Apostolic letter abolishing the Apostolic Legation and Tribunal of the Monarchy in Sicily

Apostolic letter of Pope Pius IX ·

ARE COMPLETELY ABROGATED AND DELETED. THE BISHOP, SERVANT OF THE SERVANTS OF GOD
For Perpetual Remembrance of the Matter.

1 "The supreme care of the entire flock of the Lord, which has been divinely entrusted to Us, though unworthy, in the person of the most blessed Peter, Prince of the Apostles, by Christ the Lord Himself, absolutely demands that by virtue of Our Apostolic ministry We should most diligently provide for the good and prosperity of all the Churches of the whole Catholic world, and strive for all things whereby our most holy faith and religion may flourish and grow more vigorous day by day everywhere, and ecclesiastical discipline may be preserved and promoted, and the tares which the enemy has sown in the midst of the wheat may be rooted out entirely, and all corruptions which are most adverse to the salvation of souls and the order of sacred things may be eliminated. Hence from the very beginning of Our Pontificate We have turned Our paternal solicitude toward Sicily, and We have also published Our Apostolic Letters, sealed with the Fisherman's Ring and issued on 26 January 1856, whose opening words are "Peculiaribus," for the spiritual benefit of Sicily, which from ancient times has been the beloved daughter of the Roman Church, bound to this Apostolic See by the closest ties of special piety, love and reverence. But with the greatest sorrow of Our heart We have learned of the great evils and damages by which Sicily itself has long been miserably afflicted. And seriously considering all the acts which this Holy See has issued for that same Island, We perceived that Our Predecessor of blessed memory, Clement XI, rightly and with the best of justice judged that very many and most grave evils, abuses and corruptions of Sicily arose from the pretended Legation and the Tribunal of the Monarchy, which are said to have been granted by Urban II, likewise Our Predecessor. Wherefore that same Clement XI, inflamed with apostolic zeal, on the tenth day before the Kalends of March in the year one thousand seven hundred and fourteen, issued under Lead his Pontifical Letters, beginning "Romanus Pontifex," by which he entirely abrogated and extinguished the pretended Apostolic Legation, and the so-called Monarchy, and its Tribunal, setting forth most clearly the most grave reasons on account of which he judged that such a measure ought to be undertaken by him entirely. Subsequently, however, Benedict XIII, likewise Our Predecessor, moved by the particular circumstances of affairs and times, and induced by repeated promises, and trusting in the hope that by a Tribunal constituted with certain and immutable norms and rules all abuses would be removed, on 30 August in the year 1728 promulgated under Lead his Apostolic Letters beginning "Fideli," by which he established in Sicily an Ecclesiastical Judge Delegate of causes, and his Tribunal, with faculties and laws which could never in any way be changed. But vain were the hopes of Our aforesaid Predecessor, for that judge and tribunal, retaining the name of Judge and Tribunal of the Monarchy, wrongly considered itself to have its origin, as before, from the pretended Apostolic Legation, and the lay power not only undertook to direct that same tribunal, but also issued ordinances, declarations and pragmatic sanctions contrary to the Apostolic Letters "Fideli," and moreover continued to exercise the so-called rights of the Legation removed by Clement XI, and the Delegate Judge thought it better to obey the ordinances of the government than to adhere to the aforesaid Constitution of Benedict XIII. And so this Apostolic See did not fail to protest repeatedly and to insist that the limits prescribed by the Constitution of Benedict XIII should be carefully observed. And this was renewed on the occasion of the Convention entered into between this Apostolic See and the King of Both Sicilies in the year 1818, when it was also promised by Royal Ordinance issued, which was set forth in the Letter of the Royal Administrator of 29 April in the year 1818, commanding that all abuses should be removed and the limits established in the Apostolic Letters "Fideli" should be carefully maintained. But the repeated promises were not kept, nor were Our protests and complaints, and those of Our Predecessors, heard, nor those of the Bishops in the assembly held by them in that Island in the year 1850, although the matter concerned most grave abuses, from which the greatest damages and detriments redounded to the faithful of Sicily, which all the Bishops of that Island who were present at the Council of Trent had already most vehemently deplored, unanimously reclaiming the rights of the Church before the Catholic King. We Ourselves have in some measure attempted to apply a suitable remedy to these evils, but Our solicitude has been in vain. For under the pretext of the Legation, ecclesiastical matters have been for the most part usurped, and laws concerning ecclesiastical discipline have been wrongly enacted, and this Apostolic See has been prevented from exercising its salutary action toward those Churches. And it has come to pass that in matters pertaining to ecclesiastical discipline the lay power is unwilling to depend upon the Roman Pontiff, whose vicar it falsely claims to be. And the Judge of the so-called Monarchy, not observing the limits prescribed by the Apostolic Letters "Fideli," serving the ordinances of civil Ministers, rashly executes them, and claims for himself faculties which he entirely lacks, and under the pretext and appearance of grievance, draws to himself cases, wholly neglecting the canonical sanctions set forth in the aforesaid Letters "Fideli," and compels the Bishops to render account in such a way that they can scarcely judge of cases even in the first instance, and prevents the supreme Superiors of Religious families from exercising their authority over the religious men subject to them, and does not hesitate to interfere even in the internal discipline of the Orders of Regulars. Hence it has come to pass that in Sicily the authority of the Bishops, with the greatest damage to their rights and danger to the salvation of souls, has been depressed and cast down, so that ecclesiastical discipline has been weakened, and Regular observance has been almost destroyed, and the disobedience of both Clergies toward their Superiors has been promoted and defended, so that the Bishops and Superiors of Religious Orders, pressed by the continual illegitimate action and force of that Tribunal, cannot prevent the disturbances and the sad consequences arising from the nullity of acts which are perpetrated by that same Tribunal against the statutes and prescriptions of the aforesaid "Fideli" Apostolic Letters. It also happened that almost at the end of the preceding century the Tribunal of Messina was wrongly constituted by the civil power at its pleasure, in no way depending upon the Tribunal of the Monarchy. From which most mournful state of affairs those most sad evils have at various times redounded to Sicily, which are rather to be lamented than to be mentioned, since they are known and perceived by all, especially after Our own Apostolic Letters were with the greatest injury despised and destroyed. And unless the outstanding faith, piety, reverence and obedience of the Sicilians toward this Chair of Peter, the center of Catholic unity, were known, as well as the solicitude of the Bishops for the salvation of souls, there would be reason to fear danger lest, if things should proceed thus, Sicily should be afflicted with even graver evils. Since therefore from that Tribunal mentioned above, which they call the Monarchy, so many damages have been and are derived to the Church, its authority, rights and discipline, and the repeated expositions of this Apostolic See have been in vain, that that Tribunal should carefully observe the limits fixed in the Apostolic "Fideli" Letters, and the repeated promises have always been deceptive regarding the removal of corruptions, therefore We, in the face of so many most grave evils which afflict the Church in Sicily, and in the face of so many greatest dangers which threaten that same Church, not only can in no way connive, but also by virtue of the most grave duty of Our Supreme Apostolic ministry must with all care and diligence completely remove and eliminate those evils and dangers. For We would consider Ourselves guilty of the most grave fault before God unless We took care to root out so many evils entirely. Wherefore it is fitting that We cut down and scatter, to use the words of Our Predecessor Clement XI, that tree from which the worst fruits have sprung, since the Roman Pontiff, constituted by Christ the Lord as the assertor of what is right and good, is bound to destroy all harmful things and root them out entirely. For although the matter concerned things perhaps at some time granted by this Apostolic See for legitimate causes, nevertheless such grants ought to be revoked and abolished entirely, since, with the changed circumstances of affairs and times, experience demonstrates that the greatest evils have arisen and arise from these grants, and that they open the way to corruptions and abuses of every kind, and are most adverse to the Church and the salvation of souls. And so since by virtue of Our Apostolic duty We can in no way any longer bear and tolerate so many evils and corruptions, and permit that the dignity of the ecclesiastical Order should be weakened and collapse under the pretext of the privileges of the Sicilian Monarchy, having taken into counsel a special Congregation of the Venerable Brothers, the Cardinals of the Holy Roman Church, and having heard some of Our beloved sons, the Bishops of the Roman Curia, by Our own motion, with certain knowledge, mature deliberation of Ours, and from the fullness of Our Apostolic power, by these Letters We not only confirm the suppression and abolition of the pretended Apostolic Legation of Sicily, and the so-called Monarchy, made by Our Predecessor Clement XI, but also that same Apostolic Legation and Monarchy, insofar as it may be necessary, We again suppress, extinguish and abolish by Our supreme Authority; moreover the often-mentioned Constitution "Fideli," issued by Our Predecessor Benedict XIII, as far as concerns the Judge Delegate in Sicily, whom they call the Judge of the Monarchy, and his Tribunal, together with all indults, privileges and faculties, whether granted in Apostolic Letters in the form of a Brief, both by Our Predecessor of blessed memory Gregory XVI, beginning "Iamdiu," given on 3 March in the year 1846, and by Us given on 21 January in the year 1856, whose opening words are "Peculiaribus," and in whatever other manner and for whatever reason by Us and by Our Predecessors, for whatever merit and reason, granted and confirmed to the aforesaid Judge Delegate and his Tribunal, by the tenor of these present Letters We entirely revoke, and the office of that same Judge and of the other officials and ministers, and the said Tribunal, together with the aforesaid Tribunal of Messina erected, We remove from the midst in perpetuity, and in all respects extinguish, quash and delete. We will therefore and command that all those things be held and reputed by all as plainly extinguished, suppressed and abolished, and respectively rescinded, quashed, deleted, revoked, and entirely abrogated."

2 Moreover, We have come to the foregoing matters, so that by Our Pontifical solicitude We might vindicate the liberty of the Church, and Our authority, and that of this Holy See, and of Bishops and Superiors of Religious Orders, and restore ecclesiastical discipline, and provide for the salvation of souls in peril. Since, however, We rightly regard with special charity the faithful peoples of Sicily, who, distinguished by ancestral religion and piety, glory greatly in adhering most steadfastly to Us and to this Apostolic See with unwavering faith and observance, We shall not omit to meet the inconveniences and losses of these same faithful by other of Our Apostolic Letters, granting suitable faculties to the Venerable Brethren, the Sacred Bishops in Sicily, whom these same faithful may more easily and conveniently approach. We will, decree, command, and order these things, determining that these present Letters, and whatever is contained in them, even if the aforesaid and any others whatsoever having or in any way pretending to have an interest in the foregoing, of whatever status, rank, order, preeminence and dignity, even Royal and Imperial, shall not have consented to them, nor shall have been called, cited, and heard, and the causes on account of which these present Letters were issued shall not have been sufficiently adduced, verified and justified, or from any other cause whatsoever, even however juridical and privileged, under colour, pretext, and head, even in the body of closed law, even of enormous, most enormous and total injury, shall at no time be noted with the vice of subreption or obreption, or nullity, or of Our intention, or the consent of those having an interest, or any other defect whatsoever, however great and substantial, and unforeseen and unforeseeable, and requiring individual expression; but that these present Letters shall always remain firm, valid and efficacious, and shall be, and that they shall not be hindered by any defects of law or fact which might be opposed or objected against them, chiefly by secular power, or by the aforesaid abolished and extinct Legation, Sicilian Monarchy, Tribunal, Judge Delegate, or their ministers whatsoever, for the purpose of impeding or retarding their execution in any way or from any cause, but shall obtain and secure their full and complete effects: And that therefore by all and singular, by the same secular power, or by the same abolished and extinct Legation and Tribunal, and their ministers whatsoever, by whatever impediments brought or to be brought, these shall be entirely and wholly rejected, and in no way regarded by those to whom it pertains, and shall pertain at any time, to be inviolably and firmly observed: and thus and not otherwise in the foregoing matters by whatsoever Ordinary and Delegate Judges, even Auditors of the Cases of the Apostolic Palace, and Cardinals of the same Holy Roman Church, even Legates de Latere, and Nuncios of the aforesaid See, and any others whatsoever exercising or about to exercise any preeminence and power, with the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, ought to be judged and determined; and if anything contrary to these things shall happen to be attempted by anyone whatsoever from any authority, knowingly or unknowingly, it shall be null and void.

3 » Notwithstanding the foregoing, and insofar as it may be necessary, Our rule and that of the Apostolic Chancery, the rule concerning the non-revocation of acquired right, and other Apostolic constitutions and ordinances issued in Universal, Provincial, and Synodal Councils, whether General or Special, as well as any statutes and customs and prescriptions whatsoever, however lengthy and immemorial; privileges also, indults, and Apostolic Letters of whatsoever kind granted to any Kingdoms, Provinces, and Persons, even those shining with Imperial, Royal, or any other worldly or even ecclesiastical dignity, or otherwise worthy of specific and individual mention, by the aforesaid See from whatsoever cause, even by way of contract and remuneration, under whatsoever tenor and form of words, and with whatsoever even derogatory clauses of derogations, and other more efficacious, most efficacious, and unusual clauses, irritant and other decrees, even by motu proprio, knowledge and fullness of power equal, and consistorially, or otherwise in any manner whatsoever in general or in particular contrary to the foregoing granted, issued, made, and repeatedly iterated, and approved, confirmed and renewed however many times, even containing that they cannot be excommunicated by Apostolic Letters not making full and express mention, and word for word, of these Privileges and Indults. All and singular of which, even if for their sufficient derogation special, specific, express, and individual mention, word for word, and not by general clauses importing the same, or any other expression, or any other exquisite form to be observed for this purpose, were required, these tenors, as if word for word, nothing whatsoever omitted, and the form transmitted in them observed, were expressed and inserted: having these present as fully and sufficiently expressed and inserted, which otherwise would remain in their force, for the purpose of the foregoing on this occasion only specially and expressly we derogate, and will to be derogated, and all other things whatsoever to the contrary.

4 » Since, however, these same present letters cannot be safely published in Sicily, especially in these times, as experience has proven hitherto, and it is sufficiently and more than sufficiently established to Us by legitimate proofs, as We declare by the tenor of these, and it is to be feared lest under the pretext of the rejected Law of Royal Assent the execution of these Letters be impeded; We will that they, or copies thereof, so that they may come to the knowledge of all, be affixed and published at the doors of the Lateran Church, and the Basilica of the Prince of the Apostles, as well as of the Apostolic Chancery, and the General Curia on the Citatory Hill, and in the Field of the Flower of the City, as is customary, and thus published and affixed, after two months reckoned from the day of their publication and affixion, have full effect, and bind and affect all and singular whom they concern, just as if they had been intimated to each of them individually and personally; and that copies or exemplars of these same letters, even printed and subscribed by the hand of some public Notary, and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith be given to them both in judgment and outside it everywhere as would be given to these same presents, if they were exhibited or shown.

5 » Let no man whatsoever infringe this page of Our extinction, suppression, abolition, rescission, cassation, deletion, revocation, abrogation, mandate, interdiction, declaration and will, or presume to act contrary to it with rash boldness. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God, and of the Blessed Apostles Peter and Paul.

6 » Given at Rome at St. Peter's, in the year of the Incarnation of the Lord one thousand eight hundred and sixty-four, on the 5th of the Kalends

OMNES PLANE ABROGANTUR DELENTUR. EPISCOPUS SERVUS SERVORUM DEI

FF. NN.

TUTTI COMPLETAMENTE ABROGATI E CANCELLATI.
