Lettera Apostolica sull'Ordine della Milizia Aurata
CXIX. LETTERE APOSTOLICHE

3 ANNO MDCCCXLI.
Sylvestri Pontificis in medio referat. Pauli [If decessoris Nostri, privilegium idem respicientibus, ac die decima quarta aprilis anno millesimo quingentesimo trigesimo nono sub plumbo datis, atque a rec. mem.
CXIX. APOSTOLIC LETTERS
By which certain matters concerning the equestrian Order of the Golden Militia are decreed,
GREGORY PP. XVI.
for perpetual remembrance.
1 Since the minds and spirits of men are accustomed to be aroused and inflamed to pursue virtue with all zeal, and to undertake and accomplish all noble deeds, by nothing more than by the impulse of religion, the spurs of glory, and the rewards of praise and honor, the Roman Pontiffs, being greatly concerned for the good and happiness of the Christian and civil commonwealth, have been accustomed, by provident and wise counsel, to incite men to piety and every virtue, either to institute equestrian orders, or to confirm those already instituted by their supreme authority, to restore them to their former renown, and to adorn them with the most ample privileges. For it is most fitting that he who by divine counsel is placed in the sublime Chair of the Prince of the Apostles should devote all his effort to ensure that men, spurred on and moved all the more keenly by merits, praises and honors, should cultivate religion especially, piety, justice and all virtues, exercise them, and apply their best efforts to letters, disciplines and liberal arts, and should strive greatly to accomplish those things which can be of great increase, use and protection to the Catholic religion and civil society. Certainly no one is ignorant that among the illustrious equestrian orders, that of the Golden Militia shines forth in the first place both by the antiquity of its origin and by the nature of its institution and the cause of its honor. For the opinion, confirmed by writers of no small authority, has prevailed that it was instituted by Constantine the Great on account of that remarkable prodigy, by which the sign of the life-giving cross, gleaming with the most brilliant light on all sides, he beheld in the sky, and mi- 1

4 that victory, by which he gloriously and magnificently triumphed over the most wicked tyrant Maxentius, had the same order its origin, and was approved by St. Sylvester Our predecessor, and Constantine himself was decorated with the insignia of that order by that most blessed Pontiff. Hence it came to pass that in ancient times especially the same equestrian order was held in great honor by the Roman Pontiffs and supreme princes, and its insignia were granted and bestowed by the Roman Pontiffs themselves upon most illustrious men, especially those who had deserved well of the Christian religion. But since We know that this distinguished order has fallen from the splendor of its ancient dignity and degree of esteem through the vicissitude of human affairs and times, We, following the footsteps of Our other predecessors among the Pontiffs, have determined to recall it to its pristine glory and to increase it with even greater honor. And indeed, since into this order only those men are to be admitted who, besides proven honesty and integrity, are either burning with zeal for the Catholic religion, or excelling in knowledge of the more refined letters and severer disciplines, or skilled in the liberal arts, or faithfully and uprightly discharging sacred, civil and military duties, and who strive with a certain noble effort and endeavor that by illustrious deeds they may deserve well of the Catholic faith and the civil state and of the Apostolic See, We deem it most opportune to consult and provide for the splendor of that order, as far as in Us lies, so that men adorned with those excellent gifts may obtain a worthy reward of their own virtue, and their wills may be directed more and more toward illustrious things. Wherefore by these letters, by Our apostolic authority, in perpetual manner We establish and will that henceforth the same order, retaining its ancient name of the Golden Militia, shall consist of two classes, namely of commendators and knights, who shall all wear a golden torque, and a sword, and gilded spurs, and shall enjoy all those rights and indults which the knights of the same order have hitherto enjoyed, except however the faculties removed by the Council of Trent. We command, moreover, that they wear a golden cross according to the manner and form prescribed by Our predecessor of happy memory Benedict XIV in his similar apostolic letters given on the seventh day of September in the year one thousand seven hundred and forty-six on this matter, yet so that the cross itself in the future shall be borne on a silk ribbon distinguished by red and black color, and with red edges, which on its white surface shall bear the image of St. Sylvester the Pontiff in the middle. But in order that there may be a proper distinction between commendators and knights, We command that commendators wear a large cross of this kind, which shall hang from the aforesaid ribbon inserted at the neck, while knights shall wear a small cross in the common manner of knights on the left part of their garment at the breast with the same ribbon. Moreover, in order to remove any confusion that might occur in wearing this insignia, We have ordered the schema of both crosses to be printed in new form and delivered to each knight with his diploma. And since the degree of honor and dignity shines forth the more, the smaller is the number of those to whom it is conferred, by the same Our authority, We decree and command that the commendator knights shall not exceed the number of one hundred and fifty, and that the knights shall be only three hundred. This number of each class We will to be prescribed only for those men who are subject to the civil principate of the Apostolic See, for it shall always pertain to Our judgment and that of Our successors to admit men even of foreign nations into the assembly of each class, beyond this number. Furthermore, in order that the administration of this order may perpetually flourish and never be changed at any time, We command that the chief officer of the Golden Militia order, or, as it is called, the grand chancellor, shall be a Cardinal of the Holy Roman Church from the Apostolic Brief Letters, with whom the names of the knights, their rank, the day of admission and the number shall be most diligently preserved. Now since We are by no means ignorant that very many in past times have been admitted into this order, in order to protect the honor of the same order, We decree that only those shall be held as knights of that order who have been admitted into it through similar pontifical letters, and who shall be able to wear only the ancient insignia. For all the rest admitted into the same order by any other means, We declare shall in no way hereafter belong to the same order, and therefore We decree that they have forfeited any privilege of wearing even the ancient insignia of the order. Finally, in order that in this and future times no one may have access to such an honor, except only those who shall have obtained the same honor through similar apostolic letters, by the same full apostolic authority of Ours, by the force of these letters, We completely remove from all and each of every order, rank and condition, the privilege of granting this order, even if that privilege was obtained from the Roman Pontiffs Our predecessors through apostolic letters and special constitutions, and therefore from the apostolic letters of Paul of happy memory Our predecessor, respecting the same privilege, and given on the fourteenth day of April in the year one thousand five hundred and thirty-nine under lead, and by happy memory Julius III, Gregory XIII and Sixtus V Our predecessors likewise, as is asserted, again confirmed, and all other things whatsoever in every respect for that reason, We expressly derogate, and We decree and command that those letters shall be of no force hereafter. But in order that all those who have already obtained such an honor through similar pontifical letters may certainly be known, We will that within eight months those who dwell in Rome shall exhibit their pontifical diploma to the Cardinal of the Holy Roman Church from Our Brief Letters, and those who are in Our pontifical dominion shall show it to their own bishop or Ordinary. We are indeed raised to this hope that this new restoration of the Golden Militia and this increase of honor shall attain the desired outcome, and that all who have already been admitted into the same order by apostolic letters, or shall be admitted in the future, shall respond to Our wishes most abundantly, and shall leave nothing unattempted and nothing untried, by which they may strive to deserve well of the orthodox faith, of the Chair of Peter and of the civil republic and of all most illustrious things.
5 We establish, will and command these things, and decree that these present letters and all matters expressed in them shall always and perpetually be valid and effective and ought to produce their full and complete effects, and be inviolably observed by all to whom it pertains and shall pertain, and be given full support in all things and throughout; and thus in the foregoing matters by whatever ordinary and delegated judges, even auditors of causes of Our apostolic palace, nuncios of the Apostolic See and cardinals of the Holy Roman Church, even legates a latere, judgment and definition ought to be made, with all faculty and authority to judge and interpret otherwise removed from them and from each of them, and any attempt made against these things by anyone whatsoever with any authority, knowingly or unknowingly, shall be null and void.
6 Notwithstanding the aforesaid apostolic letters of blessed memory of Benedict XIV issued concerning the cross of the same order, and those given by Paul III, Our predecessors, concerning the privilege of granting that order, and approved in any manner by Julius II, Gregory XIII and Sixtus V, likewise Our predecessors, as well as Our rule and that of the apostolic chancery concerning not removing acquired right, and other apostolic constitutions and ordinances issued in universal, provincial and synodal councils, whether general or special, and as often as it shall be necessary, even those of the same equestrian Order of the Golden Militia strengthened by oath, apostolic confirmation, or any other firmness, statutes and customs, privileges also, indults and apostolic letters granted, confirmed and renewed in any manner contrary to the foregoing; all and singular of which, holding their tenor as fully and sufficiently expressed and inserted word for word in these presents, which would otherwise remain in their force, for the purpose of the foregoing, on this occasion only, we specially and expressly derogate, and to other matters also deserving express and individual mention and derogation, to whatever things acting to the contrary. Given at Rome at St. Peter's under the ring
