A BISHOP OF NO DIOCESE, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THIS MATTER

1 The governance of the universal Church, committed to Us from on high, imposes upon Us the burden of taking the greatest care that the number of ecclesiastical circumscriptions in the Catholic world be increased, as occasion or necessity demands, so that, with the boundaries of dioceses narrowed and consequently the flock of the faithful entrusted to individual Pastors diminished, the Prelates themselves may more easily and beneficially exercise the office committed to them.

2 Since it is abundantly clear that the diocese of Amazonas in the Brazilian Republic extends most widely, and is lacking in roads, especially in the western part, namely in the provinces which are called Alto Acre and Alto Purus, where the faithful, often mixed together with infidel natives, live and are almost entirely deprived of the spiritual aids by which Christian life is nourished and sustained; We have deemed it necessary to provide for such great need.

3 Wherefore, having taken counsel with Our beloved sons, the Cardinals of the Holy Roman Church presiding over the Consistorial Congregation, and having carefully weighed all matters, We have determined to separate from the said diocese of Amazonas that part of its territory which comprises the aforesaid provinces of Alto Acre and Alto Purus, and to erect it into a Prelature Nullius. For this reason, using also the power reserved to the Apostolic See, in the Apostolic Letters under lead, whose beginning is Ad universas Orbis ecclesias, given on the twenty-seventh day of the month of April, in the year of Our Lord one thousand eight hundred and ninety-two, freely to establish a new circumscription of dioceses in the Brazilian dominion, whenever it shall seem expedient, with the assent of Our venerable brother the Bishop of Amazonas and with the consent supplied, insofar as it may be necessary, of those whose concern it is or who may presume it to be their concern, We do, from the fullness of Apostolic power, divide and separate the aforesaid territory from the diocese of Amazonas, and erect and establish it, until it can be raised to a diocese, into a Prelature, to be called the Prelature of Acre and Purus, at the same time decreeing that this Prelature, until it shall seem good to Us to dispose of it otherwise, shall for all legal effects be truly and properly a Nullius Diocese, and shall be subject to the Archdiocese of Belém of Pará and to its Archbishop for the time being as a suffragan see.

4 The boundaries of this new Prelature shall be circumscribed by the civil limits by which the said provinces of Alto Acre and Alto Purus are separated from the State of Amazonas, from the territory of Alto Purús, from the Republic of Bolivia, and from the Republic of Peru. Moreover, We grant power to the man designated below to execute these things, that he may establish the city, seat, and prelatic church of this Prelature Nullius in the place most convenient and suitable, and may grant to them all the rights and privileges which the cities and episcopal churches in the Brazilian region and their citizens enjoy and possess, and which the statutes of the Code of Canon Law permit; likewise in the same church he shall establish the prelatic seat and dignity, in the manner of episcopal dignity, for one Prelate of the Nullius Diocese, who shall preside over it with the same rights, offices, table and chapter, honors and privileges which the Prelates of the Churches in Brazil enjoy and possess, excepting those which belong to Bishops alone by special indult or by law. But in order that the Prelate of Acre and Purus, once constituted, may be able to fulfill all the parts of his office accurately in his territory and likewise to perform all the duties as Bishops do in their dioceses, We decree that the Prelate himself shall be adorned with episcopal character and dignity, and to him therefore, together with the Prelature, an episcopal title shall be conferred according to the prescription of the Supreme Pontiff; and therefore the same Prelate, thus augmented in episcopal dignity, shall exercise in his territory the same power both of order and of jurisdiction which Bishops exercise in their dioceses; and, just as he himself enjoys the rights and honors of a Bishop, so also shall he be bound by the same laws and duties. Moreover, those things which in the aforesaid Apostolic Letters under lead of the twenty-seventh day of the month of April of the year one thousand eight hundred and ninety-two are disposed to be established concerning the honors, privileges and indults of new dioceses in the Brazilian Republic, concerning the power and attributions of new Bishops, concerning the institution of the Chapter and the governance and administration of the Seminary, and finally concerning the rights and duties of the Christian faithful and clergy themselves, concerning the delivery of documents, and other matters of this kind, all things, with congruent matters referred to congruent matters, shall be religiously observed with regard to the new Prelature Nullius, according to the canons of the Code of Canon Law and the decrees of the Plenary Council of Latin America. We assign and attribute to the endowment of this new Prelature, if there be any, the goods and revenues of the Church, as above, to be erected into a prelatic church, as well as offerings, subsidies and donations of whatever kind, which are conferred gratuitously for this purpose.

5 We further decree that, in accordance with what was decreed in the aforesaid plenary Council of Latin America celebrated at Rome in the year one thousand eight hundred and ninety-nine, two chosen young men shall be sent from this newly erected Prelature Nullius, at its expense, as soon as possible may be, to the Pius Latin American College of the City, in regular succession, in which they may be trained for the aid of the Church. But in order that provision may be made more firmly both for the sustenance of these clerics and for the endowment of the College, we greatly desire that, by the care of the Prelate of this Prelature for the time being, as soon as possible may be, so many goods shall be conferred as are required, so that from their revenues the two aforesaid students, or at least one in that manner, may be sustained.

6 These present letters and all things contained therein can never at any time be noted, impugned, or called into question on account of the vice of subreptitiousness or obreptitiousness or nullity, or of Our intention, or any other substantial and unforeseen defect, but they shall exist as perpetually valid and shall be, having been made and emanated from certain knowledge and fullness of power, and shall produce and obtain their full and complete effects, and ought to be inviolably observed by all to whom it pertains; and if it should happen at any time that anything contrary to these things be attempted by anyone, by whatever authority, knowingly or unknowingly, we will and decree that it be entirely null and void and shall be.

7 Therefore, with these things constituted as above, we depute to the execution of all the same things our venerable brother Angelo Scapardini, titular archbishop of Damascus and Apostolic Nuncio in the Brazilian Republic, granting to him the necessary and opportune faculties, even to subdelegate, for the purpose of which it is a question, anyone constituted in ecclesiastical dignity and especially the present Archbishop of Belém of Pará, and to pronounce definitively upon any difficulty and opposition arising in any way in the act of execution, and moreover imposing upon him the duty of transmitting within six months to the Sacred Consistorial Congregation an authentic copy of the execution completed.

8 Notwithstanding, insofar as it may be necessary, the rules established in synodal, provincial, general, and universal councils, special or general constitutions and Apostolic ordinances, and any other dispositions of Our predecessors the Roman Pontiffs, and all other things to the contrary whatsoever.

9 We will, moreover, that to copies of these letters, even printed ones, subscribed however by the hand of some public notary and furnished with the seal of someone constituted in ecclesiastical dignity, the same faith shall be given in judicial proceedings and outside them as would be given to these same presents, if they were exhibited or shown in the original.

10 Let it be lawful for no one to infringe what has been established in these Our letters regarding dismemberment, erection, subjection, decree, commission, mandate, derogation, and will, or to act against them with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul His.

1 Il governo della Chiesa universale, affidatoci dall'alto, ci impone l'obbligo di provvedere con la massima diligenza affinché nel mondo cattolico il numero delle circoscrizioni ecclesiastiche aumenti, secondo che l'occasione o la necessità lo richieda, affinché, ristretti i confini delle diocesi e quindi ridotto il gregge dei fedeli affidato ai singoli Pastori, gli stessi Presuli possano esercitare più facilmente e più utilmente il loro ministero.

2 Poiché è ben noto che la diocesi dell'Amazzonia nella Repubblica Brasiliana si estende vastissimamente e manca grandemente di vie, specialmente nella parte occidentale, cioè nelle province che si chiamano Alto Aere e Alto Purus, dove i fedeli vivono spesso mescolati con gli indigeni infedeli e mancano quasi completamente dei sussidi spirituali, con i quali la vita cristiana si alimenta e si sostiene; Noi abbiamo ritenuto di dover provvedere a tanta necessità.

3 Perciò, consultati i nostri diletti figli Cardinali della Santa Romana Chiesa preposti alla Sacra Congregazione Concistoriale, e dopo aver maturo esame di tutte le cose, abbiamo stabilito di staccare dalla medesima diocesi dell'Amazzonia quella parte del territorio che comprende le predette province dell'Alto Aere e dell'Alto Purus e di erigerla in Prelatura Nullius. - Pertanto, usando anche della potestà riservata alla Santa Sede, nelle Lettere Apostoliche in forma di Breve, il cui inizio è Ad universas Orbis ecclesias, date il ventisette aprile dell'anno del Signore milleottocentonovantadue, di libera facoltà di istituire nella Repubblica Brasiliana nuove circoscrizioni diocesane, tutte le volte che sembrerà opportuno, con l'assenso del venerabile fratello Vescovo dell'Amazzonia e supplito, per quanto sia necessario, il consenso di coloro che vi hanno interesse o che si presume vi abbiano interesse, il suddetto territorio dalla diocesi dell'Amazzonia, dalla pienezza della potestà apostolica, dividiamo e separiamo e lo erigiamo e istituiamo, finché possa essere eretto in diocesi, in Prelatura, da chiamarsi dell'Acri e del Purús, e insieme decretiamo che questa Prelatura, finché non sia diversamente disposto, sia a tutti gli effetti giuridici vera e propria Diocesi Nullius, e sia soggetta all'Arcidiocesi di Belém del Parà e al suo Arcivescovo pro tempore come suffraganea.

4 I confini di questa nuova Prelatura siano circoscritti dai limiti civili, con i quali le dette province dell'Alto Aere e dell'Alto Purus sono separate dallo Stato dell'Amazzonia, dal territorio dell'Alto Parauá, dalla Repubblica Boliviana e dalla Repubblica Peruana. Inoltre diamo facoltà all'uomo qui sotto designato per eseguire queste cose, affinché costituisca la città, la sede e la chiesa prelattizia di questa Prelatura Nullius più opportuna e conveniente, e le conceda tutti i diritti e i privilegi, di cui godono e si gloriano le città e le chiese episcopali nella regione Brasiliana e i loro cittadini e che i decreti del Codice di Diritto Canonico permettono, e similmente nella medesima chiesa istituisca la sede e la dignità prelattizia, ad immagine della dignità episcopale, per un Prelato della Diocesi Nullius, che la presida con i medesimi diritti, uffici, mensa e capitolo, onori e privilegi, di cui godono e si gloriano i Presuli delle Chiese nel Brasile, eccettuati quelli che da speciale indulto o dal diritto appartengono soltanto ai Vescovi. Affinché poi il Prelato dell'Acri e del Purús, una volta costituito, possa e valga compiere nel suo territorio tutte le parti del suo ministero con esattezza e insieme esercitare tutti gli uffici come i Vescovi nelle loro diocesi, abbiamo stabilito che lo stesso Prelato sia ornato del carattere e della dignità episcopale, e perciò insieme con la Prelatura gli sarà conferito il titolo episcopale secondo il prescritto del Sommo Pontefice; e perciò lo stesso Prelato, così accresciuto di dignità episcopale, nel suo territorio eserciterà la medesima potestà tanto dell'ordine quanto della giurisdizione, che i Vescovi nelle loro diocesi; e, come egli gode dei diritti e degli onori del Vescovo, così sarà vincolato dalle medesime leggi e dagli uffici. Inoltre tutto ciò che nelle sopra ricordate Lettere Apostoliche in forma di Breve del ventisette aprile dell'anno milleottocentonovantadue è disposto a costituirsi riguardo agli onori, privilegi e indulti delle nuove diocesi nella Repubblica Brasiliana, riguardo alla potestà e alle attribuzioni dei nuovi Vescovi, riguardo all'istituzione del Capitolo e al governo e all'amministrazione del Seminario, riguardo infine ai diritti e ai doveri degli stessi cristifedeli e dei chierici, riguardo alla trasmissione dei documenti e ad altre cose di questo genere, tutto, riferendo le cose convenienti alle cose convenienti, sia religiosamente osservato per la nuova Diocesi Nullius, secondo i canoni del Codice di Diritto Canonico e i decreti del Concilio plenario dell'America Latina. In dote di questa nuova Prelatura assegniamo e attribuiamo, se ve ne siano, i beni e le rendite della Chiesa, come sopra, da erigersi in prelattizia, nonché le offerte, i sussidi e le donazioni qualsiasi, che a titolo gratuito sono conferiti per questo fine.

5 Stabiliamo inoltre che, secondo quanto è stato decretato nel ricordato Concilio plenario dell'America Latina celebrato a Roma nell'anno milleottocentonovantanove, anche da questa neocostituita Prelatura Nullius, a sue spese, vengano mandati al Collegio Pio Latino Americano dell'Urbe, a turno, due giovani scelti, non appena sarà possibile, nel quale vengano istruiti in aiuto della Chiesa. Affinché però sia provveduto più stabilmente sia al sostentamento di questi chierici sia alla dotazione del Collegio, desideriamo vivamente che, per cura dei Prelati di questa Prelatura di volta in volta, vengano conferiti, al più presto possibile, tanti beni quanti si richiedono, affinché dalle loro rendite i due predetti alunni, o almeno uno, possano essere sostenuti.

6 Le presenti lettere e tutto ciò che in esse è contenuto non potranno mai in alcun tempo essere notate, impugnate o messe in controversia per vizio di surrezione, di obbrezione o di nullità, né per difetto di intenzione Nostra, né per alcun altro difetto sostanziale e non preveduto, ma esse rimangono e rimarranno perpetuamente valide come emanate da certa scienza e da pienezza di potestà, e devono sortire e ottenere i loro pieni e interi effetti, e devono essere inviolabilmente osservate da tutti coloro ai quali spetta; e se da chiunque, con qualsiasi autorità, consapevolmente o inconsapevolmente, fosse tentato di fare diversamente in proposito, vogliamo e decretiamo che sia del tutto nullo e vano e rimanga tale.

7 Perciò, affinché tutto quanto sopra stabilito sia mandato ad esecuzione, deputiamo il venerabile fratello Angelo Scapardini, arcivescovo titolare di Damasco e Nunzio Apostolico nella Repubblica Brasiliana, al quale attribuiamo le facoltà necessarie e opportune, anche di subdelegare, allo scopo di cui si tratta, chiunque sia costituito in dignità ecclesiastica e in primo luogo lo stesso attuale Arcivescovo di Belém do Pará, e di pronunciare definitivamente su qualsiasi difficoltà e opposizione che sorga in qualunque modo nell'atto dell'esecuzione, imponendogli inoltre l'obbligo di trasmettere entro sei mesi alla Sacra Congregazione Concistoriale una copia autentica dell'esecuzione compiuta.

8 Non ostante, per quanto occorra, le norme emanate nei concili sinodali, provinciali, generali e universali, le costituzioni e ordinazioni apostoliche speciali o generali, e le disposizioni di qualsiasi altro dei Nostri predecessori Romani Pontefici, e qualsiasi altra cosa contraria.

9 Vogliamo inoltre che ai transunti di queste lettere, anche se stampati, sottoscritti però di mano di qualche notaio pubblico e muniti del sigillo di qualcuno che sia costituito in dignità ecclesiastica, sia prestata in giudizio e fuori di esso la medesima fede che si presterebbe alle presenti stesse, se fossero esibite o mostrate nell'originale.

10 A nessuno dunque sia lecito infrangere ciò che è stato stabilito in queste Nostre lettere circa la dismembrazione, l'erezione, la sottomissione, il decreto, la commissione, il mandato, la deroga e la volontà, né osare di contravvenire ad esse con temerità. Se qualcuno però avrà presumuto di tentare ciò, sappia che incorrerà nell'indignazione di Dio Onnipotente e dei beati apostoli Pietro e Paolo suoi.
