Sanctorum virorum
Bull on the cult and new church of St. Sylvester Guzzolini
To the venerable brother the Bishop of Auxime, or to his beloved other vicar in spiritual matters general, greeting and apostolic benediction.
Paul, Pope V, for perpetual remembrance of the matter.
1 Preamble. The virtues and merits of holy men, who while they lived on earth rendered perfect and pious service to the Most High, have deserved not only to obtain eternal reward from the Lord in heaven, but also to be celebrated daily with ever more glorious praise by the Catholic Church on earth.
2 § 1. And among the other citizens of heaven not without considerable praise is reckoned the holy St. Sylvester Cuzolinus, a noble of Auxime, founder and institutor of the Congregation of monks of the Sylvestrines, whom, since he is celebrated in the Church with many virtues and remarkable miracles, the city of Auxime rightly strives to honour and venerate its citizen glorious in heaven with special devotion even on earth, and to erect a new temple and monastery to his honour. Whence we, considering what great merit this holy abbot possessed with God and men, who, following the inspiration of heavenly vocation and running unfailingly toward the prize set before him, spurning the honours of the world and its glory, inhabited the harsh desert of Mount Fano, that he might be free for God alone and for himself, and who afterwards, inspired by the divine Spirit, went forth from there and made such progress in a short time that, with his name propagated throughout all Picenum and other provinces, he also amplified the glory of the divine Majesty itself. For we know with what zeal of piety and with what ardour of heavenly love mortals are moved to all works of piety 1.
3 1 Thus we read with Cherubinio; the Main edition has in (n. t.).

5 The cause of this constitution.
6 offices, with what virtues, humility, gentleness of spirit, charity toward neighbours, abstinence, chastity, patience, and many other virtues he flourished; and what and how many miracles He who is marvellous in His saints wrought through him, attesting the merits and sanctity of His servant by innumerable signs. For of this holy man, even predicted with the spirit of prophecy, that could truly be said which Christ the Lord proclaimed of Himself: the blind see, the lame walk, the deaf hear, the lepers are cleansed, so that perhaps it is no wonder that the Mother of God Mary herself, in a new and unheard of manner, yet indubitable, after the memory of men, by a kind of grace, placed her Son hidden under the most august sacrament of the Eucharist into his hands. Wherefore many temples were afterwards erected to him, and innumerable vows were suspended at his tomb, so that not undeservedly the Pope Clement VIII of happy memory, our predecessor, ordered this holy man to be inscribed in the Roman martyrology, and we have numbered him among the holy abbots of monks. His memory has continued to this age in blessing, and a holy inheritance to his descendants, in that, instituting the aforesaid venerable Congregation of monks, named from his name the Sylvestrines, under the rule of St. Benedict, approved also by the Pope Innocent IV of pious memory, our predecessor, and which we have also enriched by communication of privileges, both of mendicants and non-mendicants, his disciples, living a religious and praiseworthy life, diligently apply their labour in the Lord's field, promoting Christian piety by sound doctrine and examples of virtues.
7 § 2. With pious consideration therefore we willingly attend to those matters by which the construction of the church and monastery in the same city to the honour of this holy Sylvester, newly to be erected, may be brought to completion, and the convenience and utility of the persons serving the Most High under the sweet yoke of religion in it, so that they may be able to devote themselves to the study of the liberal arts and theology, may be healthily provided for together with the increase of divine worship.
8 § 3. Since indeed we have reserved to ourselves all ecclesiastical benefices here with cure and without cure, at all benefices of the Apostolic See then vacant and hereafter to become vacant, for collation and disposition by us, decreeing from then on null and void, if otherwise anything concerning these should happen to be attempted by anyone, by whatever authority, knowingly or unknowingly.
9 § 4. When therefore afterwards the parochial church of St. Andrew of Auxime was freely resigned by the resignation of your beloved John Baptist Maxim, lately rector of that church, from that which he then held for three years and more, made voluntarily in our hands and admitted by us, the same church became vacant at the Apostolic See and is vacant at present, and no one besides us could dispose of it on this occasion, or can, the aforesaid reservation and decree standing in the way:
10 § 5. And, as was recently presented to us on behalf of the aforesaid beloved sons Sebastian Facamnt and Maxim de Ubaldis, priors of their monastery, for reasons expressed by the general curator of the monks of Sylvester, this petition contained a request that care be transferred to the aforesaid beloved son, the community and men and the people of the church.

12 The citizens of the aforesaid city of Auxim, on account of the greatest zeal of piety and devotion with which they have always pursued St. Sylvester the abbot, their fellow citizen and the author and founder of this Congregation, have long and earnestly desired to call the aforesaid Sylvestrine monks within their walls and to embrace them, and compelled by the lack among them of religious men, monks especially, of whom no monasteries exist among them, who might apply themselves to spiritual exercises, to preaching and sermons concerning divine matters, to the explanation of cases of conscience, to the declaration of sacred Scripture, and who might also labor in teaching and expounding the disciplines of philosophy and theology.1 For there is no one in so great a city, whether of the secular or regular clergy, who might discharge such duties,2 and who therefore might serve day and night the church, by chanting psalms, celebrating the solemnities of Mass, imbuing the minds of young people with Christian doctrine, and both hearing confessions and administering the sacrament of the Eucharist with that religiousness and diligence as is fitting. Whence, since there existed no place neither more capable nor more suitable, they built from the foundations a monastery for the aforesaid monks near the parochial church aforesaid, and in it six of the same monks, religious men living under the rule of a subprior and regular observance, with the greatest frequency of the people and progress of religion, perform and pursue all the aforesaid duties, and exercise themselves in other works of piety and charity, and desire these to be exercised henceforth and to be increased and enlarged day by day to the glory of God almighty and the salvation of souls. Yet, because the dwellings of such a monastery are narrow and less capacious, so that the aforesaid and other monks desiring to be aggregated to their number might be received there, they are not able to execute and fulfill this pious and laudable purpose sufficiently conveniently unless provision be made for them from elsewhere. Since, however, as the same petition subjoined, if the aforesaid parochial church with its rectory house, which are very narrow and stand in great need of repair, and are comprehended within the bounds of the monastery itself, were to be granted perpetually to the abbot or prior and the aforesaid monks, to whom the use of those has already been conceded, and the parochial care, which extends to about twenty houses,34 were to be transferred to another parochial church of Auxim nearby and to you well-pleasing, and other things which follow were to be done, from this assuredly the conveniences of the aforesaid monks in exercising so many pious and laudable works, and the increase and establishment of this Congregation of theirs, would be consulted with praise and service to God in many ways; on behalf of Sebastian the general and Maxim aforesaid (asserting that the said church of St. John the Baptist, this parochial church, has been held for three years and more, as is aforesaid, and that they might live conveniently from elsewhere with the things written below; and that the fruits, revenues and income of the same parochial church do not exceed the value of twenty-four ducats of gold of the camera, according to common estimation), we were humbly supplicated that you might deign to consult in a suitable manner for the adornment of the same parochial church and the increase of divine worship in it, and the propagation of the regular institute of this Congregation, and otherwise to provide opportunely in the aforesaid matters by apostolic benignity.
We therefore, not having certain knowledge of the premises for this reason, O Pontiff, and absolving Sebastian the general and Maxim, and each of them, from whatsoever excommunication, suspension and interdict, and other ecclesiastical sentences, censures and penalties, whether by law or by name, in any occasion or cause incurred, if in any way they are bound by them, for the purpose of obtaining the present only, by the tenor of these letters and holding them to be absolved, inclined by such and the supplication of the community and men and people aforesaid, we command your fraternity, brother bishop, or your discretion, beloved son vicar, by apostolic letters, that, having first ascertained by you the premises, in the parochial church aforesaid (or the premises,
13 We therefore, not having certain knowledge of the aforesaid matters for this reason, and absolving by the tenor of these presents Sebastian, the first and the last general and Maximum, and each of them, from whatsoever excommunication, suspension and interdict, and other ecclesiastical sentences, censures and penalties, whether by law or by name, imposed for any occasion or cause whatsoever, if by any means they are bound by them, for the purpose of obtaining the effect of these presents only, and considering them absolved, being inclined by the supplication of such persons and of the community and men and people aforesaid, we command by apostolic letters to your fraternity, brother bishop, or to your discretion, beloved son vicar, that, having first ascertained the aforesaid matters for yourself, in the aforesaid parochial church (or the aforesaid,

14 or in any other manner whatsoever, or from the resignation of any other person whatsoever, whether by a similar, or another, or a free resignation of the said John the Baptist, or of any other, made in the Roman Curia, or outside it even before a public notary and witnesses voluntarily, or the Constitution of John Pope XXII of revered memory, likewise our predecessor, which begins Execrabilis, or the acquisition of another ecclesiastical benefice conferred by any authority, is vacant; even if it has been vacant for such a length of time that its collation, according to the statute of the Lateran Council, has legitimately devolved to the aforesaid See, and the same parochial church has been reserved to apostolic disposition either specially or otherwise generally, and concerning it a suit, whose status we wish to be held as expressed in these presents, is pending undecided; provided that its disposition pertains to us in this instance) the name, title and designation of perpetual rector by this authority of ours you shall suppress and extinguish; § 7. Those thus suppressed and extinguished, and in order that the church, and its rectory house, use shall remain perpetually free and absolute to the abbot, or prior, and convent of the said monastery, from the same church of St. Andrew you shall remove and separate all care of souls of the beloved sons of its parishioners now and for the time being existing, and the exercise and use thereof also perpetually by the same authority of ours; and moreover you shall transfer the care and exercise of this kind to another parochial church of Auxim nearby and suitable and well-pleasing to you, with the consent however of the beloved sons of its rector and parishioners (so that they and its rector for the time being may forthwith be subject to it, and the said John the Baptist from now on from the service of the same church of St. Andrew, and residence to be made at it, and from all and singular functions, offices, exercises, burdens and obligations parochial may be reckoned free with a safe conscience, and exempt), likewise perpetually by the aforesaid authority of ours; and to the same church, to which the aforesaid care shall happen to be transferred, from now, as from then, and conversely, after the care aforesaid shall have been transferred, all and singular uncertain emoluments arising from the exercise of care of souls in the first mentioned church and accustomed to be gained, and also tithes, after the death however of the said John the Baptist, which are reserved to him during his life and are to be reckoned as being (so that it may be lawful for its rector for the time being, by himself, or by another, or others, in his and the second mentioned church's name to receive, exact and levy the uncertain emoluments from now, and after the death of the said John the Baptist these tithes, which constitute an annual value of seven ducats of the same kind, or thereabouts, as also by assertion, and to convert them to his uses and benefit) likewise perpetually, by our aforesaid authority, you shall apply and appropriate: § 8. The church truly of St. Andrew, remaining without cure, with its rectory house of this kind (the value of which house in property does not exceed the sum of fifty ducats of this kind, and from which, if it were let out, up to six ducats of this kind yearly, as likewise by assertion, would be received) to the abbot and convent aforesaid, with the vestments and ornaments of the first mentioned church, and of its sacristy, and all and every sacred and profane furnishings, bodies of Saints, and other relics, however distinguished and principal, and other things existing in the first mentioned church, and its sacristy, for their uses and exercises, likewise perpetually, by the same authority of ours, you shall grant and assign; so that it may be lawful for the abbot and convent of the monastery, now and for the time being existing, of the church of St. Andrew, and of the house, and other aforesaid things of this kind to take corporeal, real and actual possession by themselves, or by another, or others, in the name of the said abbot and Congregation of this kind, to apprehend and perpetually retain, to enjoy and benefit from them, the license of the Bishop of the place, or of any other, being in no way required thereupon.
15 But we order that in the same church, for one secular priest to undertake the offices of the aforesaid suppressed church, it be instituted.
16 For the assignment of his portion all the aforesaid emoluments of the church except those transferred.
17 And this benefice to the said John the Baptist, as long as he shall live, with its honors and burdens is to be conferred.
18 session by himself, or by another, or others, in the name of the abbot and Congregation of this kind, to apprehend and perpetually retain, to enjoy and benefit from them, the license of the Bishop of the place, or of any other, being in no way required thereupon.
19 § 9. Moreover in the aforesaid St. Andrew, or another church well-pleasing to you, one perpetual simple and personal benefice not requiring residence under the same invocation of St. Andrew, or another, for one cleric or secular priest, perpetual future beneficiary thereof, who shall bear the remaining burdens of the first mentioned church, and of its rector, except the care of souls and the administration of ecclesiastical sacraments incumbent, likewise perpetually, without however any prejudice, by the aforesaid authority of ours you shall erect and institute.
20 § 10. To him thus erected and instituted, for his endowment and for the support of the future beneficiary and the burdens incumbent upon him, all and singular other goods, fruits, revenues, proceeds, rights and actions of the aforesaid first church, except those abdicated and transferred and granted and assigned, separating and dismembering from the aforesaid first church, in perpetuity, by our authority in this matter, we apply and appropriate: so that the future beneficiary aforesaid may freely be able to take possession of them, hold them, receive and obtain them, and convert them to his own uses and benefit, without the license of any other. § 11. And nevertheless the benefice aforesaid (whose annexed fruits, revenues and proceeds, according to the aforesaid valuation, do not exceed the annual value of fourteen ducats, as you likewise assert), vacant from its original erection and institution in this manner, we confer and assign to the said John the Baptist, after you have however found through diligent examination that the said John the Baptist is suitable for this, upon which we burden your conscience, inducing through yourself, or another, or others, the same John the Baptist, or his proctor in his name, into corporeal possession of the benefice, and of the annexed rights and appurtenances aforesaid; and defending him inducted, removing from there any illicit detainer whatsoever; and causing John the Baptist, or his proctor aforesaid in his stead, to be admitted to this benefice, as is customary, and to be fully answered by you concerning all its fruits, revenues, proceeds, rights and emoluments; compelling those who contradict by our authority aforesaid, appeal being set aside.
21 § 12. Notwithstanding the foregoing and our determination of the true annual value according to the aforesaid valuation, both of the benefice to be united and of that to which the union is made, as well as the constitutions and ordinances of blessed memory Pope Boniface VIII, likewise our predecessor, and any others contrary to the apostolic see: even if any, upon provisions to be made to them of this or other ecclesiastical benefices in those parts, have obtained special or general letters of the said See or its legates, even if by means of them proceedings have been made to inhibition, reservation and decree, or otherwise in any manner whatsoever, which letters indeed and proceedings had by the same, and whatever has followed therefrom, we wish not to extend to the aforesaid church of St. Andrew, but no prejudice regarding the obtaining of other benefices is to be generated thereby.
22 § 13. For we, as to the resignation, as it is, if perhaps it has been attempted heretofore, or hereafter, and as to that and the other matters aforesaid of this kind, and the said John the Baptist having been found suitable for this, from now we decree it equally null and void to the contrary.
23 Preservative clauses added.
24 and void, if otherwise concerning these things by anyone, by whatever authority, knowingly or unknowingly, it should happen to be attempted, and as if on the day of the date of these presents, the said John the Baptist having been found suitable for this, we had mandated provision to be made concerning this benefice.
25 Given at Tusculum, in the year of the Incarnation of the Lord 1617, on the 9th day before the Kalends of October, in the 13th year of our pontificate.
26 Given on 23 September 1617, in the 13th year of the pontificate.
