practice has prevailed that either by the Cardinal Prefect or by the Economus of the aforesaid Fabric, matters even of greater importance and requiring large sums of money, which might occur for the necessities or ornaments of the Basilica itself, should be dealt with immediately with the Pontiff; contrary to what was customarily done in former times, when more serious matters of this kind, before they were referred to the Pontiff, were first carefully and maturely deliberated upon by the Cardinal Prefect himself, together with certain other Cardinals and Ministers from among those who have a place in the aforesaid General Congregation; We wish that this more ancient custom be observed henceforth; and We are confident that this will be beneficial not only to the economic affairs of the Fabric itself, but also to suppress in great part the censures and objections with which those expenditures are usually marked, which are made for the preservation or ornament of the Vatican Temple. § 6. Therefore, for the purpose of knowing and directing such economic matters of the Fabric of St. Peter, We erect and appoint a Particular Congregation composed of one Cardinal Prefect and three other Cardinals of the Holy Roman Church, selected from the aforesaid General Congregation, and from it. We wish that the Prefect of this Particular Congregation be the same whom We have constituted above, by the tenor of these present letters, as Prefect of the aforesaid General Congregation and of the Fabric itself; and to the same Particular Congregation We assign the following three other beloved Sons of Ours, namely Silvius, Cardinal of the Title of St. Callistus, Presbyter, Valenti, and Hieronymus, Cardinal Deacon of St. Stephen in the Fish Market, ha, whom, although he, by reason of the office of Prefect of Our Apostolic Palace, both before and after his elevation to the Cardinalate, has had a place in the aforesaid General Congregation of the Fabric, nevertheless, insofar as it may be necessary, among the Cardinals of the same Congregation We commit and entrust him; and We declare by these present letters that St. G e ete ii in n Velabro, Cardinal Deacon, Colur na de § Seiarra, respectively named, whose suitability and experience in such matters We know, We elect and appoint to the aforesaid economic matters to be consulted and treated together in the same Congregation with full right of suffrage. § 7. As Secretary of this Particular Congregation with consultative vote We likewise elect and appoint the beloved Son and Master php ir of the Abbatibus Olive-rium, who is also the Economus of the same Fabric and Secretary of the aforesaid General Congregation; and moreover We wish that the beloved Son Master Ludovicum of Constantio, Judge Ordinary of the aforesaid Fabric, should also attend the same Particular Congregation with a similar consultative vote; decreeing that the respective successors of each of them in the offices of Economus and Secretary and Judge should hold a place and obtain a vote in this Particular Congregation in future times. § 8. We wish, however, that by the aforesaid Cardinal Prefect existing for the time being, together with the Economus of the said Fabric, expenditures for roofs and other conveniences of the Vatican Basilica, not exceeding the sum of five hundred scudi of current money, may be made even without the assent of this Particular Congregation or of the Roman Pontiff for the time being; but where the work to be done is known to exceed five hundred scudi, We permit nothing without the examination of the aforesaid Congregation; in which, namely, both the propriety and the condition of the matter, with other necessary considerations, shall be carefully weighed. All matters shall be reported to the Roman Pontiff, whether by the Cardinal Prefect or Secretary; not without a statement of the difference and number of votes and also of the reasons which each one shall have exhibited to the General Congregation within four months.

17 rium, who is also the General Oeconomus of the same Fabric and Secretary of the said General Congregation; and we further wish that the Beloved Son Master Ludovicus of Constantio, Judge Ordinary of the aforesaid Fabric, should likewise attend the same Particular Congregation with consultative vote: decreeing that the successors of each of them in the offices respectively of Oeconomus and Secretary, and Judge, should hold place and obtain vote in such Particular Congregation in future times. § 8. We wish, however, that by the aforesaid Cardinal Prefect existing for the time being, together with the Oeconomus of the said Fabric, expenditures for repairs, roofs, and other necessities of the Vatican Basilica, not exceeding the sum of five hundred scudi of current money, may be made even without the assent of such Particular Congregation, or of the Roman Pontiff for the time being; but where the work to be done is known to exceed such five hundred scudi, we will that nothing be done by them without the examination of the aforesaid Congregation; in which examination, namely, there shall be consulted both the fitness and the condition of the work, and other weighty reasons shall be carefully considered. All things, however, shall be reported to the Roman Pontiff, whether by the Cardinal Prefect or Secretary; not without the notation of the difference and number of votes and also of the reasons which each one shall exhibit to the General Congregation in the same manner as for four Months.

18 ait.

19 confirming his sentence: so that he, namely, with the matters known and weighed, by the Congregation, unless it seem otherwise to him, may approve and confirm it, and may entrust the care of its execution to be constantly promoted and providently directed to one or another of the four Cardinals or to two of the Prelates constituting the said particular Congregation, according to his judgment.

20 confirmandam sententiam suam attulit: ut is nimirum yon bus cognitis atque perpensis , RT care Congregatione caplam ,. nisi aliter i ipsi videatur , approbare et confirmare, ejusque executionis incessanter promoyendae ac provide, dirigendae | curam uni vel alteri ex quatuor Pardinslibues sive ex duobus Praelatis dictam peculiarem. Congregationem constituentibus , pro suo arbitrio , demandare. valeat.

21 § 9. To this same Particular Congregation, we establish and command that the general accounts and computations of the Fabric, and their summaries, are to be exhibited every four months: so that the same Congregation, having before its eyes the entire economic state of the Fabric itself, may be able to take appropriate counsel concerning the proposed expenditures. And while the Cardinals and Prelates convene for consultation, which ought to be done at least four times in the year, we wish that at the threshold of the Hall there stand the Accountant of the Fabric itself, and the Architects, and the Painter placed in charge of mosaic works, as well as the Keeper of the Fabric's storehouse, commonly called the General Factor, so that they may be at hand for all things which the same Congregation shall judge to be required from them or to be entrusted to them. Finally, since not all things can be known to you, whatever things may perhaps be opportune for the correct economic administration of the same Fabric, we will also, and by the tenor of these present Letters we decree and command, that by the aforesaid Cardinal Prefect, together with the three other aforesaid Cardinals, and the two Prelates ascribed by Us to the aforesaid Particular Congregation, as soon as it can be done, without meanwhile interrupting the course of the General and Particular Congregations prescribed also by Us above, a careful visitation of the same Fabric and of its economic state, both active and passive, shall be instituted and carried out. We have trusted that from them there will be a certain and faithful account; nor shall it be absent from their mind and care, namely the faithful administration and appropriate expenditure of the revenues and income of the Fabric itself, with abuses cut away, if any perchance shall be found to have crept in during the course of time concerning these matters, and with certain accounts established, by which the best order of things may also be provided for in the future. § 41. And thus and not otherwise in all the foregoing matters we decree and establish that it is to be done and proceeded with; Notwithstanding any contrary Apostolic Constitutions and Ordinances, or the erection, statutes, uses, styles, and customs of the same Fabric and General Congregation, even immemorial, or anything else whatsoever acting to the contrary. § 12. Let it be lawful for no one whatsoever to infringe this page of our constitution, deputation, erection, election, ascription, mandates, wills, and decrees, or to act against it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God, and of the Blessed Apostles Peter and Paul.

22 Given at Rome at St. Mary Major in the Year of the Incarnation of the Lord 1751, on the seventeenth day before the Kalends of December, in the Twelfth Year of Our Pontificate.

BENEDICTUS. EPISCOPUS.

Servus Servorum Dei.

LX

5 Virorum super eadem Fabrica instituit, Clemens VIII Congregationem Fabricae ex Cardinalibus et Praelatis compositam erexit.

10 Video Pontifice, qui Archipresbytteratum Basilicae Cardinali Daci Eboracensi commendavit, eamdem Congregationis Fabricae Praefectam constituit.

§ 8. 20 confirmandam sentenza sua attuli: ut is nimirum yon bus cognitis atque perpensis, RT care Congregatione capiam, nisi aliter i ipsi videatur, approbare e confirmare, eiusque executionis incessanter promovendae ac provide, dirigendae curam uni vel alteri ex quatuor Cardinalibus sive ex duobus Praelatis dictam peculiarem Congregationem constituentibus, pro suo arbitrio, demandare valeat.
